CODE BOARD ACTION
Code Officer Tomey gave testimony that he was notified this afternoon that Case 401-0045 and #02-
0357 had made an agreement with the City that if they removed some concrete that had been left there
during the M & M Taddy project, then the owners would clean-up their property. Chief Tomey said he
was not aware of that agreement until today, so at this time he needed to withdraw these two cases
until the City removes the concrete.
Mark Goodbread addressed the board stating they are in the process of purchasing the Gaughan &
Nairnsey property with the intentions of cleaning it up and tearing down the old building once they
closed on the property in approximately forty-five days. He requested that the Code Board work with
them on paying the lien until they could get the property cleaned -up. Chief Tomey informed the Boazd
that this case had been under a fine of $250 per day since 1999 and that the total now came to
$302,262. Chairperson Worley reminded the Board that in similar cases they had reduced the fine to an
amount that would cover the cost incurred by the City. There was some discussion by the board
members as to what the City's cost had been in this case up until this point. Member Gamiotea felt a
new owner should not be punished for a violation that involved the previous owner, Member Nelson
agreed. Brad Goodbread addressed the Board stating once the property was cleaned they intended to
build something that would add to the tax base of the City. So even if the fine was reduced the City
would still realize an increase in revenue from the property each year. Member Montesi moved to
reduce the fine on Case# 01-0154 to $500 when the property is brought into compliance within forty-
five days of closing; seconded by Member Nelson.

Attorney Cook suggested to the Board a couple of areas for discussion in reference to the sign
ordinance. One was murals which at this time are not addressed in the existing sign ordinance and the
other was the use of temporary signs and banners. After a lenghty discussion among the Board
members, Member Gamiotea moved to schedule a workshop in order to review the sign ordinance in
more detail; seconded by Member Montesi.
