PROCLAMATIONS AND PRESENTATIONS - Mayor Chief Peterson and Major Hagan introduced School Resource Officer (SRO) Kelly Margerum to the Council as she was not able to attend the last meeting due to health reasons. Swearing in of Police Officer Jason Gavern. D. Swearing in of Police Officer Jessica Francis. C. Proclaim the week of May 6 through 12, 2018 as "Municipal Clerks Week." COUNCIL ACTION - DISCUSSION -VOTE Chief Peterson then announced the Department will be utilizing an existing squad car as a Traffic Unit. This Unit was created due to the large number of complaints the Department has received regarding traffic. The Unit will patrol Monday thru Friday during business hours and Officer Holroyd, who was in attendance, graciously volunteered for this position. Chief Peterson then administered the Oath of Office to Mr. Jason Gavern. With his right hand raised, he recited the following Oath: "1, Jason Gavern, do solemnly swear or affirm that I will support, protect, and defend the constitution of the United States and of Florida and that I will bear the faith, loyalty, and allegiance to the same. I will protect and defend against all enemies, foreign and domestic. I will faithfully perform all duties of Police Officer for the City of Okeechobee." Officer Gavern was accompanied by his family and friend, Analisa. He was pinned with his badge by his parents, Louis and Donna Gavern. Officer Gavern will begin as a Full -Time Officer tomorrow. Proclaim the month of May 2018 as "Building Safety Month." COUNCIL ACTION - DISCUSSION -VOTE Mayor Watford proclaimed the week of May 21 through 27, 2018, as National Public Works Week. Mayor Watford presented the proclamation to the employees of the Public Works Department and read the document into the record as follows: "Whereas, public works professionals focus on infrastructure, facilities and services that are of vital importance to sustainable and resilient communities and to the public health, high quality of life and well-being of the citizens of the City of Okeechobee; and Whereas, these infrastructure, facilities and services could not be provided without the dedicated efforts of public works professionals, who are engineers, managers and employees from state and local governments and the private sector, who are responsible for rebuilding, improving and protecting our nation's transportation, water supply, water treatment and solid waste systems, public buildings, and other structures and facilities essential for our citizens; and Whereas, it is in the public interest for the citizens, civic leaders and children in the City of Okeechobee to gain knowledge of and to maintain a progressive interest and understanding of the importance of public works and public works programs in their respective communities; and Whereas, the American Public Works Association has celebrated the annual National Public Works Week since 1960; and Whereas, this year's theme is `The Power of Public Works' as we celebrate the hard work and dedication of the many public works professionals throughout the world. PUBLIC HEARING CONTINUED A.2.b) Public comments and discussion. c) Vote on motion CLOSE PUBLIC HEARING - Mayor The Planning Board reviewed Petition No. 18-002-R on March 15, 2018, and found it to be consistent with the Comprehensive Plan based on the findings within the Planning Staff Report and unanimously recommended approval. Planning Staff's findings are as follows: The Petition does not identify the specific use to which the property will be used. Discussion with the Applicant indicates that it will be part of Gilbert Outdoors, or used as a real estate office. Both of these uses specifically qualify as an allowable use in the CHV Zoning District. The proposed use will not have an adverse effect on the public interest; is the most appropriate for the subject property, and the proposed change will be compatible with contiguous uses. The property to the immediate West is vacant, owned by the Applicant with a Commercial Future Land Use (FLU) and Zoned CHV. The property to the North is O'Reilly's Auto Parts, with a Commercial FLU and a Zoning of Central Business District. To the East is an office with a Commercial FLU and a Zoning of Commercial Professional Office; to the Northeast and Southeast are single-family homes, with Single -Family Residential FLU and RMF Zoning; to the South is Gilbert Outdoors with a Commercial FLU and CHV Zoning. The proposed use would not be expected to adversely affect property values or living conditions on adjacent or nearby properties. There is no need for buffering. The two single-family uses to the Northeast and Southeast across Southeast 2nd Avenue from the subject property have limited exposure to the subject property and development of the subject property would not be expected to have any significant impact on these properties. The proposed use will not create a density pattern that would overburden public facilities, create traffic congestion, or create an inappropriate density pattern in the area. Should new construction be involved, it would be required to provide drainage for any increase in potential storm water runoff. The proposed use has not been inordinately burdened by any unnecessary restrictions. Clerk Gamiotea noted there were 16 notices mailed to surrounding property owners, two signs were posted on the property, and it was published in the newspaper as required. The City has not received any correspondences or phone calls on the proposed Rezoning. Mr. Dallon Boyd was present on behalf of the property owner. Mayor Watford asked whether there were any questions or comments from the public; there was none. Mayor Watford noted for the record he has a conflict of interest and will be abstaining from voting on this matter as the company by which he is employed is owned by the Applicant. NEW BUSINESS MAY 1, 2018 - REGULAR MEETING - PAGE 6 OF 8 AGENDA II COUNCIL ACTION - DISCUSSION - VOTE A. Motion to amend a previously approved purchase order to include costs in the amount of $2,066.32 for additional repairs to Fire Engine 7 - Chief Smith (Exhibit 2). B. Motion to approve a budget amendment to re -allocate expenditures to the Law Enforcement Fund - City Administrator (Exhibit 3). Council Member O'Connor moved to amend a previously approved Purchase Order [No. 4488 issued to Ten-8 Fire Equipment] to include costs in the amount of $2,066.32 for additional repairs to Fire Engine 7; seconded by Council Member Clark. At the March 6, 2018 Meeting, the Council approved a sole -source expenditure in the amount of $16,457.08 for parts and repairs to Engine 7. During the repair process, it was found that unforeseen repairs above the scope of services were required. The final repair cost to Engine 7 will now be $18,523.40. Motion by Council Member O'Connor to approve a budget amendment [as presented in Exhibit 3] to re -allocate expenditures to the Law Enforcement Fund; seconded by Council Member Ritter. At the April 17, 2018, meeting, a Budget Amendment was approved to increase the Law Enforcement Capital Line Item by $72,000.00 in the Capital Improvement Projects Fund (from Reserves). This was to purchase the necessary equipment for the two new School Resource Officers. However, upon research by Finance Director Riedel, it was realized that some of the equipment could be purchased from the Law Enforcement Special Fund. Based on this research and Chief Peterson's authorization, the recommendation is to amend the Capital Improvement Projects Fund again, decreasing the amount by $8,400.00 for Law Enforcement Capital expenditures, and re -allocate that amount to the Law Enforcement Special Fund. (Exhibit 5). 1 COUNCIL ACTION - DISCUSSION -VOTE Council Member O'Connor moved to approve the purchase of four [SLERS] radios in the amount of $17,671.40 [$8,302.60 for two Harris XG-75p hand held portables, and $9,386.80 for two Harris XG-75m mobiles], for the School Resource Officers and vehicles [through State Contract No. 725-001-01-11; seconded by Council Member Ritter. As required, Chief Peterson's letter requesting the expenditure of $8,302.06 from the Law Enforcement Special Fund, to cover a portion of this expense and that the purchase complies with Florida Statute 932.7055, was provided in Exhibit 4. Council Member O'Connor moved to ratify the re -appointments of Mr. Willie Hall as the Fifth Trustee and Ms. Jackie Dunham as an Elected Fund Trustee to the General Employees' Pension Fund, terms ending December 31, 2021; seconded by Council Member Clark. The General Trustees re -appointed Mr. Hall at their last meeting and Ms. Dunham was re-elected in January by the General Employees Membership. City Clerk Gamiotea provided a brief history on the adoption and amendments to the residency requirement in the Personnel Policies and Procedures Handbook. Prior to the adoption of the revised Handbook on October 15, 1996, there was not a residency requirement. On August 17, 1999, the policy was amended to add the Buckhead Ridge area and other counties with Okeechobee addresses to meet the residency requirement. On March 21, 2000, an amendment was approved to reduce a Department Heads evaluation time from six to three months with an additional three months to relocate. The most recent amendment was February 21, 2006, which waived the residency requirement for the entire Police Department. Administrator MontesDeOca and Fire Chief Smith added after researching this issue, they discovered surrounding counties no longer have a residency requirements. After discussing the policy with each Department Head, the recommendation was to ask the Council to remove the residency requirement for all employees, excluding Department Heads. Wa or , Jr., Mayor i Lane amiotea, C, City Clerk COUNCIL ACTION - DISCUSSION - VOTE Council Member Clark made a motion to remove "Except for Department Heads, and Police Department Employees, residents of Okeechobee County, Buckhead Ridge area of Glades County, or any areas lying outside the Okeechobee County line, but have Okeechobee addresses (physical, not post office boxes), by the end of the six (6) month probation period," from Qualifications Item 3 of Chapter 2 Hiring Process in the Personnel Policies and Procedures Handbook; seconded by Council Member Ritter. VOTE: WATFORD — YEA CHANDLER — YEA CLARK — YEA O'CONNOR — YEA RITTER — YEA MOTION CARRIED. On February 21, 2017, the Council instructed Attorney Cook to have a title search performed on the Primitive Baptist Church property located at 1003 Southwest 3rd Avenue (LEGAL DESCRIPTION: Lots 9, 10, 11, and 12 of Block 8, SOUTH OKEECHOBEE, Plat Book 1, Page 12). Attorney Cook provided an update explaining that due to the property no longer being utilized as a church, it was put on the tax roll and a tax certificate was purchased on June 1, 2017, for $1,997.81. The certificate holder cannot file a quiet title lawsuit until June 1, 2019. Attorney Cook suggested locating a survivor of the Raulerson Trust, purchase the property for a nominal fee, and pay off the tax certificate to gain access to the title. He also provided other lengthy and costly avenues to take. Ms. Magi Cable of the Okeechobee Historical Society stated she has a list compiled of Raulerson Family heirs, as well as the majority of their addresses, and that she would provide it to Attorney Cook. After further discussion, the consensus of the Council was to have Attorney Cook provide them with an update at the July meeting. Administrator MontesDeOca and Public Works Director Allen were instructed to gain access to the structures and evaluate their condition. Council Member Ritter explained that the Healthy Start Board is having trouble with member attendance and requested alternates. Council Member Clark volunteered to cover the remainder of 2018 as the Alternate. This Board appointment will be added to the Board Liaisons list, slated to be addressed in January, 2019. Mayor Watford asked whether there were any objections to appointing Council Member Clark. There were none. Clerk Gamiotea will send the appropriate notice advising of the appointment. There being no further discussion, nor items on the agenda, Mayor Watford adjourned the meeting at 7.15 P.M. The next regular scheduled meeting is May 15, 2018. Mayor Watford yielded the Planning Board reviewed Petition No. 18-002-R on March 15, 2018, and found it to be consistent with the Comprehensive Plan based on the findings within the Planning Staff Report and unanimously recommended approval. Planning Staff's findings are as follows: The proposed rezoning is consistent with the Comprehensive Plan. While the Petition does not identify the specific use to which the property will be used, discussion with the Applicant indicates that it will be part of Gilbert Outdoors, or used as a real estate office. Both of these uses specifically qualify as an allowable use in the CHV Zoning District. The proposed use will not have an adverse effect on the public interest; is the most appropriate for the subject property and the proposed change will be compatible with contiguous uses. The property to the immediate West is vacant, owned by the Applicant with a Commercial Future Land Use (FLU) and Zoned CHV. The property to the North is O'Reilly's Auto Parts, with a Commercial FLU and a Zoning of Central Business District. To the East is an office and to the Northeast and Southeast are single-family homes. The FLU to the East is Commercial with a Zoning of Commercial Professional Office; to the Northeast and Southeast is a Single —Family Residential FLU with RMF Zoning; to the South is Gilbert Outdoors with a Commercial FLU and CHV Zoning. The proposed use would not be expected to adversely affect property values or living conditions on adjacent or nearby properties. There is no need for buffering. The two single-family uses to the Northeast and Southeast across Southeast 2nd Avenue from the subject property have limited exposure to the subject property and development of the subject property would not be expected to have any significant impact on these properties. The proposed use will not create a density pattern that would overburden public facilities, create traffic congestion, or create an inappropriate density pattern in the area. Should new construction be involved, it would be required to provide drainage for any increase in potential storm water runoff. The proposed use has not been inordinately burdened by any unnecessary restrictions. Council Member O'Connor moved to amend a previously approved purchase order [No. 4488] to include costs in the amount of $2,066.32 for additional repairs to Fire Engine 7; seconded by Council Member Clark. Discussion: At the March 6, 2018 Meeting, the Council approved a request in the amount of $16,457.08 to refurbish the fire pump on Engine 7. During the repair process, it was found that additional repairs to the pump transmission shift fork assembly are required. The relief valve, which was not on the original quote, was also found to have visible wear/tear and should be repaired while the pump is broken down. The total cost of the two additional repairs is $2,066.32. The final repair cost to Engine 7 will be $18,523.40. MDO looking at putting contingencies to keep from having to bring these smaller issues that come up as they do with repairs. As part of their linex business, it is a holding spot for spraying trucks from the dealerships. The barrels contain the chemicals that are used in the spraying of the bed liners. The concrete posts are for lighting and at this time they have no plans to extend business hours. Regarding the asphalt, currently there is only millings. During the process of repairs, Troy McDonie from Ten-8 Fire Equipment contacted me to advise that the pump transmission shift fork assembly required repairs due to wear/tear. He also stated the relief valve (not part of the original job) had visible wear/tear and should be replaced while the pump was broken down and the valve can be reached more easily. A male caller identified himself by name and stated he was from Florida Power & Light (FPL). He went on to say that the vic- fim was two months behind on paying his bill and asked for the victim's account num- ber. The victim thought right away that this was a scam and told the caller he was not giving his account number to anyone, and then asked for a supervisor. The caller gave the phone number of FPL as 1-844-266-1860. This is the scary part: When you call this number, it sounds just like the legitimate FPL number. It gives you several options, just like FPL. It then trans- fers your call to "an operator," just like FPL — but it is not FPL. It's another scam. Luck- ily, this victim did not give in to the caller's demands.
