May 14, 2002 Code Enforcement Board meeting was called to order at 7:03 p.m. by Chairperson
Montesi.

Member Ballinger moved to dispense with reading and approve Summary of Board Action for April 9,
2002, seconded by Member Worley.
Motion carried unanimously.
Chief Tomey requested that three items be added to the agenda. 1) Election of a chairperson 2) Reviev
definitions prepared by Attorney Cook regarding improved and uimproved land 3) Decide whether to
have a meeting on June 11, 2002.

CODE BOARD ACTION
Chief Tomey gave testimony that Mr. Sandoval was in the process of putting up a privace fence, but it
was not completely finished. Member Worley moved to give Case #02-0029 another thirty days to
come into compliance; seconded by Member Gamiotea.

Code Officer Hillery gave testimony that he had talked with Ms. Nickels regarding Case #02-0060 and
she said the cars would be removed in two weeks. Member Worley moved to give Case #02-0060 thirty
days to come into compliance and after that time a $5.00 per day fine would commence; seconded by
Member Ballinger.

Chief Tomey gave testimony that Mr. Charles Clay had refused to accept the certified letter, so the
violation was hand delivered to his father George Clay. Attorney Cook said the notice could be posted
on the property. Member Worley moved to table Case #01-0047 until the next meeting to be sure Mr.
Charles Clay had been properly notified; seconded by Member Ballinger.

The Code Board decided unanimously to wait until the next regularly scheduled meeting to elect a
chairperson since several members were absent.

PLEASE TAKE NOTICE AND BE ADVISED that if a person decides to appeal any decision
made by the Code Enforcement Board with respect to any matter considered at this meeting,
he/she may need to insure that a verbatim record of the proceeding is made, which record
includes the testimony and evidence upon which the appeal is to be based. Tapes are for the sole
purpose of backup for official records of the departwnt.

CODE BOARD ACTION
The Code Board reviewed and discussed the definition of improved and unimproved land. Attorney
Cook suggested that he would draw up a final draft of the definition of improved and unimproved
property before May 29, 2002 for the Code Board to review. If that draft was approved by the Code
Board it could then go on the Agenda for the City Council meeting on June 4, 2002. Then the Code
Board could review the City Council's input at the next meeting on June 1 Ith before the matter went
before City Council for final approval on June 18, 2002. The Code Board members agreed to have
Attorney Cook get a final draft ready for the City Council meeting on June 4, 2002.
Member Gamiotea moved to adjourn; seconded by Member Ballinger. Meeting adjourned at 7:52 p.m.
