Discuss Code Enforcement Issues: 1. Election of a Chairperson 2. Improved & unimproved land 3. Disabled vehicles 4. Citation process CODE BOARD ACTION Code Enforcement Officer Bob Hillery gave testimony that all cases on the agenda have come into compliance. Member Sweda moved to dismiss Case # 02-0029, 02-0060, and 01-0047 due to the fact that they are in compliance; seconded by Member Irby. Worley - Yes Sweda - Yes Weisser - Yes Irby - Yes Castorina - Yes Motion Carried Attorney Cook informed the Code Board at this time they could not proceed on the issue of electing a chairperson because the City Council had not yet adopted the ordinance. Member Worley addressed the issue of improved and unimproved property stating the Code Board had not authorized the rewriting of Section 8-11, that they had only agreed to add definitions to clarify what would be considered improved and unimproved property to the existing Section 8-11. Attorney Cook suggested that the definitions be written down so that there would be no miscommunication and that he would take those definitions and incorporate it into the existing ordinance. Attorney Cook reminded the Code Board if they wanted to review the changes to the ordinance before the second reading of the City Council, then it should not be presented to the City Council for the first reading until July 2, 2002. If however the Code Board felt it was not necessary to review or discuss the changes made to the ordinance before the second reading of the City Council then it could be presented to the City Council at the next meeting on June 18, 2002. After some discussion the Code Board members decided to have Attorney Cook go ahead and autm—il the revised ordinance to t1hec City Council at the next meeting on June 18, 2002. After a lengthy discussion by the Code Board it was decided to leave Section 8-8 Disabled Vehicles as it is now. The board advised Code Officer Bob Hillery to begin enforcing Section 8-8 as it is written at this time and if at a later time they feel it is necessary to make changes it will be considered then. Attorney Cook recalled that the citation process had been approved by the City Council, but that it had never been decided which types of cases the Code Officer should issue citations and which ones should still come before the Code Board. Member Worley asked Mr. Veach if he could give the Code Board 342 AGENDA 1 IDJOURNMENT - VICE -CHAIRPERSON WORLEY PLEASE TAKE NOTICE AND BE ADVISED that if a person decides to appeal any decision made by the Code Enforcement Board with respect to any matter considered at this meeting, he/she may need to insure that a verbatim record of the proceeding is made, which record includes the testimony and evidence upon which the appeal is to be based. Attorney Cook gave a report on the Gaughan property saying the bank had said they were willing to clean the property, however at this time nothing has been done. Attorney Cook said he would attempt to contact the bank and give an update to the Code Board at the next meeting on July 9, 2002. Member Worley asked for a report on the Brantley property and Attorney Cook stated that he, the City Administrator and the Mayor would be meeting regarding this case tomorrow to discuss what to expect when we proceed with the foreclosure. Member Worley welcomed the two new alternate Code Board Members, Bea Castorina and Frank Irby. Member Sweda moved to adjourn; seconded by Member Weisser. Meeting adjourned at 7:55 p.m.
