Chairperson Worley led the Pledge of Allegiance. Brantley Chp 30 Sec 30-38 Boat docked in Taylor Creek without consent of landowner. 04-016 Marvin W. Brantley Chp 30 Sec 30-38 Boat docked II' 1811 S. Parrott Avenue in Taylor Creek without consent of land owner Code Officer Hancock requested that Case #04-058 Zenon & Maria Anselmo be withdrawn from the agenda. Case #04-058 was withdrawn from agenda pending further investigation. Code Officer Hancock stated the boat in Case #04-015 had been removed on May 13, 2004. Member Montesi moved to find Case #04-015 in compliance as of May 13, 2004 based on the testimony of Code Officer Hancock; seconded by Member Castorina. Worley - Yes Irby - Yes Montesi - Yes Castorina - Yes Revels - Yes Motion Carried There was some discussion as to whether action should be taken on Case #04-015 in order to collect the accrued fine. Member Montesi moved to send a statement to Mr. Brantley for the amount of the accrued fine; no second. Motion Failed After further discussion Member Irby moved to recommend to City Council if the accrued fine on Case #04-015 is not paid by the close of business on July 1, 2004 that a Civil Judgment be filed for the amount of the accrued fine including court costs; seconded by Member Montesi. Worley - Yes Irby - Yes MnntPci - YQe Castorina - Yes Revels - Yes Motion Carried Code Officer Hancock stated the boat in Case 904-016 is still docked in Taylor Creek and was not in compliance. Member Montesi moved to find Case #04-016 not in compliance and if the boat is not removed by June 12, 2004 to recommend City Council take the necessary action to remove the boat at the owners expense and file a Civil Judgement for the amount of the acrrued fine including all fees and court cost; seconded by Member Irby. PLEASE TAKE NOTICE AND BE .ADVISED that if a person decides to appeal any decision made by the Code Enforcement Board with respect to any matter considered at this meeting, he/she may need to insure that a verbatim record of the proceeding is made, which record includes the testimony and evidence upon which the appeal is to be based. Tapes are for the sole purpose of backup for official records of the department. Chairperson Worley reviewed the status of several cases that are still under a fine. There being no further items on the agenda, Chairperson Worley adjourned the June 8, 2004 meeting at 7:30 p.m. The next regular Code Board Meeting is scheduled for Tuesday, July 13, 2004.
