loose in the neighborhood.
On the recommendation of Administrator Westbrook, Mem er Attaway moved to continue
Case No. 2-82, Rolando & Olivia Rodriquez until February 8, 1982, due to non-service.

Case No. 5-82: David Potsko -
Administrator Westbrook informed the Board he was una le to determine if Mr. potsko
had moved from Okeechobee as he stated he was doing. on this information, Adminis-
trator Westbrook recommended Case No. 5-82, David Potsko, b continued to February 8, 1982.
Member Attaway moved to continue Case No. 5-82, secon ed by Member Jeffers and
carried.
Case No. 4-82: Frank & Nancy Wilbur - Male mixed bree dog running loose in
neighborhood.
Administrator Westbrook informed the Board he was ask'ng for a continuance until
February 8, 1982, of Case No. 4-82, Frank and Nancy Wilbur, dog running loose in neighbor-
hood, due to the fact the Humane Officer was ill and unable to attend the meeting. Member
Jeffers moved to continue Case 4-82, Frank and Nancy Wilbur Seconded by Member Walker.
Motion carried.
ADJOURNMENT
There being no further cases to be considered, Member Jeffers moved to adjourn the
meeting. Seconded by Member Walker. Motion carried. Meet"ng adjourned at 7:40 P.M.

MINUTES OF THE OKEECHOBEE MUNICIPAL CODE E FORCEMENT BOARD
Hearings of municipal code violations were held by th Okeechobee Municipal Code
Enforcement Board in City Council Chambers, Monday, Februa y 8, 1982. Chairman Gordon
v. Leggett called the meeting to order at 7:00 P.M.
The following members were present: Michael McArthur Lloyd Jeffers, Alex Amadio.
Member Jerry Walker arrived at 7:08 P.M. Member Jim Attaw y was absent.
Others present were: Building and Zoning Administrat r, Mallette Westbrook; City t
Attorney, David Conlon and Deputy Clerk, Mary Ann Holt.

Chairman Leggett instructed the Clerk to read a 1ette of commendation addressed to

involving minor infractions of ordinances within the City an be resolved in

CASES TO BE HEARD
Case No. 122-81 : Manning Wayne Brown
Administrator Westbrook informed the Board that charg s had been filed against Mr.
Brown for an overgrowth of weeds and abandoned appliances n Lots 1, 2, and 3 of Block 214.
- Manning Wayne Brown appeared before the Board and was sworn in by the Clerk.
Administrator Westbrook presented return receipts of ervice and photographs of the
property as evidence.
Mr. Brown informed the Board he received this propert as a judgement against .Zo11ie
Aldridge and the property is going back to Mr. Aldridge as he (Brown) did not receive a
clear title.

In view of these facts, Administrator Westbrook reco ended dismissal of this case.
Member McArthur moved to dismiss Case No. 122-81 agai st Manning Wayne Brown. Seconded
by Lloyd Jeffers and carried.
CASE NOS. 14-82, 15-82, 16-82: Anna Belle Rooney
Administrator Westbrook informed the Board the situat on with Anna Belle Rooney on t
S. W. 7th Avenue is the same as it was six months ago.
After a brief discussion between Board Members and We tbrook it was determined the
owner of the property, Bob Matthews, should be cited for a lowing a junk yard to operate
on the property.
Administrator Westbrook requested continuance of Case Nos. 14-82, 15-82, and 16-82.
Member McArthur moved to continue these cases. Secon ed by Member Jeffers. Motion
carried.
Case No. 17-82: Russell Smith
The following witnesses were sworn in by the Clerk: ussell E. Smith, Tom Bennett,
Norma Faye Herrin, Doris Evans and Randy Whipple.
Mrs. Evans appeared before the Board stating the Smit 's dogs had not given her any
trouble; however, she was aware that the dogs had caused t ouble in the neighborhood.
Mrs. Norma Herrin appeared before the Board stating a dog belonging to Mr. Smith had
killed her cat. Mrs. Herrin further stated Mr. Smith keep the dogs tied during the day,
but lets them run at night.
City Humane Officer, Randy Whipple, testified dogs are kept tied during the
day. Randy stated the dogs belonging to Mr. Smith had nev r been picked up by him.
Mr. Smith informed the Board the dogs had been loose nly two nights since his pre-
vious appearance before the Board. Smith further stated h had turned the dogs loose be-
cause of someone looking in his windows.
Mr. Bennett testified that he lives behind Mr. Smith nd the dogs are kept tied up.
Chairman Leggett questioned Mr. Westbrook as to what ranspired from his previous
court appearance. Administrator Westbrook stated the case had been dismissed as he met
with Mr. Smith before the meeting and was assured the dogs would be kept tied.
After further discussion between Board Members and Mr. Smi th , the consensus was to
fine Mr. Smith $40.00 for the violation.
Case No. 11-82: Zollie Aldridge
Administrator Westbrook informed the Board, Mr. Aldri ge had made progress on clear-
ing the property ,but still needed some work done. The not 'cæof service and photographs
of the property were presented in evidence.
The Board discussed previous cases involving Mr. Aldr 'dge, the vehicles and other
junk that is on the property. Member Jeffers moved to lev a fine of $1,840.00 against
Zollie Aldridge. Seconded by Member Walker. Members Jef rs, Walker and Amadio voted
in favor of the motion. Member McArthur opposed the motio .
MEMBERS OF THE AUDIENCE TO ADDRESS THE BOARD
Mr. Richard Fellóws, Administrative Assistant for the City, informed Board Members
a bill had been introduced into the Legislature which woul allow counties to form Code
Enforcement Boards.
BLAIR KUHLEWIND
Mr. Blair Kuhlewind addressed the Board regarding Cas No. 126-81 against Gustavo
Ponce. t
Mr. Kuhlewind stated his property is adjacent to Mr. once's property and there is
a problem with the livestock that is kept on the property. Kuhlewind further stated he
felt the City should enact an ordinance regulating livesto k within the City limits.

After further discussion, Attorney Conlon informed Mr. Kuhlewind he could petition
either the Planning Board or the city Council regarding an ordinance.
