Demonstrate that the proposed location and site are appropriate for the use. The site fronts on 205 NE Park Street in the heart of town within 2 blocks of four other drive through businesses previously identified on page 8 section B of the application in the City. This is a perfect location for this business. 2. Demonstrate how the site and proposed buildings have been designed so they are compatible with the adjacent uses and the neighborhood or explain why no specific design efforts are needed. The site and existing building are perfect for this use. There is an existing entrance and 13' drive between the main building onsite and the metal building to be used as the Drive -Through Convenient Store. This will allow stacking of approximately 7 vehicles onsite. The north access around the metal building will be reserved for employees of the Drive -Through and the building to the east. This layout allows for access to, around, and from the site as accessible as possible. 3. Demonstrate any landscaping techniques to visually screen the use from adjacent uses; or explain why no visual screening is necessary. Visual screening from adjacent uses should is proposed by the 4' concrete block wall on the north side of the lot that will keep headlights from shining on the adjacent lot to the north. There should be no issues with the existing building to the east. The buildings to the west are adjacent to the exit of the Drive -Through convenient store and the building across from the exit is part of the feed mill, which usually does not operate early in the morning. Since it is the exit to the Drive -Through convenient store, screening would not be an option 4. Demonstrate what is proposed to reduce the impact of any potential hazards, problems or public nuisance generated by the use; or explain how the nature of the use creates no such potential problems. The nature of the business is all service will be provides at the drive through. There should be no potential hazards during the drive-through process or public nuisances generated by the use. 5. Demonstrate how the utilities and other service requirements of the use can be met. There are existing water and septic service to the site and onsite as well as power, so there are no utility or service requirements that cannot be met currently. 6. Demonstrate how the impact of traffic generated will be handled, off site and on site. Traffic will enter from the south off NE 2nd Street, turn left through the facility and exit onto NE 2nd Avenue. The drive to the north around the building will be for employees only and will not interfere with the drive-through process. The use will not create traffic congestion, flooding or drainage problems, or otherwise affect public safety. The City staff will, in the Staff Report, address the request and evaluate it and the Applicant's submission in light of the above standards and required findings and offer a recommendation for approval or denial. The use is not contrary to the Comprehensive Plan requirements. This parcel is zoned Heavy Commercial and has a Future Land Use of Commercial and this special exception request is in the Heavy Commercial Zoning. As demonstrated previously there are several other drive-through businesses in the area and all adjacent parcels are businesses and this use will not impact those existing businesses. This parcel is perfect for business such as the one proposed and is absolutely within the spirit of the Comprehensive Plan. 2. The use is specifically authorized as a special exception use in the zoning district. According to the City of Okeechobee, Code of Ordinances Section 90-283(1), Drive-through services is permissible in this zoning district. 3. The use will not have an adverse effect on the public interest. It should have a positive effect on neighboring businesses by bringing attracting people to the area and a positive effect on the public interest. 4. The use is appropriate for the proposed location, is reasonably compatible with adjacent uses and is not detrimental to urbanizing land use patterns. Yes, this parcel is currently developed so the urbanizing land use has been established and the business is compatible with other drive-through uses in the area as previously discussed. 5. The use will not adversely affect property values or living conditions, nor be a deterrent to the development of adjacent property. This change will not negatively impact property values or living conditions, nor deter development of adjacent property as all adjacent property is already developed. 6. The use may be required to be screened from the surrounding uses to reduce the impact of any nuisance or hazard to adjacent uses. No hazards or impacts are anticipated by this use to adjacent uses as previously discussed. 7. The use will not create a density pattern that will overburden public facilities such as schools, streets, and utility services. This use will not overburden public facilities including streets and as stated previously the utilities already servicing this site are sufficient for the proposed use. 8. The use will not create traffic congestion, flooding or drainage problems, or otherwise affect public safety. Sincerely, With peak hour traffic of 52 vehicles and entrance and exit on different streets should not create traffic congestion in the area and half of the peak traffic will enter and half will exit. The acceptable level of service for the Road According to Section 74-5 is LOS -D and from the FDOT Generalizes Service Table, a level of service D on a 2 -lane undivided road with a speed limit of 35 mph or less is 13,300 AAD or 554 per hour. The 52 peak trips per hour would not create traffic congestion. As stated previously there are 7 stacking positions available onsite and does not could the one person being serviced. There should be adequate staking onsite, with 25 entering trips per hour, this would relate to a staking of 16.8 minutes of customers. The site is already developed and there are no flooding or drainage issues in the area with none anticipated. This will allow stacking of approximately 7 vehicles onsite. The north access around the metal building will be reserved for employees of the Drive - Through and the building to the east. This layout allows for access to, around, and from the site as accessible as possible. (5) STAFF COMMENTS: With all activity occurring during hours which are generally commensurate with those of other businesses in commercial districts and limited to the confines of the existing metal building, no hazards, problems or nuisance that would affect the public are expected. Demonstrate how the utilities and other service requirements of the use can be met. There are existing water and septic service to the site and onsite as well as power, so there are no utility or service requirements that cannot be met currently. STAFF COMMENTS: Potable water is provided by the Okeechobee Utility Authority (OUA), Florida Power and Light (FPL) provides electric power to the site. Assuming that the Health Department has no problem with continued use of the septic system with the expanded commercial use, we envision no problems with regard to the provision of utilities. However, we are concerned with the narrowness of the north driveway (between 16'9" and just 13'. This driveway is intended to provide the only employee ingress to and egress from the convenience store. However, it was also noted that employees of the office building to the east may use this driveway. Sound planning practice usually recognizes 24 feet as the minimum width for a two- way driveway, although widths from 20' down to as little 18 -feet may prove acceptable under certain situations. Lesser widths are only acceptable for one-way traffic. Neither the north driveway nor the convenience store access driveway from NE 2nd Street meet even the minimum threshold for other than one-way traffic. While we recognize that the number of persons using this driveway should be small; but, even with an "Employees Only" sign at the entrance, some customers will be likely to enter, increasing the possibility of vehicular conflicts. We find the proposed two-way use of the north driveway unacceptable as currently proposed. However, one other possibility would be to install an "Employees Only" sign and a code- or key -activated gate that could only be opened by employees of the conven- ience store; thereby eliminating all possibility of unauthorized persons entering the employees -only driveway from NE 2nd Avenue. The bar could be lifted, or the gate opened, either manually or electronically. With a maximum of just five employees using the driveway, the chances of conflict between employees trying to enter and leave the premises at the same time would be very limited.
