Vice Chairperson Close called the June 12, 2018, Regular Meeting to order at 6:30 pm, in the City Council Chambers, located at 55 SE V Avenue, Room 200, Okeechobee, Florida. Pledge of Allegiance was led by Vice Chairperson Close. VOTE VI. PUBLIC HEARING ITEMS. A. Disposition of Cases presented by Code Officer Sterling: Case No.16-015 Leon & Tisha Edouard. 903 SE 81 Avenue Request for release or reduction of lien This being a quasi-judicial proceeding, an oath was administered to those offering testimony, all responded affirmatively. Officer Sterling advised all events occurred within the corporate limits of the City of Okeechobee. The Officer's notes, testimony, photographs, and supporting documents were all entered as part of the official record. Case 16-015 was postponed from the previous Code Board Meeting on May 8, 2018 to allow the property owners time to provide further information to the Code Board. Leon & Tisha Edouard were both present to request a release or reduction of lien. Mr. Edouard addressed the board stating, as he had at the previous meeting, to his knowledge he had complied with everything the Code Officer had requested. He added, he was unaware a fine was imposed for failing to get a permit for his shed. There was some discussion among the Board regarding administrative fees. Member Denisuk asked Secretary Christopher how much the administrative fee would be on this particular case. Secretary Christopher stated the staff uses a standard $50.00 administrative fee. Member Bemst asked if this fee included the cost for certified mail and the secretary said it did. Member Denisuk moved on Case 16.015, Leon & Tisha Edouard, 903 SE 8"' Avenue, to reduce the existing lien of $17,125.00 to $100.00 plus an administrative fee of $50.00 totaling $150.00;seconded by Member Bernst. Officer Francisco Guerrero, Jr. 1604 NW 71 Avenue Sterling said Mr. Guerrero operates an air conditioning business from his residence at 1604 NW 7t' Avenue. Officer Sterling Ch 90 Sec 90-101,102, & 103 Operating a business in a residential area added, he had talked to Mr. Guerrero in reference to the debris and the delivery trucks driving thru the neighborhood. He said Ch 30 Sec 30-32 & 30-40 Accumulation of junk in a residential area Mr Guerrero told him he was in the process of leasing a warehouse in order to receive deliveries and store his parts/supplies Ch 30 Sec 30-43 Public nuisance at this location instead of his house. Mr. Guerrero addressed the board stating he had already signed a lease to rent a warehouse in Fulford Plaza. He said he should be able to have everything moved and his property cleaned within a few days. Attorney Cook asked Mr. Guerrero if he had a Business Tax Receipt (License) to do business within the City, he said he did. In addition, Attorney Cook asked Mr. Guerrero if he understood the requirements for permits and inspections for installing A/C units, he stated he did. Attorney Cook reminded Vice Chairperson Close to allow Council Member Monica Clark, who was in attendance, an opportunity to address the board if she wished to do so. Vice Chairperson Close asked Council Member Clark if she had any questions or comments, she stated she did not.
