SEPTEMBER 21, 1981 MINUTES OF THE OKEECHOBEE MUNICIPAL CODE Hearings on Municipal Code violations were held by th Okeechobee Municipal Code Enforce- ment Board at City Hall on Monday, September 21, 1981, at Chairman Leggett called the meeting to order. Chairman Leggett informed the Board that due to the f that Board Member, Herb Nix, was not a resident of the City, he could member of the Board and therefore, a new member, Mr. Jim Attaway, had Chairman Leggett called for a motion to accept Mr. Attaway as a member of the Board. otion made by Member Jeffers, seconded by Member McArthur and carried. ROLL CALL Chairman Leggett called for a roll call with the results as follows: Gordon Leggett - Present Jim Attaway - Present LLoyd Jeffers - Present Michael McArthur - Present Jerry Walker - Present Dr. Alex Amadio - Present Others present were: J. M. Westbrook, Building ing Administrator; Mary Ann Holt, Secretary and David Conlon, Attorney. APPROVAL OF MINUTES Upon recommendation of Chairman Leggett, Member Jeffer moved to dispense with the reading of the August 17th minutes, seconded by Member Walk r. Motion carried. Member McARthur moved to approve the mintues of the Au ust 17th hearings, seconded by Member Walker. Motion carried. CASES TO BE HEARD e Chairman Leggett instructed Building and Zoning Admini trator, J. M. Westbrook to call first the cases he was recommending for dismissal. Lamb - Structure located at 1008 7th Street is unsafe due to lack of maint Dismissal defective wiring and sewage system. 46-81 Trustees of II Fund - Junk vehicle in Dismissal 48-81 Lillian Strealy - Remodeling without a pe mit at 1112 N. Dismissal Member McArthur moved to dismiss these cases on the re ommendation of Building and Zoning Administrator Westbrook, seconded by Member Jeffers. Motion carried. Building and Zoning Administrator Westbrook called for continuance of the following cases: CASE NO. NAME AND DESCRIPTION OF VIOLATION INSPECTOR'S RECOMMENDATION 16-81 Florida Ultra Flo, Inc. - Abundance of trash and high weeds on Lots 7 & South .1 Continue until 10/12/81 2 of 10, Block 17, City of Okeechobee. 43-81 Frank & Louise Kriegl - Trash, garbage and furniture in rear yard. Continue until 10/12/81 37-81 James Auto Salvage - Has abandoned and/or junk vehicles on premises; operating a jun Continue until 10/12/81 yard without a proper license. 51-81 Palmer & Cheryl Lamb - Abandoned furniture and debris on Lots 13 & 14. Continue until 12/14/81 Member Jeffers moved to continue these cases as reco ended by Building and Zoning Administrator Westbrook, seconded by Member Walker. Motio carried. CASE NO. 35-81: Anna Belle Rooney/Annie's Garage Building and Zoning Administrator Westbrook called Ca e No. 35-81, Anna Belle Rooney, Annie's Garage, stating that Annie Rooney has not complied as she stated she would and therefore, this case should be tried as it was continued f om 8/17/81. t . ~ Westbrook offered five (5) photographs taken this dat , 9/21/81, in evidence against Anna Belle Rooney/Annie's Garage. Chairman Leggett officially offered the five (5) phot graphs to the Clerk to be filed as evidence in Case No. 35-81 - Anna Belle Rooney/Annie's arage. e It was noted by Building and Zoning Administrator Wes brook there was an error in the docket on Case Nos. 53-81 and 55-81. Case No. 53-81 should be dismissed and Case No. 55-81 should be reinstated and brought before the Board. Member McArthur moved to dismiss Case N . 53-81 and reinstate Case No. 55-81 to be heard this date, seconded by Member Amadio. M tion carried. Chairman Leggett called for a decision of the Board s ating that this case had been going on for over three months. Board members stated thei recommendations in Case No. 35-81 as follows: Member Jeffers - Impose a fine of $100.00 Member McArthur - Impose a fine of $150.00 Member Amadio - Can identify 15 different vehicles - Impose a fine of $500.00 Member Attaway - Impose a fine of $300.00 Member Walker - Impose a fine of $100.00 Chairman Leggett - Impose a fine of $250.00 After further discussion by members, Member Jeffers m ved to levy a fine of $250.00 against Case No. 35-81 - Anna Belle Rooney/Annie's Garage, seconded by Member Walker. Motion carried. CASE NO. 55-81 - Anna Belle Rooney/Annie's Garage Member Jeffers moved to dismiss this case, seconded Member McArthur. After dis- cussion between Board Members and Administrator Westbrook, Member McArthur stated that the Board actually has nothing to go on as there is no way to etermine whether Annie Rooney is in violation. Chairman Leggett called for a vote on the motion. bers McArthur, Jeffers, Attaway and Walker voted "yes". Member Amadio voted "no". Motion carried. CASE NOS. 66-81, 67-81, 71-81 - Burt Raulerson Building and Zoning Administrator Westbrook presented Case Nos. 66-81, 67-81, and 71-81 against Burt Raulerson in regard to Ordinance No. 41 , Dog Ordinance. Westbrook informed the Board that Several complaints been registered against Mr. Raulerson. The Humane Officer and the Police Department h responded to complaints and Mr. Raulerson has not made any effort to control the situa Chairman Leggett called for the Clerk to swear in the witnesses: Randy Whipple - Humane Officer, City of Buck Farrendopf - Police Officer, City of Deara Thompson Gloria Cash Administrator Westbrook and Board Members questioned itnesses in regard to Case Nos. 66-81, 67-81 and 71-81 against Burt Raulerson. Chairman Leggett presented to the Clerk as evidence i Case Nos. 66-81, 67-81 and 71-81 the reports by the Humane Officer and the Police Of cer. After testimony of the witnesses, Chairman Leggett ca a decision of the Board. Member Jeffers moved to impose a fine of $100.00 with the tipulation that the fine be purgec if Mr. Raulerson proves the dog has been spayed within thi ty (30) days, seconded by Member Walker. Motion carried. - 8 ELECTION OF VICE CHAIRMAN Chairman Leggett informed the Board that the position of Vice Chairman was vacated by Herbert Nix and therefore a new Vice Chairman must be e ected. Members Jeffers nominated Member Attaway. Member Ama io nominated Member Jeffers, Seconded by Member Walker. Nomination of Lloyd Jeffers as Vice Chairman carried. t REOPEN PREVIOUS CASES Attorney Conlon informed the Board that the fines im sed while Herbert Nix was a member of the Board are not enforceable. Member Walker m ed to reopen cases that fines were imposed on while Nix was a member of the Board, seconded by Member McArthur. Motion carried.
