CODE BOARD ACTION July 8, 2003 Code Enforcement Board meeting was called to order at 7:04 p.m. by Chairperson Worley. Chairperson Worley led the Pledge of Allegiance. Member Irby moved to recommend the City proceed with foreclosure on Case # 01- 0061; seconded by Member Gamiotea. Worley - Yes Sweda - Yes Gamiotea - Yes Castorina - Yes Irby -Yes Motion Carried. Code Officer Hancock gave testimony that the property had been cleaned, but there were some vines on the building that needed to be removed. Member Gamiotea moved that Case# 01-0074 have the $10.00 per day fine suspended as of July 8, 2003 and table any further action until the next Code Board meeting; seconded by Member Sweda. (Chairperson Worley requested that a Code Officer try to contact Joe Brown to see if this matter could be resolved before the next Code Board meeting.) Member Irby moved to proceed with foreclosure on Case # 01-0075 since nothing had been done since the last Code Board meeting to bring the property into compliance; seconded by Member Gamiotea. Worley - Yes Sweda - Yes Gamiotea - Yes Castorina - Yes Irby - Yes Olive Williams gave testimony on behalf of Joe Lawson, she stated Mr. Lawson had a stroke and was not able to take care of this matter but he intended to have the property cleaned up. Code Officer Hancock gave testimony that he had spoken with Mr. Lawson's daughter and she indicated they were going to clean-up the property. Member Gamiotea moved to table any further action on Case # 02- 0063 until the next Code Board Meeting and to have the Code Officer notify Mr. Lawson in writing that he must take some action within the next thirty days or foreclosure proceedings would most likely be recommended by the Code Board at the next meeting; seconded by Member Castorina. Attorney Cook said if notice was placed in the newspaper that would be considered constructive service. Member Sweda moved to recommend foreclosure proceedings begin on Case# 02-0216; seconded by Member Irby. Worley - Yes Gamiotea - Yes Irby - Yes Sweda - Yes Castorina - Yes Motion Carried Attorney Cook informed the Code Board that if the Court were to enter a Default against Mr. Brantley the next step would be a Summary Judgement. He said if no counter action was taken by Mr. Brantley's attorney, the property could go to the Courthouse for sale at the end of September. Mr. Brantley addressed the Code Board stating he intended to make the first payment on his $7,500 fine around the 22nd or 23rd of July 2003 in the amount of five -hundred ($500) or one -thousand ($1,000) dollars. Member Gamiotea moved to adjourn, seconded by Member Sweda. Meeting adjourned at 7:55 p.m.
