THIS CAUSE came before the Code Enforcement Board, City of Okeechobee, for public
hearing on May 8 , 20 18 . After due notice to the respondent, the Board having heard
evidence on the alleged violation by witnesses or affidavit makes the following findings:
A. FINDINGS OF FACT:

Property has been found to have commercial vehicles & unpermitted structures.
B. CONCLUSIONS OF LAW:
The owner of the property described above has been found in violation
of Ch 30 Sec 30-43 Public nuisance & Ch 54 Sec 54-51 Commercial vehicles
C. ORDER: The City of Okeechobee Code Enforcement Board has determined you
have violated the Code of Ordinances, Ch 30 Sec 30-43 Public nuisance & Ch 54 Sec 54-51
commercial vehicles concerning your property located at 1105 SW 7`h Avenue,
Okeechobee, FL . If you do not correct the violation by July 10, 2018
, or notify
the Code Enforcement Officer of the correction, the Board imposes a fine of $15.00 - - - per day
commencing that date and continuing daily until the violation is corrected or the city is notified
by you and verifies the correction, which ever first occurs. Further, if you do not correct the
violation by said date, a copy of this order as a claim of lien, shall be recorded in the office of
the Clerk of Circuit Court, Okeechobee County, Florida, and once recorded, becomes a lien
on real and personal property pursuant to Florida Statute 162. You have a right within thirty
days, to appeal this finding and order by Writ of Certiorari to the Circuit Court, Okeechobee
County, Florida. If you correct the violation prior to the above date, it is your obligation to
contact the Code Enforcement Officer to verify such compliance.

BOARD ORDER
THIS CAUSE came on for public hearing before the Code Enforcement Board, City of
Okeechobee, on May 10 , 20 16 , after due notice to the respondent, and the Board
having heard evidence on the alleged violation by witnesses or affidavit, the Board therefore
makes the following findings:
1. That respondent is granted an extension of time of Sixty (60) Days without penalty to
correct the violations of City Ordinances Ch 30 Sec 30-43 Public nuisance (storage containers)
and Ch 54 Sec 54-51 parking commercial vehicles in a residential area.
2. That respondent shall submit a plan of action with a date to have violations corrected on or
before July 10 , 20 16 , and notify the Code Enforcement Officer to arrange for a
reinspection of the property prior to said date.
3. That upon review of the evidence presented, the Board issues the following:

Code enforcement
As you are aware Case 15-013, for a nonconforming structure and commercial vehicles in a
residential area,, went before the board on August 11, 2015. At that time the board decided
to postpone taking any action and allow six months for you to bring. the property into
compliance. However, as of today nothing has been done and the case is scheduled to go back
before the Code_ Board. on March 8, 2016. If the violations have not been corrected before this
date, the Code Board will have no choice but to impose a fine which will accrue daily until the
property is found to be in compliance.
Please call our office at (863) 357-1971 to let us know what your intentions are to resolve this
matter before the Code Board Meeting on March 8, 2016.

The subject structure consisting of two oceanic shipping containers with an attached tubular
rooting system is not in compliance with either City Ordinances or the Florida Building
Code.
This structure was assembled without a permit. If a permit application had been submitted it
would have been denied due to its conflict with City Regulations and the Florida Building
Code.
Mr. Bertram communicated to me that he and Billy Mason were negotiating the sale of an
adjacent property to Mr. Bertram. If the sale materialized, then the non-compliance structure
would be disassembled and removed from the property.
As of this date, the Building Department has not been contacted by Mr. Bertram regarding
the status of the pending sale of the property and the removal of the non-compliance
structure.
