COUNCIL ACTION - DISCUSSION - VOTE Calling the 2018 City General Election, Mayor Watford read the following Proclamation in its entirety for the record: "Whereas, under and by virtue of the provisions of the Charter and the Elections Chapter 26 of the Code of Ordinances for the City of Okeechobee, and Florida State Laws, it is the duty of the Mayor to proclaim and call General City Elections at the time and manner provided therein; and Whereas, proclaiming General City Elections shall be issued by a Proclamation, at least 90 days prior to the date of holding of such election, signed by the Mayor and attested by the City Clerk; and Whereas, such Proclamation shall specify the office or offices to be filled, the cause of the vacancy of such office or offices, and the date of the expiration of the terms of such office or offices; and Whereas, the City Clerk shall publish the Proclamation in the local newspaper at least twice, once being in the fifth week, and once being in the third week, prior to the week in which the General City Election will be held. NEW BUSINESS CONTINUED B. Motion to adopt proposed Resolution No. 2018-04 for renewal of Florida Department of Transportation Maintenance Agreement Renewal No. 1 continued. C. Motion to adopt proposed Resolution No. 2018-05 honoring fifty years of Municipal Home Rule - City Attorney (Exhibit 5). D. Motion to appoint a Voting Delegate for the 2018 Annual Florida League of Cities - City Administrator (Exhibit 6). E. Discuss a potential name change of the Treasure Coast Regional League of Clies - Council Member Gary Ritter. Administrator MontesDeOca briefly explained this is the renewal to the existing Maintenance Contract No. BE391, which expires August 3, 2018. The renewal term for providing service under this Agreement shall be a period of one year beginning August 4, 2018 and ending August 3, 2019. FDOT will reimburse the City three quarterly payments of $2,406.37 and one quarterly payment of $2,406.34, for a total amount of $9,625.45 annually. Council Member Clark moved to adopt proposed Resolution No. 2018-05 honoring fifty years of Municipal Home Rule; seconded by Council Member Ritter. Mayor Watford read proposed Resolution No. 2018-05 by title only as follows: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA; HONORING FIFTY YEARS OF MUNICIPAL HOME RULE IN THE FLORIDA CONSTITUTION AND COMMITTING TO AN EDUCATIONAL INITIATIVE TO HELP FLORIDIANS UNDERSTAND THIS BENEFICIAL RIGHT, PROVIDING FOR CONFLICT, PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE." Council Member Clark moved to appoint Mayor Watford as the primary Voting Delegate and Council Member Ritter as the alternate Voting Delegate for the 2018 Annual Florida League of Cities Conference; seconded by Council Member Chandler. There was a brief discussion on this item. _ VOTE: _ WATFORD - YEA _ CHANDLER - YEA as �CLARK - YEA RITTER - YEA MOTION CARRIED. Council Member Ritter summarized the discussion at a recent meeting regarding the potential name change of the Treasure Coast Regional League of Cities (TCRLC). Patricia Christensen, Executive Director for the TCRLC, asked the membership to discuss removing the word "Regional" from the title with their Counrils There are concerns that the name change could be misleading since Indiantown, Okeechobee, Fellsmere, and Sebastian are not actually part of the Treasure Coast designated area. G. Motion to approve maximum millage rate for advertisement for 2018 Tax notices, 8.9932 for Budget Year 2018-19 - Finance Director (Exhibit 8). H. Motion to approve 2018-19 Budget Preparation and Millage Calendar setting workshop(s) to be held August 21, 2018, at 5:00 P.M., August 28, 2018, at 5:00 P.M. (if needed), First Public Hearing September 4, 2018, at 6 00 P,M.; and Final Public Hearing September 18, 2018, at 6:00 P.M., all to be held in Council Chambers at 55 Southeast 3rd Avenue, Okeechobee, Florida - Finance Director (Exhibit 9). COUNCIL ACTION - DISCUSSION - VOTE Council Member Clark expressed the name should be left as is, and the costs associated with a name change would not be worth it. Mayor Watford and Council Member Chandler echoed Council Member Clark's remarks. The consensus of the Council is to recommend the name remain the same. Council Member Chandler moved to award Bid No. PW 03-00-06-18 to Painting and Pressure Cleaning by Big Lake, LLC, in the amount of $19,580.00 for pressure washing and painting City Hall, Fire Department, and Records Retention Building; seconded by Council Member Clark. The Bid was let on June 8, 2018, and opened on June 20, 2018. There was no Pre -Bid meeting scheduled. No other Bids were received. Public Works Director Allen explained the project and added the Bid received is slightly under budget. Council Member Clark recommended Staff research paint options/variations to the elastomeric paint and ensure there is a "fading" warranty included. Council Member Ritter moved to approve the maximum Millage Rate for advertisement for 2018 Tax Notices as 8.9932 for Budget Year 2018-19; seconded by Council Member Clark. Finance Director Riedel presented the recommendation of advertising the Millage Rate at the maximum allowed. Using the "Truth in Millage" process, the Rate is calculated by the roll-back/roll-forward Rate, plus one Mill. The current FY Millage was adopted at 7.9932, Once the tentative Millage is set, the Council retains the authority to lower it through the budget adoption process, but cannot increase it more than the Rate set and advertised. Mayor Watford explained adopting the maximum rate is the City's typical procedure and is not necessarily what is enacted, but what is used to advertise. Motion and second by Council Members Ritter and Chandler to approve a one year extension of the existing contract with Public Risk Management (PRM), Inc., Group Health Trust for the Health Insurance Policy Plan No. PPO 0727 (Blue Cross/Blue Shield). Administrator MontesDeOca explained the current plan, PPO 0727, will increase $72.15 for employee only coverage from $725.14 to $797.29 (approximate 10 percent increase), and that PRM has been able to keep the rates lower than the national trend. He added the cost of the clinic is not included and details of the existing health clinic costs will be discussed at a future meeting. Finance Director Riedel added the payouts are less than last FY and some employees are utilizing the clinic. Mayor Watford conveyed his observation on the appreciation the employees have for this benefit. VOTE: WATFORD — YEA CHANDLER — YEA CLARK — YEA RITTER — YEA MOTION CARRIED. Administrator MontesDeOca briefly explained this Memorandum of Agreement Renewal No. 1 is the renewal to the existing Maintenance Contract No. BE391, which expires August 3, 2018. The renewal term for providing service under this Agreement shall be a period of one year beginning August 4, 2018 and ending August 3, 2019. FDOT will reimburse the City three quarterly payments of $2,406.37 and one quarterly payment of $2,406.34, for a total amount of $9,625.45 annually. Same as used across the state. Ritter we do the work and they reimburse us up to the amount. MDO more like an assistance grant, FDOT has worked with us in upgrades to equipment recently. We've all seen over the last two years that there has been a huge attack on local government to be able to provide services and provide what the local citizenship prefers for the area in which they live. FLC has heavily lobbied for home rule. We all want to stay very viligent in the 2019 legislative session. We are the closest government to the people. Ritter had an interesting with Patricia Christiansen TCRLC Executive Director, we are in a good situation in Okeechobee with the staff being able to work with our citizens. The membership asked Clark — leave it just like it is, cost to change would not be worth it, we are not part of the Treasure Coast. Watford — was brought up years ago, brought up same argument as Clark, corporation and expense of changing that too. Don't have any heart burn one way or the other, think we should leave it as is. Once the tentative Millage is set, the Council retains the authority to lower it through the budget adoption process, but cannot increase it more than the Rate set and advertised. $2,188,813.00 total taxable value with CPI and without new construction per the Property Appraiser. MDO — PRM went through, nationally lower on the increase, the 10% is 2% over the average. This does not include the clinic costs, that is handled in a different agreement. We are still double digits and hopefully working toward a healthier city. IR - The payouts are less that last years. Some employees are using the clinic which is a long term fix not a short term fix. Big claims trying to minimize. MDO same plan as last year, no modifications. Same level of life insurance brought up for all employees with no increases. SECTION 4: SOLID WASTE ASSESSED COSTS AND ESTIMATED RATES. It is determined that the solid waste assessed costs to be assessed for the upcoming Fiscal Year is the estimated sum of $414,750.24 and that this cost will be apportioned among customers at an estimated assessment rate for the upcoming Fiscal Year in the annual sum of $234.72. SECTION 5: UPDATING ANNUAL ASSESSMENT ROLL. That the City Administrator is directed to prepare an updated assessment roll for the Fiscal Year ending September 30, 2019, in the manner provided for in Ordinance No. 784. The updated assessment roll shall be certified on a compatible electronic medium with that of the Tax Collector, and shall post the non -ad valorem assessment for each parcel on the roll, to be presented to the City Council for adoption at an annual rate resolution, which shall be certified to the Tax Collector before September 15 of the current year. WHEREAS, Florida's voters placed municipal Home Rule powers into the Florida Constitution on November 5, 1968, during the regular elections as an amendment to Article Vill; and WHEREAS, this power has enabled each city, town, and village across the Sunshine State to consider, adopt, revise, or remove its own laws without the need to seek legislative permission from the State and has further served as the foundation upon which every municipality builds its governmental structure; and WHEREAS, the political climate within the Florida Legislature has recently included many attacks on these powers; and WHEREAS, grassroots measures calling such actions wrong and declaring that local decisions be made at the local level by local officials must continue so that all legislators clearly understand Florida's Home Rule as a Constitutional power and one upheld in State Statutes; and WHEREAS, a 501h anniversary is a fitting time for all municipalities to engage their respective citizens to educate them about the Florida Constitution and local laws, so that all Floridians may continue to receive the many benefits of Home Rule. NOW, THEREFORE, be it resolved before the City Council for the City of Okeechobee, Florida; presented at a duly advertised public meeting; and passed by majority vote of the City Council; and properly executed by the Mayor or designee, as Chief Presiding Officer for the City: SECTION 1: That this 50th anniversary presents a tremendous opportunity to educate all citizens about Florida's Constitution, municipal government and Home Rule authority, and that all necessary resources shall be provided for such public information. SECTION 2: That the City of Okeechobee will actively challenge all efforts to reduce or erode this cherished right and further employ all efforts to ensure State and Federal government partners understand that a one -size -fits -all approach to governance is not in the interests of Florida citizens. SECTION 3: That the tradition of local decision -making in Florida is essential to protect, as it provides each municipality the ability to preserve and enhance the myriad characteristics that make each one uniquely special and that maintains its quality of life. SECTION 4: That the City of Okeechobee will include this information on its website, as a regular agenda item for public discussion and within the City of Okeechobee's services in as many outreach venues as possible.
