Dobbs - archive' Cc: Marcos Montes De Oca; Patty Burnette Information needed in resubmittal of applications for 18 -001 -SSA and 18-001-R Patty Burnette Subject: Steve, A few notes about things that need to be done re: your resubmittal of 18 -001 -SSA and 18-001-R. 1. The lot that extends from 13th eastward is zoned H -Holding. Check the City's Official Zoning Map prepared by Global Mapping. You will need to change the references to RSF 1, Single -Family Zoning to Holding in both the SSA and Rezone applications. 2. If you will be using the survey of the property which states the acreage as 1.06 acres, then you must change the configuration of the subject property in all other maps to match the survey. 3. The maximum development potential of the subject property is 5 single-family units or 6 mobile home units. Whichever you choose to use, apply the associated traffic generation factor in determining the baseline traffic generation for the property. I would suggest you use single-family because the Level of Service for water, sewer, etc. is based on a single-family unit. 4. Since ITE 10th Edition is the most recent and you have that information, please use it in the calculation of peak hour traffic generation. Also, please cite the actual peak hour rate per 1,000 sf for medical offices and the rate for a single-family home. I don't have the information from the 10th Edition. 5. From the information you sent me, it seems that you are claiming that 14,000 square feet of medical office space is the maximum development potential. I understand where you are coming from and can probably support your position that this may be the realistic maximum development potential as opposed to the maximum that would result from application of the 50% building coverage maximum. But, you need to provide a clear explanation that 1 and the Planning Board will be able to understand. Walk us through it in the text of the application. 6. Similarly, if you are using the 14,000 square foot maximum development potential, use it instead of the 23,087 that still shows up in the material you sent me. 7. In the material I received the other day, the response to "C.5 Floodprone areas" is missing something after "mostly inside". Mostly inside what or where? 8. Finally, when you resubmit these two applications, resubmit them in their entirety. Do not submit replacement pages for portions of the applications. I think I've covered everything until I see the final documents. In the meantime, if you have any questions, give me a call. Have a nice weekend. 131(( Wm. F. I am providing some comments on the attached page so you can be sure to address these in your revised submission. I have also attached a copy of portions of the ITE Trip Generation, 9th Edition showing generation factors for common uses, including 720 (Medical -Dental Office Building). Please call if you have any questions or wish to discuss anything further. Ww►. F. The square footage of land area and the shape of the parcel in the survey, differs from the land area and shape shown in other parts of the Application. These discrepancies need to be corrected so that we can understand what is being proposed. however it does appear that the development of the property will involve the 1.29 acres you reference in the Application. 2. The application employs an out-of-date traffic generation factor (ITE 6th Edition) and you should be using the 9th Edition which has Code 720 (Medical -Dental Office Building) at 3.57 peak hour trips per 1,000 square feet. I have attached a copy of the 9th Edition that has the generation rates for ITE Code 720her common uses. 3. Using the 28,100 sf as the maximum size of a single -story medical office space on the 1.29 ac parcel; and applying the 3.57 ITE factor indicates 100.3 peak hour trips. Subtracting the existing potential for 7 residential trips results yields a net increase of 93 peak hour trips. This is margi- nally less than the 100 -trip threshold for a Traffic Impact Study (TIS). 4. There is also the matter that a one-story building does not necessarily represent the maximum development potential. It has long been City policy to require anticipated impacts to be based on the maximum development potential of the parcel. As we discussed, I have typically con- sidered a two-story structure as representing the maximum practical development potential for office buildings and other commercial structures. This, of course, would increase the potential peak hour traffic beyond the 100 -trip threshold and trigger the need for a TIS. You noted that you feel two stories may be unrealistic on this parcel and would provide the reasoning support- ing that position and explain why. You may also want to explain why even a small portion of the building (e.g., 2,000 square feet) on a second floor would be not be considered possible, as even this slight increase would trigger the need for a TIS. 5. CONTAINING 1.06 ACRES, MORE OR LESS. planning 1 Staff Report Rezoning Applicant's Name: William H. Mason Petition No. 18-001-R Request The matter before the Local Planning Agency and City Council is an application to rezone a 1.06 -acre vacant parcel bordering the western boundary of Taylor Creek generally from NE 14th Street to NE 13th Street, from Residential Single -Family (RSF 1) to CLT, Light Commercial. The property is also the subject of a concurrent Future Land Use Map Amendment from Single -Family Residential to Commercial. The current and proposed Future Land Use designations, zoning, existing use, and acreage of the subject property and surrounding properties are shown in the following tables and on the maps on pages 6 through 8. Current Future Land Use, Zonin • and Existin • Land Use Characteristics Future Land Use Category Zoning District Use of Property Acreage Existing Single -Family Residential RSF 1, Residential Single -Family Vacant 1.06 Acre Proposed Commercial CLT, Light Commercial Medical office building 1.06 Acre Future Land Use, Zonin • , and Existin • Uses on Surroundin • Pro • erties Future Land Use Map Classification North Zoning District Existing Land Use Commercial CHV, Heavy Commercial Vacant Future Land Use Map Classification East Zoning District Existing Land Use Taylor Creek Taylor Creek Taylor Creek Future Land Use Map Classification South Zoning District Existing Land Use Single Family Residential RSF 1, Residential Single -Family Vacant Future Land Use Map Classification West Zoning District Existing Land Use Commercial CHV, Heavy Commercial Vacant planning 2 Staff Report Rezoning Applicant's Name: William H. Mason Petition No. 18-001-R Anal sis Section 70-340 of the Land Development Regulations requires that the reviewing body find that an application for rezoning meets each of the following conditions. The Applicant has provided brief comments to each of the required findings. These are repeated below in Times Roman typeface exactly as provided by the Applicant. Staff has made no attempt to correct typos, grammar, or clarify the Applicant's comments. Staff comments are shown in this Arial typeface. 1. The proposed rezoning is not contrary to Comprehensive Plan requirements. "The proposed request in not contrary to the Comprehensive plan requirements and is currently zoned Single Family Residential." Staff Comment: The requested rezoning is consistent with the Comprehensive Plan. The request involves a zoning change to CLT which is a zoning district specifically cited in the Comprehensive Plan as appropriate for a property designated Commercial on the Future Land Use Map (FLUM). 2. The proposed use being applied for is specifically authorized under the zoning district in the Land Development Regulations." "The proposed use has yet to be determined, but the use will fall in the requested zoning classification." Staff Comment: While the application does not identify the specific use to which the property will be put, the Application of 18 -001 -SSA identified medical offices as the proposed use. Medical and other offices are permitted uses in the CLT District. 3. The proposed use will not have an adverse effect on the public interest. "The proposed land use change should have a positive impact on the public interest to develop land that has access to all utilities and roads and bring the land value up as a developed parcel instead of undeveloped. Staff Comment: We agree that the permitted uses in the CLT District are appropriate for the subject property and positively affect the public interest. While some of the allowable Special exception uses may be considered too intense for this location, any such uses would be subject to scrutiny and approval by the Board of Adjustment at a public hearing. LaKt r_ planning 3 Staff Report Rezoning Applicant's Name: William H. Mason Petition No. 18-001-R 4. The proposed use is appropriate for the location proposed, is reasonably compatible with adjacent land uses, and is not contrary or detrimental to urbanizing land use patterns. "The proposed use is appropriate for the location and compatible with the adjacent land uses." Staff Comment: We agree that medical, and other office -type uses, and other moderately intense uses permitted in the CLT District meet the above standards. In the event any of the more intense uses allowable as special exceptions should be proposed in the future, the Board of Adjustment would consider these in Tight of their effects upon Taylor Creek and the residentially designated lands immediately to the south. 5. The proposed use will not adversely affect property values or living conditions, or be a deterrent to the improvement or development of adjacent property. "The proposed use should positively impact property values, living conditions and be an improvement to the adjacent property and develop previously undeveloped land." Staff Comment: We agree that medical, other office -type uses, and most retail and other moderately intense uses will not adversely affect living conditions, property values or deter development or improvement to adjacent properties. Adjacent properties are afforded protection from the impacts of more intensive uses by the Special Exception and Site Plan Review processes. 6. The proposed use can be suitably buffered from surrounding uses, so as to reduce the impact of any nuisance or hazard to the neighborhood. "The proposed use can be suitably buffered from surrounding unlike uses to the east by Taylor Creek and the land to the east is OUA's Water Treatment Plant which should require no buffer and south by providing the City required setbacks of 20' from residential to the south." Staff Comment: A 20 -foot setback should provide an adequate buffer to the residentially designated property to the south from medical and other office uses and most other moderately intense commercial uses. Adjacent properties are afforded protection from the impacts of more intensive uses by the Special Exception and Site Plan Review processes. 7. The proposed use will not create a density pattern that would overburden public facilities such as schools, streets, and utility services. "The use will not create density patterns that would overburden any public facilities. The potential development impacts will be within the already available amenities." Staff Comment: We agree, light commercial uses on a 1.06 -acre parcel would have no impact on density and would not likely overburden public facilities, utility facilities or streets. LaRue planning 4 Staff Report Rezoning Applicant's Name: William H. Mason Petition No. 18-001-R 8. The proposed use will not create traffic congestion, flooding or drainage problems, or otherwise affect public safety. "The proposed use will not impact traffic congestion as this is currently a dead end street with abandoned prior uses and undeveloped parcels on the street with adequate access to SR 441N, which will be right in and right out as there is median on SR 441 adjacent from this street." Staff Comment: We agree that the development of the subject property alone will not likely create traffic congestion. However, with the entire balance of the lands between NE 13th and 14th Streets from US 441 east to the subject property having already been zoned to CHV, the ability of NE 13th street to accommodate peak -hour traffic from development of those properties, the subject property, and the unknown extent of development on the south side, may need to be assessed at the site plan stages of the various developments. 9. The proposed use has not been inordinately burdened by unnecessary restrictions. "The proposed use has not been inordinately burdened by unnecessary restrictions." Staff Comment: We agree. Recommendation Based on the foregoing analysis, and assuming the Application 18 -001 -SSA to change the land use designation on the FLUM to Commercial is approved, we find the requested rezoning to CLT to be consistent with the City's Comprehensive Plan, reasonably compatible with adjacent uses, and consistent with the urbanizing pattern of the area. Therefore, we recommend Approval of the Applicant's rezoning request. However, if the foregoing amendment to the FLUM (18 -001 -SSA) was not approved, the rezoning request would be inconsistent with the Comprehensive Plan and should also be denied. Submitted by: Wm. F.
