The September 20, 2018, Technical Review Committee (TRC) meeting was called to order at 10:00 a.m. by Chairperson Montes De Oca. II. STAFF ATTENDANCE — Secretary. AGENDA — Chairperson. Chairperson Montes De Oca asked whether there were any requests for the addition, deferral or withdrawal of items on today's Agenda. Under New Business, Item "B" to be heard first as the Applicants for Item "A" will be arriving about 20 minutes late. IV. MINUTES — Secretary. Public Works Director Allen moved to dispense with the reading and approve the Minutes for the regular meeting held August 16, 2018; seconded by Police Major Hagan. Motion carried unanimously. V. NEW BUSINESS — Chairperson. B. Site Plan Review Application No. 18 -004 -TRC, in regards to the redevelopment of approximately 1.44 acres as a proposed unmanned, electronically accessed, 24-hour storage facility located on the east side of Northwest 2nd Avenue between Northwest 7th and 8th Streets, Okeechobee, FL, Lots 11 through 20 of Block 58, OKEECHOBEE as recorded in Plat Book 2, Page 17, Public Records of St. Lucie County, [and recorded in Plat Book 5, Page 5, Public Records of Okeechobee County] - Senior Planner. Planning Staff Report: Planner Brisson explained the proposed project involves the removal of all improvements on the site excluding the telecommunications tower on the leased portion. Five new single -story, clear span buildings will be constructed in a symmetrical design. Storage bay doors are TRC - September 20, 2018 - Page 1 of 6 V. NEW BUSINESS CONTINUED. B. Site Plan Review Application No. 18 -004 -TRC continued. Planning Staff Report continued: located along the front, back and sides of each building and all doors open directly to the outside. No storage of any kind will be permitted outside the buildings. The rental and administrative functions will be in an off-site office; as such there will be no on-site employees. The site is and will continue to be provided potable water by Okeechobee Utility Authority (OUA). Since this is an unmanned site with no restrooms, water fountains or spigots, there should be no demand for potable water or wastewater treatment other than in the event of fire. A dumpster area is indicated in the drive aisle just outside of the southeast corner of the telecommunications tower site. Drainage, water quality, and water quantity are being handled through the permitting requirements of the South Florida Water Management District. The Applicant has submitted an estimate of traffic generation for the facility based on the 6th Edition of the Institute of Traffic Engineer's (ITE) Trip Generation Report, factor code 151 mini warehousing. His conclusion is the proposed facility will generate about 40 trips per day with four during the PM peak hour. The Planner looked at the ITE 9th edition and agreed with the Applicant's conclusion. Such traffic levels are not expected to adversely affect traffic flow into or out of the facility or on local roads. Access to the site is 24 hours a day seven days a week to and from Northwest 2nd Avenue by two, 28 -foot wide, asphalt driveways through electronically activated gates. Interior circulation is provided throughout the site by a series of 30 -foot wide drives comprised of permeable paving. A loading zone has been indicated in the drive aisle on the North side of the telecommunications tower site. The dimensional standards review appears to meet the requirements with the exception of the landscape buffer areas. The City's Land Development Regulations (LDR's) include no exemption to the minimum landscaping requirement for industrial uses; however, there is a section that provides the opportunity to demonstrate that the requirements can more effectively be met by an alternative plan. All three street frontages require the 10 -foot landscape buffer. The one interior lot line requires the two -foot landscaped buffer. The Applicant's site plan has provided no trees along the Northwest 7th and 8th Street frontages. Rather, three trees will be located between the leased telecommunications site and the location of storage building 3, which is directly to the West, with all of the remaining trees to be planted along the Northwest 2nd Avenue frontage. Trees are required along all roadway frontages not just the roadway providing access to the property. At a minimum, three more trees are required. It appears from aerial photography of adjacent developed properties that no sidewalks have been required in this area, and a photometric lighting plan has been provided. In conclusion, Mr. Brisson is recommending approval of the site plan, as submitted, with the following stipulation: the Applicant provides the required landscaping along all street frontages and interior property lines; or, the TRC determines that the Applicant's alternative landscape plan will be more effective than strict application of the landscape requirements. In any event, the Applicant should provide at least three more trees. County Environmental Health Department: No issues were received. OUA: Director Hayford commented no sewer involved and water meter involved after construction for fire. Public Works: Director Allen commented a water quality structure was needed on the southwest corner of Northwest 7th Street and 2nd Avenue. TRC - September 20, 2018 - Page 2 of 6 V. NEW BUSINESS CONTINUED. B. Site Plan Review Application No. 18 -004 -TRC continued. Police Department: Major Hagan requested their department would need access to the gate for security purposes. Building Official: Building Official Newell inquired about whether an irrigation system would be installed. Fire Department: Chief Smith requested the loading zone area to be relocated to another area so that 20 feet of the drive aisles on both sides of the leased telecommunications site could be marked as fire lanes. Either a knoxbox would need to be installed on the gates for access or the Applicant would need to provide the electronic code if using a key pad. He did offer that the hydrant and water supply seemed adequate and asked whether hazardous waste was being stored there. Mr. Steven Dobbs, Consultant, was present and available for questions along with the Property Owner and Applicant, Mr. William Freeman. Responding to staff's questions, no hazardous waste will be stored at the site, the Applicant will be installing an electronic keypad on the gate and will provide the key code and irrigation is being provided and the water source will be a well. Regarding the landscaping, given the Applicant has provided an excess amount of shrubs the Board was in agreement that the Applicant did not need to provide three additional trees along the east interior property line. Chairperson Montes De Oca asked whether there were any comments or questions from those in attendance. There were none. Chairperson Montes De Oca then asked TRC Members to disclose for the record whether they had spoken to anyone regarding the Application or visited the site. Chairperson Montes De Oca disclosed he had conversations with both Mr. Dobbs and Mr. Freeman. Building Official Newell also disclosed he met with Mr. Freeman to discuss the construction plans. There were no other disclosures. Site Plan Review Application No. 18 -002 -TRC, second review, in regards to the construction of a proposed 1,412 square foot fast food restaurant with drive-through service including 500 square feet of outdoor dining space located at 100 Southeast 8th Avenue, Okeechobee, FL, Lots 1 through 3 TAYLOR CREEK MANOR as recorded in Plat Book 3, Page 4, Public Records of Okeechobee County - Senior Planner. Planning Staff Report: Planner Brisson explained at the TRC July 19, 2018, meeting, the Applicant's original site plan was denied but authorized to resubmit a revised site plan to address the 11 conditions set. However, the revised site plan submitted has not addressed all of those conditions. 1. The interior circulation system is modified such that the hazard to pedestrian safety crossing the parking lot is significantly reduced. The internal circulation system has not been modified in any way to reduce the recognized hazards to pedestrian safety. 2. Closing time is limited to not later than Midnight. Nothing in the resubmittal indicates that the closing time has been changed as stipulated. 3. Limit deliveries by semis or other large trucks that must enter the site in a contra -flow direction and/or block ingress, egress, parking or interior circulation, to nonbusiness hours after 6 a.m. Nothing in the resubmittal indicates that deliveries will be limited to other than "off business hours" as was stted in the original submission. 4. A new solid fence is constructed along the southern property line with the proposed trees and shrubs (hedge) planted to the north within the five-foot landscape buffer as presently proposed. The resubmittal includes no reference to a new fence along the southern property. 5. The dumpster enclosure is moved eastward three feet to meet the required 10 -foot minimum setback, otherwise approval of a Variance would be necessary. The new submittal shows that the dumpster enclosure has been relocated to be consistent with the minimum 10 -foot setback. 6. Solid waste collection is conducted only between 6 a.m. and 8 a.m. While the Applicant has not mentioned this limitation in the resubmittal, my earlier discussions with Waste Management indicated that this is the timeframe within which they would be serving the Checker's site. 7. Provide sidewalk (to City standards) along the west side of Southeast Avenue from State Road 70 to the driveway at the south end of the property. The resubmittal does not include provision of the required sidewalk, but when verbally informed that this was a crucial component, the Applicant's representative indicated that the sidewalk would be provided. 8. Provide a two -foot landscape strip between the restaurant structure and all vehicular use areas (Note: due to the nature of the drive-through service, this is likely impractical. If so, approval of a Variance is necessary). The Applicant has provided landscaping strips between the building and the vehicular use area in at least a couple of areas. 9. Submit lighting plan for the entire site. The Applicant has provided a lighting plan for the site. 10. Should it be possible, try to preserve the larger existing trees on site. There is no indication that the Applicant has tried to do anything in this regard or explained why not. 11. Submit off-site water and wastewater plans prior to construction. Not applicable at this stage. County Environmental Health Department: Chairperson Montes De Oca read into the record written comments received from Director Faconti. The Checkers project indicates that septic will be used for sewage disposal. At this point with what was submitted, I cannot determine if a septic system could be permitted. I am not sure there is enough room on that parcel for a septic system. OUA: Director Hayford commented other than his previous comments at the July 19, 2018, meeting he has no additional comments to add other than to note no one from Checkers has contacted them and there is some confusion as their plans show septic but they have discussed sewer connections. TRC - September 20, 2018 - Page 4 of 6 V. NEW BUSINESS CONTINUED. A. Site Plan Review Application No. 18 -002 -TRC continued. Public Works: No additional comments other than his previous comments at the July 19, 2018, meeting. Police Department: No additional comments other than his previous comments at the July 19, 2018, meeting. Building Official: No additional comments other than his previous comments at the July 19, 2018, meeting. Fire Department: In addition to his previous comments at the July 19, 2018, meeting, he would like to request OUA to do a flow test on the hydrant. Chairperson Montes De Oca commented for the record both the Applicant's and the City's Traffic Engineers determined full access via Southeast 8th Avenue to the site is appropriate given Florida Department of Transportation's (FDOT's) denial of access to State Road 70. He still had some concerns though with pedestrian traffic and safety on site due to the double looping and requested crosswalk stripping and some sort of traffic separation curbing. Also indicate there is a walk up window with signage. Mr. Chad Riddle and Mr. Adam Schildmeier with the Wantman Group, Inc were present for the Applicant and responded to the 11 conditions. With FDOT denying their request for access from State Road 70 East, and having their signage face the residential area to the south if they rotate the building, they suggested there is no solution to modifying the interior circulation other than what was already presented. They did not agree that their closing time should be limited as the McDonalds Restaurant is opened 24 -hours and a significant amount of their business occurs after this time. Garbage pickup will be off -hours, a solid fence will be constructed, dumpster enclosure has been relocated, solid waste collection will be during off -hours, a sidewalk, landscape, and a lighting plan will be provided. Regarding preserving larger existing trees on-site, they will do their best but given that the site is small this may be difficult. They will be contacting OUA and submitting water and wastewater plans prior to construction. Chairperson Montes De Oca asked whether there were any comments or questions from those in attendance. There were none. Chairperson Montes De Oca then asked TRC Members to disclose for the record whether they had spoken to anyone regarding the Application or visited the site. Chairperson Montes De Oca disclosed he had numerous conversations with Mr. Schildmeier. There were no other disclosures. Building Official Newell is opposed to the project as he had commented at the previous TRC meeting on July 19, 2018, that he had concerns with the double looping of the drive-through 'and he felt the entire site plan needed to be re-examined. He feels the revised site plan being submitted has not addressed his concerns and as such he cannot support the project. A motion and a second was offered by Major Hagan and Public Works Director Allen to approve to Site Plan Review Application No. 18 -002 -TRC, second review, in regards to the construction of a proposed 1,412 -square foot fast food restaurant with drive-through service including 500 -square feet of outdoor dining space located at 100 Southeast 8th Avenue, TRC - September 20, 2018 - Page 5 of 6 Okeechobee, FL, Lots 1 through 3 TAYLOR CREEK MANOR as recorded in Plat Book 3, Page 4, Public Records of Okeechobee County, with the following conditions: 1. Requiring a curb or median from the Northwest corner of the drive thru to the Southwest of the drive thru to separate traffic with signage and applicable cross walk stripping. 2. Request OUA to do flow test. 3. Contact and coordinate with OUA in regards to the water and wastewater. 4. Loading times must be during non business hours. 5. Submit copy of off-site improvements prior to construction. Motion carried with Building Official Newell opposing. VI. ADJOURNMENT— Chairperson. Site Plan Review Application No. 18 -003 -TRC, in regards to the development of a proposed storage yard facility and future construction of a 10,000 square foot building located at Northeast 9th Avenue and 12th Street, Lots 10 and 11 of the CITY OF OKEECHOBEE COMMERCE CENTER, as recorded in Plat Book 7, Pages 10 through 14, Public Records of Okeechobee County - Senior Planner. Planning Staff Report: Planner Brisson explained the proposed project involves the development of a 6.1 acre site as a storage yard facility to store building tunnel forms. It will include a 5,081 square foot steel shell type building containing a 600 square foot office and an asphalt parking area for seven parking spaces and a non -asphalt outdoor storage area. Operation of the site will be limited to no more than two employees working 7 a.m. to 4 p.m. TRC - August 16, 2018 - Page 1 of 4 V. NEW BUSINESS CONTINUED. A. Site Plan Review Application No. 18 -003 -TRC continued. Planning Staff Report continued: The site is and will continue to be provided potable water by Okeechobee Utility Authority (OUA). The potential increase from the project is insignificant and will have no effect upon the available capacities that can be provided by the OUA. The County has confirmed a considerable level of excess capacity available to serve the solid waste disposal needs. Drainage, water quality, and water quantity are being handled through the permitting requirements of the South Florida Water Management District. No traffic generation information has been provided by the Applicant. However, using information from the 8th Edition of the Institute of Traffic Engineer's Trip Generation Report, warehousing, which would appear to be the closest use category to the proposed storage yard, would generate between about 1.2 and 1.6 trips in the PM peak hour based on the two employees and 5,081; square feet. Such traffic levels are not expected to adversely affect traffic flow into or out of the Commerce Center or the proposed site. Access to the proposed steel building, associated parking and dumpster area is provided by a 40 -foot wide driveway off Northeast 9th Avenue. The outside storage area occupies the balance of the parcel. The site is entirely enclosed by 8 -foot chain link fencing. The yard is surfaced with millings with shell or crushed concrete with a stabilized subbase. Two gated, 30 -foot wide driveways will be provided in the future providing access from Northeast 9th Avenue in the southwest and southeast corners of the site. Interior circulation is unburdened throughout the site. The dumpster pad is situated outside the northeastern part of the proposed building and separated from the balance of the storage yard by a 6 -foot high chain link fence. The dimensional standards review appears to meet the requirements with the exception of providing a location for the loading zone. As a modification to this requirement, an explanation was offered that basically the entire yard is the loading zone for this type of use and to designate one area would not make sense. The site is to be operated by two employees in a building that will be an open shed. As such, a parking study is not necessary for this project. The landscape plan showed only perimeter landscaping treatment along road frontages as it appeared the Applicant mistakenly used the landscaping requirements of Okeechobee County instead of the City of Okeechobee. The plan shows only 28 trees and 144 shrubs when 89 trees and 266 shrubs are required. The City's Land Development Regulations (LDR's) include no exemption to the minimum landscaping requirement for industrial uses; however, there is a section that provides the opportunity to demonstrate that the requirements can more effectively be met by an alternative plan. Vehicular use areas include all parking spaces, back -out areas and access driveways. These areas occupy 2,728 square feet therefore, 108 square feet of interior and perimeter landscaping is required and none is shown. Two trees are required and a two -foot landscape strip is needed between the parking area and the building. Lastly with landscaping, the plan shows no trees or shrubs along interior property lines. It appears from adjacent developed properties within the Commerce Center that no sidewalks have been required along adjacent streets and with just six or perhaps fewer parking spaces, a photometric lighting plan would not be necessary. , In conclusion, Mr. Brisson is recommending approval of the site plan, as submitted, with the following stipulations: the TRC accepts the Applicant's explanation as to why no loading zone is necessary; the Applicant provides the minimum landscaping requirement of 89 trees and 266 shrubs; or the TRC determines that the storage yard use occupying the vast majority of the site does not warrant so many trees and shrubs; the Applicant provides the required 108 square feet of perimeter and interior landscaping for the parking lot; a two -foot landscape strip is provided between the TRC - August 16, 2018 - Page 2 of 4 V. Site Plan Review Application No. 18 -003 -TRC continued. parking area and the building; and at least 8 trees and 25 bushes are provided along the interior property lines of the property. County Environmental Health Department: No issues were received. OUA: Director Hayford commented the OUA has inquired to the Applicant about whether the driveway on Northeast 12th Street could be moved to the west and about the water service connection. Public Works: No issues were received. Police Department: No issues were received. Building Official: Building Official Newell first commented he was in support of the project. He then inquired as to whether the Applicant had a copy of the Declaration of Protective Covenants for the Okeechobee Commerce Center as it is stated each plot shall provide not Tess than twenty percent (20%) of its area in landscaped open space. This differed from the City's LDR's of fifteen percent (15%). He wanted to make sure the alternative landscaping plan would be compliant with these Covenants. Fire Department: Chief Smith inquired as to the type of storage, whether there would be storage inside the steel building and whether there would be any manufacturing and storage of hazardous materials. Mr. John GoodFellow, Agent for the Property Owner, LD Properties, LLC, was present and commented they would be storing steel tunnel forms for residential construction. The forms are fabricated and reused and there would be no storage of hazardous materials. The tallest form would be around nine foot and there would be an eight foot high fence around the entire perimeter. Chairperson Montes De Oca asked whether there were any comments or questions from those in attendance. There were none. Chairperson Montes De Oca then asked TRC Members to disclose for the record whether they had spoken to anyone regarding the Application or visited the site. Chairperson Montes De Oca disclosed he had several meetings and phone conversations with Mr. Orlando Rubio, PE with Craig A. Smith & Associates. These discussions regarded the City's South Florida Water Management District permit in the Industrial Park. There were no other disclosures. DEVELOPMENT PROPOSAL The current development proposal for the site is as follow: Checkers Restaurant A 912 SF Checkers fast food restaurant with a single drive-through service lane and 500 SF of outdoor dining area with 6 tables (totaling 1,412 SF) proposed at the Southwest corner of State Road 70 and SE 8th Ave. The single drive-through service lane is 10 feet wide and directs vehicles towards the point of service located at the northeast side of the building. The drive through lane situates along the southern and eastern portions of the building where the proposed 11 foot wide bypass lane runs parallel and allows vehicles to exit towards the eastern exit. The 8' x 14' bun freezer and menu board/speaker are located towards the south of the proposed restaurant. Outdoor Dining Area The Outdoor dining area is located towards the northwest portion of the site and provides 6 tables seating 4 individuals each, accommodating a total of 24 individuals. Access There is one (1) 37 foot wide point of access from SE 81h Ave. This access is located towards the southeastern portion of the site is derived from an existing curb cut that will be provide ingress and egress options. Parking Pursuant to Section 90-512 of the City of Okeechobee's Land Development Code, fast food restaurants require 1 space per every 75 square feet of gross floor per. That calculation equals 6 required standard spaces, one of which is required to be ADA accessible (500/ 75=6). The proposed design provides a 12 standard parking spaces, of which 1 is ADA accessible. This provides sufficient parking for both the public and employees that visit the site, thus accommodating a total of 12 parking spaces and meeting regulation. Loading Loading and unloading will occur directly adjacent to the proposed fast food restaurant with drive-through service during off -business hours. In order to mitigate adverse impacts and nuisance of noises, loading and unloading will be is located away from the single-family residential home located to the south. Dumpster Location The proposed dumpster is located northwest of the site and will be only used by the proposed restaurant. Landscape Buffers The proposed development provides a 10' landscape buffer along right-of-ways of State Road 70 and SE 8th Ave and a required 2' buffer around the perimeter of the property line. A 5' landscape buffer and fence are located towards the southern portion of the site in order to mitigate adverse impacts with the residential uses to the south. Signage There is one (1) pylon sign that is located towards the northeast portion of the site. Additionally, there are two (2) illuminated signs located towards the southeast portion of the site, which provide entry and exit guidance. JUSTIFICATION The proposed development of a fast food restaurant with a drive-through service lane, known as Checkers Restaurant, is compatible and consistent with the existing FLU designation of Commercial and Zoning District Heavy Commercial. The land uses immediately surrounding the site are consistent with the proposed use as they are commercial in nature, with similar or greater intensities. The proposed 1,412 SF Checkers Restaurant with a drive-through service (including 500 SF of outdoor dining) provides a 10' landscape buffer along right-of-ways of State Road 70 and SE 8th Ave and a required 2' buffer around the perimeter of the property line. Although the site requires a 2' buffer, a proposed 5' landscape buffer and fence has been provided to mitigate adverse effects, including visual impact and the intensity of the proposed use towards the adjacent lands. The parking, point of service, and outdoor dining area have been logically located towards the northwestern and northeastern portions of the site in order to mitigate adverse impacts towards the residential uses to the south. It is the intent of the applicant to propose a design that is compatible with the existing commercial developments within the area, while maintaining the prototype appearance of the Checkers brand. Exhibit 1 includes the property record summary from the Okeechobee County Property Appraiser's office, while Exhibit 2 includes a copy of a preliminary site plan for the project. There are two (2) existing buildings on site that will be replaced with a 912 Square Feet Fast Food Restaurant with a Drive - Through Window. One (1) of the existing buildings is a 970 Square Feet Small Office Building and the other is a 1,296 Square Feet Retail Building. In order to determine the driveway operations and the impact to local traffic, AM and PM turning movement counts, as well as, northbound queues were collected at the intersection of NE Park Street and SE 8th Avenue. A summary of the data is included in Exhibit 4 while Exhibit 5 includes HCS analyses for both AM and PM peak hour operations. Results of this analysis are summarized in Table 3. Furthermore, based on the field data collection, an average of three (3) vehicles are queued on the northbound left turn lane. Therefore, there will be enough room for cars leaving the site to cross SE 8th Avenue to travel northbound and make a left or a right at the NE Park Street and SE 8th Avenue intersection. Table 3: Driveway Analysis The proposed Okeechobee Checkers development to be located at 100 SE 8th Avenue, Okeechobee, Florida has been evaluated following the Okeechobee County - Transportation Concurrency Requirements - Article V, Section 5.05.00 of the Okeechobee County Code of Ordinances. This analysis shows that the proposed development will generate less than 100 two-way peak hour trips where all links would be impacted with less than 30 peak -hour two-way trips. A shopping center's composition is related to its market area in terms of size, location, and type of store. A shopping center also provides on-site parking facilities sufficient to serve its own parking demands. Factory outlet center (Land Use 823) is a related use. Additional Data Shopping centers, including neighborhood centers, community centers, regional centers, and super regional centers, were surveyed for this land use. Some of these centers contained non -merchandising facilities, such as office buildings, movie theaters, restaurants, post offices, banks, health clubs, and recreational facilities (for example, ice skating rinks or indoor miniature golf courses). Many shopping centers, in addition to the integrated unit of shops in one building or enclosed around a mall, include outparcels (peripheral buildings or pads located on the perimeter of the center adjacent to the streets and major access points). These buildings are typically drive-in banks, retail stores, restaurants, or small offices. Although the data herein do not indicate which of the centers studied included peripheral buildings, it can be assumed that some of the data show their effect. The vehicle trips generated at a shopping center are based upon the total GLA of the center. In cases of smaller centers without an enclosed mall or peripheral buildings, the GLA could be the same as the gross floor area of the building. Time -of -day distribution data for this land use are presented in Appendix A. For the 10 general urban/ suburban sites with data, the overall highest vehicle volumes during the AM and PM on a weekday were counted between 11:45 a.m. and 12:45 p.m. and 12:15 and 1:15 p.m., respectively. Site Plan Review Application No. 18 -002 -TRC, in regards to the construction of a proposed 1,412 - square foot fast food restaurant with drive-through service including 500 square feet of outdoor dining space with associated parking located at 100 Southeast 8th Avenue, Okeechobee, FL, Lots 1 through 3, TAYLOR CREEK MANOR, as recorded in Plat Book 3, Page 4, Public Records of Okeechobee County - Senior Planner. Planning Staff Report: Mr. Ben Smith with LaRue Planning explained the subject property is a 27,980 square foot rectangular parcel located at the southwest corner of State Road 70 and Southeast 8th Avenue. The two existing buildings on the property will be demolished and replaced with the new building. No indoor seating will be offered; rather, there will be six outdoor dining tables capable of seating 24 persons. The point of service window will be located at the northeast corner of the building and the menu board with speaker is located just south. The restaurant is proposed to provide TRC - July 19, 2018 - Page 1 of 5 V. NEW BUSINESS CONTINUED. A. Site Plan Review Application No. 18 -002 -TRC continued. Planning Staff Report continued: food service between 10:00 a.m. and 4:00 a.m., seven days a week, and the number of employees will vary from three to seven per shift. Twelve new parking spaces, including one space designated for the handicapped, will be provided to the west of the building. The dumpster and trash enclosure will be located in the northwestern corner of the site. The site is provided potable water by Okeechobee Utility Authority (OUA) and the Applicant has stated that "Checkers" will connect to OUA for wastewater services. The potential increase from the project is relatively small and will have no effect on the available capacities that can be provided by OUA. The County has confirmed a considerable level of excess capacity available to serve the solid waste disposal needs. Information received from the Applicant's Traffic Engineer, Dr. Juan Ortega, concluded no Traffic Impact Statement is necessary. Through his analysis, he has further determined that full access via Southeast 8th Avenue to the proposed site is appropriate given this is the only access since the Florida Department of Transportation's (FDOT) denial of access to State Road 70. The City enlisted Ms. Susan O'Rourke, professional Traffic Engineer, who concluded the location of the driveway met the City's Code requirement of at least a minimum of 140 -feet. She indicated there could be times when the northbound travel extends beyond the driveway. However, she further noted the site shows 85 -feet of on-site storage for waiting vehicles, which should be more than adequate. She also confirmed the proposed full access driveway on Southeast 8th Avenue can be accommodated. As per the conditions of Special Exception Petition No. 18 -001 -SE, approved on May 17, 2018 by the Board of Adjustment, the site plan was revised. A new configuration of the driveway showing a 37 - foot wide curb cut on Southeast 8th Avenue provides for a 26 -foot wide entry and an 11 -foot wide exit lane. The loading zone area and dumpster were relocated to the northwest corner of the vehicular use area eliminating the need for these service vehicles from backing out onto Southeast 8th Avenue to exit the site. Lastly, a five-foot buffer was installed along the southern property line. These changes have widened the U-turn into the site improving customer vehicular access. However, interior circulation is cumbersome for customers. In order to receive service, drive-through customers must complete a full circle through the parking lot to arrive at the service window; then go around the building again, passing through the parking lot once more and accessing the by-pass lane to exit the site. This could increase the hazards to those who also park in the lot and use the outdoor dining area. In addition, with the new placement of the loading area, a difficult pattern is created for the trucks to navigate. They need to access lanes in the opposite direction when entering and exiting the site, thereby making it necessary to have all deliveries made only during non-operating business hours. The new dumpster location requires the garbage truck to enter the property and maneuver in such a way as could possibly cause conflict and congestion unless the pick-ups occur during non- operating business hours. Waste Management can commit to serving the proposed site during off - business hours, most likely between 6 a.m. and 8 a.m. The new configuration also allows for a five- foot landscaped buffer to reduce the nuisance impacts of the site's operation on the residential neighbor immediately south. The Applicant is proposing to allow for the planting of five live oaks which eventually could grow to be a six foot Spanish Stopper hedge. Given the menu board and loudspeaker for order taking is located about 35 feet from the residential neighbor to the south and. this nuisance factor is magnified by the proposal to operate the drive-through until 4:00 a.m. it would be suggested that a solid six-foot high fence also be constructed along the south property line. TRC - July 19, 2018- Page 2 of 5 V. NEW BUSINESS CONTINUED. A. Site Plan Review Application No. 18 -002 -TRC continued. Planning Staff Report continued: The dimensional standards review appears to meet the requirements with the exception of the dumpster enclosure which does not meet the required ten foot minimum rear yard setback. The loading zone area is not identified and the parking space used is not the required loading space size. The required parking spaces are located where customers will need to cross the parking lot at least twice and due to the double looping required for the drive-through customers, pedestrians may be subjected to unreasonable safety hazards and as well as increased congestion as they attempt to back out due to their location. The required two feet of landscaping between the restaurant facility and vehicular use areas is not provided and a sidewalk will need to be provided along the east property line from State Road 70 south to the beginning of the driveway. In conclusion, Mr. Smith is recommending denial of the site plan, as submitted. Should the Technical Review Committee, wish to approve the site plan, he would recommend that the site be modified to address each of the following conditions: the interior circulation system is modified such that the hazard to pedestrian safety crossing the parking lot is significantly reduced; closing time is limited to not later than Midnight; limit deliveries by semis or other large trucks that must enter the site in a contra -flow direction and/or block ingress, egress, parking or interior circulation, to nonbusiness hours after 6 a.m.; a new solid fence is constructed along the southern property line with the proposed trees and shrubs (hedge) planted to the north within the five-foot landscaped buffer as presently proposed; the dumpster enclosure is moved eastward three feet to meet the required 10 - foot minimum setback, otherwise approval of a Variance would be necessary; solid waste collection is conducted only between 6 a.m. and 8 a.m.; provide sidewalk (to City standards) along the west side of Southeast 8th Avenue from State Road 70 to the driveway at the south end of the property; and provide a two -foot landscaped strip between the restaurant structure and all vehicular use areas (Note: due to the nature of the drive-through service, this is likely impractical. If so, approval of a Variance is necessary.) County Environmental Health Department: No issues were received. OUA: Mr. Hayford inquired as to the water source the Applicant would be using for the landscape irrigation and the reason they were requesting such a large size meter. Normally a one inch meter is rather large for a single use restaurant. He will also need a copy of the plumbing plans to determine information regarding the grease trap. Public Works: Mr. Allen commented there appears to be a connection to an existing catch basin from the new site that ties into an FDOT drainage system which we would not be able to allow unless the Applicant justified that connection with a driveway exemption and a drainage connection permit from FDOT. Police Department: Major Hagan voiced concerns with the proposed drive-through and the fact that one must circle the site twice, noting possible congestion concerns and safety issues for pedestrians to cross. He offered a suggestion of possibly rotating the building. Building Official: Mr. Newell commented he encourages new business growth but this location for this proposed business does not work. The existing property is difficult to work with and for their proposed business there just needs to be a better location. Site Plan Review Application No. 18 -002 -TRC continued. something that needs to be re-examined. His suggestion is to re-examine the entire site plan and bring it back as he cannot support the site plan as currently presented. Fire Department: Chief Smith explained he looks at life safety and accessibly for fire trucks and emergency vehicles. Normally engines do not go inside that close to buildings. With that being said, there is an area on the south side of the building by the drive-through that is under the minimum 20 feet required so that may need to be discussed should ambulances need to have access. The hydrant should be sufficient even though it is a little small. Fire flow should be fine although will require a flow test from OUA. Chairperson Montes De Oca commented as an Engineer he looks at traffic from what an expected level of traffic service is and what a true traffic problem is compared to what a perceived traffic concern is. He sat for several mornings at the traffic light at the intersection at State Road 70 and Southeast 8th Avenue in the Peak AM hour and gathered data. Hefound the minimum wait time was around 10 seconds and the maximum was 145 seconds. Typically only three to four cars were queued and when the light changed the que was always cleared. The majority of the time there were no cars and typically within two minutes it was empty. He further commented he agreed the Applicant needed to provide a sidewalk, he believed the setback with the dumpster area is minor, would like the Applicant to conserve as many of the larger trees on site as they could if possible, and has some concerns with the double looping as well but not from a pedestrian standpoint. Thinking people will probably try to go back against traffic, perhaps placing bollards will prevent that. Regarding off-site, should the Applicant choose to go with the force main due to septic tank and the proximity of Taylor Creek just remember to coordinate with Public Works Director Allen and obtain bond requirements for working in the Right -of -Way. Need copies of all FDOT permits. Mr. Chad Riddle and Mr. Adam Schildmeier with the Wantman Group, Inc. (WGI) were present on behalf of the Applicant. They commented on the double looping explaining they needed to do this as there was no access from State Road 70. They did increase the drive isle widths as requested by the Board of Adjustment. They would be open to the idea of installing bollards. There was a lengthy discussion about rotating the building although no idea seemed to fit everything needed. Regarding the utilities, they plan to extend the gravity sewer down the sidewalk to the kingman hole just to the south of the site and will be coordinating with OUA. Chairperson Montes De Oca asked whether there were any comments or questions from those in attendance. Mr. Dowling Watford, Mayor for the City of Okeechobee, spoke as a concerned citizen. He inquired about whether the traffic observation that Chairperson Montes De Oca conducted was done recently. Chairperson Montes De Oca replied it had. He further commented that during school time, traffic would be much heavier at this location and to please take that into consideration. He next inquired as to whether the distance of the entrance to the proposed location from State Road 70 was shorter than the distance of the entrance to the Family Dollar site (that is located on Southeast 10th Avenue) from State Road 70. Chairperson Montes De Oca responded it is shorter. He next voiced his concern with people turning right onto Southeast 8th Avenue from State Road 70 and people leaving the proposed Checkers site and trying to make a left hand turn onto Southeast 8th Avenue. There could be people blocking lanes and cars stacking up on Southeast 8th Avenue. This was a huge safety concern for him. Another issue he had was with lighting. He did not want lights taking over. Purpose: The purpose of this report is to provide South Florida Water Management District (SFWMD) and the City of Okeechobee with the calculations and documentation necessary to demonstrate the proposed surface water management system complies with state and local criteria. Proiect Description: The site is approximately 1.6 acres in size and is located in Section 15, Township 37 South, Range 35 East 1 block west of 441N in the City of Okeechobee (Parcel ID 3-15-37-35-0010- 00580-0110. There is an existing cell tower site on this parcel that reduces the project are to 1.44 acres. The historic discharge is sheet flow from the site into the adjacent ditches, then to the south into the NW 7th Street ditch, then to the east into Taylor Creek then into Lake Okeechobee through S-133. The request is for construction authorization to construct the mini - warehouse storage facility, underground drainage system, and pervious paving. The water management system will be designed in accordance with the buildout criteria. The Soils Map for Okeechobee County indicates that the soil for this site is Immokalee Fine Sand, which is poorly drained in undeveloped conditions and better drained in the developed condition. The north portion of the site was previously developed and used as a propane company, while the south portion of the site is undeveloped. There is an existing cell tower site on the east side of the site that will remain in its original condition. Proposed Use: The site will be developed into a mini warehouse storage facility with pervious paving and an underground water detention system. prainaee Considerations; To ensure that water quality standards are met, we propose to pass all drainage from the mini warehouse storage area under the pervious parking area and will discharge through a bleeder structure into the roadside ditch system. As shown on the Exhibit from the National Wetland Inventory, there are no wetlands onsite. This project will use Truegrid pervious pavement system for parking and stormwater treatment. According to their literature, there is a void space of 40%, so the required treatment will be adjusted to compensate for the void space of the rock. Allowable discharge for the S-133 basin is 15.62 csm for the 25 year — 3 day event: Q= 15.6 csm / 640 ac/sm * A Q = 15.6 csm / 640 acres/sq. mile x 1.6 acres = 0.04 cfs Water Oualitv: The 1st inch of the site is the plus 50% times 1.6 to compensate for the rock in the detention area that is the required treatment volume of 0.29 Ac -Ft and it will be provided in the form of dry detention under the rock substructure and rock pavers within the proposed improvements. The dry detention area will discharge through a control structure to the adjacent City of Okeechobee ditch. The system exceeds the design criteria for water quality and for pretreatment as specified under Section 5.2.1 of the SFWMD's Environmental Resource Permit Information Manual Volume IV. Based on the attached stage storage spreadsheet, the required treatment volume of 0.29 Ac -Ft is met at elevation 26.7 NAVD. The proposed bleeder will be set 1' below wet season water table which is 3.5' below natural ground from the attached GFA Stormwater Report. The average ground elevation on this site is approximately 27.5, so the wet season water table is set at 24.0 NAVD. This is the elevation the bleeder is set and the bottom of the dry detention area is set at elevation 25.0. A protective slotted pipe with a drainage sock will protect the 3 -inch diameter circular bleeder opening. Water Ouantitv: This project is located in the S-133 Basin which discharges ultimately into Lake Okeechobee. The allowable peak discharge rate was calculated to be 0.04 cfs for the 25 year 3 day event. The actual maximum discharge rate for the 25 -year, 72 -hour storm event was calculated to be 0.31 cfs, which is greater than the maximum discharge, but the bleeder is the minimum allowed by the SFWMD. To demonstrate conformance to this criteria, the proposed project was flood -routed using AdICPR. The 10 year, 24 hour storm (5.0") w/ discharge, the 25 year, 72 hour storm (9.0") w/ discharge, and the 100 2 year, 72 hour storm (10.0") w/o discharge, were evaluated based on the proposed plan. Flood Plain Analysis: As shown on the attached FEMA Panel 12093C0415C, this project is located in Zone X of the flood plain. No flood plain compensation is required. Nutrient Analysis: As previously stated, the project proposes to provide 150% of the required water quality treatment volume in the dry detention system in order to meet the nutrient removal requirements. Construction Recommendations: Runoff and/or any water generated by short-term dewatering during construction will be contained on-site. However, there is some potential for transport of sediment to off-site areas should heavy rainfall occur. In order to reduce the potential of any off- site transport of sediment or turbidity we recommend installation and maintenance of temporary silt fence inside the southerly property line in the area of the proposed paving of the existing rock road and upstream of the existing control structure until site work has been completed and the site has been stabilized. The existing perimeter conditions meet or exceed the required perimeter elevation to contain the 25 year 3 day event. Conclusions: In my professional opinion, the proposed construction should have no impact to existing drainage patterns off-site and should have no impact on off-site areas. The recommendations above should be followed during and after the site work until such time as the ground surface has been adequately stabilized to prevent the off-site transport of any soil or suspended solids. The estimates are used in land use planning that involves engineering considerations. Hydrologic soil groups are based on estimates of runoff potential. Soils are assigned to one of four groups according to the rate of water infiltration when the soils are not protected by vegetation, are thoroughly wet, and receive precipitation from long -duration storms. While trees are required along all roadway frontages, not just the roadway providing access to the property, § 90-539 provides the opportunity for the Applicant to demonstrate that landscape requirements can more effec- tively be met by an alternative plan. At a minimum, three more trees are required. Other Requirements and Considerations Sidewalks: Sec. 78-36(a)(1) requires that all projects (except for an individual single- family home) where the land adjoins a collector or arterial street or city right-of-way, provide sidewalks adjacent along each such street or right-of-way. However, it appears from aerial photography of adjacent developed properties that no sidewalks have been required in this area.
