BOARD ACTION - DISCUSSION - VOTE -
This being a quasi-judicial proceeding, an oath was administered to those offering testimony, all responded affirmatively. Officer Sterling
advised all events occurred within the corporate limits of the City of Okeechobee. The Officer's notes, testimony, photographs, and
supporting documents were all entered as part of the official record.
Officer Sterling testified Case 18-043 was postponed from the Code Enforcernent meeting on March 12, 2019 in order to give the property
owner time to remove personal items from the property. Officer Sterling stua when he last inspected the property he could not see any
progress on the demolition of the property. Mr. Raul Rodriguez (brother of property owner Gloria Rodriguez) addressed the Magistrate
testifying he had a contract with Apex Septic to pump out and fill in the septic system within two weeks. He said this has to be done before
any demolition of the structure can be done. Special Magistrate Azcona advised Mr. Rodriguez to contact Officer Sterling when the septic
system work is completed so Officer Sterling can monitor the progress being made to get the property ready for demolition.
Special Magistrate Azcona postponed Case 18-043, Gloria Rodriguez, 914 NW 2nd Street, until the next regularly scheduled
meeting, ordering the property owner to have the septic system work completed, power shut off, personal items removed and
a demolition permit obtained for the structure from the City Building Department by the next meeting on May 14, 2019.
Officer Sterling testified Digital Bookkeeping at 109 NW 11`h Avenue was hand delivered a Notice of Violation/Notice of Hearing on March
26, 2019, but the business owner was not present at this meeting. Officer Sterling stated Digital Bookkeeping is operating a business in
the City without a current Business Tax Receipt (BTR). He recommended imposing a fifty dollar per day fine beginning two days after
receipt of proper notification, if the business owner has not obtained a current BTR by that date.
Special Magistrate Azcona found Case No. 190325014, Digital Bookkeeping, 109 NW 11th Avenue, in violation of Chapter 50 Section
50-32 Local business tax imposed, based on the testimony of Code Officer Sterling and the evidence presented. Magistrate
Azcona ordered Digital Bookkeeping to pay all delinquent fees and obtain a current Business Tax Receipt within two days of
receiving proper notification, after that date a fine of fifty dollars per day will be imposed in addition to all delinquent fees.

Officer Sterling testified Signature Signs of Okeechobee, 204 N Parrott Avenue, was hand delivered a Notice of Violation/Notice of Hearing
on March 26, 2019, but the business owner was not present at this meeting. Officer Sterling stated the business owner said he was not
aware he needed a license to operate a business in the City. However, Officer Sterling said in previous years the owner had obtained the
proper business license, therefore he believes the business owner was aware of the requirement to have a current Business Tax Receipt
(BTR). Officer Sterling recommended imposing a fifty dollar per day fine beginning two days after receipt of proper notification, if the
business owner has not obtained a current BTR by that date.
Special Magistrate Azcona found Case No. 190325019, Signature Signs of Okeechobee, 204 N Parrott Avenue, in violation of
Chapter 50 Section 50-32 Local business tax imposed, based on the testimony of Code Officer Sterling and the evidence
presented. Magistrate Azcona ordered Signature Signs of Okeechobee to pay all delinquent fees and obtain a current Business
Tax Receipt within two days of receiving proper notification, after that date a fine of fifty dollars per day will be imposed in addition
to all delinquent fees.

of Hearing on March 28, 2019, but the business owner was not present at this meeting. Officer Sterling stated The Alarm Company of
Okeechobee is operating a business in the City without a current Business Tax Receipt (BTR). He recommended imposing a fifty dollar
per day fine beginning two days after receipt of proper notification, if the business owner has not obtained a current BTR by that date.

Chapter 50 Section 50-32 Local business tax imposed, based on the testimony of Code Officer Sterling and the evidence
presented. Magistrate Azcona ordered The Alarm Company of Okeechobee to pay all delinquent fees and obtain a current
Business Tax Receipt within two days of receiving proper notification, after that date a fine of fifty dollars per day will be imposed
in addition to all delinquent fees.

and I have been duly sworn in prior to presenting evidence.

4. Based upon records of the City Finance Office Digital Bookkeeping does not have a current
Business Tax Receipt (BTR) which is required to do business in the City of Okeechobee.
7. On March 26, 2019 a Notice of Violation/Notice of Hearing was issued to the
