PROCLAMATIONS AND PRESENTATIONS X Proclaim the month of March 2019 as "Red Cross Month." E. Present a Certificate of Appreciation to Senior Planner, Mr. Bill Brisson COUNCIL ACTION e DISCUSSION e VOTE March was proclaimed as American Red Cross Month; Mayor Watford presented the proclamation to John and Peggy DuBose, Sarah Ruwe, and Cindy Thompson. The proclamation was read into the record as follows: "Whereas, more than 137 years ago, the American Red Cross was established as a humanitarian organization, guided by seven fundamental principles —including humanity, impartiality and independence —to provide services to those in need regardless of race, religion, gender, sexual orientation or citizenship status. Today, the American Red Cross is one of the largest humanitarian organizations in the world, and delivers its mission every day to prevent and alleviate human suffering in the face of emergencies; and Whereas, in Okeechobee county, the Red Cross has a long history of helping our neighbors in need. Florida's Coast to Heartland Chapter assisted with 113 local disasters in the past year alone and helped save lives through our Home Fire Campaign. Since the campaign launched in October 2014, the chapter has worked with community partners to install 2,900 smoke alarms making households safer. Meanwhile, in our area, the Red Cross handles an average of 600 emergency military calls every year; and Whereas, March is Red Cross Month, a special time to recognize and thank the Red Cross volunteers and donors who give of their time and resources to help members of the community. The Red Cross depends on these local heroes to deliver help and hope during a disaster. We applaud our heroes here in Okeechobee County who give of themselves to assist their neighbors when they need a helping hand; and Whereas, the American Red Cross shelters, feeds and provides emotional support to victims of disasters; supplies about 40 percent of the nation's blood; teaches skills that save lives; provides international humanitarian aid; and supports military members and their families; and Whereas, we dedicate the month of March to all those who support the American Red Cross mission to prevent and alleviate human suffering in the face of emergencies; our community depends on the American Red Cross, which relies on donations of time and money to fulfill its humanitarian mission. Now, Therefore, 1, Dowling R. Watford, Jr., by virtue of the authority vested in me as Mayor of the City of Okeechobee, Florida, do hereby proclaim March 2019 as `American Red Cross Month'." Mayor Watford presented Senior Planner, Mr. Bill Brisson with a Certificate of Appreciation that read as follows: "Whereas, Mr. Bill Brisson attended his first City of Okeechobee Planning Board Meeting on January 16, 2007. This meeting holds the record as the longest in recent history, approximately three -hours of which he provided Planning Staff findings and recommendations on a Special Exception Petition for the City's first adult entertainment business (which was denied), two Future Land Use Map Amendments and two Rezoning Petitions. He also assisted Attorney Cook in obtaining recommendations to amend the Land Development Regulations to create a special exception use for residences of convicted .sexual offenders, - and amend the billboard policy, that unknowingly would become the "Perfect Sign Ordinance;" and Whereas, the land development regulation text amendment fondly known as the "Perfect Sign Ordinance" will be one that Bill will remember for many years to come as this amendment took five meetings before the Planning Board, eight meetings before the City Council, and two combined Council and Planning Board workshops, until it was finally adopted in April of 2009. He remained true to his calling as a professional Planner, even when it was not popular to provide a recommendation of denial. Now, Therefore, 1, Dowling R. MAYOR WATFORD CLOSED THE PUBLIC HEARING AT 6:20 P.M. At the February 19, 2019, meeting, Council Member Keefe expressed his interest in performing a review of the City Charter, Code of Ordinances, Zoning Map, Future Land Use Map, and Comprehensive Plan, The Council learned that Mr. Brisson, who has been the Senior Planner assigned to the City since 2007 is retiring. LaRue Planning and Management, who by contract provides the City's Planning Staff services, will be assigning Mr. Ben Smith in April as the Planner. Because of this change, the Council asked Mr. Brisson to provide recommendations and priorities he believes the City needs to address, at least from a Planner's standpoint. Mr. Brisson explained the City Charter was not within his jurisdiction, but provided a list of pending items needing to be resolved relative to the Future Land Use and Zoning Maps, the Comprehensive Plan, and amendments to the Land Development Regulations: 1. Rezone properties still identified as Holding on the Zoning Map. These were identified in 2013, but only some have been addressed on an individual basis. A chart with this information has been provided to Mr. Smith. 2. Eleven properties with Future Land Use and Zoning conflicts in the area between Northwest 2nd to 5th Avenues, and Northwest 4th to 8th Streets. The Future Land Use Map should be amended to a classification compatible with the Commercial Professional Office zoning. 3. A large number of other Future Land Use and Zoning conflicts identified are in the Southeast quadrant of the City, but also scattered in other areas, and should be amended for compatibility. Mr. Smith has been provided This information. 4: Variety of needed changes to the Land Development Regulations including: a) differentiating between temporary uses and temporary structures; b) revision to the landscape regulations such as requiring changes of use and change in ownership to meet landscape requirements, requiring irrigation systems, allow flexibility to meet landscape regulations; emphasize concentrated landscaping in areas adjacent to the actual residential use when more intense use is located nearby; more intense landscaping between non-residential and residential uses; require xeriscaping. Review of the City Charter, Code of Ordinances, Zoning Map, Future c) Modify sign regulations to take on a'content neutral approach' as required by the recent Supreme Court ruling. d) Land Use Map, and Comprehensive Plan continued. Mandatory wastewater connections �s required by State Legislation; mandatory water connections in a practical and sensitive manner. e) Differentiate between a major and minor site plan review and when a Technical Review Committee review is required. 6. Update the required Water Supply Plan within the Comprehensive Plan. This is a requirement, but is not critical. Lastly, Mr. Brisson explained the current Comprehensive Plan is not as detailed as it should be, but the State has not reported any problems with it. An evaluation is required to be performed every five years and reported to the State. The Council thanked Mr. Brisson for his service and continued professionalism. No official action was taken on this item. IX. NEW BUSINESS ITEM ADDED TO AGENDA A.1 Motion to approve a request by Okeechobee A memorandum from Administrator MontesDeOca was distributed prior to the meeting requesting the Council County Firefighters for a Boot Drive at the main intersection of State Road 70 consider approving the Muscular Dystrophy Association (MDA) Boot Drive. Council Member Keefe moved to and Highway 441 on March 22, 2019, from 4:00 to 6:00 P.M.; March 23, 2019, approve a request by Okeechobee County Firefighters to conduct a Boot Drive at the main intersection of North Park Street/State Road 70 and Parrott Avenue/U.S. Highway 441 on March 22, 2019, from 4:00 to 6:00 and March 24, 2019, from 9:00 A.M. to 2:00 P.M. to benefit the Muscular P.M.; March 23, 2019, and March 24, 2019, from 9:00 A.M. to 2:00 P.M. to benefit the MDA; seconded by Dystrophy Association - City Administrator. Council Member Abney. Mr. Jarrod Akins of the Okeechobee County Fire Rescue, and Local Union 2918, appeared before the Council noting his appreciation for support by the Council and the community. He provided a brief history on how funds are expended to local citizens. He confirmed the Firefighters will be wearing bunker gear and the proper safety vests. VOTE: WATFORD • YEA ADNEY - YEA CLARK ­ YEA JARRIEL - YEA KEEFE YEA MOTION CARRIED, A.2 Motion to adopt proposed Resolution No. 2019-02 concerning Lake This item was changed to discussion only. Mayor Watford distributed two news articles from recent issues of the Okeechobee levels - City Administrator (Exhibit 2). Palm Beach Post (dates not provided) pertaining to a proposed lower water level for Lake Okeechobee entitled the National Environmental Policy Act (NEPA), to be adopted by the Army Corps of Engineers (Corps). He has had i discussions with Okeechobee County Commissioner Owens and Hendry County Commissioner Carson Tuifner to develop a resolution for cities and counties around the Lake to adopt stating objections, and the devastation NEPA would. have if adopted. Palm Beach County, along with Okeechobee, does not support the proposed 'ten and one-half feet avater level. Okeechobee County Commissioner Hazellief is working with the 16-County Coalition to adopt a similar resolution. These resolutions and information would be provided to the Corps, South Florida Water Management District, and Governor DeSantis as a means to keep the NEPA proposal from being adopted. 443 I I I MARCH 5, 2019 - REGULAR MEETING - PAGE 6 OF 11 11 AGENDA 11 COUNCIL ACTION - DISCUSSION - VOTE 11 IX. NEW BUSINESS CONTINUED A.2 Motion to adopt proposed Resolution No. 2019-02 concerning Lake Okeechobee levels continued. B. Motion to approve a Grant of Easement for Encroachment for property located at 308 Northwest 5th Avenue - City Attorney (Exhibit 3). C. Motion to dispose of obsolete and surplus equipment that is no longer needed by the City - City Administrator (Exhibit 4). Council Member Abney agreed with Mayor Watford on this issue and announced he invited Mr. Jeff Sumner, President of the Economic Council of Okeechobee, to address the Council and answer any questions they may have regarding the technical aspects of the lower Lake water levels. Mr. Sumner thanked Mayor Watford and Council Members Abney and Keefe for attending and speaking at a recent public meeting held in Okeechobee by the Corps and encouraged the Council to stay involved in the process. He announced that the Corps has extended the public comment deadline for the NEPA scoping phase from March 31, 2019, to April 22, 2019, and encouraged the Council to submit written comments, in addition to any resolution adopted. Mr. Sumner offered to provide the Council with a copy of the letter he will be preparing on behalf of the Economic Council of Okeechobee. He has also attended and spoke at the Corps' public meetings held in West Palm Beach and Stuart, adding Palm Beach County and the City of West Palm Beach have recently come out strongly against the proposed NEPA regulations as they understand how greatly this will affect their water supply. He then briefly discussed a few of the potential downsides to the proposal and publicly endorsed by Congressman Mast. The Council thanked Mr. Sumner for his information. No official action was taken on this item. Council Member Keefe moved to approve a Grant of Easement for Encroachment for property located at 308 Northwest 5th Avenue [LEGAL: Lots 3, 4, 5, and 6, of Block 126, TOWN OF OKEECHOBEE, Plat Book 1, Page 10; and Plat Book 5, Page 5, Public Records of Okeechobee County, Florida]; seconded by Council Member Jarriel. The City owns the rights -of -way, Northwest 4th Street and Northwest 5th Avenue. There is an existing permanent structure that was built in or around 1962, on Lot 6 of Block 126, that encroaches into the right-of-way by two -feet on the 4tn Street side. Since this structure cannot be moved, the lending company is requesting an Agreement with the City to allow the structure to remain, and the owner will hold the City harmless of liability. Attorney Cook explained the encroachment agreement will be recorded in the public records and remain with the land until the building is demolished. COUNCIL ACTION - DISCUSSION - VOTE Administrator MontesDeOca explained the auditors. recommended that prior to the sale of the police cars each year, they be declared surplus. Council Member Jarriel moved to approve additional Personal Unpaid leave for Police Dispatcher Tiffany Noel up to 30 days, through May 1, 2019; seconded by Council Member Abney. There are two vacant alternate member positions on the Planning Board/Board of Adjustment/Design Review Board previously held by Council Members Jarriel and Keefe. After advertising in multiple sources, applications were received from Mr. Rick Chartier, Mr. Felix Granados, Ms. Roberta Ann Vu, and Mr. Mike O'Connor. Mayor Watford recommended using a ballot -type system to rank the applicants where each Council Member writes their first and second choice on a piece of paper. The Council offered the applicants in attendance the opportunity to give a brief background of themselves and why they were interested in the appointment. G. Update regarding Code Enforcement foreclosures - City Attorney COUNCIL ACTION - DISCUSSION - VOTE In alphabetical order the following applicants addressed the Council: Mr. Chartier moved to Okeechobee in 1977 and is a 1983 Okeechobee High School graduate. After completing his tenure at the University of Central Florida in 1990, Mr. Chartier moved back to Okeechobee and opened ICS Computers. Although he lives in the County, his business has been in the City since inception. He has also been involved in multiple civic organizations and is willing to become a regular member when the opportunity arises. Mr. Granados was born in Okeechobee but recently moved back from Orlando to raise his family. He has been in the Engineering business for approximately 13 years, and wants to contribute to the expansion of this community. He also is willing to become a regular member. Mr. O'Connor moved to Okeechobee in 1964. He is a City resident, business owner and former Council Member. He has served on the City Planning Board and Code Enforcement Board and feels his past experience on these Boards adequately qualifies him for this appointment. He feels he has a progressive attitude and also agrees to becoming a regular member. The rankings were tabulated with the assistance of Clerk Gamiotea. Mr. Chartier received four number one rankings and zero number two rankings; Mr. Granados did not receive any number one rankings but received five number two rankings; Ms. Vu did not receive any rankings; and Mr. O'Connor received one number one ranking and zero number two rankings. The'papers were collected by the Clerk and will become part of the official minutes record. Council Member Keefe moved to appoint Mr. Rick Chartier, term being March 6, 2019, through April 30, 2021, and Mr. Felix Granados, term being March 6, 2019, through April 30, 2020 as an Alternate Members to the Planning Board/Board of Adjustment/Design Review Board; seconded by Council Member Jarriel. VOTE: WATFORD — YEA ABNEY — YEA CLARK — YEA JARRIEL — YEA KEEFE — YEA MOTION CARRIED. Attorney Cook provided a memorandum to the Mayor and Council dated February 20, 2019, explaining to them the methods the City has used for many years regarding foreclosures enacted on Code Enforcement Cases. The memorandum explained once the special magistrate finds a property in violation, a daily fine is recorded as a lien in the public records. Once the lien has accrued for at least 90 days without any cooperation to bring it into compliance, the Case is then reevaluation and either the fine continues to accrue; or one option is to file foreclosure on the property. This is done by the special magistrate recommending the City Council approve the foreclosure (previously the Code Board made the recommendation). The recommendation is then considered by the City Council for approval or denial. The unwritten policy That staff has followed for nearly 30 years as directed by Mayor Kirk is that the City should not be in the business of foreclosing on real property, and this option should be pursued as a last resort. Should the Council approve the foreclosure, it is not filed immediately. The majority of the times, the owners have brought the property into compliance without the foreclosure being filed. Filing a foreclosure does not bring the property into compliance, which is the ultimate goal. MARCH 5, 2019 - REGULAR MEETING - PAGE 9 OF 11 AGENDA COUNCIL ACTION - DISCUSSION - VOTE IX. NEW BUSINESS CONTINUED G. Update regarding code enforcement foreclosures continued. Should a foreclosure be filed its purpose is to recover the amount of the lien plus interest, the filing costs (approximately $2,000.00) is not recovered by the City. The procedures through the court system c -m be lengthy. Another option the City can take it to instruct Public Works to enter the property, clean it, and then file a lien covering the costs to clean the property. Code enforcement issues can be frustrating, and unfortunately take time, when the owner does not cooperate. The policy staff has followed can be changed. If it is the intent of the Council to bear the expense and file a foreclosure action the day after City Council approval, it is the Council's prerogative to enact this and perfectly legal. The memorandum concluded that this matter could be placed on an agenda and a written policy for code violation enforcement be considered. Since the memorandum was prompted from a recent conversation between Council Member Abney and Attorney Cook, he (Abney) requested that this be on the agenda, along with Code Violation Cases that were approved by the City Council for foreclosure, and the action taken to date of them. At the request of Attorney Cook, research materials were distributed by the Clerk's Office to the Mayor and Council via email on March 4, 2019. The research provided a summarized list of properties that the Code Enforcement Board had recommended foreclosure, the Council action on the recommendation, date foreclosure filed, and date brought into compliance (if applicable). Copies of City Council and Code Enforcement minute pages accompanied the list. Out of the twelve cases on the list, two have not come into compliance and foreclosure filed; eight were brought into compliance with no foreclosure being filed. One was brought into compliance after the foreclosure was filed, and one Case has not been presented to the City Council to date. NEW BUSINESS CONTINUED G. Update regarding Cade Enforcement foreclosures continued. Council Member Keefe voiced his concerns of staff operating under unwritten policies. Several Council Members voiced concerns over the as well as the length of time to file the foreclosure or to bring the property into compliance. It was suggested that new policies and/or regulations regarding code violations, cases, and foreclosure processes be written and adopted. Attorney Cook added that he recently met with Code Officer Sterling to review some new procedures and methods to be implemented. Mayor Watford suggested, since Code Enforcement has just as of tonight officially been transferred to the Police Department, that the Council give Chief Peterson and his staff time. to implement these changes, before making new ones. The Council also wanted time to review and process the research provided. The Council instructed the Administrator to have this item on the agenda for further discussion at the April 16, 2019, regular meeting. Chief Peterson added that he will be prepared to give a presentation on changes/methods being implemented and provide a complete step-by-step process on the code violation policies. Additionally, should Council want any further information on these Cases, they need to provide them to Clerk Gamiotea as she will be providing a revised list with details explained better. This list provided was rushed in order to furnish it to the Council as soon as possible; there is information that should be provided to give a complete picture for each Case. X. COUNCIL COMMENTS A. Mayor Watford. Mayor Watford offered no comments. B. Council Member Abney. Council Member Abney thanked the Clerk's office for their research efforts on the foreclosure cases. He also thanked Mr. Jeff Sumner for his attendance at tonight's meeting to provide insight on the Lake Okeechobee water levels. C. Council Member Clark. Council Member Clark commented about the increase in traffic and its impact on traffic flow at the intersection of North Park Street/State Road 70 and Parrott Avenue/U.S. Highway 441. Prior to the expansion of that intersection, her travel time to work took approximately seven minutes; it now takes a minimum of 17 minutes. She asked Public Works Director Allen to contact Florida Department of Transportation to see whether it would be possible to make adjustments to the traffic lights. D. Council Member Jarriel. Council Member Jarriel expressed his excitement for the upcoming Town Hall meeting (March 19, 2019) at the Okeechobee Freshman Campus Auditorium. He has been walking door to door in neighborhoods and the downtown businesses handing out the Town Hall flyer. He encouraged other Council to do the same in their neighborhoods. Council Member Abney asked whether the City was doing anything different to promote the event, and how it was being advertised. Since all City advertising falls under the responsibility of the City Clerk, Mrs. Gamiotea explained the flyer has been shared via email, with a request to "post it and forward it" to all local government agencies, including their various departments and divisions. Council Member Keefe asked whether Council Members were going to make individual opening remarks at the Town Hall meeting. This lead to a discussion that clarified the room set up within the auditorium in that there will be a table with chairs for the Mayor and Council to sit facing the audience, and their nameplates will be on the table. Mayor Watford will moderate the meeting, individuals who wish to address the Council will need to complete a comment card and submit it to the City Clerk. There will be a three to five minute time limit for comments. Florida' Coast to Heartland Chapter assisted with 113 local disasters in the past year alone and helped save live through our Home Fire Campaign. Since the campaign launched in October 2014, the chapter has worke, with community partners to install 2,900 smoke alarms making households safer. The OUA's accrued liability is $7,018,472.00 and valuation assets are $5,698,626.00, which equals to a separation of 40 percent for the City and 60 percent for the OUA. The OUA has conveyed to Administrator MontesDeOca they are in agreement to the apportionment. This Agreement authorizes the OUA to withdraw their 60 percent portion of accrued benefits through September 30, 2015, and only 80 percent of their 60 percent for October 1, 2015, through September 30, 2016, The purpose of the 20 percent retention is to determine whether the fund's investment strategy yield gains or losses to the account, determine costs associated with servicing the fund, or determine other variables that may affect how the remaining funds are distributed. Upon conclusion of the FY 2015-16 audit and actuary reports, should there be no investment losses in the funds, the 20 percent retention held by the City will be transferred to the OUA. On the other hand, should the audit and actuary reports indicate losses, the retention held by the City will be applied against the losses and any remainder will be distributed to the OUA. B. Motion to re -appoint Mr. Herb Smith to the Firefighters' Pension Board of Trustees, term being October 1, 2017, through September 30, 2021 - City Clerk (Exhibit 1). C. Consider a recommendation by City Attorney Cook to proceed with foreclosure proceedings for Super Stop Petroleum, Inc., located at 510 Northeast Park Street, due to property owner's failure to honor terms of the Lien Release Agreement with a lien in the amount of $29,500.00, which was to be released if the new owner brought the property into compliance; nothing has been done as of this date to bring the property into compliance with City ordinances - Attorney Cook. It was comforting to have telephone calls from Governor Scott's office and an aide from the White House Office of Inter -Governmental Affairs. Congressman Rooney and Florida Representative Pigman visited the EOC command center; their aides have continued to keep in touch and assist in the distribution and clean-up operations. The Army Corps of Engineers and South Florida Water Management District's updates and assistance were appreciated and commended. The National Guard was staged at the Okeechobee County Agri -Center; they along with Operations Director Matt Dorriety were very efficient in providing supplies to residents. All in all, the community came together, everyone pitched -in going above and beyond what is expected, and then extended that same willingness and assisted surrounding counties with man -power and resources. It has been a shining moment well worth documenting. There was no official action required for this item. In May of 2015, Fortex Holdings, LLC's legal counsel contacted Attorney Cook regarding a Code Enforcement Lien, Case Number 11-069 (recorded in Official Record Book 709 Page 20), on property located at 510 East North Park Street. On May 12, 2015, the Code Enforcement Board approved the release of the Lien, per Attorney Cook's recommendation with stipulations to be spelled out in an agreement. The agreement was signed May 22, 2015, providing that the $29,500.00 Lien would be released so long as the property was brought into compliance within 12 months. Motion to approve Addendum No. 1, JMC Landscaping Services, Inc., for additional lawn maintenance due to Hurricane Irma - City Administrator (Exhibit 3). After failure to comply with the Agreement, a letter was sent to Fortex Holdings, LLC, advising that a recommendation for foreclosure was being presented to the City Council at the September 19, 2017, meeting. Mr. Masroor Rab, Manager of Fortex Holdings, LLC, provided documentation today in the form of email correspondences between himself and the Florida Department of Environmental Protection Petroleum Restoration Program on soil contamination issues he has been diligently working to get resolved. Attorney Cook requested to delay the foreclosure proceedings based on the update provided by Mr. Rab. The Mayor and City Council agreed. However, a status report is to be provided to them in 60 to 90 days. A revised exhibit two was distributed at the meeting amending Section 2 of the Franchise, extending the expiration date to September 30, 2022, unless terminated by either party, and clarifying an extension after that date is not an automatic renewal; amending Section 29 adding a paragraph that the City approved annual commercial and residential rate schedules on July 18, 2017; and incorporated into the renewal along with future annual rate resolutions. The revision included the statutorily required public records verbiage for contracts awarded or amended after July 1, 2016. Attorney Cook confirmed Waste Management failed to send the City their request by April, to extend the current Franchise Agreement; it expires September 30, 2017. Council Member Chandler moved to approve Amendment Five to the Waste Management Franchise Agreement (as presented in revised exhibit two); seconded by Council Member Clark. A revised exhibit three was distributed at the meeting authorizing the proposal for additional work and adding the statutoriiy required public records verbiage for contracts awarded or amended after July 1, 2016. Administrator MontesDeOca explained the proposal provided by Mr. Jose Manuel Cisneros, owner of JMC Landscaping Services, Inc., who was in attendance, details the work to be completed is directly related to damage from Hurricane Irma. The work will be processed by separate records in order to apply for reimbursement from the Federal Emergency Management Agency (FEMA). The cost breakdown and services are as follows: $5,000.00 for the removal of five damaged oak trees in FLAGLER PARK; $3,850.00 for the trimming of 110 palm trees located within FLAGLER PARK, right-of-ways, medians, and flower beds along Parrott Avenue, North Park Street (East 13th to West 12th Avenues), and South Park Street (East 2na to West 6th Avenues); and $1,500.00 for the cleaning of medians and FLAGLER PARK areas. 260. l IX. During the initial planning horizon of five years, the annexation would be fiscally neutral and possibly generate a small gain to the City. However, as development progresses in the suggested annexation areas, the long-term fiscal perspective is positive with larger gains, all while being able to maintain essential services. Additional capital facility needs and future revenues will be produced with annexation. A more detailed capital improvements study should be completed prior to annexation. The consensus of the City Council was to bring this item back at a later date as additional time is needed to review the study. No official action was taken on this item. Attorney Cook was contacted by Mr. Masroor Rab, Manager of Fortex Holdings, LLC, property owner of Super Stop Petroleum, Inc. located at 510 Northeast Park Street. He informed Mr. Rab the code compliance issue was going to be addressed again at this meeting. Over the weekend, Mr. Rab had the property mowed and cleaned up. He has been working diligently with the Florida Department of Environmental Protection Petroleum Restoration Program in Tallahassee on the soil contamination issues. This item was previously addressed at the September 19, 2017, meeting. Mayor Watford recommended the City continue to monitor the situation as the property owner is making some progress on the contamination issue and has made an effort and responded to the City's request.
