VI. PUBLIC HEARING ITEMS.
A. Disposition of Cases presented by Code Officer Sterling: This being a quasi-judicial proceeding, an oath was administered to those offering testimony, all responded affirmatively. Officer
Sterling advised all events occurred within the corporate limits of the City of Okeechobee. The Officer's notes, testimony,
photographs, and supporting documents were all entered as part of the official record.
Case No. 17-015 Officer Sterling stated this case had originally come before the board in August of 2017 for a structure that needed to be secured
Billy & Jerri Lynn Hill. 1005 NW 81h Avenue to keep people out . Officer Sterling said the property was mowed but the windows/doors were never boarded up. Therefore
Request for reduction or release of lien. ($1,860) a fine of $15.00 per day began on November 4, 2017 and accrued until March 8, 2018 when the property owner secured the
building. Property owner, William (Billy) Hill addressed the board, stating he had been mowing the property and did not realize
the building needed to be boarded up until the fine had already begun to accrue. He added he has a buyer for the property who
plans to demolish the building so there should no longer be a problem. Mr. Hill requested the Code Board release the lien so
the property could be sold.
Member Close moved Case No.17-015, Billy & Jerri Lynn Hill,1005 NW 8`h Avenue, be given a reduction of the lien from
$1,860 to $50.00 to cover administrative costs, based on the testimonies of Code Officer Sterling and Property Owner
Billy Hill; seconded by Member Denisuk.

Case No.17-038 Officer Sterling testified notice of violation/notice of hearing was sent via certified mail and in addition the property was posted.
Kemp Properties of Okeechobee. 909 S Parrott Avenue He stated the property was in violation on December 6, 2017 until it was brought into compliance on March 12, 2018.
Ch 30 Sec 30-43 Public nuisance Therefore, he recommended the property be found in violation for this time period, so if there is a problem in the future they

Member Close moved to find Case 17-038, Kemp Properties of Okeechobee, 909 S Parrott Avenue, in violation of Ch
30 Sec 30-43 Public nuisance and Sec 30-44 General cleaning & beautification from December 6, 2017 until March 12,
2018, and is now in compliance based on the testimony of Code Officer Sterling; seconded by Member Bernst.

Case No. 18-006 Officer Sterling testified notice of violation/notice of hearing was hand delivered to property address and received. He stated
Omar Zaben Nafal. 1002 NW Park Street property owner was given permits to put a food trailer in front of the building on the west end to be used for cooking. However,
Ch 54 Sec 54-41 Blocking or obstructing the owner has moved the food trailer to the east end of the building without applying for permits from the City building
department. The Building Official, Jeff Newell, said the trailer must be moved back to the original location or else completely
removed from the property. At this time, the trailer has not been moved back to the original location. The trailer is still parked
in an unpermitted area on the east side of the building.
Member Denisuk moved to find Case 18-006, Omar Zaben Nafal,1002 NW Park Street, in violation of Ch 54 Sec 54:41
Blocking or obstructing, based on the testimony of Code Officer Sterling, imposing a fifty dollar per day fine beginning
seven days after receipt of proper notification; seconded by Member Close.
