Pledge of Allegiance was led by Chairperson Gamiotea. A. Disposition of Cases presented by Code Officer Sterling: This being a quasi-judicial proceeding, an oath was administered to those offering testimony, all responded affirmatively. Officer Sterling advised all events occurred within the corporate limits of the City of Okeechobee. The Officer's notes, testimony, photographs, and supporting documents were all entered as part of the official record. Case No. 15-013 Officer Sterling testified notice of violation/notice of hearing sent by certified mail was returned therefore notice was posted at Anthony Bertram. 1105 SW 71h Avenue the property owner's address. Officer Sterling gave some background information on this case stating it had been before the Ch 30 Sec 30-43 Public nuisance board three times since August of 2015 and each time Mr. Bertram was given an extension to remove all commercial vehicles Ch 54 Sec 54-51 Parking in residential neighborhoods and remove storage containers from property. Officer Sterling stated at this time all commercial vehicles have been removed, but the storage containers are still there. Mr. Anthony Bertram addressed the board stating he had purchased another piece of property and is working to get it cleared so that he can store his equipment at the new location and remove storage containers from 1105 SW 7`h Avenue. Chair Gamiotea asked Mr. Bertram what he thought was a reasonable time to have the containers moved. Mr. Bertram stated he would need two months. Chair Gamiotea suggested the board consider the upcoming hurricane season, since the storage containers would need to be removed before the active part of hurricane season. He also reminded the board Mr, Bertram has always worked with the Code Officer and made an effort to comply. Member Close moved to find Case No. 15-013, Anthony Bertram, 1105 SW 7' Avenue, in violation of Ch 30 Sec 30-43 Public nuisance and Ch 54 Sec 54-51 Parking in residential neighborhoods, based on the testimony of Code Officer Sterling, allowing until July 10, 2018 to have the property in compliance, if not in compliance by that date a fine of fifteen dollars per day would be imposed beginning July 10, 2018; seconded by Member Conrad. VOTE GAMIOTEA - YES CLOSE - YES BERNST - ABSENT CONRAD-YES DENISUK - YES PIPPIN - YES SANDERS - YES WILT - YES MOTION CARRIED Case No. 16-015 Officer Sterling testified this property was under a twenty-five dollar per day fine from June 3, 2016 until April 19, 2018 for a Leon & Tisha Edouard. 903 SE 8`n Avenue total amount of $17,125.00 for failure to get a permit for a shed and disabled vehicles. Mr. Sterling stated the disabled vehicles Request for release or reduction of lien were removed a few weeks ago but the permit for the shed was not issued until April 19, 2018. Leon & Tisha Edouard were present along with their attorney Jim Cox. Attorney Cox spoke on behalf of his client requesting a continuance to have time to present google earth photographs establishing exactly when the disabled vehicles were removed to show his client was making an attempt to bring the property into compliance. Attorney Cox also stated the notices sent to Mr. Edouard were all returned and he never saw the notices that were posted on the property. Chair Gamiotea informed Attorney Cox by posting notice on the property and at City Hall the legal requirements for proper notification had been satisfied. Mr. Edouard stated he was completely unaware a fine was running and as soon as he found out he came in the very next day to get a permit. MAY 8, 2018 -CEB REGULAR MEETING - PAGE 3 OF 5 AGENDA III BOARD ACTION - DISCUSSION - VOTE Case No. 16-015 He added, he did receive a notice which was hand delivered by Officer Sterling to him at his residence in Blue Heron.He said Leon & Tisha Edouard. 903 SE 81h Avenue he took care of everything Officer Sterling made him aware of except for the shed permit which he was unable to get until a Request for release or reduction of lien (cont'd from page 2) survey was done. Officer Sterling said the reason the fine had continued to accrue was because he never got the permit for the shed. Officer Sterling stated the application for a permit was picked up on May 31, 2016 but never returned until April 13, 2018. City Attorney Cook reminded the board that a request for continuance was made by Attorney Cox in order to supply the board with aerial photos. Attorney Cook said if the board feels this information is needed to make their decision then he recommended granting a continuance. Attorney Cox addressed the board stating he would like the opportunity to demonstrate to the board the Edouard's were attempting to get the property into compliance, but were unaware of the time limits or that a fine was imposed. Member Conrad moved to postpone Case 16-015, Leon & Tisha Edouard, 903 SE 8th Avenue, until the next regularly scheduled meeting, based on the testimony of Code Officer Sterling that the property is in compliance at this time, seconded by Member Wilt. He added, he spoke to the owner who lives out of Ch 30 Sec 30-43 Public nuisance state and plans to come to Okeechobee this week to hire a lawn maintenance company to clean the property. Ch 30 Sec 30-44 General cleaning & beautification Member Close moved to find Case 18-008, Thomas Corcoran, 302 NE 7m Street, in violation of Ch 30 Sec 30-43 Public nuisance and Sec 30-44 General cleaning & beautification, based on the testimony of Code Officer Sterling, allowing fifteen days after receipt of proper notification to bring the property into compliance if not in compliance by that date a fine of fifteen dollars per day would be imposed; seconded by Member Conrad. Case No 18-013 Code Officer Sterling testified notice of violation/notice of hearing was sent via certified mail and received by property owner. MTGLQ Investors LP. 1609 SW 7`h Avenue Officer Sterling said this particular property is scheduled to be auctioned at the courthouse on May 23, 2018. The staff is Ch 30 Sec 30-43 Public nuisance suggesting this be postponed until after the sale of the property, so the new owner can be notified of the violation. Chair Ch 30 Sec 30-44 General cleaning & beautification Gamiotea voiced some concerns of the property not getting cleaned up until possibly August or September if we wait until after the property is sold to take action. Attorney Cook advised the board they could go ahead and impose a fine on the current owner and the lien would transfer to the new owner. Chair Gamiotea stated he was in no way trying to punish the new owner, he is just trying to get the property cleaned up without dragging it out over a long period of time. Member Sanders moved to find Case 18-013, MTGLQ Investors LP,1609 SW 71h Avenue, in violation of Ch 30 Sec 30-43 Public Nuisance and Sec 30-44 General cleaning & beautification, based on the testimony of Code Officer Sterling, imposing a fine of fifteen dollars ($15.00) per day five (5) days after receipt of proper notification; seconded by Member Close. VOTE GAMIOTEA - YES CLOSE - YES BERNST - ABSENT CONRAD- YES DENISUK - YES PIPPIN - YES SANDERS - YES WILT - YES MOTION CARRIED. Before Chair Gamiotea adjourned the meeting there was a brief discussion among the board about whether or not some parameters could be set when deciding how much to reduce a lien, so people don't have a preconceived idea when they make a request their liens would be automatically released. Chair Gamiotea reminded the board that we have to look at each case on a case by case basis. He added, it would not be feasible to have a set amount across the board because every case is different. He concluded by encouraging the board to voice any concerns they might have even if everyone doesn't agree.
