BOARD ACTION - DISCUSSION- VOTE
This being a quasi-judicial proceeding, an oath was administered to those offering testimony, all responded affirmatively. Officer Sterling
advised all events occurred within the corporate limits of the City of Okeechobee. The Officer's notes, testimony, photographs, and
supporting documents were all entered as part of the official record.
Officer Sterling testified property owners Aaron & Karla Parriott were found in violation on March 12, 2019 for operating a business without
a current Business Tax Receipt (BTR). A fine of $250.00 per day was imposed on April 1, 2019 and accrued through May 1, 2019. Officer
Sterling stated the total amount of the lien is $7,750.00 (31 days @ $250.00 per day). Aaron & Karla Parriott appeared before the
Magistrate to request a reduction of the lien. Attorney Cook advised Magistrate Azcona the Parriott's already paid approximately four
hundred dollars to renew the license (BTR) which includes late fees.
Special Magistrate Azcona found Case No. 190215007/19.002, Aaron & Karla Parriott, 201 SW 5th Avenue, now in compliance and
granted a reduction of lien in the amount of $25.00 per day for 31 days totaling $775.00 to be paid to the City of Okeechobee.
Officer Sterling testified Case 18-043 was postponed from the April 9, 2019 meeting. Raul Rodriguez (property owner's brother) was given
a thirty day extension to have the septic tank filled in, power shut off, personal items removed and obtain a demolition permit. Mr. Raul
Rodriguez appeared before the Magistrate stating the abandonment of the septic tank was complete and it has been filled in. However,
the utilities are in his sister's name and she will need to give her consent to have them turned off. Mr. Rodriguez added the power and water
have to be off before he can get the demolition permit. Therefore, he is requesting additional time to have the power and water turned off,
finish removing the personal items from inside the house and then obtain a demolition permit. Officer Sterling recommended allowing thirty
to sixty days to have the work completed or see significant progress.
Special Magistrate Azcona found Case No. 14-043, Gloria Rodriguez, 914 NW 2"d Street, to be in violation of International Property
Maintenance Code Ch 3 Sec 304.1.1(8) Unsafe condition & Sec304.7 Roof damage, based on the testimony of Code Officer Sterling
and the evidence presented. Magistrate Azcona granted a thirty day extension to turn off power and water, remove all personal
items and obtain a demolition permit. If these things have not been done within the next thirty days a fine of $25.00 per day will
be imposed.
Officer Sterling testified Notice of Violation/Notice of Hearing was hand delivered on April 30, 2019. He said Ruiz Investments LLC is the
owner of the building located at 625 NE Park Street. The tenant who is leasing the building has excessive signage. Officer Sterling stated
he advised them to meet with the City Building Official, Jeff Newell, to determine how many signs they are permitted to have as well as the
type and size allowed. As of this date no one has come in to meet with the building official. Officer Sterling recommended giving a specific
deadline to meet with the building official and then imposing a fine if they have not met with the building official by that date.

Special Magistrate Azcona found Case No. 190219011, Ruiz Investments LLC at 625 NE Park Street in violation of Ch 90 Sec 90-569
Sign area computation, Sec 90-572 Building signs and Sec 90-573 Limitations on number & type of signs, based on the testimony
of Code Officer Sterling and the evidence presented. The Magistrate ordered property owner to schedule a meeting with the City
Building Official within fifteen days from receipt of proper notification. If the property owner does not comply a fine of $100.00
per day will be imposed. Magistrate Azcona requested an update on this property be provided at the next regular meeting.
Code Officer Sterling testified Notice of Violation/Notice of Hearing was sent via certified mail and received by the property owners. He
said he received a call from the Leggett's attorney, Colin Cameron, wanting to know what needed to be done to bring the property into
compliance. Officer Sterling advised him vehicles needed to have current tags or be removed, debris removed and yard mowed. As of this
date some weed killer was sprayed and cars turned around, but the property remains in non-compliance.
Special Magistrate Azcona found Case No. 190313009, Julian and Wanda Leggett, 106 & 115 SE 13th Avenue, in violation of Ch
30 Sec 30-41 Disabled vehicles, Sec 30-43 Public nuisance and Sec 30-44 General cleaning & beautification, based on the
testimony of Code Officer Sterling and the evidence presented, allowing thirty days from receipt of proper notice to comply, if
not in compliance by that date a fine of $100.00 per day will be imposed.
Code Officer Sterling testified Notice of Violation/Notice of Hearing was hand delivered to property owner on April 25, 2019. He stated
the property owner has a disabled motor home with no tag. Property owner's Fred & Sheila Bradley appeared before the magistrate
requesting additional time to get a current tag for the motor home. Mr. Bradley stated the motor home is owned by his stepfather and title
has to be transferred so that he can get a tag. He told the magistrate he would be able to get this issue resolved within thirty days.
Special Magistrate Azcona found Case 190411007, Frederick and Sheila Bradley in violation of Ch 30 Sec 30-41 Disabled vehicle,
based on the testimony of Code Officer Sterling and the evidence presented, allowing thirty days from today to comply (by
June 14, 2019), no fine will be imposed as long as property is in compliance by this date.

NOTICE IS HEREBY GIVEN that the alleged violation will be presented in the City Council Chambers, City Hall, 55 SE Third
Avenue, Okeechobee, Florida on the 12th day of February, 2019, at 6:30 p.m.
If you have corrected the violation(s) by the time stated above and received notification from the Code Officer that all
violations have been corrected, you will not be required to appear. Otherwise, you must be present at this hearing to avoid
an order being entered solely on the evidence to be presented by the petitioner and a lien being recorded against your
property. Violators may be fined up to $250.00 for each day the violation is proven to exist. In cases of a repeat violation,
the Special Magistrate may increase the fine up to $500.00 per day. In addition to fines, the amount of the lien may include
costs incurred in prosecuting the case pursuant to Section 162.07(2), Florida Statutues and reasonable cost of repairs
required to bring the property into compliance pursuant to Section 162.09(1).
You have the right to obtain an attorney if you wish, and the Magistrate will receive testimony and evidence at said PUBLIC
HEARING, make findings of fact as are supported by the evidence, and issue appropriate orders necessary to bring the
alleged violation into compliance, including the payment of a fine by the Respondent(s). It is your obligation to insure an

Pursuant to Section 162.06 Florida Statutes, you have a responcibility to disclose violations to any potential buyer of the

duly sworn in prior to presenting evidence.

4. On May 8, 2018 , I personally inspected the property and observed the following:
a. Disabled vehicles
b. Old equipment/tires/debris
c. Property needs mowing and cleaning
5. Based upon my investigation, I issued a courtesy card/letter to Respondent(s) notifying them
of the violation with a request to have the property come into compliance within 10 days.
6. On April 18, 2019 I reinspected the property and found it still in violation. A
Notice of Violation was issued on April 18, 2019 and delivered by:

In Accordance with Fla. Statute 162.11(2005), an aggrieved party may appeal a final administrative order to the circuit court. Such an appeal shall be
filed within 30 days of the execution of the order to be appealed.
