the person is in violation. However, a repeat violator is subject to a fine of up to $500 per day on the date
they are cited. There is no period to clean it up or no other notice than the Code Officer setting this
matter to be heard in front of the Code Board. So if this Board were to find that this property is in
violation and is a repeat violation, the Board would have the option to impose a fine of nothing up to
$500 per day commencing December 13, 1999 the date the violation was cited by the Code Officer.
Marvin Brantley advised that he had informed the Code Enforcement Officer he would be making a
parking lot after the holidays were over. He stated, after he was given this fine, he felt as if what he had
discussed with the Code Enforcement Officer had never been talked about.
Attorney Cook explained the thrust of Orddinance 711. One it prohibits the placement of an item that
could be defined as junk under this ordianance anywhere in the City. The other issue involves the safety
actor of illegalparking. So what the Board must decide tor�ght is first, is he in violation and is

repeat violator. Then you must decide if you are going to impose a fine, how much and what date you
want to start the fine.
Member Sweda commented that she felt a sign should be posted stating that cars will be ticketed if they
are parked here.

Member Gamiotea moved to find Case# 98-08-02, Marvin Brantley to be in violation of Ordinance 711.
Seconded by Member O'Connor. After further discussion, Member Gamiotea amended his motion to
find Case#98-08-02, Marvin Brantley in violation of Ordinance 711 and find him as a repeat violator and
assess a fine of $250 per day beginning January 1, 2000.
