A letter submitted by Brenda Brown in her absence was read by Chairperson Worley stating the following: Dear Members of the Board, My name is Brenda Brown and I am the sister and granddaughter in charge of the Brown and Taylor properties. The purpose of this letter is to explain my absence from this meeting. My mother has recently been diagnosed with an illness that requires major and extensive surgery and I feel that I should be with her at this time. Please don't think that I don't take this meeting and it's purpose very seriously, because I do, but it is impossible for me to be in two places at once. I sincerely hope that you will understand my position and allow my brother, who is also an owner of this property, to stand in my place at this meeting. First, I would like to apologize for the condition in which the properties have become. Please know that until approximately a month or so ago, I did not know this was happening. Since I have family residing there, I was under the impression that everything was being handled. The correspondence you have been sending I knew nothing about. However, as soon as I became aware of the situation, I immediately started trying to get the matter resolved. Part of the property has already started being cleaned and I am now in the process of trying to find someone to keep this job done on a regular basis and to your satisfaction. I am a single mother with two minor children doing the best I can to make ends meet and I am not financially able to pay these fines. I would ask that you please drop them and give me a chance to get the properties cleaned. Being a woman that keeps her word, I promise that all the properties will stay cleaned and you won't have this problem again. I must also ask that all future correspondence be sent directly to me at the address you now have on file. Again, please drop the fines and give me a chance. I thank you for time and your consideration. Sincerely, Brenda Brown After the letter was read there was a lengthy discussion among the board members on whether proof of moved to table Case #01-0074 and #01-0075 until the next meeting; seconded by Member Weisser. Code Officer Tomey gave testimony that Case #01-0084 had been in violation of Sec 30-44 for general cleaning and overgrown grass since October 31, 2001. Barbara Mills addressed the Board stating she and her son were trying to get the property cleaned, but she would probably need a couple of months to complete the work. Code Officer Hancock gave testimony that he had hand delivered several notices I 9, 2003 - CEB 3 of 3 388 AGENDA Status Report Attorney Cook 1 ADJOURNMENT - CHAIRPERSON WORLEY PLEASE TAKE NOTICE AND BE ADVISED that if a person decides to appeal any decision made by the Code Enforcement Board with respect to any matter considered at this meeting, he/she may need to insure that a verbatim record of the proceeding is made, which record includes the testimony and evidence upon which the appeal is to be based. Member Sweda moved to find Case #01-0084 Bruce & Barbara Mills in violation of Sec 30-44 General Cleaning and Beautification and be given five working days to meet with Code Officer Hancock in order for him to provide a list of what needs to be done to bring the property into compliance. Then the property must be in compliance within thirty days after the five working day grace period or a $10.00 per day fine would be imposed; seconded by Member Castorina. Worley - Yes Nelson - Yes Gamiotea - Yes Sweda - Yes Irby - Yes Weisser - Yes Castorina - Yes Motion Carried Attorney Cook stated as of this afternoon the final hearing for foreclosure on Case # 00-01-01 Marvin Brantley had been set for October 28, 2003. He also gave an update in reference to Case #02-0216 Evelyn Dasher Estate. Attorney Cook said he would be meeting with the City Administrator tomorrow to determine if the recommendation for foreclosure would have to be approved by the City Council. If it does not require their approval then he could file to proceed with foreclosure by the end of this week. Code Officer Hancock updated the Code Board on Case # 02-0063 Joe Louis Lawson. He said the work was almost completed and that he would call Mr. Lawson to confirm that he understood he would need to pay the $415.00 fine that was imposed on his property. Member Gamiotea moved to adjourn, seconded by Member Nelson. Meeting adjourned at 8:20 p.m.
