Mayor Kirk read proposed Ordinance No. 931 by title only as follows: "AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA; AMENDING THE OFFICIAL ZONING MAP OF OKEECHOBEE BY REZONING A CERTAIN TRACT OFLANDMORE PARTICULARLYDESCRIBED HEREIN, FROM RESIDENTIAL MULTI -FAMILY (RMF) ZONING DISTRICT TO HEAVY COMMERCIAL (CHV) ZONING DISTRICT; AMENDING THE ZONING MAP ACCORDINGLY; PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE." FEBRUARY 21, 2006 - REGULAR MEETING - PAGE 3 OF 7 477 VII. PUBLIC HEARING FOR ORDINANCE ADOPTION CONTINUED. A. 2. a) Motion to adopt proposed Ordinance No. 931. Council Member Markham moved to adopt proposed Ordinance No. 931; seconded by Council Member Chandler. b) Public comments and discussion. Mayor Kirk asked whether there were any questions or comments from the public. There were none. This Ordinance amends the Zoning designation on Lots 9 and 10 of Block 143, Okeechobee, for vacant property located in the 300 Block of Northeast2" Street from RMF to CHV. The application was submitted by property owners, E. David and Judy Hester. The Future Land Use was recently changed to Commercial, therefore both maps would be consistent, allowing for development of the property. This application was reviewed by the Planning Board on January 24, 2006. Twenty-three letters were mailed to surrounding property owners with no responses. The sign was posted on the property. All advertisements were published. The Planning Staff and Planning Board are recommending approval based on the following criteria: (1) The proposed use is not contraryto Comprehensive Plan requirements. Office uses are permitted within the Commercial Future Land Use Category as described in the Future Land Use Element of the City's Plan. (2) The proposed use is authorized under the zoning district. Specifically, Code Book Section 90-282(1) allows office uses within the CHV Zoning District. (3) The proposed use will not adversely affect the public interest. (4) The proposed use is appropriate for the Icoation, is reasonably compatible with adjacent land uses. The Future Land Use designations to the North, South, East and West are all Commercial, along with the zoning being Heavy Commercial. Existing use to the North is vacant, a therapy center and mixed residential. To the South is a beauty parlor (Executive Hair and Spa) and a bank (Inter -Bank). To the East is Elite Title Company and the West is State Farm Insurance, which is owned by the applicant as well. It is not contrary or detrimental to urbanizing land use patterns. (5) If approved, the CHV Zoning and office use will not be a deterrent to the improvement or development of adjacent properties. (6) If necessary, site plan buffering requirements can help to reduce any impacts of any nuisance or hazard to the neighborhoods. (7) The proposed use should not impact density patterns nor public facilities. The area can accommodate the proposed use. (8) The proposed use will not create any inordinate traffic congestion or flooding, nor will it impact public safety. (9) The proposed use should be able to develop within the existing City Code requirements and will not be inordinately burdened by unnecessary restrictions. (10) If granted, the proposed change will not bestow any special privileges to the owner as contrasted with the public welfare. Council Member Markham reiterated his concerns regarding parking requirements being met and reviewed carefully during site plan by the Technical Review Committee. Discussion pertaining to the Commerce Center - Travis Chambers, Adron Fence Co. B. Discussion pertaining to ground maintenance bids - City Administrator. VOTE KIRK - YEA MARKHAM - YEA WILLIAMS - YEA CHANDLER - YEA WATFORD - YEA MOTION CARRIED. MAYOR KIRK CLOSED THE PUBLIC HEARING AT 6:08 P.M. At the February 7, 2006 meeting the Council authorized the Administrator to proceed with replatting Lots 18 to 20 of the Commerce Center. The purpose of the replatting would be to do away with a roadway and cul-de-sac in order to accommodate Mr. Travis Chambers's needs to relocate to the Commerce Center. However, Administrator Whitehall discovered during a meeting with the project engineers that there is a main drainage easement that runs along with the roadway and cul-de-sac. It was also revealed that the lakes were not constructed in the parks and need to be prior to any further construction. Mr. Chamber's is meeting with his project engineers and wanted clarification as to whom he meets with for negotiation once he has project costs analysis available. Mayor Kirk advised he would negotiate with the Administrator, who would then bring the issues for the Council to approve or reject. There was no official action taken on this item. The ground (lawn) maintenance bids received were as follows: Bidding Company City Property/Parks Right -of -Ways Total Big 0 Lawn Care $10,800.00 $12,000.00 $22,800.00 Riverside Land Maintenance $17,000.00 No Bid $17,000.00 (for only 1 of 2) Charlie's Lawn Maintenance $19,200.00 $11,400.00 $30,600.00 Bass Property Management $41,925.00 $43,860.00 $85.785.00 The recommendation from the Administrator and Public Works Director would be to reject all bids, hire a part-time employee and purchase a mower, bringing the lawn maintenance back in house. Discussion ensued regarding the pro's and cons of this option. Council Member Chandler moved to award both Lawn Care Maintenance Bids (PW-02-10-01-06 and PW-03-1 0- 01 -06) to Big 0 Lawn Care (low bidder) in the amount of twenty-two thousand eight hundred dollars ($22,800.); seconded by Council Member Watford. Discussion pertaining to ground maintenance bids continued. J 1 VOTE KIRK - NO MARKHAM - NO WILLIAMS - NO CHANDLER - YEA WATFORD - YEA MOTION DENIED. Discussion continued regarding how the part-time position could be used as a training position and then be changed to a full time position. Council Member Williams suggested a current full-time employee be moved to the lawn maintenance operator and the part time employee could assist the others. Her concern was part time employees would be hard to keep, there would be a constant change over and training, and the care of the City's equipment. Council Member Markham agreed, but suggested that it would be up to the Public Works Director as to who worked where. Council Member Markham moved to hire a part time person to do the mowing, purchase the mower and work toward changing the part-time employee to a full-time employee; seconded by Council Member Watford for discussion. Following a brief discussion, motion and second were withdrawn from the floor. Council Member Markham then made a motion to hire a part-time employee for the Public Works Department, work towards changing the position to full time, purchase the mower; seconded by Council Member Williams. Council Member Markham called the question. VOTE KIRK - YEA MARKHAM - YEA WILLIAMS - NO CHANDLER - NO WATFORD - NO MOTION DENIED. Discussion pertaining to residency requirements of city employees - At the February 7, 2006 meeting, staff was instructed to bring back recommendation for the Council to consider in City Administrator. regards to changes in the residency requirements for employees. Administrator Whitehall advised that the Staff recommendation is to (1) remove the residency requirement for the entire police department and (2) expand the residency area for all other employee's to Okeechobee addresses (physical, not post office boxes). This would enable employee's to live on the reservation or some of the surrounding counties that have Okeechobee addresses. Mayor Kirk questioned the idea of a waiver and how that would factor into the plan. Although there was no official action taken to implement a waiver process, the Administrator suggested that it would be processed through him and not the Council. Council Member Watford moved to remove residency requirement for police department only and that we expand to Okeechobee addresses (as recommended by Staff); seconded by Council Member Markham. VOTE KIRK - YEA MARKHAM - YEA WILLIAMS - YEA CHANDLER - YEA WATFORD - YEA MOTION CARRIED. D. Discussion pertaining to the cost for professional liability insurance At the October 18, 2005 meeting, the City Council approved a revised legal services contract with John Cook. The in reference to the city attorney's contract for legal services - City contract was amended by deleting the professional services liability insurance being paid by the City. Council further Attorney (Exhibit 2). instructed Attorney Cook to bring back the costs for the professional insurance and they would reconsider it. Administrator Whitehall advised that Attorney Cook was at a meeting in Orlando, he had hoped to be here by now. However, he asked that I explain to you that he was able to find a $1 million policy for one hundred dollars ($100.00) per month. A policy page could be provided at the next meeting. Council Member Watford moved that we request the Attorney to purchase the professional liability insurance policy at his expense; seconded by Council Member Markham. Kirk, Mayor ATTEST: Lane Gamiotea CMC, City Clerk Each Council Member forwarded their completed evaluation on Administrator Whitehall to Mayor Kirk, who calculated an average score of 4.7 out of a 5.0. Mayor Kirk noted this was the highest evaluation he could ever remember an administrator scoring. Mr. Whitehall thanked the Council for their vote of confidence. Council Member Watford suggested that should any of the Council have specific items they want to discuss with him, that they meet individually with him to discuss them. Council agreed. The evaluations were forward to the City Clerk. They will be a matter of public record and part of his official personnel file. Again each Council Member forwarded their completed evaluation on Attorney Cook to Mayor Kirk, who calculated an average score of 3.5 out of a 5.0. Travis Chambers - seems engineers decided with drainage it would be hard to abandon the cul de sac, what part of the drainage are we going to be responsible for along with drainage around it, what do you feel about drainage through areas to get cost analysis of clearing lakes, excavation and drainage through east side of park, tied to contracts, meeting wed with project managers and engineer, analysis and numbers to present to you. Whitehall, clarify 1st lakes cannot be half constructed or half dug, in exchange for that granting fill taken out of lakes, swells on east side around cul-de-sac and berm on so of 18 and 19 up to you to handle, obligated since you do not want the cul de sac Travis proposals in contract I can't respond to until I have numbers, need to more forward with final need to get done, put together cost analysis for next meeting. Watford, appreciate you appearing, govt. works different than private enterprise, neg thru admin, switch back & forth, not open road and go into lot next door, now as I understand, what we think is the right of way will remain on the plat but we wont actually pave street or cul de sac none of those improvements, you make improvements to paving and drainage.
