LIEN / ORDER
THIS CAUSE came before the Code Enforcement Board, City of Okeechobee, for public
hearing on May 9 , 20 17 . After due notice to the respondent, the Board having heard
evidence on the alleged violation by witnesses or affidavit makes the following findings:
A. FINDINGS OF FACT:
Lots: 19 & 20 Blk: 21 Section: City of Okeechobee
Parcel: 3-15-37-35-0010-00310-0190
Property location: 201 NE 10th Street, Okeechobee, FL
Property owner: Jackie & Melinda Rediker
Property has been found to have disabled vehicles and needs general cleaning.
B. CONCLUSIONS OF LAW:
The owner of the property described above has been found in violation
of Chapter 30 Section 30-41 Disabled vehicles & Sec 30-43 Public nuisance
C. ORDER: The City of Okeechobee Code Enforcement Board has determined you
have violated the Code of Ordinances, Ch 30 Sec 30-41 Disabled vehicles & 30-43 Public
nuisance concerning your property located at 201 NE 10th Street , Okeechobee, FL 34972 .
If you do not correct the violation within forty-five (45) days from receipt of notice , or notify the
Code Enforcement Officer of the correction, the Board imposes a fine of $ 15.00 per day
commencing that date and continuing daily until the violation is corrected or the city is notified
by you and verifies the correction, which ever first occurs. Further, if you do not correct the
violation by said date, a copy of this order as a claim of lien, shall be recorded in the office of
the Clerk of Circuit Court, Okeechobee County, Florida, and once recorded, becomes a lien
on real and personal property pursuant to Florida Statute 162. You have a right within thirty
days, to appeal this finding and order by Writ of Certiorari to the Circuit Court, Okeechobee
County, Florida. If you correct the violation prior to the above date, it is your obligation to
contact the Code Enforcement Officer to verify such compliance.

Enclosed are the City Council Minutes from the March 3, 2020 Hearing. As you were aware
that they could have reduce it to the 10% of the fine amount. They decided to reduce to the 10%
of the $8,640.00 bringing the amount due �o $864.00 to be made in $50.00 a month payment.
Please be advised if you miss any payments then the ruling will be overturned, and the

Attorney Fumero read proposed Ordinance No. 1206 by title only as follows: "AN
ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA; AMENDING SECTION 6-1
OF CHAPTER 6 OF THE CODE OF ORDINANCES TO PROVIDE FOR THE SALE OF
ALCOHOL WITHIN THE CITY AT CERTAIN TIMES; PROVIDING FOR CONFLICT;
PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE."
A motion was made by Council Member Jarriel to adopt praposed Ordinance No. 1206;
seconded by Council Member Clark.
Mayor Watford opened the floor for public comments; there was none. He then confirmed
with Attorney Fumero that the time change is specific to restaurants oniy. Administrator
MontesDeOca added, the County recently adopted a modified ordinance that allows all
sales to begin at 10:00 A.M. (package stores and restaurants) and inquired whether the
Council woutd want to entertain an amendment to the ordinance. Attorney Fumero
recommended a separate ordinance be generated, should the Council decide to pursue
that option due to the notice to the public being a change specifically and only for
restaurants.
Mayor WatFord, Council Members Abney, Clark, Jarriel, and Keefe voted: Aye.
Nays: none. Motion Carried.

VI. NEW BUSINESS
A. A motion was made by Council Member Clark to approve the Code Enforcement Special
Magistrate recommended fine reduction for Code Enforcement Case No. 15-058, for
property located at 110 Northwest 6t'' Street; Legal: Lots 10 to 12 of Block 76; CITY OF
OKEECHOBEE, Plat Book 5, Page 5, Okeechobee County, Florida public records; from
$2,795.00 to $279.00 plus a$50.00 administrative fee [as provided in Exhibit 3];
seconded by Council Member Keefe.
The property was found in violation of Code Sections 30-44 and 30-43 from July 18, 2016
through January 17, 2017 and has been complying since then. At the January 7, 2020,
Code Enforcement meeting, the property owner, Mr. Kevin Dag stated he was stationed
overseas on military service, making it hard to resolve the issue. City Attorney Kowalsky
recommended the Case be presented to the Council with a waiver due to Mr. Dag's
military service. During the Council meeting, City Attorney Fumero advised the
representations did not hold true, therefore the military service waiver recommendation is
withdrawn. Mayor Watford opened the floor for public comments; there was none.
Mayor WatFord, Council Members Abney, Clark, Jarriel, and Keefe voted: Aye.
Nays: none. Motion Carried.
B. A motion was made by Council Member Jarriel to approve the Code Enforcement Special
Magistrate recommended fine reduction for Code Enforcement Case No. 17-005, 201
Northeast 10th Street (being the mailing address, property is located at 115 Northeast 10�n
Street); Legal: Lots 19 and 20 of Block 31, CITY OF OKEECHOBEE, Plat Book 5, Page
5, Okeechobee County, Florida public reocrds; from $8,640.00 to $864.00 [as provided
in Exhibit 4]; seconded by Council Member Clark.
The property was found in violation of Code Sections 30-43, 30-44 and 30-41 from
February 20, 2017 to December 19, 2019, with a fine of $15.00 per day. At the January
7, 2020, Code Enforcement meeting, the property owner, Mr. Jackie Rediker, requested
a fine reduction. Magistrate Azcona agreed to reducing it to 10 percent at which time Mr.
Rediker explained he receives a monthly disability income and requested to make
monthly payments. Magistrate Azcona and Mr. Rediker agreed to $50.00 per month due
to the City on the first of each month until the balance is paid in full. Should a payment
not be made on time, the Case will be overturned, and foreclosure procedures will begin.
Mayor Watford opened the floor for public comments; there was none. It was confirmed
through discussion that the Code Enforcement staff will monitor the monthly payments
are made on time to the Finance Department.

C. A motion was made by Council Member Clark to approve the Code Enforcement Special
Magistrate recommended fine reduction for Code Enforcement Case No. 17-028, located
at 1006 Southwest 5�n Avenue; Legal: Lots 2, 3, and 4, less that part lying West of a line
described in Official Record Book 257, Page 1677, of Block Y, SOUTH OKEECHOBEE,
Plat Book 5, Page 7, Okeechobee County, Florida public records; from $6,615.00 to
$661.00 plus the foreclosure filing fee of $400.00 [as provided in Exhibit 5]; seconded by
Council Member Jarriel.
On December 17, 2017, the property was found in violation of Code Sections 30-44 and
30-43. A fine of $15.00 per day was issued beginning January 19, 2018. On August 14,
2018, the Code Enforcement Board recommended foreclosure, which was approved by
the City Council on September 4, 2018. The property remained in violation and under the
ownership of Lorene Mott during this time. The City's foreclosure was filed on March 4,
2019. The property was brought into compliance on March 5, 2019. On December 11,
2019, the City filed a voluntary dismissal for the foreclosure due to the property being
sold.
It was explained at the January 7, 2020, Code Enforcement meeting the property was
recently purchased by Mr. David Feltenberger. He requested the fine reduction.
Magistrate Azcona recommended the fine reduction as stated above totaling $1,061.00.
Mayor Watford opened the floor for public comments; there was none. It was noted for
the record that Mr. and Mrs. Feltenberger were in attendance to answer any questions.
Council Member Keefe stated he has a better understanding of the Code Enforcement
and foreclosure process after discussing the issues Mr. Feltenberger has had to resolve
to purchase the property. He asked whether the Council could amend the
recommendation from Special Magistrate Azcona. Attorney Fumero explained based on
the documents he has reviewed; the Council has retained final authority on these
decisions.
Council Member Keefe moved to amend the fine reduction to a flat fee of $600.00;
seconded by Council Member Clark.
Mayor Watford and Council Member Jarriel did not agree to reduce the fine amount
further. Each explained that while they understood the situation, they were of the opinion
that the Council has a responsibility to uphold the Magistrate's recommendation.
Council Members Abney and Keefe voted: Aye. Nays: Mayor Watf�rd, Council
Members Clark and Jarriel. Motion to Amend Denied.

D. A motion was made by Council Member Abney to approve an Electric Vehicle Charging
(EVC) Equipment Agreement with Florida Power and Light (FPL) [as provided in Exhibit
6]; seconded by Council Member Keefe.
Administrator MontesDeOca explained the installation of the EVC equipment is another
step in making the City parks more innovative. Should the Agreement be approved, this
will be the first EVC station in the County. The proposed location, six on-street parking
spaces along the Northside of East South Park Street, at the Southwest corner of Block
P(City Hall Park) of FLAGLER PARK, CITY OF OKEECHOBEE, Plat Book 1, Page 10,
Okeechobee County, Florida public records.
The City will be responsible for paying all consumption costs for electricity dispensed,
with a third-party provider collecting the fees the users are charged. The providerwill then
remit the fees collected quarterly to the City. On or prior to January 31 of each year, FPL
will make a payment to the City equal to the amount by which the aggregate amount of
the City's payments to FPL. FPL will also cover the costs of the infrastructure.

I have found a few discrepancies on Rediker. First the original lien that was filed back in 2017 the Block number is
incorrect — should be Block 31, and the address is 201 NE 10t'' Street. Second the property appraiser say the address is
115 NE 10th Street, But the warranty deed says 201 NE 10th Street???? All documents have the same parcel number. On
the minutes from 2017 the address is listed as 201 NE 10th street as well. On my minutes from January the Lots should
say Lot 19&20 and I have 19&30 But the block is correct. I have done some research and the lady at the property
appraisers office was quite confused as well. She said they can make up a mailing address which doesn't make any sense
to me, but from seeing the warranty deed it clearly states the address to be 201 NE 10th Street, and the parcel numbers
match every document. I will not be able to make tonight, my daughter moved yesterday and is needing me to help her
with the kids and I really need to be around to help her out. Please have all this information for tonight hearing. I am
sorry for any mess ups, I was going of off the old paper work. I sure hope this doesn't mess this case up from going for a
fine reduction.

STATEMENT O:F VIOLATION AND NOTICE OF HEARING
Pursuant to Florida Statutes 162.02 and 162.12, Florida Statutes, and the Code of Ordinances of City of
Okeechobee, I(hereinafter the "City of Okeechobee), the undersigned Code Enforcement Officer hereby gives
notice of an uncorrected violation of the City of Okeechobee Code, as more particularly described herein, and
hereby requests a Hearing before the Okeechobee City Code Enforcement Special Magistrate.

Chambers. The Magistrate will receive testimony and evidence at said Hearing and shall make fndings of fact and
conclusions of law as are supported by the evidence and testimony, and shall make an order thereupon. You are entitled to be
represented by counsel, present evidence, and present testimony. Please be advised that any evidence presented to the
Magistrate for his consideration will be retained by Code Compliance Department. If you fail to appear at the hearing the
Magistrate may enter an Order of Violation, & impose a fine in your absence.

VIII. OLD CASES AND FINE REDUCTION REQUESTS
A. Case Number 17-005; Jackie Rediker, 201 Northeast 10t" Street, Okeechobee, Florida
34972. Chapter 30 Sections 30-43, 30-44 and 30-41 City of Okeechobee Code Ordinances.
[City of Okeechobee Lots 19 and 30, Block 31 ]
Mr. Rediker was sworn in and Special Magistrate Roger Azcona asked Code Officer
Sterling to explain the issue with this property. Officer Sterling stated that the property sits
on two parcels, one which has the home and the other which has a workshop. He went
on to explain that Case Number 17-005 has been ongoing since February 2017. The
property was found in violation of Chapter 30 Section 30-43 Public Nuisance and Section
30-44 General Cleaning and Beautification as well as 30-41 Disabled Vehicles. The fine
on the property ran for 576 days at $15.00 per day, bringing the fine amount to $8,640.00.
Mr. Rediker stated that he was gone during this time period. He stated that his wife was
supposed to take care of the property but did nothing. Special Magistrate Azcona asked
Mr. Rediker if the Case goes to the City Council for a request of Fine at 10 percent totaling
$864.00 could he pay it? Mr. Redikers stated that he is on disability and only gets $522.00
a month, but he could pay $50.00 a month. Magistrate Azcona stated that if the City
Council approves the fine reduction to the 10 percent making the fine $864.00, it would
have to be paid on the first of every month. Mr. Rediker agreed to this term. Magistrate
Azcona stated, If the fine is not paid every month then the case will be overturned, and
the foreclosure process will begin. This property was deemed in compliance as of
December 10, 2019.
B. Case Number 17-028; Lorene Mott (Feltenberger), 1006 Southwest 5th Avenue,
Okeechobee, Florida 34974. Chapter 30 Sections 30-44 and 30-43 City of Okeechobee Code
Ordinances. [ South Okeechobee Lots 2,3 and 4 Less That Part Lying West of a Line Described
in or 257, Page 1677 Block 7]
Mrs. Feltenberger was sworn in and Special Magistrate Azcona asked Code Officer
Sterling to explain the issue with the above property. Officer Sterling stated that the
property has been in disarray and that the Feltenbergers just purchased the property. Mr.
Sterling stated that the property was in violation of Chapter 30 Sections 30-44 General
Cleaning and Beautification and Section 30-43 Public Nuisance. Officer Sterling stated
that they have gone in and started the cleanup process. Mrs. Feltenberg was asked by
Special Magistrate Azcona if the case was to go to the City Council for a recommendation
of a fine reduction of 10 percent, would she be fine with that. Mrs. Feltenberger stated
that she would like to get the fine down around $500.00 to $600.00. She stated, they have
gone in and cleaned the property up and that the property has also been a thorn in the
City Code Enforcements side. Mrs. Feltenberger also stated that they have had to pay an
attorney to do the probate on the property, and that it has all been paid. Special Magistrate
Azcona stated that the recommendation on the fine reduction is usually 10 percent of the
fines due. Special Magistrate Azcona also stated that the fee of $400.00 would have to
be paid for the filing of the foreclosure that the city already paid. Mr. Azcona

Code Officer Sterling testified that he spoke with the owner Joel Prince and he provided
us with his lawn maintenance companies information. Officer Sterling meet with the lawn
company and went over what the issue is with the property. Mr. Sterling stated that half
of the tree that has faflen is on Walmart's property. Officer Sterling stated thaf he
contacted the manager at Walmart, and they have agreed to help Mr. Prince get the tree
trimmed and cleaned up. Officer Sterling recommended that we give them until the nexi
scheduled Special Magistrate Hearing to come into compliance. Special Magistrate
Azcona found this property to be in violation of Chapter 30 Section 30-83 Public Nuisance.
Que to Officer Sterling's testimony Magistrate Azcona recommended giving this Case

duly sworn in prior to presenting evidence.
2. Respondents Jacky Rediker is/are () present or () not present. The

On October 28, 2019 Chelsie contacted us about the case that was to come in front of the
Special Magistrate Meeting on November 12, 2019. In regarding recommendation for
foreclosure. She stated that you did not have the income for the fine due. We deferred the case
to the December 10, 2019 meeting. For you to come in front of the Special Magistrate for a
recommendation for a fine reduction this property needs to be in compliance. As of this date
this property is not in compliance. The lien order that was filed on May 9, 2017 has a fine of
$15.00 per day. The fine started on May 14, 2018 to date the fine amount is $8,265.00. For the
fne to stop we need to have the property list above in compliance. Once this is done you can
pick up a fine request form from us at the City Police Department. At that that time I will
schedule you for the next scheduled Special Magistrates Meeting which is held the second (2ndl

Tuesday of each month at 6:30pm at the City Council Chambers, on the second floor of the City

Okeechobee Code Enforcament OfEicer, �'red 9cerling.
At 109 NE lOth Street, the Jackie Rediker residence, there is a camper parked on
the city right of way between lOth Street and Rediker'a fence. It hae no tag and
unknown peop�e axe living in it.
on 1o/o�/2oi5 at about 1:55pm, I cailed �ted�kex. He eaid no one ie living in hia
camper, which ie ineide hie fence.
Rediker aaid about 1 week a.go, a truck parked that cam�er on the outaide of hie
le31Ce. A ma� named '�Robby" told Redikex he wae moving the camper directly but
needed to do aome preparea. Rel�iker helped him by giving him �ome ecrap aluminum
to plug eome holes on the campnr. �'Robby° told him he waa moving the trailer
la�t weekend and it ie still eitting at hie house,
LateY that day I went to Rediker'e and met the owner. He showed me iD and his
name wae ttobert 6ryan smlth DOB a/26/1968. I wae only able to locate a partial
V2N plate and iC was hanging irom Che eeverely rusted trailer tongun. We removed
thdt tdg dztd the numbere were 2 3DW 000160. The tail light lenees ehoed the
camper to be 2t 1973
NOTE: A9 I WA8 HELPINp REMOVE THI$ ALUMINUM TAp WS WERE BEINa $HOCKBD 8Y THF
FRAME. Robert unplugged the trailer�s power. 2 warned him about the trailer
catching fire and later called and tvld Code Officer Fred Sterling.

city limits. Thie wae whnther he had a property owner�e permission or noC. He
muat be in a legal mobile home park.
I left the Redicker'e and turned thia caee over to Code enforcement. End of

mobile home or manufactured home on any street,
alley or highway or other public place, or on any
tract, lot, or parcel of land, except as specifically
permitted in this Code, such as in chapter 90,

Sec. 54-121. Findings and purposes.
(a) The city council finds that the driving,
riding and use of motorcycles, motor bikes,
minibikes, dirt bikes, trail bikes, dune buggies,

lines; and 20-foot set back from rear prop-
erty lines. The junk shall not be viewable
from public rights of way, and shall be
obscured from ordinary view of those per-
sons passing upon the highways and mu-
nicipal rights of way in the City of
Okeechobee. If not otherwise obscured by
foliage or shrubbery that complies with
applicable city codes, the junk shall be
obscured by the erection of an opaque
fence, with a minimum height of eight
feet. Any fence so placed shall not be
permitted to encroach into the front prop-
erty line set backs for the zoning district
regardless of other codes to the contrary.
The fencing material shall be either con-
structed of wood, or by hurricane fencing,
with plastic slats woven through the fence
fabric to make it obscure. Any fence so
constructed shall comply with all other
applicable city permitting process and
codes.
In the event the real property on which
the junk is located is greater than 100 feet
in width from side property line to side
property line, there shall be placed a
30-foot unobstructed vehicle access lane
from the front property line to the rear
property line for ingress and egress for
fire and emergency services, and a similar
30-foot lane placed for every additional
100 feet of the width of the real property.
Any location meeting the definition of a
junkyard under this ordinance or F. S.
§ 339241, "Florida Junkyard Control Law",
and as hereafter amended, shall be open
at all regular business hours for inspec-
tion by environmental or law enforcement
off`icers, city code compliance officers, and
litter enforcement officer, to deterinine
compliance with this ordinance and state
laws.
Compliance by a property owner, tenant
or agent with these code provisions shall
not preclude an action for relief and en-
forcement by the city under applicable
state statutes to enjoin a pubic nuisance,
if in the opinion of the city the property
and its contents do in fact constitute a
public nuisance under state laws or these
ordinances.

Sec. 30-41. Disabled vehicles.
No person in chaxge or in control of any prop-
erty within the city, whether an owner, tenant,
occupant, lessee or otherwise, shall allow any
disabled vehicle to be placed or remain on such
property unless such vehicle is within a com-
pletely enclosed building or is on the premises of
an automotive repair or storage business for which
the owner of the business has a current city
occupational license and zoning approval.
(1) Prima facie evidence. A vehicle will be
considered physically or mechanically in-
capable of being operated on the public
streets if it is wrecked, partially disman-
tled, has no engine, has no transmission,
has a dismantled engine or transmission,
has no valid current license tag or is in
some comparable physical state render-
ing it inoperable.
(2) Interpretation of this section. Nothing in
this section shall be construed as permit-
ting the disassembling, tearing down or
scrapping of a vehicle or to permit one
vehicle to be scavenged or stripped for
parts for use on another vehicle.
(3) Responsibility for compliance. The owner,
agent and/or tenant of the property on
which the violation occurs and the owner
of the disabled vehicle shall be jointly and
individually responsible for compliance
with the requirements of this section.

Sec. 30-42. Procedure for abandoned or lost
property.
(a) Whenever a code enforcement officer ascer-
tains that an article of lost or abandoned property
is present on public property and is of such nature
that it can be easily removed, the officer shall
