Parrott Avenue Sec. 8-8 Disabled Vehicles Sec. 8-8 Disabled Vehicles Sec. 8-2 Responsibility of owners, agents and tenants CODE BOARD ACTION Member Gamiotea moved to find that Case# 02-0124 was in violation of Sec. 8-8 Disabled Vehicles, but has come into compliance; seconded by Member Weisser. Worley - Yes Weisser - Yes Gamiotea - Yes Castorina - Yes Montesi - Yes Irby - Yes Motion Carried Code Officer Hillery stated that Case# 02-0129 was still not in compliance, vehicle has flat tires and no tag. Member Gamiotea moved to find Case # 02-0129 in violation of Sec. 8-8 and be fined $5.00 per day beginning 15 days after receipt of notification; seconded by Member Irby. Worley - Yes Weisser - Yes Gamiotea - Yes Montesi - No Motion Carried Castorina - Yes Irby - Yes Wallace Norton asked to address the board saying he appreciated the members of the board, but he felt they should show a little more consideration for others. He felt the Code Board and Officiers should consider peoples circumstances. He said what was printed in the newspaper was unnecessary. Marvin Brantley addressed the board requesting his fine be further reduced to fair amount that he could afford to pay, he felt $1,500 would be a fair amount. He further requested the foreclosure proceedings be stopped and that he be given a payment plan in order to pay his fine. Attorney Cook informed the Board that the foreclosure suit had been served on Marvin a couple of weeks ago and he has twenty days to respond. Member Montesi moved to reduce the fine on Case# 00-01-01 to $7,500 plus costs and recommend to the City Council that the foreclosure would be abated; seconded by Member Gamiotea. After a lengthy discussion among the board members, Attorney Cook reminded the Board that any settlement of the foreclosure action would be a staff recommendation from himself and Mr. Veach to the City Council based upon what they preceived were the wishes of the Code Enforcement Board. Gaughan & Nairnsey Case401-0154 1 ADJOURNMENT - CHAIRPERSON WORLEY PLEASE TAKE NOTICE AND BE ADVISED that if a person decides to appeal any decision made by the Code Enforcement Board with respect to any matter considered at this meeting, includes the testimony and evidence upon which the appeal is to be based. Tapes are for the sole purpose of backup for official records of the department. ATTEST- Mack Worley, Jr., Chair son .� i , ue Christopher, Secretary CODE BOARD ACTION Attorney Cook gave a report regarding Case# 01-0154. Cook said he had spoken with the attorney that was supposed to be handeling the matter for the bank that holds the mortgage on the property. The banks attorney indicated that the foreclosure was not up and running at this time. Cook told him that there was very little chance of the property being rehabilitated and it needed to be torn down. Cook stated he would be sending some people to talk to the banks attorney in Minnesota with a proposal to buy it and raze the property. If the bank does not seem interested in selling it under those circumstances, then our only recourse is to proceed with the condemnation. He suggested we put this item back on the agenda in September or October and if the bank has not responded to any of the offers then the Code Board could recommend to the City Council to file a condemnation. Chairperson Worley asked Code Officier Hillery and Secretary Christopher to compile a list of fines running at this time and what date they began to be presented at the next meeting. Member Montesi requested that Attorney Cook review the ordinance on disabled vehicles. Member Irby also added he would like to see some emphasis on the positive things being done in the community. Mr. Veach commented that some action was already being taken along those lines. Member Gamiotea moved to adjourn; seconded by Member Irby. Meeting adjourned at 8:00 p.m.
