sewers, streets and highways, public buildings, solid waste collection; and WHEREAS, the health, safety, and
comfort of this community greatly depends on these facilities and services; and WHEREAS, the quality and
effectiveness of these facilities, as well as their planning, design, and construction, is vitally dependent upon
the efforts and skill of public works officials; and WHEREAS, the efficiency of the qualified and dedicated
personnel who staff public works departments is materially influenced by the people's attitude and

essential to the democratic system of government, and Whereas, as a cornerstone of democracy Americans
have observed certain rules of behavior generally known as civility, and Whereas, civility, derived from the
Latin words "civitas" meaning city and "civis" meaning citizen, is behavior worthy of citizens living in a
community or in common with others; and Whereas, displays of anger, rudeness, ridicule, impatience, and
a lack of respect andpersonal attacks detract from the open exchange of ideas, prevent fair discussion of the
issues, and can discourage individuals from participation in government, and Whereas, civility can assist in
reaching consensus on diverse issues and allow formutuall y respectful ongoing relationships; and Whereas,
civility can uplift our daily life and make it more pleasant to live in an organizedsocieiy, and Whereas, the City,
County and Local Government Law Section of The Florida Bar urges the adoption of a pledge of civility by all

BLOCK GRANT PROGRAM - Mayor. III PROGRAM AT 6:10 P.M.
A.1. a) Discuss the Community Development Block Grant (CDBG) Program Nancy Phillips of Nancy Phillips and Associates, Grant Administrator, informed the Mayor, Council and those present
for the Fiscal Year 2005 Funding Cycle - Nancy Phillips, Grant that this is the first of two required public hearings for the Federal Fiscal Year 2005 Community Development Block
Administrator. Grant Program. The purpose of the hearing is to advise the citizens of the City of Okeechobee that the City is
considering applying for seven hundred thousand dollars ($700,000.00) in CDBG Economic Development funds. The
categories of activities for which these funds may be used are in the areas of housing, neighborhood revitalization,
commercial revitalization, or economic development and include such improvement activities as acquisition of real
property, loans to private -for -profit business, purchase of machinery and equipment, construction of infrastructure,
rehabilitation of houses and commercial buildings, and energy conservation.

VIII. FIRST PUBLIC HEARING FOR CDBG PROGRAM CONTINUED.
A.1. a) Discuss the Community Development Block Grant (CDBG) Program The City is eligible for the economic development grant, which is based on job creation and the City forms a
for the Fiscal Year 2005 Funding Cycle continued. partnership with a private business to create these jobs. The grant funds are awarded to the City on behalf of the
private business for a certain amount, according to the number of jobs created. Conducting this public hearing, will
facilitate the CDBG grant application process and allow the City to submit an Economic Development project in a more
timely manner. May 19, 2005 is the deadline to submit an application.
Council Member Watford mentioned that the City is looking at expanding some of the paving, water and sewer lines
at the Commerce Center and inquired whetherthis would be eligible forthe grant? Ms. Phillips answered that the grant
would cover these improvements. Ms. Phillips also stated that the second hearing will be held after the partnership
of the private business and the City is established.

b) Public comments and discussion. This Ordinance amends the zoning designation on Lots 14 through 19 of Block 32 and Lots 7 through 19 of Block 35,
City of Okeechobee, from Residential Single Family -One to Residential Multiple Family. The property is located at
Northeast 9"' Street and Northeast 31 Avenue.
Clerk Gamiotea reported by memorandum in Exhibit One, all fees have been paid. The ordinance was advertised in
the Okeechobee News on April 8. The Planning Board voted unanimously to recommend approval at the March 22nd
meeting. The Planning Staff amended their recommendation, based on information provided at the March 221
meeting, and also recommended approval. The General Services Department mailed seventeen courtesy notices
to the surrounding property owners, with no response to date. The property was posted with a sign advertising the
request of the rezoning, dates and times of both the Planning Board and City Council public hearings.
Since there were several members of the public present, Attorney Cook explained the property was located between
about the best use for this property and also stated that the environmental concerns of the wetland area will be
addressed by South Florida Water Management District.
Mayor Kirk asked whether there were any questions or comments from the public. There were none.

the Okeechobee News on April 8. The Planning Board voted unanimously to recommend approval at the March 22Id
meeting. The Planning Staff amended their recommendation, based on information provided at the March 22'
meeting, and also recommended approval. The General Services Department mailed fifty-six courtesy notices to the
surrounding property owners, with no response to date. The property was posted with a sign advertising the request
of the rezoning, dates and times of both the Planning Board and City Council public hearings.
While no one from the public has stated their objection of this rezoning at a public meeting, they have contacted
individual Council Members to state their objections.

Council Member Watford addressed the Council and those present that he sympathizes with those who do not want
this proposed change, but that it is up to the property owner how the land is used as long as it meets the criteria. He
also stated it is a reasonable request and City Staff will do their best to address the issues of drainage and traffic. He
also feels this project will be a nice addition for our City. Mr. Barry Hurtz, Executive Vice President of Finlay
Development, LLC was present and showed the public and Council pictures of the proposed project for the Multi -
Family Housing.

MAYOR KIRK CLOSED THE PUBLIC HEARING AT 6:33 P.M.
Update on negotiations for the purchase of additional Commerce Center Mayor Kirk updated the Council on the negotiations between Mr. Robert Meyers and the City, as authorized at the April
property by Robert Meyers. 5 meeting, concerning the sale of Lots 4 and 5 at the Commerce Center. The purchase price will be thirty five -
thousand dollars ($35,000) per acre. The agreement will be written with contingencies and a time frame condition so
the City can submit for a grant for the infrastructure improvements. Mayor Kirk stated without the grant it would be
cost prohibited for anyone to develop this property. Attorney Cook advised another condition will be that Mr. Meyers
will have to utilize his option on Lots 10 to 12 before he can develop Lots 4 and 5.
Council Member Watford moved to instruct the Mayor and City Attorney to enter into an option contract with
Robert Meyers. or his corporation for Lots 4 and 5 of the City Commerce Center, in the amount of thirty five
thousand dollars ($35,000 00) per acre, contingent upon the city obtaining the grants and use of his other lots
seconded by Council Member Chandler. Discussion ensued.

Maureen Burroughs, President of Okeechobee Main Street, distributed copies to Council of the Second Quarterly
Update. Items noted of accomplishment were: submitted four grants to the State of Florida and received the approval
on three of them totaling twenty-three thousand dollars ($23,000.00); Arts and Culture Committee have partnered with
the Okeechobee Community Theater to bring in two additional events for the 2005 season; purchased and placed
twenty banners in the Park Street Area; an original of the revised Banner Guideline was given to the Clerk for the
City's official record; sponsored the Third Annual Top of the Lake Barbeque Affair which produced a net profit of five
thousand dollars ($5,000.00); increased membership to thirteen businesses and two individuals; sent two members
to attend the quarterly State Main Street convention which was held in March 2005; hired Lydia Jean Williams to be
the Executive Director for OMS; established the advertisement guidelines of the banner inserts for other organizations.
in the May Bike Rally, chili cook -off in the Fall; hold Board of Director Elections in
April; attend the National Main Street Conference in May; continue with HarK Street Deauuncaaun pulCuLa JUUI1 aJ
replacing the plants already displayed on Park Street; submittal of additional grants in May for the restoration of the
old jail building since the prior grant application had been denied; work with consultants for the Local Program Area
on the Vision Plan grant funds of ten thousand dollars ($10,000.00). Also in the packet distributed was a copy of the
Budget Trial Balance Report for October 2004 through March 2005.
Council Members Watford and Markham commended Mrs. Burroughs on her presentation of the OMS activities and
update to the Council, and extended their appreciation concerning the great job they are doing for our community.

Council Member Watford advised that due to a recent conflict with a particular development and the interpretation of
the Land Development Regulations (LDR's), he questioned whether the term "project" should be defined so that it is
not misinterpreted? Specifically, the conflict involves whether or not sidewalks have to be constructed.
Mayor Kirk and Council Member Markham offered that no matter how the language is worded, someone will always
interpret it how they see fit. What matters is how the City interprets it and that we consistently enforce the LDR's. Mr.
Jeff Sumner, President of the Economic Council briefly addressed the Council, reinforcing his statements made in a
recent letter from the Economic Council to the City requesting consistency with the interpretations of the LDR's. He
noted that the letter was not due to any particular project, and that they also forwarded the same letter to the County.
Council Member Williams suggested a workshop with the Land Planning Agency (LPA) to see what areas of
interpretation they would like to revisit.
The Council agreed with Attorney Cook's suggestion that he discusses areas of the LDR's with the LPA and
report back to the Council. He also noted for the record that the area of sidewalks is enforceable, and since the
creation of the Technical Review Committee (TRC), the City Staff has done their best to be consistent with
interpretation to all developers and projects. Projects and developments completed prior to the creation of the TRC
were not consistent.
Mayor Kirk elaborated for the Council, regarding a proposal from James Slattery to purchase Lot 19 of the City
Commerce Center. Mr. Slattery's intentions are to put an office on property to the South that he owns, with his facility
offered by the Mayor was twenty five -thousand dollars ($25,000.00) per acre since there are no amenities such as
paved streets, water or sewer. Attomey Cook stated on behalf of Mr. Slattery that he is interested in being a co -
applicant for the CDBG Grant. Mr. James Slattery was present and informed the Council that he is proposing to move
his Salvage business from Stuart to Okeechobee. Mr. Slattery reassured the Council that the appearance of his
business is not like the salvage businesses seen in the area and he would be able to comply with the noise ordinance.
Council Members Watford and Markham expressed their desire to visit Mr. Slattery's Salvage Business in Stuart. The
matter will be brought back to the Council.
ITEM ADDED TO AGENDA: Temporary Street Closing for Southwest 18'h Street - Council Member Watford moved to approve a Temporary Street Closing located at Southwest 18th Street
City Clerk (Exhibit 4). between South Parrott Avenue and 2nd Avenue beginning April 20, 2005, until paving is complete or twenty
days; seconded by Council Member Markham. There was a brief discussion on this item.

Watford, problem with local project, installation of sidewalks. Back to LPA . Revise language in LDRs to make
clear. Read what it states, projects but don't define what a projec# is? No just a single commercial building.
Do we need to reword this or word this so that its, know we all received letter, think we have tightened up
the enforcement so this wont happen in the future. Do we need to work that language?
Markham, don't know if you can put a word in there, anything being bu t is a project, anything you break
ground on, you can question any of it, pick it apart, but its how we interpret those LDRs and we need to
enforce them, changing single words where and there,

37 South, Range 35 East, from Holding (H) to Residential Multiple Family 96 Unit Nlulti-Family community on 9.9 acres of land. This would allow for 10 units per acre.

Planning Staff Report Analysis: (1) The application is not consistent with the requirements of

Man Amendment to allow a Multi -Family land use category which was not recommended for

use would not have an adverse effect on the public interest, especially as it relates to the potential
increased traffic generation that would result from Multi -Family dwellings. This general area

incompatible with nearby residential land uses, future Multi -Family uses could have a detrimental
impact to the residential character of the neighborhood. Multi -Family uses with a density as high
as the one being proposed could allow heavy traffic flow and may be difficult to buffer from
adjacent and nearby residences. (5) Such permitted uses as allowed in the Residential Multiple
Family (RMF) district could affect or have the appearance of affecting property values in the
neighborhood, because of the potential density allowed by the Residential Multiple Family (RMF)
district, it is possible that Single family Residential values may be negatively impacted.

Please consider this memo an update to the original Staff Reports for these items. New
information was made available at the March 22" d LPA public hearing. Our original Staff Report
of March 16'", expressed concerns regarding public infrastructure capacity, potential traffic
impacts and compatibility. There originally was not much evidence presented with this
application that pointed to a need or capacity for this change in Futur Land Use from Single -
Family to Multi -Family. However, new information was presented at the meeting:
(1) Evidence was presented to show how ingress/egress for development at this site could be
achieved from S.W. 2" `� and S.W. 6°i Streets.
(2) Institute of Traffic Engineers (ITE) peak -hour trip -generation typical rates for Multi -
Family use were presented illustrating that while Multi-Famil dwelling units could be
twice the Single -Family units at this site, traffic impact rates for Multi -Family use are
typically 25% to 45% less in volume than Single -Family use.
(3) The proximity of the railroad track and Industrial uses to the E st were visible deterrents
for Single -Family development at this location, as well as Mul i-Family uses to the North.
(4) Confirmation was made by the applicant that sewer and water ould be provided by

Amendment to allow a Multi -Family land use category which was not recommended
