CITY OF OKEECHOBEE 55 Southeast 3rd Avenue Okeechobee, Florida 34974 The April 19, 2018, Technical Review Committee (TRC) meeting was called to order at 10:02 a.m. by Chairperson Montes De Oca. II. STAFF ATTENDANCE — Secretary. AGENDA — Chairperson. Chairperson Montes De Oca asked whether there were any requests for the addition, deferral or withdrawal of items on today's Agenda. There being none the Agenda stands as published. IV. MINUTES — Secretary. Building Official Newell moved to dispense with the reading and approve the Minutes for the regular meeting held March 15, 2018; seconded by Public Works Director Allen. Motion carried unanimously. V. NEW BUSINESS — Chairperson. A. Site Plan Review Application No. 18 -001 -TRC, in regards to the construction of a proposed 3,750 - square foot public works facility building with associated parking located at 306 Northwest 9th Avenue, Okeechobee, FL, all of Blocks 130 and 133, CITY OF OKEECHOBEE, as recorded in Plat Book 1, Page 10, Public Records of Okeechobee County - Senior Planner. Planning Staff Report: Planner Brisson explained the proposed site contains eight buildings totaling 28,035 -square feet for the Okeechobee County Public Works yard that provides for storage, repair, and office use. The proposed plans remove the 5,471 -square foot quonset hut building and replace it with a new 3,750 -square foot building that will provide office space for Public Works, Engineering, and Road Maintenance staff. The building is designed to accommodate 35 people and will be the department's operations center, with hours from 7:00 a.m. to 5:00 p.m., Monday through Friday. The applicant has provided more than the required parking including a space designated for the TRC - April 19, 2018 - Page 1 of 3 V. NEW BUSINESS CONTINUED. A. Site Plan Review Application No. 18 -001 -TRC continued. Planning Staff Report continued: handicapped. The site is provided potable water and sewer service by Okeechobee Utility Authority (OUA). The potential increase from the project is insignificant and will have no effect upon the available capacities that can be provided by the OUA. The County has confirmed a considerable level of excess capacity available to serve the solid waste disposal needs. The proposed construction should have no impact to existing drainage patterns off-site and should have no impact on off-site areas. Information from the 9th Edition of the Institute of Traffic Engineer's Trip Generation shows that a government office building is expected to generate 1.21 trips per 1,000 -square feet of office space in the PM peak hour. This translates to less than five additional trips during the PM peak hour for the proposed new building. Access to the proposed office building will be by way of a two-way, 30 -foot wide driveway cut on Northwest 2hd Avenue directly into/out of the parking lot directly in front of the building. The dimensional standards review appears to meet the requirements with the exception of providing a location for the collection of trash/garbage associated with the new proposed use. There were originally some issues with the landscape buffer areas as the Applicant mistakenly classified the western property line as an interior property line and therefore did not calculate the appropriate number of required trees and bushes correctly. The Applicant is providing only 11 trees and 33 shrubs when 14 trees and 42 shrubs are required. Prior to today's meeting, Mr. Dobbs emailed a new landscape plan to Mr. Brisson and the requirement was satisfied. In conclusion, Mr. Brisson is recommending approval of the site plan, as submitted, with the following stipulation: the Applicant explains how trash/garbage associated with the new office building will be handled. County Environmental Health Department: No issues were received. OUA: No issues were received. Public Works: No issues were received. Police Department: No issues were received. Building Official: No issues were received. Fire Department: Chief Smith inquired as to the use and type of storage. Mr. Steve Dobbs, Project Consultant for the Applicant, Okeechobee County, was in attendance. He replied this would be for offices and no storage other than office equipment. Chief asked whether there would be security gates as this was needed due to liability so the public could not access. Mr. Dobbs said yes. Chief requested either a knoxbox with a lock in it or a knoxlock on both gates. Chairperson Montes De Oca asked whether there were any comments or questions from those in attendance. There were none. Chairperson Montes De Oca then asked TRC Members to disclose for the record whether they had spoken to anyone regarding the Application or visited the site. A motion and a second was offered by Fire Chief Smith and Public Works Director Allen to approve to Site Plan Review Application No. 18 -001 -TRC, in regards to the construction of a proposed 3,750 -square foot public works facility building with associated parking located at 306 Northwest 9th Avenue, Okeechobee, FL, all of Blocks 130 and 133, CITY OF OKEECHOBEE, as recorded in Plat Book 1, Page 10, Public Records of Okeechobee County, with the following conditions: 1. Show elevation grades to the tenth. 2. Show grate elevations of the structure. 3. Completely re -pave entire driveway entrance on Northwest 9th Avenue rather than just the crescent, coordinate with City Public Works Director prior to starting work. 4. Pave Northwest 8th Avenue as that loop and provide elevation grades for that section, coordinate with City Public Works Director prior to starting work. 5. Add inlet section under Northwest 8th Avenue, coordinate with City Public Works Director prior to starting work. 6. Provide knoxbox with lock in it or knoxlock on both gates located on Northwest 8 and 9th Avenues. 7. Applicant needs to provide a location for collection of trash/garbage associated with the new office building or explain how such trash/garbage will be addressed. Motion carried unanimously. VI. JAi oma•.• �,c�, 481,34's o N' ; 1' r Purpose: The purpose of this report is to provide the City of Okeechobee and the South Florida Water Management District with the calculations and documentation to demonstrate that the surface water management system for the proposed project complies with applicable state and local water resource requirements. Existing Conditions: Okeechobee County currently owns approximately 4.8 acres located in Section 15, Township 37S, and Range 35E. The property's parcel ID is 3-15-37-35-0010-01300-0010. It is currently located in the City of Okeechobee with a current zoning of Public Facility and a FLU of Public Facility. There are eight existing buildings onsite totaling 28,035 sf on the 209,088 sf lot for a coverage of 13.4%. The rest of the site is approximately 2.26 acres of concrete and asphalt and approximately 2.04 acres of pervious and shell covered area. The drainage calculations and routings to address the required water quality treatment volumes and anticipated surface water stages for the proposed site improvements will be provided. Proposed Use: This request is for a construction permit to construct a new 3,750 sf building with associated parking and drainage to treat the newly paved areas. To accommodate the new building, the Quonset hut — approximately 5,471 sf and the new building will be built in that location. Potable water and sewer is currently provided by the Okeechobee Utility Authority (OUA) and will continue using OUA as the utility provider. This project will incrementally increase the existing potable water demand on OUA. Site Drainage Considerations: Okeechobee County is seeking an operation permit for a majority of the parcel and will have the ability to provide water quality for the new construction with a project area of 0.78 acres. A majority of the water falling on the project area will be collected and routed through a dry detention area that will meet the water quality requirement of 0.13 at elevation 32.0 NGVD '29 The Soils Map for Okeechobee County indicates that this parcel's soils are made up of Immokalee Fine Sand. This soil types are very poorly drained "D soil" in the natural state and a better drained "B soil" to in the developed state. The Soils Map information also indicates that the anticipated wet season water table is approximately 1' below natural ground for the Immokalee Fine Sand and Myakka Fine Sand. The adjacent ditches are at the control elevation of 29.0 NGVD '29 The site is located in the S-133 Basin. The proposed outfall for the project will be on the southeast side of the proposed dry detention area that will discharge through an onsite canal that leads to the headwaters of the SW 12th Avenue ditch thru the S-133 structure which discharges into Lake Okeechobee. The allowable discharge for the S-133 Basin is 15.6 csm (cfs /sq. mile) for the 25 year 3 day event: Q = 15.6 csm / 640 acres/sq. mile x Project Area Q = 15.6csm / 640 acres/sq. mile x 0.78 acres = 0.02 cfs A. Water Quality Water quality treatment is provided in the form of dry detention for the project drainage area. Since the proposed water quality system is dry detention, the volume required is 75% of the calculated volume, however since this project discharge into an impaired water basin and with a presumption of compliance with nutrient control by adding an additional 50% to the water quality volume the total water quality volume is 0.09 acre-feet. The dry pretreatment criteria of (0.5") is less than the (1") water quality requirement, therefore the system meets the pretreatment criteria as specified under Section 5.2.1 of the SFWMD's Environmental Resource Permit Information Manual Volume IV and the required water quality volume. Based on the attached stage storage spreadsheet, the water quality volume (0.09 acre-feet) is met at elevation 32.03 NGVD '29. B. Water Quantity This project is located in the S-133 Basin which discharges ultimately into Lake Okeechobee. The allowable peak discharge rate in this basin is 15.6 csm. The allowable peak discharge rate for this project, based on the 25 -year, 72 -hour storm event was calculated to be 0.02 cfs. The actual maximum discharge rate for the 25 - year, 72 -hour storm event was calculated to be 0.374 cfs, which is greater than maximum allowable peak rate, but the project is only providing minimum water quality as a development of an existing project. To document the reaction of this project, the proposed project was flood -routed using AdICPR. The 10 year, 24 hour storm (5") w/ discharge, the 25 year, 72 hour storm (9.0") w/ discharge, and the 100 year, 72 hour storm (10.0") w/o discharge, were evaluated based on the proposed plan. Please refer to the attached AdICPR flood routing input/output parameters. A summary of the flood routings is provided as follows: 10 Year, 24 Hr. Storm (5.0") 25 Year, 72 hr. Storm (10.0") Peak Stage (ft- NGVD'29)) 33.37 Flood Plain Analysis: As shown on the attached FEMA Panel 12093C0480C, this project is located in Zone C of the flood plain. No flood plain compensation is required. Nutrient Analysis: As previously stated, the project proposes to provide 150% of the required water quality treatment volume in the dry detention system in order to meet the nutrient removal requirements. Construction Recommendations: Runoff and/or any water generated by short-term dewatering during construction will be contained on-site. However, there is some potential for transport of sediment to off-site areas should heavy rainfall occur. In order to reduce the potential of any off-site transport of sediment or turbidity we recommend installation and maintenance of temporary silt fence inside the southerly property line in the area of the proposed paving of the existing rock road and upstream of the existing control structure until site work has been completed and the site has been stabilized. (The existing perimeter berm should prevent any potential off-site transport of sediment from other areas of the site during construction.) Conclusions: In my professional opinion, the proposed construction should have no impact to existing drainage patterns off-site and should have no impact on off-site areas. The recommendations above should be followed during and after the site work until such time as the ground surface has been adequately stabilized to prevent the off-site transport of any soil or suspended solids. This project is for redevelopment consisting of a 3,750 square foot building, associated parking and pavement. Project runoff is directed via site grading to a perimeter dry detention area which discharges to the City of Okeechobee SWM system. This permit is issued pursuant to the water quality net improvement provisions of Chapter 62-330.062, F.A.C.; therefore, state water quality certification is waived. Site Description: The site contains eight buildings, pavement and material storage areas serving the County Road and Bridge Department. There are no permitted water management facilities within the project area. There are no wetlands or other surface waters affected by the proposed project. Permit No: 47-100139-P, Page 2 C 7 Engineering Evaluation: Water Quality Water quality treatment is provided in the 0.02 -acre dry detention area. The project provides 0.13 acre-feet of required water quality treatment volume based on 2.5 inches times the percent net impervious over the controlled basin area(s). The project includes implementation of a Turbidity and Erosion Control Plan (Exhibit 2) as additional reasonable assurance of compliance with water quality criteria during construction and operation. Certification, Operation, and Maintenance Pursuant to Chapter 62-330.310, F.A.C., Individual Permits will not be converted from the construction phase to the operation phase until construction completion certification of the project is submitted to and accepted by the District. This includes compliance with all permit conditions, except for any long term maintenance and monitoring requirements. It is suggested that the permittee retain the services of an appropriate professional registered in the State of Florida for periodic observation of construction of the project. For projects permitted with an operating entity that is different from the permittee, it should be noted that until the construction completion certification is accepted by the District and the permit is transferred to an acceptable operating entity pursuant to Sections 12.1-12.3 of the Applicant's Handbook Volume I and Section 62-330.310, F.A.C., the permittee is liable for operation and maintenance in compliance with the terms and conditions of this permit. In accordance with Section 373.416(2), F.S., unless revoked or abandoned, all SWM systems and works permitted under Part IV of Chapter 373, F.S., must be operated and maintained in perpetuity. The efficiency of SWM systems, dams, impoundments, and most other project components will decrease over time without periodic maintenance. The operation and maintenance entity must perform periodic inspections to identify if there are any deficiencies in structural integrity, degradation due to insufficient maintenance, or improper operation of projects that may endanger public health, safety, or welfare, or the water resources. If deficiencies are found, the operation and maintenance entity is responsible for correcting the deficiencies in a timely manner to prevent compromises to flood protection and water quality. This permit does not release the permittee from complying with any other agencies' requirements in the event that historical and/or archaeological resources are found on the site. Water Use Permit Status The applicant has indicated that water for irrigation and construction dewatering are not required for this project. This permit does not release the permittee from obtaining all necessary Water Use authorization(s) prior to the commencement of activities which will require such authorization, including construction dewatering and irrigation. Water and Wastewater Service Okeechobee Utility Authority Permit No: 47-100139-P, Page 6 r General Conditions for Individual Environmental Resource Permits, 62-330.350, F.A.C. 1. All activities shall be implemented following the plans, specifications and performance criteria approved by this permit. Any deviations must be authorized in a permit modification in accordance with Rule 62-330.315, Florida Administrative Code (F.A.C.). Any deviations that are not so authorized shall subject the permittee to enforcement action and revocation of the permit under Chapter 373, F.S. 2. A complete copy of this permit shall be kept at the work site of the permitted activity during the construction phase, and shall be available for review at the work site upon request by the Agency staff. The permittee shall require the contractor to review the complete permit prior to beginning construction. 3. Activities shall be conducted in a manner that does not cause or contribute to violations of state water quality standards. Performance-based erosion and sediment control best management practices shall be installed immediately prior to, and be maintained during and after construction as needed, to prevent adverse impacts to the water resources and adjacent lands. Such practices shall be in accordance with the "State of Florida Erosion and Sediment Control Designer and Reviewer Manual" (Florida Department of Environmental Protection and Florida Department of Transportation June 2007), and the "Florida Stormwater Erosion and Sedimentation Control Inspector's Manual" (Florida Department of Environmental Protection, Nonpoint Source Management Section, Tallahassee, Florida, July 2008), unless a project - specific erosion and sediment control plan is approved or other water quality control measures are required as part of the permit. 4. At least 48 hours prior to beginning the authorized activities, the permittee shall submit to the Agency a fully executed Form 62-330.350(1), "Construction Commencement Notice" indicating the expected start and completion dates. If available, an Agency website that fulfills this notification requirement may be used in lieu of the form. 5. Unless the permit is transferred under Rule 62-330.340, F.A.C., or transferred to an operating entity under Rule 62-330.310, F.A.C., the permittee is liable to comply with the plans, terms and conditions of the permit for the life of the project or activity. 6. Within 30 days after completing construction of the entire project, or any independent portion of the project, the permittee shall provide the following to the Agency, as applicable: a. For an individual, private single-family residential dwelling unit, duplex, triplex, or quadruplex- "Construction Completion and Inspection Certification for Activities Associated With a Private Single -Family Dwelling Unit"[Form 62-330.310(3)); or b. For all other activities- "As -Built Certification and Request for Conversion to Operational Phase" [Form 62-330.310(1)]. c. If available, an Agency website that fulfills this certification requirement may be used in lieu of the form. 7. If the final operation and maintenance entity is a third party: a. Prior to sales of any lot or unit served by the activity and within one year of permit issuance, or within 30 days of as- built certification, whichever comes first, the permittee shall submit, as applicable, a copy of the operation and maintenance documents (see sections 12.3 thru 12.3.3 of Applicant's Handbook Volume I) as filed with the Department of State, Division of Corporations and a copy of any easement, plat, or deed restriction needed to operate or maintain the project, as recorded with the Clerk of the Court in the County in which the activity is located. Within 30 days of submittal of the as- built certification, the permittee shall submit "Request for Transfer of Environmental Resource Permit to the Perpetual Operation Entity" [Form 62-330.310(2)] to transfer the permit to the operation and maintenance entity, along with the documentation requested in the form. If available, an Agency website that fulfills this transfer requirement may be used in lieu of the form. 8. The permittee shall notify the Agency in writing of changes required by any other regulatory agency that require changes to the permitted activity, and any required modification of this permit must be obtained prior to implementing the changes. 9. This permit does not: a. Convey to the permittee any property rights or privileges, or any other rights or privileges other than those specified herein or in Chapter 62-330, F.A.C.; b. Convey to the permittee or create in the permittee any interest in real property; c. Relieve the permittee from the need to obtain and comply with any other required federal, state, and local authorization, law, rule, or ordinance; or d. Authorize any entrance upon or work on property that is not owned, held in easement, or controlled by the permittee. 10. Prior to conducting any activities on state-owned submerged lands or other lands of the state, title to which is vested in the Board of Trustees of the Internal Improvement Trust Fund, the permittee must receive all necessary approvals and authorizations under Chapters 253 and 258, F.S. Written authorization that requires formal execution by the Board of Trustees of the Internal Improvement Trust Fund shall not be considered received until it has been fully executed. 11. The permittee shall hold and save the Agency harmless from any and all damages, claims, or liabilities that may arise by reason of the construction, alteration, operation, maintenance, removal, abandonment or use of any project authorized by the permit. 12. The permittee shall notify the Agency in writing: a. Immediately if any previously submitted information is discovered to be inaccurate; and b. Within 30 days of any conveyance or division of ownership or control of the property or the system, other than conveyance via a long-term lease, and the new owner shall request transfer of the permit in accordance with Rule 62-330.340, F.A.C. This does not apply to the sale of lots or units in residential or commercial subdivisions or condominiums where the stormwater management system has been completed and converted to the operation phase. 13. Upon reasonable notice to the permittee, Agency staff with proper identification shall have permission to enter, inspect, sample and test the project or activities to ensure conformity with the plans and specifications authorized in the permit. 14. If any prehistoric or historic artifacts, such as pottery or ceramics, stone tools or metal implements, dugout canoes, or any other physical remains that could be associated with Native American cultures, or early colonial or American settlement are encountered at any time within the project site area, work involving subsurface disturbance in the immediate vicinity of such discoveries shall cease. The permittee or other designee shall contact the Florida Department of State, Division of Historical Resources, Compliance and Review Section, at (850) 245-6333 or (800) 847-7278, as well as the appropriate permitting agency office. Such subsurface work shall not resume without verbal or written authorization from the Division of Historical Resources. If unmarked human remains are encountered, all work shall stop immediately and notification shall be provided in accordance with Section 872.05, F.S. Permit No: 47-100139-P, Page 8 T 'J 15. Any delineation of the extent of a wetland or other surface water submitted as part of the permit application, including plans or other supporting documentation, shall not be considered binding unless a specific condition of this permit or a formal determination under Rule 62-330.201, F.A.C., provides otherwise. 16. The permittee shall provide routine maintenance of all components of the stormwater management system to remove trapped sediments and debris. Removed materials shall be disposed of in a landfill or other uplands in a manner that does not require a permit under Chapter 62-330, F.A.C., or cause violations of state water quality standards. 17. This permit is issued based on the applicant's submitted information that reasonably demonstrates that adverse water resource -related impacts will not be caused by the completed permit activity. If any adverse impacts result, the Agency will require the permittee to eliminate the cause, obtain any necessary permit modification, and take any necessary corrective actions to resolve the adverse impacts. 18. A Recorded Notice of Environmental Resource Permit may be recorded in the county public records in accordance with Rule 62-330.090(7), F.A.C. Such notice is not an encumbrance upon the property. Operation and maintenance of the stormwater management system shall be the responsibility of Okeechobee County. RIGHT TO REQUEST ADMINISTRATIVE HEARING A person whose substantial interests are or may be affected by the South Florida Water Management District's (SFWMD or District) action has the right to request an administrative hearing on that action pursuant to Sections 120.569 and 120.57, Fla. Stat. Persons seeking a hearing on a SFWMD decision which affects or may affect their substantial interests shall file a petition for hearing with the Office of the District Clerk of the SFWMD, in accordance with the filing instructions set forth herein, within 21 days of receipt of written notice of the decision, unless one of the following shorter time periods apply: (1) within 14 days of the notice of consolidated intent to grant or deny concurrently reviewed applications for environmental resource permits and use of sovereign submerged lands pursuant to Section 373.427, Fla. Stat.; or (2) within 14 days of service of an Administrative Order pursuant to Section 373.119(1), Fla. Stat. "Receipt of written notice of agency decision" means receipt of written notice through mail, electronic mail, or posting that the SFWMD has or intends to take final agency action, or publication of notice that the SFWMD has or intends to take final agency action. Any person who receives written notice of a SFWMD decision and fails to file a written request for hearing within the timeframe described above waives the right to request a hearing on that decision. If the District takes final agency action which materially differs from the noticed intended agency decision, persons who may be substantially affected shall, unless otherwise provided by law, have an additional Rule 28-106.111, Fla. Admin. Code, point of entry. Any person to whom an emergency order is directed pursuant to Section 373.119(2), Fla. Stat., shall comply therewith immediately, but on petition to the board shall be afforded a hearing as soon as possible. A person may file a request for an extension of time for filing a petition. The SFWMD may, for good cause, grant the request. Requests for extension of time must be filed with the SFWMD prior to the deadline for filing a petition for hearing. Such requests for extension shall contain a certificate that the moving party has consulted with all other parties concerning the extension and that the SFWMD and any other parties agree to or oppose the extension. A timely request for an extension of time shall toll the running of the time period for filing a petition until the request is acted upon. FILING INSTRUCTIONS A petition for administrative hearing must be filed with the Office of the District Clerk of the SFWMD. Filings with the Office of the District Clerk may be made by mail, hand -delivery, or e- mail. Filings by facsimile will not be accepted. A petition for administrative hearing or other document is deemed filed upon receipt during normal business hours by the Office of the District Clerk at SFWMD headquarters in West Palm Beach, Florida. The District's normal business hours are 8:00 a.m. — 5:00 p.m., excluding weekends and District holidays. Any document received by the Office of the District Clerk after 5:00 p.m. shall be deemed filed as of 8:00 a.m. on the next regular business day.
