E. Consider a request for a time extension of Final Plat Approval, A written request was made by property owners, Mr. David and Anita Nunez for an extension of the final plat approval
Applewood Estates - David and Anita Nunez (Exhibit 5). for their development. According to the Land Development Regulations, a final plat approval must be submitted within
twelve months of the preliminary plat being approved. The preliminary plat was approved February 3, 2004. The
Nunez's are requesting a six-month extension due to the hurricanes, engineers schedule, repairs to owned rental
properties damaged during the hurricanes, and resolving the South Florida Water Management drainage easement.
The Council discussed the request, noting the reasons were all justifiable to grant the time extension. Council
Member Watford moved to approve a six-month time extension for Applewood Estates; seconded by Council
Member Markham.

Attorney Cook read proposed Resolution No. 05-01 by title only as follows: "A RESOLUTION OF THE CITY COUNCIL
OF THE CITYOFOKEECHOBEE, FLORIDA, AUTHORIZING THELEASE-FINANCING OFCERTAINEQUIPMENT
THROUGH EXECUTION OF A MASTER LEASE -PURCHASE AGREEMENT WITH POPULAR LEASING U.S.A.,

There was a brief discussion on this item. This is the annual resolution between the City and Kislak Bank for the police
car leasing program.

Council Member Watford requested the matter of enforcement of the noise ordinance be discussed. Clerk Gamiotea
has verified that CSX Railroad was forwarded a copy of the City's noise ordinance, which included regulating train
horns and the restriction of them at night. He asked whether or not Staff could research what needs to be done in order
to enforce the ordinance, he has received several complaints from neighbors.
Following a lengthy discussion, Mayor Kirk instructed Administrator Veach and Attorney Cook to research the
best method of enforcing the restrictions on train horns, and report back their findings to the Council. It was
noted that the City of Vero Beach enforces their noise ordinance.
Item Added to Agenda: H. Motion to approve a request from the Sheriff Clerk Gamiotea explained in Exhibit Seven that the Sheriff s Office Law Enforcement Expo Event has grown, and they

Item added to agenda: I. Discuss a Letter of Resignation, from City
Administrator Bill L. Veach and discuss adverting guidelines - Mayor Kirk
(Exhibit 8).
Mayor Kirk requested the matter of Administrator Veach's resignation be discussed. The resignation was submitted
Friday, January 28, 2005 as an official 30-days notice. The Mayor continued his comments further by stating, under
Mr. Veach's leadership, these have been the best (five) years, we have had less worries than with any other
administrator. Council Member Watford echoed those comments by stating, "we certainly appreciate him and we have
been fortunate to have him."
Council Member Watford moved to accept a Letter of Resignation, with regret, from City Administrator Bill
L Veach effective February 28, 2005, his last day to work at City Hall will be February 25, 2005: seconded by
Council Member Markham.

Mayor Kirk then turned to Exhibit Eight which was material provided by Clerk Gamiotea regarding information that
would be needed to begin advertising the administrator's position. Following a lengthy discussion, the following was
the direction of the Council:
1. The annual salary range is set and will be advertised from $55,000.00 to $60,000.00. Whateverthe negotiated
salary is agreed upon, that will then be the new step one salary for the administrator position for the Step Pay
Plan.
2. The deadline for accepting the applications is two months.
3. The education requirement will remain the same, a suitable 4-year college degree from an accredited college
or university, with a minimum of five -years experience in city management.
4. The written questions will remain the same.

5. Clerk Gamiotea has the authority to advertise the position as she deems appropriate to get the best coverage.
6. Interim Administrator. Attorney Cook will serve as Interim Administrator effective immediately, and remain until
a new administrator begins. Attorney Cook is to turn in requests for the additional hours he works with
Administrator Veach during the month of February. This is in addition to his regular contract salary. Then
beginning March 1, 2005 and until he no longer serves as Interim Administrator, he will receive a salary of
$5,000.00 per month, or a part thereof. This is not in addition to his regular contract salary. Attorney Cook is
expected to be at City Hall 25 to 30 hours per week to perform his duties as Interim. The only responsibility
he will not perform while serving as interim is signing of any accounts payable or payroll checks.

Use Element Policy 2.2: In accordance with property rights policies adopted by the Central
Florida Regional Planning Council in the Central Florida

Comprehensive Plan, the City shall continue to ensure that its land development regulations protect
the use and value of private property from adverse impacts of incompatible land uses, activities,
and hazards. Planning for land use and public facilities in the City shall consider private property
rights, and ensure citizen input into government land use making decisions affecting property
rights. Policy 3.2: The City of Okeechobee shall amend its land development regulations, by
2002, to prevent expansion of existing land uses which are inconsistent with the Future Land Use
Element. These regulations shall be enforced to ensure that when such land uses are discontinued,
they shall not be reestablished. Objective 9: The City of Okeechobee shall continue to ensure that
proposed land use activities in the Taylor Creek area are not inconsistent with the stated goal of
the Resource Management Plan for the Lower Kissimmee River and Taylor Creek Drainage Basis,
prepared pursuant to Chapter 380, Florida Statutes.
Planning Staff Report Analysis and Conclusions: The applicant's request is inconsistent with
• the Comprehensive Plan Goals, Objectives, and Policies. As such, the location of the property and
the intended use are inconsistent with surrounding property and would create an isolated district
within the area. In this instance, it is a separate issue as to whether a nonconforming use has been
abandoned or not because of changing operators/owners. Staff recommends denial of the request
to amend the Future Land Use Map from Single Family to Commercial.
Mr. LaRue continued by explaining that he still has a concern with the change in land use from
Single Family to Commercial and is still not recommending approval due to the numerous uses
that are permitted within the Commercial Land Use Designation.
Attorney John Cook explained to the Agency that it would be difficult to recommend approval for
the Commercial request due to the location. He recommended that the Agency table the petition.

The applicant purchased these lots from the Stokes Fish Company. In researching the property's
history, staff has concluded that the previous business operated without an occupational license.
According to the applicant's letter of request for a land use change, the request is being made to
accommodate a commercial fishery and in order to receive an occupation license for the intended
use.

The surrounding land uses are Single -Family. In examining t iese uses, it appears that the
proposed land classification of Commercial would create anc. isolated land use
designation. Since there are no commercial uses surrounding the property such a request

of Okeechobee's Comprehensive Plan and would not be con idered suitable for the
property.

Public utilities would be available to the site. The roads alon NE 3rd and NE 71h are
paved and maintained by the City. A commercial use on the subject property will not
strain transportation facilities, but the impact of fish processing on the sewer system is
not known at this time.

WHEREAS, the City has received an Alley Closing Application (No. 73) from CBC
Management, Inc., Close Construction, Chris Close, Pr sident/CEO, for the closing
of two certain alleyways as described in this ordinance o utilize the entire property
for future development; and
WHEREAS, a review of such application reveals that it is in the best interest of the citizens
of the City of Okeechobee as a whole to grant said ap lication; and
WHEREAS, the granting of the application will serve a legitim to public interest and is a
proper exercise of the municipal authority of the ity of Okeechobee as a
discretionary function;
NOW, THEREFORE, be it ordained by the City Council for the City of Okeechobee,
Florida; presented at a duly advertised public meeting; and passed by majority vote
of the City Council; and properly executed by the Mayor or designee, as Chief
Presiding Officer for the City:

OKEECHOBEE, FLORIDA, AUTHORIZING THE L SE -FINANCING OF
CERTAIN EQUIPMENT THROUGH EXECUTION OF MASTER LEASE -
PURCHASE AGREEMENT WITH POPULAR LEA ING U.S.A., INC.,
PROVIDING FOR THE PAYMENT OF THE LEASE P YMENTS; MAKING
CERTAIN OTHER COVENANTS AND AGREEMENT IN CONNECTION
THEREWITH; AND PROVIDING AN EFFECTIVE DA E.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE,
FLORIDA:
Section 1: Authority for this Resolution. This Resolution is adopted pursuant to
the Constitution and laws of the State of Florida, including particularly Chapter 166, Part 11,
Florida Statutes, and other applicable provisions of law (hereinafter collectively referred to
as the "Act").
Section 2: Findings. It is hereby ascertained, found, determined and declared by
the City of Okeechobee, Florida, (the "Lessee") that:
(a) It is necessary, desirable, and in the best interest of the Lessee and its
inhabitants that the Lessee acquire the equipment described in Exhibit A
hereto (the "Equipment") and pay for such acquisition through a lease -
purchase financing structure pursuant to a Master Lease -Purchase
Agreement (the "Lease -Purchase Agreement") between the Lessee and
Popular Leasing U.S.A., Inc. (the "Lessor").
(b) The Lessee is authorized and empowered by the Act to enter into
transactions such as that contemplated by the L ase-Purchase Agreement
and to fully perform its obligations thereund in order to acquire the
Equipment.
(c) The execution and delivery of the Lease-Purchas Agreement by the Lessee
will comply with all of the provisions of the Act.
(d) The Lessee has requested proposals from financial institutions and has
determined that the terms proposed by the Bank are in the best interest of
the Lessee consistent with the request for proposals issued for this purpose.
Section 3: Authorization of Equipment. The lease -fin ancing of the Equipment is
hereby authorized, pursuant to the provisions of a Lease -Purchase Agreement which shall
contain terms consistent with the proposal of the Bank attached hereto as Exhibit B.
Section 4: Approval of Lease -Purchase Agreemi

will officially begin this new job on March 1, 2005. I am excited about this new
opportunity but will certainly miss the friends I have made in Okeechobee.
My years as City Administrator in Okeechobee have been most rewarding. I have
enjoyed working with you and the members of the City Council, both past and present
and I will miss the daily interaction with our dedicated staff. However, I leave knowing
our City is in good hands.
I take with me the pride in knowing all that we have accomplished working together. I
truly believe our City is a better place than it was five years ago. I feel I had a part in
making that a reality.

motion" for advertising the administrator position.

In the past the Council has been very specific in regards to whal publications we advertise
in. The costs of advertising have increased greatly over the Iasi few years. I would like for
the Council to consider not being as specific. I can assure you I will make every effort to
publish the advertisements to as many areas as possible, including some of the Florida
League of Cities and City/County Managers Association N sletters. Several of the
organizational/association type publications have gone to an email type newsletter. The
internet is also a new tool that we use and has been very effective by posting our ads to
various colleges and other government agency's web pages.

As Enumerated in the City of Okeechobee Code of Ordinances
It is the intent of the City Council to authorize a form of City Administration hat ensures an adequate and efficient
provision of services to the citizens of the City, that provides for coordinatec administration of City Departments to
better protect the health, welfare, safety and quality of life of the residents, c nd that places in the hands of the City
Administrator the multitude of details which must necessarily arise from the d ily operation of the City, thus enabling
the City Council to perform freely its fundamental intended purpose of set ing the broad policy mandates for the
operation of the City.
The City Administrator shall be qualified by administrative and executive experience to serve as administrator and
shall have a suitable college degree with a minimum of five (5) years experience in city management. The City
Administrator shall be responsible to the City Council for the administration of all City affairs placed in his charge.
The City Administrator shall carry out and exercise such powers and d�ties required by City Ordinance and
prescribed by the City Council. The City Administrator shall have the following general duties and responsibilities:
✓ Direct and supervise the administration of all Departments, Offices and Agencies of the City, except the City Clerk's
Office and as otherwise provided by law. The intent of this paragraph is tc explain the City Administrator is to assist
the Department Heads in the administration of their specific Departments. The specific Departments the City
Administrator acts as Department Head for are: General Services (Procurement and Management), Finance, Building
and Zoning, and Code Enforcement.
✓ Attend all City Council meetings with the right to take part in discussions but not to vote.
✓ See that all laws and acts of the Council subject to enforcement by him or by officers subject to his supervision, are
faithfully executed.
✓ Prepare and submit the annual budget, budget message and capital outlay program and supervise and administer all
phases of the budgetary process with the assistance of the Department Heads and City Clerk, who are responsible for
their Department's budget.
✓ Make such reports as the City Council may require concerning the operation of city departments, offices and agencies
and organize and oversee the operation of said departments, offices, and gencies.
✓ Negotiate leases, contracts and other agreements including consultant services for the City subject to approval of the
City Council and see that all terms and conditions of same are performed as required and notify the Council of any
noted violation.
✓ Keep the Council fully advised as to the financial conditions and fu ure needs of the City and make such
recommendations to the Council concerning the affairs and operations of t e City as he/she deems desirable.
✓ Perform such other duties as may be required by the Mayor and City Coun il.

Below is a brief summary of past and upcoming events.

Interior work will commence shortly. Thus far, $324,367.26
in damage estimates has
been submitted to FEMA for approval. Additional
costs are currently being determined
for submittal in the near future.
Industrial Park — Construction continues in the
industrial park. Streets are being
paved. CAS is voicing concerns regarding makin
budget. The early indication is that
once line item quantities are totaled, they may be z
bout $20,000 short. I've indicated to
Gene Schriner and Jay Beaton that, if this project
on is in fact a reality at the end of the
job, they would need to address it with the City Council
and they should expect that it
might not be well received.
Downtown Streetscape Project — The second p
iase of work in the downtown parks
has begun in Parks 5 and 6. Completion is planne

OUA — As you know, L.C. Fortner has responded
to the letter I sent him regarding
extra connection costs associated with pipe join
s in the Commerce Center. At this
point, there seems to be a completely different explanation
from CAS and OUA. I have
discussed this briefly with L.C. and plan to get
both sides together to see if we can
determine what has actually occurred.
At an Economic Steering Committee meeting on
anuary 11, Carl Leonard announced
that the OUA had officially reached sewer capacity
limits and no further reservations
would be issued.

Final preparations are underway related to the sale
of this year's cars and the arrival of

Planning is underway related to the constructio

tension wires) tower. At the current time, it appears
as though the tower may be placed
closer to the fire station than originally intended
in order to minimize electronic
interference with sensitive communication equipment.
If this occurs, the upper stories of the training tow
r (the tower attached to the City Hall
Garage) will be taken down and a roof will be added
to enclose the lower section. This
will then be used for much needed storage. The
training tower was badly damaged
during the hurricanes and the repairs/improvements
would seem to be no more costly
than repairing it in its current state. However,
taff feels the facility would become
much more functional and look nicer as well.
CITY ATTORNEY
GRIT — John Cook has recently unsuccessfull
attempted to initiate contact with
potential re -insurance providers. He has notified
RIT's attorney that there has been no
response from the re -insurance contact they provided.
As part of the terms of the
settlement with GRIT, they must provide us
with viable re -insurance contact
information.
The following are additional items I have asked
Attorney Cook to address.
1. Advise on Sneider lawsuit
2. Schedule Raulerson hearing
3. Assist in drafting a new FPL contract
4. Pursue legal options related to reinsurance
and GRIT
5. Annexation issue
6. Review draft of new Adelphia Contract

commencement of site -work permitting and
sidewalk, curb and guttering issues
CITY CLERK
The public service announcements are being publ
shed regarding the vacancy ofvarious
citizen boards. In addition to the OUA Board, there
are terms expiring on other boards.
These ads are being published in the Okeechobee
News, Okeechobee Times, and
broadcasted on WOKC. Citizens have responded
to these ads, and we have some
completed applications returned.

Okeechobee Main Street will host "Main Street 1 C 1 Training," February 2-
3 in Okeechobee at the South Florida Water Managemer t District Office, 2"d floor
of the Bank of America Building, 205 N. Parrott Ave (HWY 441 N).
Florida Main Street 101 Training is an excellen training opportunity to
acquaint oneself with the basics of the Main Street Four Point Approach. The
training includes sessions on each of the four points —organization, design,
economic restructuring, and promotion —presented by veteran Florida Main
Street consultants and program managers. This workshop is an ideal way for
program managers, board members, and any interested parties to learn about
the Main Street Approach and gain an understanding of how to create a
successful Main Street Program.
