CODE BOARD ACTION January 14, 2003 Code Enforcement Board meeting was called to order at 7:02 p.m. by Chairperson Worley. Motion carried unanimously. Code Officer Tomey requested that an update from Attorney Cook be added to the Agenda. 14, 2003 - CEB 2of3 366 02-0107 02-0216 -1 AGENDA Linda M. Ballinger & Chp. 8 Sec. 8-2 Responsibilty of owners, Bobby Sweat agents, and tenants 1009 SW 11th Avenue Evelyn P. Dasher Estate Chp. 8 Sec. 8-10 Public nuisances 818 SE loth Street CODE BOARD ACTION Code Officer Tomey gave testimony that they had been talking with Ms. Ballinger regarding this problem for about a year. He said about three months ago Code Officer Hancock began inspecting the property on a regular basis. Code Officer Hancock stated he had inspected Case#02-0107 around noon today and most of the junk had been removed, but at this time the property was still not completely in compliance. Linda Ballinger gave testimony that she had notified Mr. Sweat in a letter that she had hired someone to clean the property and gave him ten to fifteen days to contact her. Since Mr. Sweat had made no effort to clean the property, she sent a crew that she had hired to clean the property. Mr. Sweat refused to let them clean. She called the police and they said they could not do anything that is was a Code Enforcement matter. She stated she had tried to do everything she could to get it cleaned up and W. Sweat would not let anyone clean the property. She said she wanted to do whatever was necessary to get it cleaned -up. Mr. Sweat gave testimony that he could have the property completely in compliance in a few more days. Member Gamiotea stated he had looked at the property about 5 p.m. today and almost everything was gone. Member Sweda felt at this time a fine should not be initiated since so much work had already been done. Member Castorina moved to table Case #02-0107 until the next meeting on February 11, 2003; seconded by Member Sweda. Worley - Yes Nelson - Yes Gamiotea - Yes Irby - Yes Montesi -Yes Sweda - Yes Castorina - Yes Motion Carried Code Officer Tomey stated that Case #02-216 had been declared a Public nuisance by the Code Board on September 10, 2002. Code Officer Hancock added that several people are interested in buying the property, but one of the heirs has not been located. Attorney Cook advised they could recommend to the they would authorize filing an abatement law suit; seconded by Member Nelson. Worley - Yes Gamiotea - Yes Irby - Yes Montesi - Yes Nelson - Yes Sweda - Yes Castorina - Yes Motion Carried 367 January 14, 2003 - CEB Regular Meeting - Page 3 of 3 AGENDA �I CODE BOARD ACTION Chairperson Worley requested that Code Officer Tomey prepare a list of all open cases for the Code Board to review at the meetings each month. Code Officer Tomey gave an update on Case # 01-0154 Gaughan/Nairnsey stating that the building was going to be burned by the Fire Department in a few weeks. Attorney Cook gave an update on Marvin Brantley, stating he had been working with Mr. Brantley's attorney and he felt they were showing some good faith in getting things started, but they still had some things to do. He added the issue of the foreclosure had not been resolved as to whether Mr. Brantley would be required to pay $7,500 or $15,000. Member Montesi moved that Case #01-0127 Gearaldine Bertram be referred to the City Counci to take whatever action is necessary to resolve this matter including foreclosure; seconded by Member Gamiotea Worley - Yes Gamiotea - Yes Irby - Yes Montesi - Yes Nelson - Yes Sweda - Yes Castorina - Yes Member Gamiotea stated he felt there needed to be more consistency in the way each case is handeled as far as time and effort spent. He thought we should use every resource to make personal contact before a fine is initiated, but that a line has to be drawn somewhere. Attorney Cook advised that an administrative fee could be established to cover these cost. Member Montesi moved to adjourn, seconded by Member Gamiotea. Meeting adjourned at 8:10 p.m. ADJOURNMENT - CHAWERSON WORLEY PLEASE TAKE NOTICE AND BE ADVISED that if a person decides to appeal any decision made by the Code Enforcement Board with respect to any matter considered at this meeting, he/she may need to insure that a verbatim record of the proceeding is made, which record includes the testimony and evidence upon which the appeal is to be based.
