Worley - Yes Irby - Yes Montesi - Yes Nelson - Yes Sweda - Yes Weisser - Yes Castorina - Yes Motion Carried 403 April 13, 2004 - CEB 2 of 3 II AGENDA III CODE BOARD ACTION 11 REQUEST FOR THE ADDITION, DEFERRAL OR WITHDRAWAL OF ITEMS ON TODAY'S AGENDA. 04-037 Zollie & Vineta Aldridge Chp 30 Sec 30-43 Public 215 SW e Avenue nuisances: unsafe buildings Status Report from Code Officer Hancock Status Report from Attorney Cook There were no requests for the addition, deferral or withdrawal of items on today's agenda. Code Officer Hancock reported the unsafe buildings were to be burned for training purposes by the City Fire Department. Member Montesi moved to table Case #04-037 until the next regularly scheduled meeting; seconded by Member Castorina. Code Officer Hancock updated the Code Board regarding the status of cases currently under a fine. He stated in reference to Mr. Brantley's seven violations nothing had been done to come into compliance. Attorney Cook gave a status report on Case #02-0216 Evelyn Dasher Estate. He stated the foreclosure lawsuit was prepared and ready to be filed. However he recently learned there were outstanding tax certificates and those people would have to be named in the lawsuit. Also, Chief Tomey is checking to see how much expense the City incurred in cleaning the property in order to include these cost in the total amount of foreclosure. Attorney Cook added that the fines imposed by the Code Board alone amounted to approximately eighteen thousand eight hundred and fifty dollars ($18,850.00). There was some discussion regarding the boats belonging to Marvin Brantley in Taylor Creek. Member Irby expressed concern when the ninety day mandatory period was complete would we have any recourse to have the the boats could be removed by the City if the City Council gave approval to spend the money to have it done. Member Montesi suggested we start the process of getting bids from salvage companies interested in removing the boats. Attorney Cook advised the board no action could be taken on a pending violation without notice to the violator. Therefore Member Irby made a recommendation to have City Council pursue bids or interest of salvage companies that would consider removing the boats from Taylor Creek should the occasion arise; seconded by Member Montesi. There was a consensus among all board members on the recommendation.
