Mayor Watford called the April 16, 2019, Regular City Council Meeting to order at 6:02 P.M. In the absence of Father Shevlin, the invocation was given by Pastor Don Hanna of the First United Methodist Church; the Pledge of Allegiance was led by Mayor Watford. PROCLAMATIONS AND PRESENTATIONS A. Recognize Okeechobee Main Street for designation as a Nationally .Accredited Main Street. B. Proclaim the month of April 2019 as "Guardian ad Litem Month." C. Proclaim the month of April 2019 as "Water Conservation Month." COUNCIL ACTION - DISCUSSION - VOTE Mayor Watford received a letter dated March 18, 2019, from the Florida Department of State, Division of Historical RP sources and Preservation, notifying the City that Okeechobee Main Strer:t (OKMS) obtained national accreditation for 2019; a copy of the letter has been incorporated into the minute file for the official record. The Council extended congratulations to OKMS representatives in attendance, President Angie Griffin and Executive Director Lynda Powers. April was proclaimed as Guardian ad Litem Month. The Proclamation was presented to Mr. Barry Scanlon, Volunteer Child Advocate with the Guardian ad Litem Program, by Mayor Watford and read into the record as follows: "Whereas, the City of Okeechobee prides itself on giving back to the community, contributing to the quality of life among our citizens; and Whereas, the Guardian ad Litem Program speaks for the best interests of abused, abandoned, and neglected children who are involved in the court system; and Whereas, 192 children in the community are currently in danger of suffering from some form of abuse or neglect, and Whereas, Okeechobee community members are encouraged to join together, throughout the month of April to raise awareness for those children fallen victim to abuse, neglect and abandonment; and Whereas, this effort will give abused, neglected, and abandoned children in our community an improved chance for a safe permanent home and positive future. Now Therefore, 1, Dowling R. Watford, Jr., by virtue of the authority vested in me as Mayor of the City of Okeechobee, Florida, do hereby proclaim the month of April 2019 as `Guardian ad Litem Month' and urge all citizens to give of their time to make a difference in the lives of our most vulnerable children by volunteering with the Guardian ad Litem Program." April was proclaimed as Water Conservation Month. The Proclamation was presented to Mrs. Libby Pigman of South Florida Water Management by Mayor Watford and read into the record as follows: "Whereas, water is a basic and essential need of every living creature; and Whereas, the State of Florida, Water Management Districts and the City of Okeechobee are working together to increase awareness about the importance of water conservation; and Whereas, the State of Florida has designated April, typically a dry month when water demands are most acute, as Florida's Water Conservation Month to educate citizens about how they can help save Florida's precious water resources; and Whereas, the City of Okeechobee has always encouraged and supported water conservation through various educational programs and special events; and Whereas, every business, industry, school, and citizen can make a difference when it comes to conserving water; and Whereas, every business, industry, school, and citizen can help by saving water and thus promote a healthy economy and community. Motion to approve the March, 2019 Warrant Register: General Fund ........... .............................................................. $511,752.73 Public Facilities Improvement Fund ........................................$ 39,811.46 Capital Improvement Projects Fund ........................................$ 12,515.90 COUNCIL ACTION - DISCUSSION - VOTE Mayor Watford proclaimed May 19 through 26, 2019, as Florida Water Reuse Week, presented the Proclamation to Mrs. Libby Pirrnan of the South Florida Water Management District, and read the following into the record: "Whereas, safe, clean and sustainable water resources are essential to Florida's environment, economy, citizens, and visitors; and Whereas, although Florida's water supplies are finite, the state's population, and need for water resources continue to increase; and Whereas, water reuse provides a means for conserving and augmenting Florida's precious water resources and is key to the state's sustainable water future; and Whereas, Florida has established the encouragement and promotion of water reuse as state objectives in Chapters 373 and 403, Florida Statutes; and Whereas, Florida has risen to be the national leader in water reuse - reusing 813 million gallons of reclaimed water per day to conserve freshwater supplies and replenish our rivers, streams, lakes, and aquifers; and Whereas, Florida's permitted reuse capacity is over 1.6 billion gallons per day (approximately 71 percent of Florida's total permitted capacity for all domestic wastewater treatment facilities); and Whereas, WateReuse Florida, the state section of the WateReuse Association, has proclaimed the week of May 19 through 26, 2019 as Florida Water Reuse Week; and Whereas, the City of Okeechobee has joined with WateReuse Florida, the Florida Department of Environmental Protection, and the South Florida Water Management District in encouraging and promoting water reuse and conservation. Council Member Jarriel moved to read proposed Ordinance No. 1182 by title only, revising the formal bidding procedures and proposal requirements, increasing authorized purchase amounts by the City Administrator and Department Heads; seconded by Council Member Abney. Council Member Jarriel moved to adopt proposed Ordinance No. 1182; seconded by Council Member Keefe. Mayor Watford opened the floor for public comments; no public comments were offered. He explained the purchasing limits are being amended to increase the maximum amount the City Administrator can approve without Council approval from $7,500.00 to $15,000.00; increases the maximum amount Department Heads can spend without prior approval from the Administrator from $500.00 to $1,000.00; and increases the amount of requiring formal bidding procedures from $7,500.00 to $15,000.00. Council Member Clark asked that local vendor preference apply to awarding quotes in addition to formal bids. Attorney Cook explained in Chapter 2, Section 2-290 of the Code of Ordinances reads local vendor preference applies to any purchases. Council Member Clark then read Code Section 2-290(f) "The City Council reserves the exclusive right to exercise the option as to whether or not to apply the local vendor preference to any procurement." Discussion ensued concerning the interpretation of this applying to all purchases. Attorney Cook suggested the Ordinance be amended should the Council want to ensure this is clear. 476 APRIL 16, 2019 - REGULAR MEETING - PAGE 5 OF 11 AGENDA VIII. Update regarding Code Enforcement Foreclosures - Attorney Cook (Exhibit 2). COUNCIL ACTION - DISCUSSION - VOTE Council Member Clark moved to amend proposed Ordinance No. 1162 adding a Section 2-269(6) to add local vendor preference language for quotes; seconded by Council Member Keefe. [Note for Clarification: upon legal review the amendment language will be a separate paragraph following Section 2-289 to ensure the interpretation includes proposals (as set out in Section 2-285) and open market purchases (as set out in Section 2-286)], VOTE ON MOTION TO AMEND: WATFORD e YEA ABNEY — YEA CLARK e YEA JARRIEL — YEA KEEFE — YEA MOTION TO AMEND CARRIED. Mayor Watford again asked whether there were any comments from the public since the Ordinance was amended; there were none. Discussion began at the March 5, 2019, meeting regarding Code Enforcement Cases that have been considered for foreclosure due to the length of time their fine has accrued without property owners making progress towards bringing the property into compliance. The Council needed additional time to review the information provided. The table below (located on page six, and included in Exhibit 2) provides information on which Code Cases the Code Board recommended, and City Council authorized, the foreclosure proceedings to begin. As explained at the previous meeting, City Staff, acting as instructed, were not to file the foreclosures immediately. IHowevei-, several Council Members voiced their exception to this practice, and want immediate action on foreclosures in the future. Attorney Cook prepared and distributed a i-nemorandum dated March 'i i, 20'19, (included in Exhibit 2) alone wiih a copy of relevant sections of Florida Statutes Chapter 162 concerning Code Enforcement. He reiterated the difficulty of adopting "hard and fasi rules" pertaining io Code Enforcement non-compliance..' he COUndl briefly discussed the possibility of adopting a policy mandating all Cases; hat have been non -complain' for 90-days be brought before the Council to review and recommend a course of action. At the April 2, 2019, meeting while considering appointing a new Alternate Member to the Planning Board, Board of Adjustments, and Design Review Board, it was noted that there could be an issue with Mr. Williams Ward's application that could cause dual office holding as he is currently appointed to the Okeechobee County Construction Industry Licensing Board. The Council deferred action on this item to allow Attorney Cook time to research the matter. Attorney Cook explained according to the Florida Attorney General Opinion 2013-31, the County's Construction Industry Licensing Board is considered an "office;" the City Planning Board, Board of Adjustments, and Design Review Board is also an "office." Therefore Mr. Ward is ineligible for appointment. Clerk Gamiotea added she explained the issue with dual office holding to Mr. Ward; he withdrew his application for consideration this afternoon. Mayor Watford explained a ballot -type system would be used to rank the applicants. Each Council Member ranked the three applicants on a piece of paper. The rankings were tabulated with the assistance of Clerk Gamiotea, Mr. O'Connor received one number one ranking, three number two rankings, and zero number three rankings; Mr. Shaw received three number one rankings, one number two rankings, and zero number three rankings; and Ms. Vu received one number one ranking, one number two ranking, and five number three rankings. The papers were collected by the Clerk and have become part of the official minute file record. Mr. Shaw was the only applicant in attendance. Motion to appoint an Alternate to the Planning Board, Board of Council Member Clark moved.to appoint Mr. James Shaw as an Alternate to the Planning Board, Board of Adjustment, and Design Review Board, term being May 2019, to April 30, 2021; seconded by Council Adjustment, and Design Review Board, term being 54ay 1, 2019, to April 30, 2021 continued. Member Jarriel. VOTE: WATFORD — YEA ABNEY — YEA CLARK — YEA JARRIEL — YEA KEEFE — YEA MOTION CARRIED. X. NEW BUSINESS A. Consider a motion to amend the Extension of Lease Agreement with On October 16, 2018, the Council approved an Extension of the March 24, 2012, Lease Agreement with the the Chamber of Commerce of Okeechobee County to include following additions: 1. That this Lease is hereby extended for an additional term of 60-months commencing on elimination of the requirement of Errors and Omissions coverage by October 1, 2018, and expiring on September 30, 2023, unless earlier extended, modified or terminated; 2. That all the Chamber - City Attorney (Exhibit 4). original terms, conditions, covenants, agreements, and rental fees shall remain in full force and effect, and are incorporated herein by reference; and 3. That for clarification, it is expressly understood that the terms of the original Lease, which terms also apply in this extension, the City is responsible for all maintenance and repair of structural components of the building, being the parking lot, roof, soffit, and stucco; that Chamber is responsible for maintenance and repair of all other normal maintenance and repairs such as plumbing, heating, electrical, air conditioning, windows, signage, etc. or normal wear and tear." This Agreement was executed by the City but not by the Chamber representatives. Instead the Chamber returned an executed Agreement amending item "2" (listed above), by adding at the end, "Except the Lease requirement for Errors and Omissions (E&O) Insurance is deleted." Included in Exhibit 4 was a letter from Attorney Cook to Chamber Executive Director Paulette Wise explaining the added language was not approved by the City Council, and would need to be placed on a meeting agenda to determine whether the Council would approve the change. Council Member Keefe noted for the record he is the Secretary for the Chamber and questioned whether this was a conflict of interest requiring him to abstain from voting on this matter. Attorney Cook confirmed there was not a conflict of interest as there would have to be a direct or indirect personal gain. Council Member Jarriel moved to discuss (the consideration to amend the Extension of Lease Agreement with the Chamber of Commerce of Okeechobee County to include elimination of the requirement of Errors and Omissions coverage by the Chamber); seconded by Council Member Clark. VOTE: WATFORD — YEA ABNEY — YEA CLARK — YEA JARRIEL — YEA KEEFE — YEA MOTION CARRIED. Council Member Jarriel questioned the reasoning behind the Chamber's request to omit the E&O Insurance requirement. Council Member Keefe explained it was a budgeting issue for the Chamber. Council Member Abney questioned the liability the City would incur by allowing the Chamber to not provide this type of insurance. Consider a motion to amend the Extension of Lease Agreement with Discussion then lead to the requirement for the Chamber to provide or reimburse the City for liability insurance, hold the Chamber of Commerce of Okee,�hobee County to include the City harmless, and what certificates of insurance were on file listing the City as an additional insured. The elimination of the requirement of Errors and Omissions coverage by consensus of the Council was to defer this item as unfinished business for the May 7, 2019, meeting to give Staff time to contact the City insurance provider, Public Risk Management, for their recommendation on the Chamber continued. whether or not this type of insurance should be included in the Lease Agreement, as well as research the questions regarding certificates of insurance and reimbursement of insurance paid by the City. B. Motion to approve a Sub -Lease Agreement between the Chamber of Council Member Jarriel moved to approve a Sub -Lease Agreement between the Chamber of Commerce of Commerce of Okeechobee County and State Representative Cary Okeechobee County and Dr. Cary Pigman, Florida House of Representative District 55 [for office space at 55 South Pigman - City Attorney (Exhibit 5). Parrott Avenue, Park "R" of FLAGLER PARKS, Plat Book 1, Page 10, Okeechobee County Public Records]; seconded by Council Member Keefe. Exhibit 5 contained a copy of the Sub -Lease Agreement executed by the Chamber and Dr. Pigman. Due to the direction of the previous item, Attorney Cook confirmed action could be taken on this item since the City technically has a month -to -month Lease with the Chamber. Consider a Temporary Street Closing Application submitted by First Council Member Clark moved to approve a Temporary Street Closing Application submitted by First Baptist Church Baptist Church of Okeechobee for a Children's Ministry Easter Egg of Okeechobee for a Children's Ministry Easter Egg Hunt on Saturday, April 20, 2019, from 8:00 A.M. to Noon, Hunt on April 20, 2019, from 8:00 A.M. to Noon, closing Southwest 4th closing a portion of Southwest 4th Street between Southwest 5th and 6th Avenues; seconded by Council Member Street between Southwest 5th and 6th Avenues - City Administrator Abney. Discuss preparation of a Strategic Plan and Mission Statement - City Administrator MontesDeOca explained the matter of creating a City Strategic Plan and adopting a Mission Administrator. Statement was discussed at the April 2, 2019, meeting. He has placed these items on the agenda for Council to offer direction on how to proceed. Council Member Keefe provided an example of how the structure of the County's Strategic Plan is working, adding he believed having a Plan would give Staff clear goals, direction, and perimeters over a period of years, which will ultimately lead to a more efficiently run City and give Staff a sense of accomplishment. Stating further, Indiar River State College has facilitators that the City can use for moderating the workshops. The results of the workshops could help generate a Mission Statement. She also suggested workshops for the pending amendments to the Comprehensive Plan/Land Development Regulations, as well as a future workshop to consider how to proceed with the Charter Review Committee. After a brief discussion, the consensus of the Council was to conduct a workshop for generating a Strategic Plan. The Council also instructed the Administrator to meet with County Administrator Chartier to gain insight on the process they took to create their Plan. An official date/time to conduct the workshop will have to be determined once Administrator MontesDeOca follows up with Indian River State College and Mrs. Chartier. Police Chief Peterson expressed his support for the suggestion briefly discussed during Unfinished Business Item "A," that all non -compliant Code Enforcement Cases be sent to the City Council for action after a fine has accrued for 90-days. Once the Case is heard by the Magistrate, an Order is issued, then a daily fine is assessed by a Lien. The Case is not reconsidered by the Magistrate. However, rather than allow the fine to continue to accrue until the Case is in compliance, it could be presented to the City Council. Mayor Watford confirmed with Chief Peterson this would be the procedure followed from today forward. The floor was yielded to Major Hagan to present the Code Enforcement procedures implemented that takes a pro -active approach to handle non-compliance. Each (weekday) morning, he drives through residential neighborhoods making notes on potential violations. Code Officer Sterling is doing the same, only he will be focusing on the main commercial corridor areas. The notice of violation and how to process them are as follows: 1. Door hanger is provided as a courtesy notice, the address is checked for compliance after one -week. 2. If not corrected, a courtesy card is mailed via United States Postal Service (USPS) to the property owner; the address is checked again after 10-days. 3. If not corrected, a Notice to Appear before Code Enforcement Special Magistrate is sent via certified USPS mail. 4. If owner/representative is not present at the Code Hearing, Magistrate will give a number of days to cure (brought into compliance) by issuance of an Order. This Order is recorded in the County Official Records, and a copy mailed USPS to the owner. 5. If not in compliance within the number of days given within the Order, a Lien is then recorded in the Official Records with a per day fine amount set by the Magistrate. Major Hagan also explained all complaints are to be filed through City Dispatch by calling 863-763-5521. Dispatchers are assigning each complaint with a case number. Police Officers are responding to after-hours and weekend complaints in an attempt to deter unlicensed contractors and individuals from performing work without permits. Officers will make contact with the owner and the person doing the work, take pictures and statements, and then it is turned over to Code Officer Sterling to perform the investigation the following Monday. COUNCIL ACTION - DISCUSSION - VOTE Major Hagan expressed his support of Code Officer Sterling's performance, stating he has been doing a great job. Recently., he appeared on the Department's monthly WOKC mdio show (8:30 A.M., first Thursday of each month), to provide insight on code issues. He has started a "Code Enforcement Corner" column for the Sunday Editions of the Okeechobee News, which will educate citizens on potential code violations. He also explained the administrative side is more complex than what was anticipated and the Chief will be addressing those issues in the future. He added, some sections of the Code of Ordinances may need to be amended or clarified; giving the example of properties used for agriculture, implementing an exemption waiver may need consideration. The presentation was concluded by Major Hagan thanking the media for their support, the attention given to Code Enforcement has helped greatly. The ultimate goal is not to harass citizens, but for everyone to be proud of the City. The Mayor and Council extended their appreciation to Staff and the media as well. No official action was requested for this item, excluding the procedure change explained in the first paragraph. Mayor Watford explained Attorney Cook recently completed a trip to Nepal (March 20, through April 14, 2019). After being made aware that the purpose of the trip was to provide disaster relief, and thinking this was a worthy cause, he asked for the Attorney to share information about the trip and the work that was done. Attorney Cook explained the editor of Backpacker Magazine organized a trip to help support the All Hands and Hearts Disaster Relief Organization. This Organization came to Nepal in 2015 to help rebuild after two major earthquakes. The group he travelled with helped rebuild schools, primarily by hand with no running water or electricity. The Organization provided their group with three meals per day and daily transportation to and from the construction site. The children attend school during construction, some walking two hours one-way down the mountains. He then provided a brief slide -show of pictures taken while on the trip. The pictures shown have been printed and made part of the official minute file. The Mayor and Council thanked Attorney Cook for his service and contribution to this cause. Fire Chief Smith provided a memorandum in Exhibit 7 explaining after attending a recent Treasure Coast Fire Chief's meeting, he became aware of a need for fire trucks and equipment for rural communities in the Panhandle due to the devastation and loss caused by Hurricane Matthew. Since the Council recently declared the 1980 GMC Fire Engine 5 as surplus, he is requesting this Engine be donated to the St. James -Lanark Volunteer Fire Department in Franklin County. After a brief discussion on the condition of Fire Engine 5 and the logistics of delivery, Mayor Watford opened the floor for a motion. JC — yes that's doable. DW — if it's brought here we have to discretion to say its worth that to have it cleaned or if another discretion. Don't want these to sit out there and at least bring it here. Wes — after magistrate does what he could don. JC — been don't 90 days runs, Sue/Fred put on agenda these properties are 90 days or more, code board would make a recommendation to foreclose then to the city council. Wes — understand value of property need to look at the properties and not let these set, need to look at why the fine is there, clean up should have as much weight as the fine. Council deferred action to allow Attorney Cook time to research the matter. JC - according to the Florida Attorney General Opinion 2013-31, the County's Construction Industry Licensing Board is considered an office. We also know that they consider the City's Planning Board/etc., an office. Same situation, holding that office would prohibit one in the city, office described sitting board vote is affecting municipal policy and board like centennial board that gather info and material and present to council, sitting actual, unless, he resigns. Council Member Jarriel Want to make sure staff working toward getting information about the charter review for the budget process. BJ — want to bring up for next meeting for the fire assessment. LG — that's the meeting you all just changed to hold at 2 PM and there's already a few items on that agenda. IR/MDO — we'll have to schedule the consultants to be in attendance, not sure if they could be at the May 7 meeting. DW — to BJ, would you be agreeable to having it on the agenda when staff is able to schedule the consultants to attend instead of the May 7 agenda? BJ — yes. E. Council Member Keefe Would like to request office space for council members here at city hall that we could hold meetings with constitutes, etc instead of having to meet them at a local coffee shop or at our businesses. The BOCC has offices and hold office hours, I think it's a great idea to have that, we could publish the information of when we have office hours, then staff would be available to respond to questions or concerns when/if they arise. I've found when I do research at my business, I end up having to come to city hall to do face to face with whomever the appropriate staff is to get answers. DW — I've held meetings here, I either use the administration waiting area or the council chambers when no one else using it. But we can ask Admin MDO to research space that might be available and report back on it, don't want to run anyone out of their offices though. XII. Some points to consider: -The city has adopted part II of this chapter, which I have not included; it permits an alternative procedure for code enforcement, with the issuance of a citation against a violator by the code officer, which is filed and heard in county court. We have appropriate forms to issue citations, but it has not been used very much, as the process is somewhat cumbersome, and carries certain court fees and expenses with it that we may not be able to recover. However, with law enforcement now designated as code officers, it might to the time to re-evaluate that process. -The code enforcement process in part I of the statute is what we rely on at present. As we are prohibited from seeking foreclosure on homestead real property, that process will not work on a private homeowner residing in the residence, and is more suited to vacant property, or property owned by a business or corporation, The alternative procedure in part I as I mentioned, is to not seek foreclosure, but to file a civil action in court against the violator to obtain a money judgement, for the amount of the accrued fine, which I would suggest is the route we take on cases where the violation is failure to pay BTR, or business licenses, although it could be done in other cases if we wish. -As far as written policies in addition to this statute, we should think about stating what our allowable administrative expenses are, but they are minimal since we cannot collect staff or magistrate salary as part of a violation; setting procedures and a scale outlining how to address requests for reduction of ongoing fines;, such as no reductions in excess of 90% or 75% of the fine; setting time periods in which to take collection action; fashioning a policy of pursuing foreclosure lawsuits, etc. Of course, once we set hard and fast written policies, that takes away discretion from the magistrate to handle violations where the person may have some situation or issue that prevents or delays coming into compliance. 1Cookf- City Attorney Statutes & Constitution : View Statutes : Unlme Junsliine Yage 1 of 2 Select Year: 2018 v1 GJ The 2W8 Florida Statutes Title XI Chapter 162 View Entire COUNTY ORGANIZATION AND COUNTY OR MUNICIPAL CODE Chapter INTERGOVERNMENTAL RELATIONS ENFORCEMENT 162.06 Enforcement procedure.— (1) It shall be the duty of the code inspector to initiate enforcement proceedings of the various codes; however, no member of a board shall have the power to initiate such enforcement proceedings. (2) Except as provided in subsections (3) and (4), if a violation of the codes is found, the code inspector shall notify the violator and give him or her a reasonable time to correct the violation. Should the violation continue beyond the time specified for correction, the code inspector shall notify an enforcement. board and request a hearing. The code enforcement board, through its clerical staff, shall schedule a hearing, and written notice of such hearing shall be hand delivered or mailed as provided in s. 162.12 to said violator. At the option of the code enforcement board, notice may additionally be served by publication or posting as provided in s. 162.12. If the violation is corrected and then recurs or if the violation is not corrected by the time specified for correction by the code inspector, the case may be presented to the enforcement board even if the violation has been corrected prior to the board hearing, and the notice shall so state. (3) If a repeat violation is found, the code inspector shall notify the violator but is not required to give the violator a reasonable time to correct the violation. The code inspector, upon notifying the violator of a repeat violation, shall notify an enforcement board and request a hearing. The code enforcement board, through its clerical staff, shall schedule a hearing and shall provide notice pursuant to s. 162.12. The case may be presented to the enforcement board even if the repeat violation has been corrected prior to the board hearing, and the notice shall so state. if the repeat violation has been corrected, the code enforcement board retains the right to schedule a hearing to determine costs and impose the payment of reasonable enforcement fees upon the repeat violator. The repeat violator may choose to waive his or her rights to this hearing and pay said costs as determined by the code enforcement board. Minutes shall be kept of all hearings by each enforcement board, and all hearings and proceedings shall be open to the public. The local governing body shall provide clerical and administrative personnel as may be reasonably required by each enforcement board for the proper performance of its duties. (2) Each case before an enforcement board shall be presented by the local governing body attorney or by a member of the administrative staff of the local governing body. If the local governing body prevails in prosecuting a case before the enforcement board, it shall be entitled to recover all costs incurred in prosecuting the case before the board and such costs may be included in the lien authorized under s. 162.09(3). (3) An enforcement board shall proceed to hear the cases on the agenda for that day. All testimony shall be under oath and shall be recorded. The enforcement board shall take testimony from the code inspector and alleged violator. Formal rules of evidence shall not apply, but fundamental due process shall be observed and shall govern the proceedings. (4) At the conclusion of the hearing, the enforcement board shall issue findings of fact, based on evidence of record and conclusions of taw, and shall issue an order affording the proper relief consistent with powers granted herein. The finding shall be by motion approved by a majority of those members present and voting, except that at least four members of a seven -member enforcement board, or three members of a five -member enforcement board, must vote in order for the action to be official. The order may include a notice that it must be complied with by a specified date and that a fine may be imposed and, under the conditions specified in s. 162.09(1), the cost of repairs may be included along with the fine if the order is not complied with by said date. A certified copy of such order may be recorded in the public records of the county and shall constitute notice to any subsequent purchasers, successors in interest, or assigns if the violation concerns real property, and the findings therein shall be binding upon the violator and, if the violation concerns real property, any subsequent purchasers, successors in interest, or assigns. If an order is recorded in the public records pursuant to this subsection and the order is complied with by the date specified in the order, the enforcement board shall issue an order acknowledging compliance that shall be recorded in the public records. A hearing is not required to issue such an order acknowledging compliance. In addition, if the violation is a violation described in s. 162.06(4), the enforcement board shall notify the local governing body, which may make all reasonable repairs which are required to bring the property into compliance and charge the violator with the reasonable cost of the repairs along with the fine imposed pursuant to this section. Making such repairs does not create a continuing obligation on the part of the local governing body to make further repairs or to maintain the property and does not create any liability against the local governing body for any damages to the property if such repairs were completed in good faith. If a finding of a violation or a repeat violation has been made as provided in this part, a hearing shall not be necessary for issuance of the order imposing the fine. If, after due notice and hearing, a code enforcement board finds a violation to be irreparable or irreversible in nature, it may order the violator to pay a fine as specified in paragraph (2)(a). (2)(a) A fine imposed pursuant to this section shall not exceed $250 per day for a first violation and shall not exceed $500 per day for a repeat violation, and, in addition, may include all costs of repairs pursuant to subsection (1). However, if a code enforcement board finds the violation to be irreparable or irreversible in nature, it may impose a fine not to exceed $5,000 per violation. (b) In determining the amount of the fine, if any, the enforcement board shall consider the following factors: 1. The gravity of the violation; 2. Any actions taken by the violator to correct the violation; and 3. Any previous violations committed by the violator. (c) An enforcement board may reduce a fine imposed pursuant to this section. (d) A county or a municipality having a population equal to or greater than 50,000 may adopt, by a vote of at least a majority plus one of the entire governing body of the county or municipality, an ordinance that gives code enforcement boards or special magistrates, or both, authority to impose fines in excess of the limits set forth in paragraph (a). Such fines shall not exceed $1,000 per day per violation for a first violation, $5,000 per day per violation for a repeat violation, and up to $15,000 per violation if the code enforcement board or special magistrate finds the violation to be irreparable or irreversible in nature. Any ordinance imposing such fines shall include criteria to be considered by the code enforcement board or special magistrate in determining the amount of the fines, including, but not limited to, those factors set forth in paragraph (b). (3) A certified copy of an order imposing a fine, or a fine plus repair costs, may be recorded in the public records and thereafter shall constitute a lien against the land on which the violation exists and upon any other real or personal property owned by the violator. Upon petition to the circuit court, such order shall be enforceable in the same manner as a court judgment by the sheriffs of this state, including execution and levy against the personal property of the violator, but such order shall nor be deemed to be a court judgment except for enforcement purposes. A fine imposed pursuant to this part shall continue to accrue until the violator comes into compliance or until judgment is rendered in a suit filed pursuant to this section, whichever occurs first. A lien arising from a fine imposed pursuant to this section runs in favor of the local governing body, and the local governing body may execute a satisfaction or release of lien entered pursuant to this section. After 3 months from the filing of any such lien which remains unpaid, the enforcement board may authorize the local governing body attorney to foreclose on the lien or to sue to recover a money judgment for the amount of the lien plus accrued interest. No lien created pursuant to the provisions of this part may be foreclosed on real property which is a homestead under s. 4, Art. X of the State Constitution. The money judgment provisions of this section shall not apply to real property or personal property which is covered under s. 4(a), Art. X of the State Constitution. In my role as member and chair of the Town of Farmington, NY Zoning Board of Appeals 1 was asked to review applications of fellow residents of the town, and make a determination about the minimum relief necessary for the applicant. This review often took into consideration the changing dynamics of the town, the current town code, as well as prior decisions of the board on similar matters, with the view of preserving the character of the Town. PIGMAN is accidently exposed to any information marked COC confidential, then REP. PIGMAN should maintain the confidentiality of said information within their organization. REP. PIGMAN will be required to sign the COC's confidentiality agreement which will cover all of the above and can be amended as required. EQUIPMENT: The parties acknowledge that certain equipment may be installed or used on the premises. UNLAWFUL USE: REP. PIGMAN shall make no unlawful use of the premises, or permit such use to occur, and use the property solely for REP. PIGMAN business uses. GENERAL CONDITION OFPREMISES: REP. PIGMAN shall keep the premises clean, picked up, orderly, and not in violation of any City or County codes or State statutes. I became aware of a need for fire trucks and equipment in counties/communities located in the panhandle that suffered losses during the last hurricane. While attending a Treasure Coast Fire Chief°s Meeting, one of the members advised us of this need and that his department had sent a surplus engine/pumper to one of these communities recently. He requested our participation if possible. I felt our Engine 5 would serve perfect for this need. The vetting for a volunteer department was assisted by a regional contact through one of our mutual fire equipment sales companies. The regional contact located a volunteer department in Franklin County that suffered hurricane damages. I have contacted this volunteer fire department and feel their community can benefit from this donation. The fire department requests approval from the city council for the donation of Engine 5 to St. James -Lanark Village Volunteer Fire Department in Franklin County Florida.
