CITY OF OKEECHOBEE 55 Southeast 3rd Avenue Okeechobee, Florida 34974 The August 16, 2018, Technical Review Committee (TRC) meeting was called to order at 10:14 a.m. by Chairperson Montes De Oca. II. STAFF ATTENDANCE — Secretary. There being none the Agenda stands as published. IV. MINUTES — Secretary. Building Official Newell moved to dispense with the reading and approve the Minutes for the regular meeting held July 19, 2018; seconded by Fire Chief Smith. Motion carried unanimously. V. NEW BUSINESS — Chairperson. A. Site Plan Review Application No. 18 -003 -TRC, in regards to the development of a proposed storage yard facility and future construction of a 10,000 square foot building located at Northeast 9th Avenue and 12th Street, Lots 10 and 11 of the CITY OF OKEECHOBEE COMMERCE CENTER, as recorded in Plat Book 7, Pages 10 through 14, Public Records of Okeechobee County - Senior Planner. Planning Staff Report: Planner Brisson explained the proposed project involves the development of a 6.1 acre site as a storage yard facility to store building tunnel forms. It will include a 5,081 square foot steel shell type building containing a 600 square foot office and an asphalt parking area for seven parking spaces and a non -asphalt outdoor storage area. Operation of the site will be limited to no more than two employees working 7 a.m. to 4 p.m. TRC - August 16, 2018 - Page 1 of 4 V. NEW BUSINESS CONTINUED. A. Site Plan Review Application No. 18 -003 -TRC continued. Planning Staff Report continued: The site is and will continue to be provided potable water by Okeechobee Utility Authority (OUA). The potential increase from the project is insignificant and will have no effect upon the available capacities that can be provided by the OUA. The County has confirmed a considerable level of excess capacity available to serve the solid waste disposal needs. Drainage, water quality, and water quantity are being handled through the permitting requirements of the South Florida Water Management District. No traffic generation information has been provided by the Appiicant. However, using information from the 8th Edition of the Institute of Traffic Engineer's Trip Generation Report, warehousing, which would appear to be the closest use category to the proposed storage yard, would generate between about 1.2 and 1.6 trips in the PM peak hour based on the two employees and 5,081 square feet. Such traffic levels are not expected to adversely affect traffic flow into or out of the Commerce Center or the proposed site. Access to the proposed steel building, associated parking and dumpster area is provided by a 40 -foot wide driveway off Northeast 9th Avenue. The outside storage area occupies the balance of the parcel. The site is entirely enclosed by 8 -foot chain link fencing. The yard is surfaced with millings with shell or crushed concrete with a stabilized subbase. Two gated, 30 -foot wide driveways will be provided in the future providing access from Northeast 9th Avenue in the southwest and southeast corners of the site. Interior circulation is unburdened throughout the site. The dumpster pad is situated outside the northeastern part of the proposed building and separated from the balance of the storage yard by a 6 -foot high chain link fence. The dimensional standards review appears to meet the requirements with the exception of providing a location for the loading zone. As a modification to this requirement, an explanation was offered that basically the entire yard is the loading zone for this type of use and to designate one area would not make sense. The site is to be operated by two employees in a building that will be an open shed. As such, a parking study is not necessary for this project. The landscape plan showed only perimeter landscaping treatment along road frontages as it appeared the Applicant mistakenly used the landscaping requirements of Okeechobee County instead of the City of Okeechobee. The plan shows only 28 trees and 144 shrubs when 89 trees and 266 shrubs are required. The City's Land Development Regulations (LDR's) include no exemption to the minimum landscaping requirement for industrial uses; however, there is a section that provides the opportunity to demonstrate that the requirements can more effectively be met by an alternative plan. Vehicular use areas include all parking spaces, back -out areas and access driveways. These areas occupy 2,728 square feet therefore, 108 square feet of interior and perimeter landscaping is required and none is shown. Two trees are required and a two -foot landscape strip is needed between the parking area and the building. Lastly with landscaping, the plan shows no trees or shrubs along interior property lines. It appears from adjacent developed properties within the Commerce Center that no sidewalks have been required along adjacent streets and with just six or perhaps fewer parking spaces, a photometric lighting plan would not be necessary. In conclusion, Mr. Brisson is recommending approval of the site plan, as submitted, with the following stipulations: the TRC accepts the Applicant's explanation as to why no loading zone is necessary; the Applicant provides the minimum landscaping requirement of 89 trees and 266 shrubs; or the TRC determines that the storage yard use occupying the vast majority of the site does not warrant so many trees and shrubs; the Applicant provides the required 108 square feet of perimeter and interior landscaping for the parking lot; a two -foot landscape strip is provided between the TRC - August 16, 2018 - Page 2 of 4 V. Site Plan Review Application No. 18 -003 -TRC continued. parking area and the building; and at least 8 trees and 25 bushes are provided along the interior property lines of the property. County Environmental Health Department: No issues were received. OUA: Director Hayford commented the OUA has inquired to the Applicant about whether the driveway on Northeast 12th Street could be moved to the west and about the water service connection. Public Works: No issues were received. Police Department: No issues were received. Building Official: Building Official Newell first commented he was in support of the project. He then inquired as to whether the Applicant had a copy of the Declaration of Protective Covenants for the Okeechobee Commerce Center as it is stated each plot shall provide not less than twenty percent (20%) of its area in landscaped open space. This differed from the City's LDR's of fifteen percent (15%). He wanted to make sure the alternative landscaping plan would be compliant with these Covenants. Fire Department: Chief Smith inquired as to the type of storage, whether there would be storage inside the steel building and whether there would be any manufacturing and storage of hazardous materials. Mr. John GoodFellow, Agent for the Property Owner, LD Properties, LLC, was present and commented they would be storing steel tunnel forms for residential construction. The forms are fabricated and reused and there would be no storage of hazardous materials. The tallest form would be around nine foot and there would be an eight foot high fence around the entire perimeter. Chairperson Montes De Oca asked whether there were any comments or questions from those in attendance. There were none. Chairperson Montes De Oca then asked TRC Members to disclose for the record whether they had spoken to anyone regarding the Application or visited the site. Chairperson Montes De Oca disclosed he had several meetings and phone conversations with Mr. Orlando Rubio, PE with Craig A. Smith & Associates. These discussions regarded the City's South Florida Water Management District permit in the Industrial Park. There were no other disclosures. A motion and a second was offered by Fire Chief Smith and Public Works Director Allen to approve to Site Plan Review Application No. 18 -003 -TRC, in regards to the development of a proposed storage yard facility and future construction of a 5,081 square foot building located at Northeast 9th Avenue and 12th Street, Lots 10 and 11 of the CITY OF OKEECHOBEE COMMERCE CENTER, as recorded in Plat Book 7, Pages 10 through 14, Public Records of Okeechobee County, with the following condition: 1. Submit alternative landscaping plan to address landscaping along the North as long as the City found that legally sufficient to meet the City LDR's and the Declaration of Covenants of the Okeechobee Commerce Center. Proposed is a 10,000 sf future steel shell type building with associated asphalt parking containing a 600 sf future office to be operated by no more than 2 employees working from 7am to 4pm. Asphalt parking was based on the 600 sf office space which will be inside the steel building. The future office will be connected to existing OUA facilities and the site will have 2 driveway entrances with one future driveway. Note that each lot within the OCC was planned to have a connection to OUA services. Non -asphalt surface will be either millings with shell or crushed concrete with a stabilized subbase. A (future) temnn�onstruction trailer is also proposed as shown on the plans with temporary water and sewer hookups. The site will be gated and first responders will have access to the site via a "Knox box" with the main entrance being at the existing cul-de-sac off of NE 9th Avenue. Proposed landscaping will be provided by others and is to accompany this submittal. The site's permit requirements are governed by the master South Florida Water Management District (District) Permit No. 47-00638-P of the OCC. The permit allowed each lot to consist of 50% Building, 40% pavement, and 10% pervious and the proposed site is within those parameters. Site data can be seen on Sheet SP01. The site is part of Basin nos. 2 and 3 of District permit and each lot is to provide %" of dry pre-treatment prior to overflowing into the master wet detention system. For the western halves of the lots, proposed is the installation of a dry pre-treatment swale between the adjacent roads and property. This pre- treatment volume will be controlled by the existing overflow structure consisting of a grate with a V -notch Bleeder located on the northeast corner NE 9th Avenue and NE 12th St. The 1/2" of pre-treatment calculations are attached with this submittal. Site grading is to follow the grading assumptions made in the master permit where the finished floor elevation is set at 25.0' NGVD and lot grading (drivable surface) is to be graded from elevation 22.5' to 25.0' NGVD. The remaining green areas can be graded between 20.5' to 22.5' NGVD. The proposed site grading is consistent with the master permit requirements. Instances where the Staff believes the submission to be deficient are highlighted. POTABLE WATER AND SANITARY SEWER: The Applicant stated that potable water is, and will continue to be, provided by the Okeechobee Utility Authority (OUA). Applying the City's Level of Service standard for nonresidential use of 0.15 gallons of water per day per square foot (gpd/sf) indicates a demand of about 750 gallons of potable water and waste water treatment each per day for the 5,081 square foot building. However, it would appear unlikely that the proposed operation with only minimal interior space and employment is likely to generate this level of demand. It would seem more appropriate that water and sewer demand be calculated based on the 600 square feet of enclosed office space. This would result in negligible demand for such services. However, we defer to OUA in determining the likely demand and adequacy of the utility to provide water and sewer services to this use. SOLID WASTE DISPOSAL: On several occasions the County has confirmed a considerable level of excess capacity available to serve the solid waste disposal needs of other developments in the City. It's reasonable that the volume of solid waste generated by this storage facility will also be minimal and can be accommodated within the capacity of the County's Solid Waste Facility. DRAINAGE: The Engineer's Report accompanying the Application addresses drainage, water quality and water quantity. Such traffic levels are not expected to adversely affect traffic flow into or out of the Park of Commerce or the site in particular. INGRESS AND EGRESS: Access to the proposed steel building, associated parking, and dumpster area is provided by a 40 -foot wide driveway off NE 9th Avenue. The outside storage area referred to as the "lay -down yard", occupies the balance of the parcel. The site is entirely enclosed by 8 -foot high chain Zink fencing. The yard is surfaced with millings with shell or crushed concrete with a stabilized subbase. Two gated, 30 -foot wide, driveways will be provided in the future affording access from NE 9th Avenue in the southwest and southeast corners of the site. INTERIOR CIRCULATION: Interior circulation is virtually unencumbered throughout the site. DUMPSTER LOCATION The dumpster pad is situated outside the northeastern extremity of the proposed 5,081 square foot steel building and separated from the balance of the storage yard by a 6 -foot high chain Zink fence. LOADING ZONE Sec. 90-513(2) indicates that one loading space is required for industrial uses of 5,000 to 25,000 sf of floor area. Sec. 90-483(3) provides for modification of the number of required loading spaces by provision of a study indicating that the number of spaces required is excessive or that there is no need for all the spaces required. The Applicant's engineering consultant has provided the following statement in support of the contention that no loading zone is needed for this operation. "After reviewing this section of the LDR and discussion with the applicant, the loading zone requirement would be excessive for this type of use because the lay -down yard is basically your loading area. The lay -down yard encompasses most of the site and to designate a loading zone area would be counterintuitive. The site is to be operated by 2 employees (3 maximum) in a building that will be an open shed (4 sides). As such, a parking study is not necessary for this project."
