Page - 1 Staff Report Site Plan Review Application No.: 09 -005 -TRC Applicant's Name: Jerry Suarez (Banquet Hall) General Description: The proposed site plan under consideration is for a 12,000 square foot building on a parcel of about 65,463 square feet (1.50 acres) and zoned CLT. An existing 1,859 square foot single- family structure will be converted to office use. This property was the subject of an approval of a special exception for the banquet hall granted by the Board of Adjustment on February 19, 2009. That approval was given with the following conditions. 1. Evening and nighttime hours of operation are to be limited to midnight on weekdays and 2:00 AM on Saturday and Sunday. 2. Activities shall be undertaken entirely within the building. 3. Amplified music or the use of loudspeakers shall be prohibited. 4. The building shall be located between the parking area and Taylor Creek so as to minimize the potential nuisance impacts of vehicular lights and noise associated with attendees of functions. 5. Possible increased setbacks of the building and parking areas from residentially zoned properties to the north. 6. A revised traffic analysis should be submitted that uses a more appropriate land use category, such as a multi-purpose recreational facility or recreational community center, for determination of the traffic impact of this use. Following is the Staff analysis of the project's consistency with the various City requirements and regulations. Instances where the Staff believes the submission to be deficient are highlighted. The rationale supporting this approach centers largely on the fact that the primary focus of the "banquet hall" will be weekend meetings, receptions and parties. The subsequent traffic generation estimates, provided by the Applicant's Traffic Engineer for the entire Shoppes on the Boardwalk project, reflect this assumption. We find the explanation and rationale acceptable and concur with the use of a church for purposes of calculating traffic generation. Page 6 of the Traffic Analysis for Shames on the Boardwalk, dated December 12, 2008 contained the following summary of the intersection analyses: "The two intersections which would provide the primary access to the project were analyzed; SR-70/NE 7th Avenue and NE 7th Avenue 3rd Street. Counts were made on November 6, 2008 and grown to 2010. The traffic volumes on SR -70 provide few gaps for vehicles to turn left from NE 7th Avenue. Therefore, the intersection would operate at level of service F. The analysis was re -run as a right -out only and reanalyzed. With the modification the intersection operates at level of service B and The final configuration at SR -70 and NE 7th Avenue will be determined in conjunction with the FDOT...." No other intersections were significantly affected. We agree with the above findings and suggest the following condition be attached to any approval of the site plan: The Applicant shall consult with FDOT on this matter in order to ascertain the adequacy of this two-way controlled stop sign intersection and the Applicant's possible cost sharing for any intersection modifications that may be necessary (e.g., signing/marking/directional median openings, etc.). Page - 3 Staff Report Site Pian Review Application No.: 09 -005 -TRC Applicant's Name: Jerry Suarez (Banquet Hall) Comparison of Proposal with Dimensional Standards: In addition to the general requirements and limitations applicable to all uses in the CLT district, the site plan should be reviewed in light of the conditions set forth in the Board of Adjustment and Appeals' approval of the special exception. Provided A total of just 49 spaces are shown. 44 spaces (including two handicap spaces) are located within the main parking lot. Five spaces, (including one handicap space) are shown as back -out parking onto NE 3rd Street. Explanatory comments: This matter was discussed with the Applicant's representative during a conference call in early September. At that time the Applicant was advised that we would expect justification for the applicant's classification of the "banquet hall" as a private club. We suggested that it should be treated more like indoor recreation and expected that the parking requirement for the use would probably be about one space per 200 square feet of floor area. The Applicant has submitted no rational for using the parking requirement for a private club. Therefore we offer our explanation for the opinion that the use should be considered indoor recreation for the purposes of calculating required parking. The "banquet hall" does not meet the definition of a private club as set forth in Sec. 66.1, which reads as follows: "Private club means an establishment catering exclusively to an association of persons and their guests, which is not available for unrestricted public access, includes fraternal lodge, sorority, union hall." The primary distinction is that the "banquet hall" will not be available exclusively to persons of an association, etc. It is not similar to a fraternal lodge, sorority or union hall. Rather, it will be open to the general public for a variety of events and purposes, although the primary focus will be for weekend meetings, reception and parties. While the "banquet hall" does not also strictly meet the definition of indoor recreation in the LDC, we are of the opinion that this would be the most similar category upon which to base the need for off-street parking. We have reviewed other codes and find that indoor recreation, meeting halls, exhibition halls without fixed seating may have parking requirements ranging from 6 to 12 spaces per 1,000 square feet. We believe that the five spaces per thousand square feet the City requires for indoor recreation uses is the absolute minimum that should be applied in this case. Applying this minimum requirement indicates that there should be at least 60 spaces devoted to the banquet hall, plus another six for the office use, for a total of 66 spaces. Page - 5 Staff Report Site Pian Review Landscaping Total Site (Sec. 90-532) Parking & Vehicular Use Areas (Sec. 90-533) Application No.: 09 -005 -TRC Applicant's Name: Jerry Suarez (Banquet Hall) Minimum of one tree and three shrubs per 3,000 square feet of lot area = 22 trees and 65 shrubs. 46 spaces @18 sf/required space = 828 sf landscaped area plus 1 tree/ 72 sf of required landscaped area = 12 trees. One landscaped island (5' X 15') for each 10 spaces with a maximum of 12 uninterrupted spaces in a row =4.6. This is rounded up to 5 landscaped islands. Minimum dimension of landscaping is four feet, except adjacent to buildings. Minimum 2' landscaping between vehicular use areas and buildings 23 trees and about 150+ shrubs Although the site plan did not provide calculations of the square footage of landscaped area within the vehicular use areas, it is apparent that the area provided exceeds the minimum required. The Applicant is providing more than the minimum of five landscaped islands. All are of adequate size and contain a sufficient number of trees. All landscaped areas meet this requirement. Just two areas do not meet this requirement, those along the front and east sides of the "banquet hall" where only the sidewalk separates the build- ing from the vehicular use area. The regpirernent for the two feet of landscaping is intended to soften the appearance of the building; The landscaping can be located between the building and the sidewalk, or between the sidewalk and the parking areas. Therefore, based on 464 feet of non -driveway frontage along NE 3rd Street and NE 7th Avenue and about 694 feet along the other property lines, there should be about 4,640 sf of landscaped area along the roadway frontage and about 1,328 sf along the balance of the peri- meter = total of about 5,968,sf of buffer area. At 1 tree & 3 shrubs/300 sf of required buffer = 20 trees and 60 shrubs. Trees may be planted in clusters, but shall not exceed 50' on centers abutting the street. The only area along a street frontage that does not meet the minimum 10' landscape requirement is the easternmost end of the parking lot abutting NE 7th Avenue. Otherwise, there are over 8,000 square feet of Landscaped area, 23 trees and almost 200 bushes meeting the location and spacing requirements. Other Re • uirements and Considerations: Sidewalks (Sec. 78-36): No sidewalk is shown along the east side of NW 7th Avenue. Lighting Plan (Sec. 78-71): No lighting plan has been submitted for the vehicular use area. Dumpster Location: The dumpster location shown on the site plan appears to be reasonably located. Elevations: No elevations have been provided. Special Exception Consideration: The Board of Adjustment and Appeals' approval of the special exception included recommendations addressing the following issues: 1. The building shall be located between the parking area and Taylor Creek so as to minimize the potential nuisance impacts vehicular lights and noise associated with attendees of functions. We believe the proposal as submitted meets this condition. Page - 7 Staff Report Application No.: 09 -005 -TRC Site Plan Review Applicant's Name: Jerry Suarez (Banquet Halq 2. Possible increased setbacks of the building and parking areas from residentially zoned properties to the north. We believe the setbacks, as proposed are adequate for their intended purpose. 3. A revised traffic analysis should be submitted that uses a more appropriate land use category, such as a multi-purpose recreational facility or recreational community center, for determination of the traffic impact of this use. The Applicant's Traffic Engineer has submitted information adequately establishing that for purposes of traffic generation, a church use is appropriate in this instance. Recommendation: Because parking is a critical component of any site plan and can have impacts on the location of structures, drainage, access and interior circulation and landscaping, Staff recommends that the Applicant return with a revised site plan that adequately addresses the need for parking for the banquet hall, and any attendant changes provision of adequate parking may have upon other aspects of the project. Specifically, we recommend the following conditions be included: 1. The site plan is revised to provide at least 66 spaces, 60 for the "banquet hall" and six for the office building, and parking is provided in such a manner that there is no back -out parking onto either NE 3rd Street or NE 7th Avenue and the noted deficiencies in the plan pertaining to parking setbacks and minimum landscaping between the building and vehicular use areas be rectified. 2. The gazebo is set back the required minimum of 20 feet from the top of the bank of Taylor Creek. 3. Provision is made for a sidewalk along the east side of NE 7th Avenue if found to be necessary by the TRC. 4. A lighting plan meeting the City's requirements is submitted. 5. Elevations of the building(s) are submitted. 6. In accordance with the conditions set forth by the Board of Adjustment as follows: a. Hours of operation shall run no later than midnight on weekdays and 2:00 AM on Saturday and Sunday. b. Activities shall be undertaken only entirely within the building. c. Amplified music or the use of loudspeakers shall be prohibited. Staff Report Applicant: Anita’s Rental Properties Rezoning Petition No. 19-002-R 2 Request The matter before the Local Planning Agency and City Council is an application to rezone a 1.449-acre parcel bounded by NE 3rd Street, NE 7th Avenue, and Taylor Creek. The request is to rezone from Light Commercial (CLT) to Heavy Commercial (CHV). The Applicant has stated that, if the rezoning request is approved, a special exception use petition for a recreational vehicle park will be following. The current and proposed Future Land Use designations, zoning, existing use, a nd acreage of the subject property and surrounding properties are shown in the following tables and on the maps on pages 7 through 9. Current Future Land Use, Zoning and Existing Land Use Characteristics Existing Proposed Future Land Use Category Commercial Commercial Zoning District Light Commercial (CLT) Heavy Commercial (CHV) Use of Property Office Recreational Vehicle Park Acreage 1.449 Acre 1.449 Acre Future Land Use, Zoning, and Existing Uses on Surrounding Properties North Future Land Use Map Classification Commercial Zoning District Light Commercial (CLT) Existing Land Use Taxidermy and Wholesale and Single family residence East Future Land Use Map Classification Taylor Creek Zoning District Taylor Creek Existing Land Use Taylor Creek South Future Land Use Map Classification Commercial Zoning District Light Commercial (CLT) and Heavy Commercial (CHV) Existing Land Use Parking lot for restaurant and Service commercial West Future Land Use Map Classification Commercial Zoning District Light Commercial (CLT) Existing Land Use Vacant Staff Report Applicant: Anita’s Rental Properties Rezoning Petition No. 19-002-R 3 Analysis Section 70-340 of the Land Development Regulations requires that the reviewing body find that an application for rezoning meets each of the following conditions. The Applicant has provided brief comments to each of the required findings. These are repeate d below in Times Roman typeface exactly as provided by the Applicant. Staff has made no attempt to correct typos, grammar, or clarify the Applicant’s comments. Staff comments are shown in this Arial typeface. 1. The proposed rezoning is not contrary to Comprehensive Plan requirements. “Proposed rezoning is consistent with the Comprehensive Plan with the approval of a special exception” Staff Comment: The subject property is designated Commercial on the City’s Future Land Use Map (FLUM). Both CLT and CHV are listed as zoning districts which may be appropriate for the Commercial Future Land Use designation. 2. The proposed use being applied for is specifically authorized under the zoning district in the Land Development Regulations.” “Proposed use applied for is listed specifically as a special exception to Heavy Commercial Zoning” Staff Comment: The Applicant has stated that the desired use for this property is a recreational vehicle (RV) park. That use is not listed as a permitted use in the CHV district, but it is listed as a special exception use in the CHV district. The Applicant has stated that a special exception use petition will be submitted if this rezoning request is approved. 3. The proposed use will not have an adverse effect on the public interest. “The proposed use will not have an adverse effect on public interest” Staff Comment: Depending on the location, an RV park can have an adverse effect on the public interest. RV parks provide allotted spaces (lots) where patrons with RVs can stay overnight or up to 6 months. Essentially, this is a type of transient lodging. Okeechobee Code Section 90-700 allows up to 15 RV lots per acre in a designated RV park, which translates into a potential maximum of 21 RV lots on the Applicant’s 1.449 acre parcel. The subject property is located in an area with some service commercial and predominantly single family residences. Allowing for this many temporary dwelling units could have an adverse impact on this existing single family neighborhood. Staff Report Applicant: Anita’s Rental Properties Rezoning Petition No. 19-002-R 4 4. The proposed use is appropriate for the location proposed, is reasonably compatible with adjacent land uses, and is not contrary or detrimental to urbanizing land use patterns. “The proposed use is appropriate for the location” Staff Comment: In addition to the RV Park, which is the Applicant’s intended use, the Board must also consider the uses that would be allowed by right if this request to rezone to CHV is approved. The subject property’s current zoning of CLT already allows for several types of commercial uses. In addition to the uses allowed in the CLT district, the CHV district regulations allow the following uses by right: (1) Retail service, retail store including outdoor display of merchandise. (2) Restaurant, take-out restaurant, cafe. (3) Dry cleaner/laundry, laundromat. (4) Funeral home. (5) Hotel, motel. (6) Private club, nightclub and bar. (10) Business school. (11) Commercial indoor recreation. (12) Commercial parking garage or lot, taxistand, bus terminal. (14) Taxidermist. (17) Indoor auction house. Several of the above uses could have adverse impacts, including significant increases in vehicle trips and noise. Most of the above uses would not be appropriate for the surrounding neighborhood, which is predominantly single family. The current zoning of the subject parcel provides the best compatibility with the directly adjacent parcels which are all zoned CLT. Staff acknowledges that there are properties with CHV zoning to the south of the subject property. Those properties are generally the outermost extent of the Park Street commercial corridor; and historically, it has been the goal of the City to limit the heavy commercial corridor to properties that are within a couple blocks of the state roadways (Park Street and Parrot Avenue). 5. The proposed use will not adversely affect property values or living conditions, or be a deterrent to the improvement or development of adjacent property. “The proposed use will not affect property values or living conditions” Staff Comment: It is likely that increasing the intensity of the subject property by allowing an RV park would affect property values of other nearby parcels. Staff Report Applicant: Anita’s Rental Properties Rezoning Petition No. 19-002-R 5 6. The proposed use can be suitably buffered from surrounding uses, so as to reduce the impact of any nuisance or hazard to the neighborhood. “Yes, there will be suitable landscape to buffer any nuisance to the neighborhood” Staff Comment: Significant landscaping, beyond what is required by City standards, would need to be planted to have any effect at reducing the potential impacts of an RV park. No amount of landscaping or other buffering will negate the effects of increased vehicle trips that would be generated by an RV park. 7. The proposed use will not create a density pattern that would overburden public facilities such as schools, streets, and utility services. “The proposed use will not overburden any public facility” Staff Comment: Continually allowing expansion of the heavy commercial corridor could increase demand for services and potentially overburden some public facilities. 8. The proposed use will not create traffic congestion, flooding or drainage problems, or otherwise affect public safety. “No there will be no traffic congestion or affect public safety.” Staff Comment: Without a proposed site plan or a traffic impact study, it is difficult to know what effect the Applicant’s proposed use would have on traffic congestion. However, the ITE Manual trip generation rates for an RV park suggests that approximately 108 vehicle trips per weekday would be generated for a 1.449 acre RV park. Any new site plan would have to meet minimum stormwater management requirements according to City Code Section 78-101. 9. The proposed use has not been inordinately burdened by unnecessary restrictions. “The proposed use is free from unnecessary restrictions” Staff Comment: We agree. Staff Report Applicant: Anita’s Rental Properties Rezoning Petition No. 19-002-R 6 Recommendation Based on the foregoing analysis, we find the requested rezoning from CLT to CHV to be inappropriate for the subject property, incompatible with adjacent land uses, and contrary to the established and desired land use patterns. Therefore, we recommend Denial of the Applicant’s rezoning request.
