CODE BOARD ACTION Chairperson Worley called the September 10, 2002 Code Enforcement Board meeting to order at 7:04 p.m. Pledge of Allegiance Present Present Present Present Present Absent with consent (Bea Castorina filled the seat for Member Sweda) Present Present Present Present Present Present Member Gamiotea moved to dispense with reading and approve Summary of Board Action for August 13, 2002, seconded by Member Montesi. Motion carried unanimously. Chief Tomey informed the Code Board that Mr. Ordonez was in attendance in order to request a reduction of the 100 foot buffer requirement that he was cited to clear on his property located around River Run Phase 11. Dasher Estate c/o Glynn Dasher 818 SE 1 Oth Street C' 02-0351 NICERJA Enterprises Mr. Ordonez River Run Phase II 1 Sec. 8-10 Public Nuisance Sec. 8-11 General Cleaning Discuss Code Enforcement Issues: 1) Temporary Signs/Banners 2) Disabled Vehicles CODE BOARD ACTION Code Officier Tomey gave testimony that the attorney handeling the estate had been notified by certified mail that Case #02-0216 was on tonights agenda. Code Officier Tomey said the property appeared to be unrepairable at this point. Member Gamiotea advised the Code Board that he lived near this property and he also felt it was unrepairable and dangerous. Member Montesi moved that Case #02-0216 be declared a public nuisance and that a recommendation be made to the City Council to start condemnation proceedings; seconded by Member Nelson. Worley - Yes Gamiotea - Yes Ballinger - Yes Montesi - Yes Nelson - Yes Castorina - Yes Weisser - Yes Motion Carried Code Officier Tomey addressed the Board on behalf of Mr. Ordonez Case # 02-0351 stating he was planning to clear the property around River Run Phase H and hoped the Code Board would reduce the 100 ft. buffer requirement to 50 ft. After some discussion as to whether the 100 ft. buffer applied to unimproved (raw) land, Attorney Cook advised the Board it would not be necessary to take any action and that he would meet with the Code Officiers and straighten it out so that Mr. Ordonez would not have to go to any unnecessary expense. Attorney Cook suggested the Code Board members study the City and County ordinances on signs and he would prepare a draftt upctatmg the sign The Code Board members reviewed the existing ordianance on disabled vehicles and reconsidered a draft on disabled vehicles that the Board had rejected earlier this year. After a lengthy discussion as to whether some exemptions should be made for cars that are being restored, race cars, hunting buggies, etc., the Board decided to keep the existing ordianance in effect without any changes at this time. City Administrator Bill Veach stressed to the Code Board members the importance of the need for more clarity in regards to the existing ordiance on signs. Chairperson Worley assured the administrator the Board would work towards a more specific and clear definition. 1351 10.2002 - CEB Reeular Meeting - Page 3 of 4 AGENDA Update from Attorney Cook: 1. Gaughan & Nairnsey Case#01-0154 Review of cases currently being fined for non-compliance. 1. Geraldine Bertram Case# 01-0127 CODE BOARD ACTION Attorney Cook gave a report on the Gaughan property stating he had not heard anything from the attorney on Case# 01-0154, therefore he would suggest the Code Board recommend to the City Council to commence with condemnation proceedings. Member Gamiotea moved to request that the City Council commence with condemnation proceedings in Case# 01-0154; seconded by Member Weisser. Worley - Yes Gamiotea - Yes Ballinger - Yes Montesi - Yes Nelson - Yes Castorina - Yes Weisser - Yes Motion Carried The Code Board reviewed cases that are currently under fines for non-compliance. Case# 01-0127 (Geraldine Bertram) has been under a $30 per day fine since March 7, 2002. Chairperson Worley suggested the Board take some action before the fine becomes any larger. Member Montesi moved to send a notice of pending foreclosure on Case#01-0127 and allow sixty days after receipt of notice for removal of the disabled vehicle, the fine would continue to run during the sixty day extension; seconded by Member Nelson. Worley - No Gamiotea - No Ballinger - Yes Nelson - Yes Castorina. - Yes Weisser - Yes Motion Carried Member Castorina moved to request that all Code Board members be provided with a current copy of the City Code of Ordinances; seconded by Member Ballinger. Chairperson Worley thanked him for his interest and comments. Member Gamiotea moved to adjourn, seconded by Member Montesi. Meeting adjourned at 8:20 p.m. ADJOURNMENT - CHAIRPERSON WORLEY thASE TAKE NOTICE AND BE ADVISED that if a person decides to appeal any decision e by the Code Enforcement Board with respect to any matter considered at this meeting, e may need to insure that a verbatim record of the proceeding is made, which record includes the testimony and evidence upon which the appeal is to be based.
