1171 Millage Rate FY 2018-19ORDINANCE NO. 1171 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA, ADOPTING A MILLAGE RATE TO BE LEVIED ON ALL REAL AND TANGIBLE PERSONAL PROPERTY WITHIN THE CITY FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2018 AND ENDING SEPTEMBER 30, 2019; PROVIDING THAT 7.9932 PER THOUSAND DOLLAR VALUATION SHALL NOT BE LEVIED ON HOMESTEAD PROPERTY; THAT 7.9932 VALUATION SHALL BE USED FOR GENERAL CITY PURPOSES; THAT SAID MILLAGE RATE IS 5.00 PERCENT (5.00%) MORE THAN THE ROLL -BACK RATE COMPUTED IN ACCORDANCE WITH FLORIDA STATUTE 200.065 (1); PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Chapter 166, Florida Statutes and Article VII, §2 of the Florida Constitution, the City of Okeechobee, Florida, has the governmental, corporate and proprietary powers to conduct municipal government; and WHEREAS, these powers include to adopt millage rates to be levied by the City Council on all taxable real and tangible personal property within the City each Fiscal Year; and WHEREAS, the City Council of the City of Okeechobee deems it necessary and advisable to adopt and levy a millage rate for the City for the Fiscal Year 2018-19; and NOW, THEREFORE, be it ordained before the City Council for the City of Okeechobee, Florida; presented at a duly advertised public meeting; and passed by majority vote of the City Council; and properly executed by the Mayor or designee, as Chief Presiding Officer for the City: Section 1: A millage rate is hereby adopted and levied by the City Council of the City of Okeechobee for Fiscal Year beginning October 1, 2018, and ending September 30, 2019, pursuant to the Laws and Constitution of the State of Florida. The City Council of the City of Okeechobee, Florida, hereby levies a tax of 7.9932 per thousand dollar valuation on all real and tangible personal property within the corporate limits of the City of Okeechobee, provided however, that 7.9932 shall not be levied upon property in the City of Okeechobee claimed and allowed as homestead on the general laws of the State of Florida. Section 2: That as designated in Section 1, hereof, 7.9932 per thousand dollar valuation shall be used for general City purposes in carrying on and conducting the government of said City. Section 3: The millage rate adopted is 5.00 percent more than the roll -back rate of 7.6125 as computed in accordance with Florida Statutes Section 200.065(1). Section 4: That this Ordinance was proposed, considered, and adopted under the provisions of Florida Statutes Chapter 166 and Section 200.065. Section 5: The Finance Department shall furnish a certified copy of this Ordinance upon second reading and final adoption to the Okeechobee County Property Appraiser, the Okeechobee County Tax Collector, and the Florida Department of Revenue as required by law. Section 7: If any provision or portion of this Ordinance is declared by any court of competent jurisdiction to be void, unconstitutional, or unenforceable, then all remaining provisions and portions of this Ordinance shall remain in full force and effect. Section 8: This Ordinance shall take effect October 1, 2018.
