Attorney Cook requested this Ordinance be tabled until the March 1, 2005 Meeting, allowing time for further review and discuss some concerns with Planning Consultant LaRue. Council Member Watford moved to table the adoption of proposed Ordinance No. 878 until March_ 1, 2005; seconded by Council Member Markham. WILLIAMS - YEA MOTION CARRIED. MAYOR KIRK CLOSED THE PUBLIC HEARING AT 6:10 P.M. JANUARY 18, 2005 - REGULAR MEETING - PAGE 4 OF 8 173 AGENDA = COUNCIL ACTION- DISCUSSION =VOTE �I Vill. NEW BUSINESS. A. Consider preliminary plat approval of Taylor Creek Estates - Close Construction, Applicant (Exhibit 2). B. Presentation and discussion on Downtown Redevelopment Project - Nancy Phillips. Council MemberWatford moved to approve the preliminary plat of Taylor Creek Estates; seconded by Council Member Markham. Planning Consultant LaRue presented to Council the request from Chris Close, applicant, for Gary Eubanks, owner of property, to approve the preliminary plat of Taylor Creek Estates, Lots K and L of Block 252, City of Okeechobee, located between Southeast 2"d and 3' Streets and Southeast 51h and 6th Avenues, approximately 1.66 acres. The proposed use of the property is to subdivide two existing lots into six lots and build single family residences on each lot. The Technical Review Committee recommends approval of the preliminary plat/subdivision of the above - mentioned property. Mr. LaRue stated from a planning perspective this plat is consistent. The next step is to consider a final approval of the plat and there is to be no construction until final approval. Council Member Markham noted this will be a nice improvement to the area. VOTE KIRK - YEA CHANDLER - YEA MARKHAM - YEA WATFORD - YEA L. WILLIAMS - YEA MOTION CARRIED. Note: Councils' approval or conditional approval does not constitute acceptance of the final plat, rather, it shall be deemed an expression of acceptance for the layout submitted on the preliminary plat as a guide to the preparation of the final plat and approval of construction plans for required improvements and required supplementary materials. Nancy Phillips presented the proposed facade changes for Park Plaza and Display Systems. These preliminary changes were not finalized at the December 7, 2004 City Council Meeting. Ms. Phillips explained that each business must first be brought up to Americans with Disabilities Act (ADA) Codes. After the (ADA) Codes have been met, the suggested renovation for Park Plaza is to add decorative cast iron bars for the archways. The owner had already painted the building of their own accord. There were minor renovations suggested for Display Systems as the owner prefers to leave the building similar to its present style. The implementation of the (ADA) Code is to be accomplished first and then lift the concrete walkway to meet the entrance. Council Member Watford mentioned a requirement of occupancy of the building and Ms. Phillips informed them that Mrs. Conlon is still operating a business in this building. North Park Tire has agreed upon paint colors of a beige tone trimmed with navy blue. 174 JANUARY 18, 2005 - REGULAR MEETING - PAGE 5 OF 8 AGENDA COUNCIL ACTION - DISCUSSION = VOTE JI VIII. NEW BUSINESS CONTINUED. B. Presentation and discussion on Downtown Redevelopment Project continued. C. Present quarterly update of Main Street - Maureen Burroughs Council Member Watford moved to approve the concepts as presented for Park View Plaza and Display Systems; seconded by Council Member Markham. VOTE KIRK - YEA CHANDLER -YEA MARKHAM - YEA WATFORD - YEA L. WILLIAMS - YEA MOTION CARRIED. Ms. Phillips informed Council that Phase 11 of the CDBG Park Remodeling is under construction and the estimated time of completion is the end of February. Bridget Waldeau and Paul Mitchell of Okeechobee Main Street updated the Council by presenting copies of their quarterly budget report. The formation of three committees which consist of Beautification, Arts and Culture, and Design was created. They also sponsored a Luncheon Meeting for the Business and Property Owners in the local program area, increased their membership to nine businesses and four individuals, attended the Annual State Main Street Convention which was in October, they hired an Executive Director, but now they are in the process of replacing the position. They participated in the Downtown Christmas Parade in December and had their first on site meeting with Florida Main Street Coordinator January 11, 2005. A Main Street 101 training, provided by the State with Guest Speakers is scheduled for February 2 and 3. The 3`d Annual BBQ Cook Off is scheduled for February 25, and 26, 2005. The Council was approached with a request to hang banners within the program area of the City. The banners were of a picturesque design featuring a historical part of the City, and they also adorned a velcro strip where local community festivities and events could be advertised. There was some discussion pertaining to the procedure and permits and also of who would be responsible for the hanging of the banners. Mayor Kirk informed Okeechobee Main Street to set up guidelines and consider donating the banners to the City. Mr. Mitchell stated their intentions are to work closely with the Chamber of Commerce, the City's Redevelopment and Historical Society along with the Main Street Design Committee for the beautification of our City. Council MemberWatford moved to approve the concept from Okeechobee Main Street regarding banners with velcro inserts as presented to be used for the downtown area; seconded by Council Member Markham. Council Member Markham made a motion to approve one hundred dollars ($100.00) per month mailing expenditure for Okeechobee Main Street; seconded by Council Member Chandler. Following a brief discussion, Council Members Markham and Chandler withdrew their motion and second from the floor. Council Member Markham moved to approve the budget item for the 2004-2005 Fiscal Year, allowing the expenditure of up to one hundred dollars ($100.00) per month for postage to Okeechobee Main Street; seconded by Council Member Chandler. The parties agree that the CITY'S wi Iingness to enter into this Agreement, the staff approval or recommendation relative to the proposed Developemn, land use plan designations, tie passage of ordinances attempting to modify the land use designations submittals to or before the City of Okeechobee City Council or the Florida Department of Community Affairs, and any other act in furtherance of this Agreement by the CITY, including the negotiations leading up to the execution of this Agreement, will not be used by the OWNER or its successors in interest in any way whatsoever as committing the CITY legally through theory of equitable estoppels, vesting of rights, obligation of authorship, or other legal theory to the approval of such proposed Development in the event theis Agreement is terminated, does not proceed to final plat approval, or for any other reason does not take effect in all material respects. The parties further agree that any and all action by the OWNER or its representatives in negotiation of this Agreement and including all efforts in the implementation of the Agreement or submittals to other governmental bodies shall in no way be deemed to be an action in reliance that it is not possible to implement this Agreement fully, the parties' legal positions will be identical to the legal position that they would have maintained, if any, and all matters regarding the proposed Development of the PROPERTY had never been discussed between them, and the CITY held harmless by OWNER. 6. Nothwithstanding the current land use plan designations, the maximum intensity which may be built on the PROPERTY shall not be greater than six (6) residential lots; with reoadway, drainage and such improvements as designated on preliminary pat of TAYLOR CREEK ESTATES prepared by Tradewinds Professional Services, on behalf of OWNER. a. In accord with the PI subsequent phases, expansions, -3- preliminary plat, any new structures, and/or • I 0 modifications will require new site plans subject to the CITY'S ordinances and review and approval process, particularly but not limited to all roadway construction and storm water drainage requirements. b. When the public health, safe ly and welfare would be adversely affected by such Development all such matters will be addressed during the permitting process and nothing herein shall limit the legislative discretion of the CITY in the permitting process to ensure and protect the health, safety and welfare of the public. However, such limitations shall not act to reduce the maximum allowable Development provided for herein above. C. All government approvals and permit will be obtained by OWNER at OWNER'S sole cost, including if applicable, water and wastewater availability fees and connection fees from the Okeechobee Utility Authority. In the event that any Development permissions are not received, no her Development of the PROPERTY will be allowed until such time as the City Council has reviewed the Development and de rmined whether or not to modify it in a manner consistent with the public interest. Under these conditions, action and reliance on these expenditures in pursuance of its terms and of any ri t accruing the OWNER hereunder, shall not vest any Development rights in OWNER nor shall it constitute partial performance entitling OWNER to a continuation of this Agreement. 7. Maureen Bu oughs motioned to accept the treasurer's report, Pat Bain second. All were in favor, motion ca ied. Old Business Terry Burroughs updated the members on the progress for the BBQ committee. The landowner is still posing a problem regarding the removal of the cement blocks. Terry has approached the Economic Council for assistance in this matter. An alternative location was suggested to move the contest to the American Legion Hall. Further investigation will be pursued by Terry and Lydia Jean. Cindy Burnett stated 170 BBQ contestant brochures were mailed on 12-14-04. The judge's invitations (150) will be mailed the first week in January. After the h lidays, the BBQ committee will be meeting weekly. Lydia Jean updated members on the streetlamp banners. She is getting additional prices on multi- color versus dual color. Kathleen Shatto said she would like us to go for the multi -color, original logo, if the price difference is not significant. Bridgette Waldau recapped the business owners meeting held on 11-1 will be scheduled in January as a follow-up to the first meeting. Carl Watson provided a list of potential sponsors and members that the BBQ. Keith stated he would help with Martha's House and Crii Albright said he would help with D.R. Willson. AND GENERAL Fortner and the OUA Board related to the issues CAS raised at our last City Council SERVICES meeting. I have received no response. CONTINUED At an Economic Steering Committee meeting on January 11, Carl Leonard announced that the OUA had officially reached sewer caps ity limits and no further reservations would be issued. Florida Power and Light — Attorney Cook and I have a scheduled meeting next week with representatives of FPL to discuss their Fran hise Agreement, which will expire this year. We will be working together to develop a new contract, which should come before the City Council soon. PUBLIC WORKS Public Works has, for the most part, returned to their regular routine. City Employees will be involved with the gutting and rebuild of the City Barn facility as soon as a new roof is installed. CODE Attorney Cook has filed the documents related t foreclosure on the Brantley property. ENFORCEMENT He also included a nuisance abatement element to the proceedings, which should enable the City to deal with the ongoing and growing I iroblem while the foreclosure is being pursued. The Code Board has approved this ap roach. FINANCE Our audit for this past year has begun. Staff is working closely with the auditors regarding the implementation of GASB 34.
