A. Consider preliminary plat approval of Applewood Estates The matter before the Council is a request to approve a preliminary plat for Applewood Estates. A subdivision to be
Subdivision - Jeff Kennedy (Exhibit 1). implemented on a 1 0-acre parcel of land located the in Southeast section of the City, North of the existing "The Oaks"
at Blue Heron Golf and County Club Phase IV -A. This property was part of the Blue Heron subdivision. However the
property was sold and the new owner wishes to create their own subdivision consisting of nine lots, one road that
dead -ends with a cul-de-sac. The Technical Review Committee discussed the project at their January 21, 2004
meeting and recommended approval. General Services has verified that all property taxes have been paid on the
property.

Mr. Tom Murphy was present to represent the project engineer, Jeff Kennedy. The property owners, David and Anita
Nunez were also present. Mr. Murphy reported that the OUA advised them today that a wastewater connection was
not available at this time, nor was a projected time that it would be available given. Therefore one main change in the
project will be the installation of septic tanks. Water can either be connected with existing OLIA waterlines or
connection to existing Blue Heron water lines.
Southeast 13' Court, the only road into the proposed subdivision was discussed. The developer understands they
must install the roadway to City specifications and at their cost. The intention is that the roadway remain a private road.
The owners and home owners association will maintain it, and could dedicate it to the City at a later day. The
alignment of the roadway is not with 13t' Street, but between existing 13"' and 141 Streets. This is keeping with what
The Oaks created to the South of this parcel. The developer's intension is to assist in reducing traffic -flow through the
area. The cul-de-sac will be installed to the appropriate standards. A Fire hydrant is to be installed at the entrance to
Southeast 13' Court.
At the Technical Review Committee meeting, sidewalks were discussed. At the time of the meeting Mr. Hill (City
Planning Consultant) was under the impression that sidewalks were a suggestion only. However, afterfurther review,
he discovered that it is a requirement. Therefore a sidewalk will be installed in the subdivision.

preliminary plat is approved, the developer will now make all necessary changes, have all their issues resolved and

Preliminary Platting for Applewood Estates has now been approved. The Council's approval does not constitute
acceptance of the final plat, rather it shall be deemed an expression of acceptance for the layout submitted on the
preliminary plat as a guide to the preparation of the final plat and approval of construction plans for required
improvements and required supplementary materials. Mr. Murphy also stated that they will not sell a lot to anyone until
all problems have been solved, and the responsibility of the ownership in the subdivision is understood.
B. Discussion related to postage for Main Street - Councilman Watford. Council Member Watford requested the Council continue their support of Okeechobee Main Street by approving use
of postage. This request was made to the Council on February 4, 2003 and the Council approved it for one year. He
apologized for not bringing it up during budget preparations. Administrator Veach reported they never exceeded their
maximum, and used approximately $400.00 for an eight month period.

Mrs. Bobbi Poole, owner of Photography by Bobbi, 213 Southeast 2n' Street, is making a request to the Council for
approval to use the adjoining property owners paved parking lot in lieu of installing the required three paved parking
spaces for her business. Visiting Nurses Association, Inc. owns the entire East half of the block, and submitted a letter
authorizing Mrs. Poole the use of their paved parking lot. Mrs. Poole will have the one required handicap parking space
at her business, using what was the carport on the structure, which is already paved. She will need to coordinate with
staff to obtain the regulations for marking/identifying the handicap space.
Council and Staff discussed how this is a unique situation. Mrs. Poole rents the converted residential home as her
photography studio and bakery. The bakery is a carry out only business and the studio is mainly by appointments. She
is located on the comer of Southeast 3r' Avenue and 2nd Street and has adequate on -street parking. She moved into
the structure and started renovations prior to applying for her occupational license. Staff has implemented steps into
the required occupations license paperwork to eliminate these types of problems. The City Code requires that she
bring the property and building up to existing code. However, once you have a business operating at a location, it is
difficult to have them go back and address every issue. The intent is to catch the owners before the move to a location.

should Mrs. Poole move from this location, any new business will have to bring the property entirely up to Code. The
Council also stated again the overriding factors are that the adjoining properties are owned by one owner, this is a
residence converted to a business, the parking requirements are very low, it is not a heavily visited type business and
has on -street parking.
Council also noted there was discussion to consider revising regulations to assist staff when working with residential
homes that are being converted to commercial -type businesses. This is some Staff still needs to address and bring
to the Council for consideration.

Mr. Brad Goodbread appeared before the Council requesting permission to allow two businesses to operate on non-
conforming use property and in non -conforming buildings. The area is 703 North ParroftAvenue, one business is Signs
of All Kinds, the other is a concrete statue manufacturer and sales. Attorney Cook advised this is again a situation
brought by businesses opening and operating prior,to completing an occupational license application and checking
whether the property is in compliance or not. The Futur� Land Use Map and Zoning Maps are conflicting. The buildings
would need to be brought up to code. Parking requirements forlhe sign business need to be met. Mr. Goodbread does
not want to rezone the property to Heavy Commercial at this time since that would not allow the concrete statue
business to stay in operation. He is requesting the Council allow him to rent to these businesses for awhile, until some
of his commercial investment could be recouped. His intentions are to demolish all the buildings on Lots 4 to 10 of
Block 58, City of Okeechobee and have a new commercial type business built. However, he contends that he cannot
do that at this time, nor can he bring the buildings up to code, due to costs involved.
Following a brief discussion, Attorney Cook suggested that Mr. Goodbread meet with him and other City Staff to come
to some lypg of resolution and research whether a conditional occupation license could be worked out. There are to
many items that need to be addressed for the Council to waive them all. Eve!yone has to bring their buildings up to
code. This will give us the oppgrtunily to work uQ some Qrovisions and time frames that can be met. Council agreed.
Administrator Veach advised that following the joint City, County and School Board workshop, each entity was to
submit a list of items they want researched on the feasibility of impact fee's. Mr. Bill Royce and Mr. Ty Hancock of the
County Planning and Development Department were present. Mr. Veach had asked them to attend the meeting to
assist with information regarding impact fee's. Mr. Joey Hoover, Director of the Economic Council was also present
and provided helpful information to the Council.
Following a lengthy discussion, Council listed the following for areas to research for impact fees: 1 - Stormwater
2 - Roadways[Transportation/Right-of-ways/Mass Transit. 3 - Fire. 4 - Police.

he knew the City and County were entering a new area on this topic. "The Economic Council is here to support you

be a sidewalk. Not required by City ordinance.
Kelly Hill, 78-36 any new subdivision will have sidewalks required. That was the only issue we (planning) saw. That
has to go to TRC. Exact procedure will be. Preliminary and then come back with final. John - recently updated those
procedures, Pre -application goes to TRC. Preliminary and Final to Council. Draft of developers agreement, document
developer will develop project according to plat. Sit down and make changes to document. Markham, how far sewer
line? Don't know. None available, no time frame or anything. Septic tank % or larger. OUA water if available, we will
use. Looking at blue heron if not available. Hope to have solved by final. Don't intend to sell anyone a lot until we have
all these problems solved, responsibility of ownership in the subdivision, Copy of ordinance.

should have thought about it dudng the budget process, they have requested it again. Used less than allotment. Never

Kirk think we should help in any ways we can, and this is a good way. Markham moved to support main street postage,
same as last year up to $100.00 for one year, remainder of this budget year; seconded by Chandler.

Bobbi Poole, request use of visiting nurses association parking lot which is next to my site and my land owner, don't
own property, renting, cant put $4000 in property I don't own, understand what you want from me, but cannot do.
Watford, not that there would not be any parking, just use the parking lot of which owns all the land. Not a request we
felt was unreasonable, but out of staff authority to approve. VNA adequate parking, it wouldn't hurt them. They have
new building, they have adequate, as far as requirements as submitted by design, adequate with other square footage
of additional building, not sure, said Veach. Bobbi, bakery is take out only, photographic is by appointment only, there's
not that many people coming to the site, don't triple book. Watford, tough one, have to consider every business, only
problem I have, when you have, which we have several in the City, if somebody converted a RES structure to
Commercial, very difficult to do. Especially when you change the uses, flip side is that its more valuable. As older
families move out, better than letting them run down, use the commercial renovations. Need regulations to take that
into account. 1 property owner, good plus, adjoining property. Reasonable request.
Parameters or guidelines? Businesses usually start operation and find out rules later. Goal of City when RSF
converted to C, come up to code as much as possible. We have our documents arranged to put land owners and
tenants on notice to let them know before you spend a lot of money, check out the regulations. In Bobbi's case, even
if you paved the parking, most of her parking would probably be off street anyway because of her layout of the building.
Bobbi - people go to the obvious, even if it was there, don't think they would use. Chandler, you have a different
situation. Cook - intent is to catch them before, Williams - cease to do business, this is null and void. If another
business comes in there, they have to start from square one. Yes. We gave the City Council authority to do this by
the LDR's. Cook - we have done it before.
Watford moved to allow Photography by Bobbi to use VNA parking to meet their re quirements; seconded by Williams.
This will come up again and again, overriding factor is owned by 1 owner, residence converted to business, very low
parking requirements, not heavily visited, has on -street parking. Vote all yea.

Veach, haven't told them to stop, wafting to see what the direction of Council. License is pending until other matter
is resolved. Markham, only have to look at lot 7, other can do business? Yes, but defer. But there's a lot to bring 7 up
to code. Are we going to put them together or separate out? Kelly, because the FLU is C can only do what is allowed
by FLU. Manufacturing would not be aflowed because of that. Lot 6 with internet companies, allowed in both. 7 out
what would happen? Shed guy there, no 6 month vacancy, he is allowed. Really don't have to worry about. If every

City Administrator. fees in certain areas. Need to know what areas you want to consider. Kirk, building or development being done, does
it have to impact that area to charge it? Nexsus of benefit.. Study that says that new development will cost this much
of an impact and this is how much its going to cost. Money spent on captial improvements. Can't pay for what you got,
personnel. Can pay for new buildings, roads, turn lanes, storm water drainage. Only what that new development
created.

the impact and therefore that would be the cost. Joey Hoover. Economic Council, supports impact fees, time coming.

can't use. Water and sewer is one of the main concerns for the city. OUA needs to be in this mix or the County needs
to have some mechanism to impose that fee. OUA has connection fee's etc that handle their capacity, other charges,
to address the same issues. Markham, but are they using the money for that? Their auditors have to be the ones to
monitor. Veach, agree with Hoover, time limit of what you can spend, areas you want to study need to be cost effective
endeavor if we under take it, Hoover, Bill Nht on that. Cost of doing plan doesn't recoup itself, have to discover.
Royce, that is addressed in the study, not going to raise enough money will be addressed. Usually you can see where
your going to need areas of growth. Watford, to Royce, the payor of the impact fee has to receive benefit of the impact
fee. Royce, yes. Commercial development benefits of impact fees. Impact fee the same for the whole county, say build
home in Bassinger? Royce some items will be county wide others no, depending on who provides the service.
Recreation example. Establish zones, don't have to be countywide, can be countywide and benefit different from one
zone to another, those prices could be different depending on zone. Most coastal communities have impact fee, so
its an excepted, every developer will fight it, its part of doing business anymore, How much it is and when do you have
to pay ft. Permit time? Problem with it them, Attomey General opinion on it. Wont' stop things, can create cash flow
problems. Developer put in subdivision, Usually paid during building permit. 1 time cost by developer, he passes it
along when he sells the property. Williams, what kind of time frame are we looking at? Veach never been involved
can't answer, just as any study. Probably 1 year. Have to review them every 2 years, keep them updated. As quick
as you can tell me. FLC what's normal? Veach, found 2-3 areas, transportation, recreation, emergency services.
Special needs city, can look at any areas. Police and Fire/EMS. EMS could be countywide and Fire specific to city.
We do have parks, that would classify with recreation. Storm water. DEP has a study. Roads/transportation, right of
ways, mass transit. Sidewalks are not usually involved. Reasonable to think police. Limited size reasonable to assume.
Rsdevelo�t is also an issue, Limit the height. Expanse is just as cumbersome as one 6-7 stories. Adding one fire

9 V4 All DEVELOPMENT AGREEMENT
THIS Agreement, made and entered into this day of 2004,
by and between David Nunez, Jr. and Anita S. Nunez, (hereinafter refereed to as
"OWNER"), and THE CITY OF OKEECHOBEE, a political subdivision of the State of
Florida (hereinafter referred to as "CITY").
RECITALS
A. OWNER is the fee simple owner of a certain tract of land located within The
City of Okeechobee consisting of approximately 10.06 acres; the said
property hereinafter being referred to as "PROPERTY" and being more
particularly described in Exhibit "A" attached hereto and made a part hereof.
OWNER is the holder of all legal and equitable ownership rights in the
PROPERTY.
B. The OWNER represents that it is the fee simple owner of the PROPERTY
and that the rights granted herein and the obligations created hereby shall
in no way be affected by the property right of any other entity at the time of
the execution of this Agreement; upon sale or assignment of the property or
development to any other person or entity; or at any time between the
execution of this Agreement and the recording of this Agreement in the
Public Records of Okeechobee County, Florida.
C. The OWNER desires to develop the PROPERTY as a subdivision consisting
of nine developed lots, with improvements, tentatively to be named
APPLEWOOD ESTATES at this time. The current land use plan is therefore
reasonable and appropriate for application to the PROPERTY upon
fulfillment of the OWNER's obligations under this Development Agreement.
It is the purpose of this Agreement to provide a mechanism to mitigate
potential adverse roadway, drainage, parking and traffic circulation impacts
created by the development of the PROPERTY and to ensure that adequate
public services may be provided to the PROPERTY and to the balance of the
residents of the CITY.
D. The OWNER agrees to construct certain roadways, parking, landscaping,
pedestrian, and transportation improvements as set forth in this Agreement,
in conjunction with development of residential lots, which improvements will
mitigate the potential adverse impacts of the proposed development.
E. This Agreement is authorized by Florida Statutes (2000), and the CITY OF
OKEECHOBEE Unified Land Development Code Ordinance No. 716, as
amended, and the provisions of those laws as they exist as of the date of this
Agreement are incorporated herein by reference and shall govern the
relationship of the parties under the terms of this Agreement. Any matters
required by existing state statute or CITY Ordinance(s) which are not a part
of this Agreement shall, nevertheless, be complied with by the parties. The
OWNER and its successors or assigns in interest shall be responsible for
every obligation set forth under the terms of this Agreement. The PROJECT
as set forth herein is consistent with the CITY OF OKEECHOBEE
Comprehensive Land Use Plan and CITY OF OKEECHOBEE Unified Land
Development Code.
NOW THEREFORE, in consideration of the mutual promises and covenants herein
made and agreed to be kept, the parties hereto agree as follows:

reference.

2. This Agreement will be valid for twenty (20) years from the date that it is
executed by all parties. This Agreement may be extended by mutual consent
of the CITY and OWNER, subject to a public hearing and participation.
Further, this Agreement may be canceled only by the mutual consent of the
parties or their successors in interest.
2. The OWNER represents that nothing herein is barred or prohibited by any
other contractual agreement to which it is a party or to which any of its
agents or representatives are a party, by any existing statute or rule, by an
existing governmental agency, by any third party, or by the rights of any
other party with a direct or contingent interest in the PROPERTY, whether
legal or equitable.
3. All development rights created hereunder will be subject to compliance with
all CITY ordinances, and including but not limited to zoning approval,
Ordinance No. 814, and site plan approvals, and platting requirements,
including ch. 86 land development regulations, each of which shall be in
compliance with all development permits and applicable regulations of CITY,
Regional, District, State and Federal Agencies. The failure of this Agreement
to address a particular permit, condition, term, or restriction shall not relieve
the OWNER of the necessity of complying with the existing law governing
said permitting requirements, conditions, terms or restrictions and any matter
or thing required to be done under existing ordinances of the CITY or
regulations of any other government agency or other entity having legal
authority over the PROPERTY. No such ordinance, law or regulation will
otherwise be amended, modified or waived unless conduct constituting such
modification, amendment or waiver is provided for herein and all necessary
procedural steps are taken relative to the granting of such modification,
amendment or waiver in accordance with terms of applicable CITY
ordinances and State Statutes. All applicable impact fees, development
review fees, building permit fees, and all other fees of any type shall be paid
in accordance with their terms and in such amounts applicable as they
become due and payable except as is otherwise specifically provided herein.
4. a. The parties agree that the CITY's willingness to enter into this
Agreement, the staff approval or recommendation relative to the
proposed development, land use plan designations, the passage of
ordinances attempting to modify the land use designations, submittals
to or before the City of Okeechobee City Council or the Florida
Department of Community Affairs, and any other act in furtherance of
this Agreement by the CITY, including the negotiations leading up to
the execution of this Agreement, will not be used by the OWNER or
its successors in interest in any way whatsoever as committing the
CITY legally through theory of equitable estoppel, vesting of rights,
obligation of authorship, or any other legal theory to the approval of
such proposed development in the event that this Agreement is
terminated or for any other reason does not take effect in all material
respects. The parties further agree that any and all action by the
OWNER or its representatives in negotiation of this Agreement and
including all efforts in the implementation of this Agreement or
submittals to other governmental bodies shall in no way be deemed
to be an action in reliance giving rise to an equitable estoppel, or a
vesting of rights, and, in the event that it is not possible to implement
this Agreement fully, the parties' legal positions will be identical to the
legal position that they would have maintained, if any, and all matters
regarding the proposed development of the PROPERTY had never
been discussed between them.

5. Notwithstanding the current land, use plan designations, the maximum
intensity which may be built on the PROPERTY shall not be greater than
nine residential lots; with roadway, drainage and such improvements as
designated on preliminary plat of Applewood Estates prepared by Kennedy,
Lynch & Assoc. Inc. on behalf of owner.
a. In accord with the Project's preliminary plat, any subsequent phases,
expansions, additions, new structures, and/or modifications will
require new site plans subject to CITY's ordinances and review and
approval process, particularly but not limited to all roadway
construction, parking and storm water drainage requirements.
b. When the public health, safety and welfare would be adversely
affected by such development all such matters will be addressed
during the permitting process and nothing herein shall limit the
legislative discretion of the CITY in the permitting process to ensure
and protect the health, safety, and welfare of the public. However,
such limitations shall not act to reduce the maximum allowable
development provided for herein above.
C. All government approvals and permits will be obtained by OWNER at
OWNER's sole cost. In the event that any development permissions
are not received, no further development of the PROPERTY will be
allowed until such time as the City Council has reviewed the
development and determined whether or not to modify it in a manner
consistent with the public interest. Under these conditions, action and
reliance on these expenditures in pursuance of its terms and of any
right accruing the OWNER hereunder, shall not vest any development
rights in OWNER nor shall it constitute partial performance entitling
OWNER to a continuation of this Agreement.
6. The OWNER shall provide to the city the following, prior to final plat
approval:
a. Proof of compliance with all provisions applicable in ch. 86 land
development regulations, including but not limited to sections 86-71
through 86-74.
b. A description of the work to be done, and the time specified therefore
by OWNER.
C. That no exceptions to requirements or standards shall be granted to
OWNER unless same are duly approved by the technical review
committee or the city council.
d. A written, separate agreement, as to any participation by CITY in the
project.
e. A written, separate agreement, if any, as to the lien imposed upon the
lands of OWNER for any work to be performed by the CITY.
Proof of compliance with all conditions precedent to the issuance of
building permits to be issued by the CITY.
9. Proper documents conveying by OWNER to CITY of all water,
wastewater, and storm lines installed within dedicated public rights -of -
way.

h. A written, separate agreement of OWNER to maintain and repair all
streets, rights of way, curbing, and drainage facilities in the
subdivision for a period of one (1) year prior to acceptance of same
by CITY.
i. Provide a certificate executed by the city administrator showing
approval of the city council that OWNER has complied with either (1)
that the development will proceed without bond, or (2) that a surety
bond has been procured guaranteeing that the work will be completed
in accord with the final plat and all conditions attached thereto.
A certified drawing from OWNERS engineer of all Landscaped areas
as may be indicated and approved on the site plan of OWNER forthis
project, and
k. Street/median landscaping, irrigation and continued maintenance;
Adequate and safe pedestrian crossings for street parking based on
a plan approved by the City Engineer;
M. Road improvements to meet CITY parking and curbing standards as
per CITY Land Development Regulations and fire safety codes.
n. Stormwater drainage facilities based upon a plan approved by the
City Engineer, which design shall provide access from public rights of
way for maintenance of such facilities.
7. The development of the PROPERTY shall be in accordance with the
preliminary plat as approved by the city council, or as thereafter amended;
shall be completed with all designated improvements and requirements of
CITY; and shall meet the requirements of all existing CITY ordinances
except as is otherwise specifically waived or modified herein. The CITY and
the OWNER shall coordinate the scheduling of construction obligations
herein with the development schedule of the OWNER so that infrastructure
improvements provided for herein will be completed in a timely fashion so as
to provide services to the proposed development in an orderly manner.
8. Any notice or request required or authorized to be given by the terms of this
Agreement or under any applicable law by either party shall be in writing,
hand -delivered, or sent by certified or registered mail, postage prepaid,
return receipt requested. Such written notice shall be addressed as follow:

Either party may, by subsequent written notice, designate a different address or
party for receiving notice.
This Agreement shall constitute a covenant running with the land for the
duration hereof and shall be binding upon the OWNER, their heirs,
successors in interest or assigns, and upon all persons deriving title by,
through or under said OWNER and upon its assigns and successors in title.
The Agreements contained herein shall benefit and limit all present and
future owners of the PROPERTY and the CITY for the term hereof.

2. This Agreement constitutes the entire Agreement and understanding
between the parties and no modification hereof shall be made except by
written Agreement executed with the same formality of this Agreement. The
parties acknowledge that there are no outstanding agreements of any kind
between the parties other than as reflected herein. Except as is otherwise
specifically provided herein the PROPERTY shall be subject to the laws,
9011 ordinances and regulations of The City of Okeechobee, Florida, as they exist
as of the date of this Agreement.
3. Any reference in this Agreement to the OWNER contemplates the
undersigned or its successors in interest. Assignment of any rights or interest
or obligations under this Agreement shall not relieve the OWNER from
responsibility to perform all obligations of the OWNER hereunder except
upon a release being executed by the parties hereto and recorded in the
Public Records of Okeechobee County Florida, upon such terms that are
mutually satisfactory to the parties.

Visiting Nurse Association, Inc. owns the property. The property has been rezoned; therefore the
building must be brought up to code. All departments have metwith Ms. Poole explaining what is
required- 'Me only major item in question is the parking requirement. According to the size of the
building there should be 3 parking spaces (1 of those being handicapped). The existing back porch
could be utilized as the handicap space. She has a letter from the property owner (Visiting Nurse
Association, Inc.) agreeing for the additional parking spaces to be used from their parking lot behind
their existing facility which is directly to the north of Ms. Poole's business.

George Goodbread owns all the property surrounding this business. There has never been an
occupational license issued at this location. However, we have the adjoining property to the north and

they would like to use the existing parking at the Internet business to the north. This business
location has not been vacant for more than 6 months and has not had a change of use that would
require any upgrades as required in the IDWs.
Wooley Sheds was located on the property to the south; however, this business has been out for
approximately 5 months. Another business that manufactures and sells concrete statutes has moved
in this location and has applied for a license. There is issue with the zoning and the FLUM. If the
zoning is changed — they must bring everything up to code. Once again, we have requirements that are
required by the LDR's such as parking, building and fire codes.

Visiting Nurse Association, Inc. owns the property. The property has been rezoned; therefore the
building must be brought up to code. All departments have met with Ms. Poole explaining what is
required. The only major item in question is the parking requirement According to the size of the
building there should be 3 parking spaces (1 of those being handicapped). The existing back porch
could be utilized as the handicap space. She has a letter from the property owner (Visiting Nurse
Association, Inc.) agreeing for the additional parking spaces to be used from their parking lot behind
their existing facility which is directly to the north of Ms. Poole's business.

George Goodbread owns all the property surrounding this business. There has never been an
occupational license issued at this location. However, we have the adjoining property to the north and
south that have been licensed for various businesses. There is a parking issue with the Sign business;
they would like to use the existing parking at the Internet business to the north. This business
location has not been vacant for more than 6 months and has not had a change of use that would
require any upgrades as required in the LDWs.
Wooley Sheds was located on the property to the south; however, this business has been out for
approximately 5 months. Another business that manufactures and sells concrete statutes has moved
in this location and has applied for a license. There is issue with the zoning and the FLUM. If the
zoning is changed — they must bring everything up to code. Once again, we have requirements that are
required by the LDR's such as parking, building and fire codes.

MEMORANDUM
TO: Mayor and City Council DATE: January 29, 2004
SUBJECT: Status Report

Below is a brief summary of past and upcoming events.
ADMINISTRATION GRIT — NO CHANGE IN STATUS - We are still awaiting the promised proposed
AND GENERAL settlement from the GRIT attorneys. Attorney Robbins has officially requested the
SERVICES proposal twice. When we receive it, our attorneys (Cook and Robbins) win review it
and John will bring the proposal (or a refined version) to the City Council for approval.
Industrial Park — The City has withdrawn our original (Sheffield related) EDTF
$1.125 million Economic Development Transportation Fund (EDTF) grant and
submitted a new proposal (Federal Cast Stone, Inc. related — Robert Meyer's new
company). The submittal is being distributed to the approximately 30 reviewing
agencies and we hope to receive word within the next 30 to 60 days. We have also
officially requested a three-month construction timeline extension form EDA. Asa
Williams, EDA's Atlanta based administrator, indicates he will approve the request at
the time we sign a notice to proceed for construction. This seems to be a reasonable
approach that would offer assurances to EDA that the project is truly moving forward.
I spoke with County officials this week and they indicate the $300,000 they have
budgeted to assist with the bridge, etc. is still in place and as soon as we sign
construction agreements, we can request payment.
CAS submitted the proposed site plan to the Technical Review Committee on January
2 1. They will submit a preliminary plat to the City Council on February 17 and request
final approval on March 2. John Cook has several issues to address in the preparation
of the plat submittal but feels he can meet this tirneline, as well.
Right -of -Way Acquisition and Annexation — We received written confirmation from
Mr. Mason's attorney that the proposed agreement has been accepted and Attorney
Cook indicates a judge has authorized payment. This morning I signed the check to the
County Clerk, so it would appear this transaction is final.
ADMINISTRATION Property Acquisition Request — On January 15, Attorney Cook and I met with
AND GENERAL Dennis Murphy to discuss the possibility of his purchasing property (at the old water
SERVICES plant site on Taylor Creek) from the City. As previously reported, our records indicate
CONTINUED this same question arose several years ago. John Cook has requested clarification from
the Corps of Engineers as to requirements involving their right-of-way. Ultimately, this
matter may come before the City Council. Until then, I will keep you updated.
Licensing Issues — In accordance with Chapter 50 of our Code of Ordinances and at
the request of staff and the City Attorney, I have sent letters to three local businesses
(Signs of All Kinds, Sod Services, Inc., and Photography By Bobbi & Bakery) revoking
their right to do business. In each case, -we have indicated to the business owners (and
the property owners) actions that will remedy their situation. As always, staff has
worked for many weeks to try to resolve the matter.
As per the procedures outlined by ordinance, these companies may request a hearing in
front of the City Council. Signs of All Kinds and Photography By Bobbi have made
such a request and will come before the City Council on February 3. I'll send you
details of each case with your agenda packets and notes.
Impact Fees — Following our workshop on impact fees, I am trying to quickly get up
to speed on the subject. I will include this as a discussion item for our February 3
meeting, in order that I can participate, as directed, with the County and School Board
staffs in creating an RFP for a consultant.
PUBLIC WORKS Oscar Bermudez is working with Katrina in General Services to finalize bid documents
for this year's proposed street projects. Oscar is also preparing the engineered
drawings for the work to be done with regard to Downtown Redevelopment (parks,
storefronts and sidewalks) and staff will be preparing bid documents related to this
project within the next few weeks.
Donnie Robertson continues preparation for the niodifications to the 0 Street boat
ramp.
CODE It is my understanding that Code Enforcement staff, working in conjunction with the
ENFORCEMENT City Attorney, is preparing a comprehensive citation related to Mr. Brantley and his
multiple, repeat inftactions. I'm told this will be served within the next few days.

DEPARTMEINT
SYNOPSIS
FINANCE
Staff is working with the auditors in finalizing this year's audit. The only missing
component is the financial reports related to pensions, which must be provided by
OUA.
POLICE
The police department anticipates the delivery of this year's new cars within the next
DEPARTMENT
two weeks. They are exploring the possibility ofmodifying next year's fleet request to
include a limited number of SUV's.
The department personnel are experimenting with 12-hour shifts. It is hoped this will
lessen the stresses of revolving 8-hour shifts. Early indications are the change is being
well received.
FIRE
Chief Torney is finalizing details that will permit the installation of a new repeater
DEPARTMENT
system for the department's radios. This should enhance communication capabilities
and improve safety for our on scene firefighters.
Chief Torney has raised the issue of possible future increases in the City's ISO rating.
He feels very strongly that the City's ISO rating will be increased significantly (to
possible maximum levels) when the new Court House becomes operational, if the City
does not acquire a ladder truck This will likely be a discussion for a future City
Council meeting.
CITY ATTORNEY
The following are included in the items I have asked Attorney Cook to address.
1 . Recommendations related to reversionary action in alley closings, etc.
2. Hamrick Trust — John is in discussion with the County Attorney on this matter.
3. Research annexation issues.
4. GRIT issues.
5. LDR issues, such as conversion of former residential structures to commercial,
non -conforming structures, building site elevations, visibility triangles, drainage,
sidewalk requirements and street cut/right-of-way resolution.
6. Marvin Brantley's continuing situation.
7. Advise police on matters related to IRCC Crime Lab Contract and
skateboarding.
