WHEREAS, the City received Abandonment of Right -of -Way Petition No. 18 -001 -AC from the property owner, JMK of Okeechobee, Inc., for the closing of a certain alleyway as described in this Ordinance; and WHEREAS, the Technical Review Committee for the City of Okeechobee reviewed and discussed Petition No. 18 -001 -AC at a duly advertised public meeting held on March 15, 2018, and recommends approval with conditions; and WHEREAS, Petition No. 18 -001 -AC was reviewed and discussed by the Planning Board for the City of Okeechobee at a duly advertised Public Hearing held on April 19, 2018, determining such Petition to be consistent with the Comprehensive Plan, and recommending approval; and WHEREAS, the City Council reviewed Petition No. 18 -001 -AC and finds it to be consistent with the Comprehensive Plan, is not the sole access to any property, is in the best interest of the citizens, provides a benefit to the City of Okeechobee, and would not jeopardize the location of any utility; and WHEREAS, the granting of the Petition will serve a legitimate public interest and is a proper exercise of the municipal authority of the City of Okeechobee as a discretionary function. NOW, THEREFORE, it is ordained before the City Council for the City of Okeechobee, Florida; presented at a duly advertised public meeting; and passed by majority vote of the City Council; and properly executed by the Mayor or designee, as Chief Presiding Officer for the City: SECTION 1: The alleyway described hereafter is hereby closed, vacated, and abandoned by the City of Okeechobee, Florida to -wit: THE 15 -FOOT WIDE ALLEYWAY RUNNING NORTH TO SOUTH LOCATED BETWEEN LOTS 10 THROUGH 17 OF BLOCK 2, CITY OF OKEECHOBEE SUBDIVISION, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 5, PAGE 5, OF THE PUBLIC RECORDS FOR OKEECHOBEE COUNTY, FLORIDA. SECTION 2: The City Clerk shall cause a certified copy of the Ordinance to be recorded in the public records of Okeechobee County, Florida. SECTION 3: Conflict. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: Severability. If any provision or portion of this ordinance is declared by any court of competent jurisdiction to be void, unconstitutional, or unenforceable, then all remaining provisions and portions of this ordinance shall remain in full force and effect.
