Member Worley moved to give Case # 02-0063 fifteen days to come into compliance, after that time a fine of $10.00 per day would commence; seconded by Member Sweda. Montesi - Yes Worley - Yes Ballinger - Yes Gamiotea - Yes Nelson - Yes Sweda - Yes Weisser - Yes Motion Carried After some discussion as to whether Case #02-0124 was in violation, due to the fact that the car was being stored in a carport, Member Worley moved to table Case #02-0124 until the next regularly scheduled meeting; seconded by Member Ballinger. Gaughan & Nairnsey Case#O 1-0154 2. Marvin Brantley Case# 00-01-01 Discuss Code Enforcement Issues: 1. Election of a chairperson 2. Citation process CODE BOARD ACTION Attorney Cook gave a report on the Gaughan property saying the bank had filed a foreclosure action against the property, and they were not in a position to repair or demolish the building until the foreclosure extinguished some secondary liens. Attorney Cook said he sent a letter to their attorney requesting a status of the foreclosure action. Attorney Cook stated he should have an idea of how soon they believe the foreclosure will conclude by the next Code Board Meeting on August 13, 2002. Chairperson Montesi requested this item be put back on the agenda for August 13, 2002. Attorney Cook reported that he was prepared to file the foreclosure on Case # 00-01-01 as soon as he researched the legal description, and could probably have it ready by next week. Mr. Brantley addressed the Board stating he felt he had been treated unfairly and that he had requested to be put on the agenda for August 13, 2002 to request a further reduction of his fine. He said he did not understand why the Code Board would not wait until after that meeting to take any further action. Member Nelson moved to wait until August 14, 2002 to file the foreclosure; no second was made. Motion failed. Chairperson Montesi opened the floor for nominations of a Chairperson and Vice -Chairperson. Member Weisser nominated Mack Worley, Jr for Chairperson, he accepted. The Board voted unanimously to elect Memeber Worley as Chairperson effective as of the next meeting August 13, 2002. Member Worley nominated Jamie Gamiotea for Vice -Chairperson, he accepted. The Board voted unanimously to elect Member Gamiotea as Vice -Chairperson. After a lengthy discussion regarding the citation process, the Code Board decided not to put it into effect at this time. But if they felt it was needed at a later time they would reconsider the issue. 11 Member Gamiotea moved to adjourn; seconded by Member Ballinger. Meeting adjourned at 8:20 p.m. ADJOURNMENT - CHAIRPERSON MONTESSI PLEASE TAKE NOTICE AND BE ADVISED that if a person decides to appeal any decision made by the Code Enforcement Board with respect to any matter considered at this meeting, he/she may need to insure that a verbatim record of the proceeding is made, which record includes the testimony and evidence upon which the appeal is to be based.
