STAFF ATTENDANCE — Secretary. Fire Chief Smith moved to dispense with the reading and approve the Minutes for the regular meeting held June 15, 2017; seconded by Building Official Newell. Motion carried unanimously. V. NEW BUSINESS —Secretary. A. Abandonment of Right -of -Way Petition No. 18 -001 -AC, to abandon the 15 -foot wide alley running North and South between Lots 11 through 16 and 10 and 17 of Block 2, CITY OF OKEECHOBEE, as recorded in Plat Book 5, Page 5, Public Records of Okeechobee County - Senior Planner. Planning Staff Report: Planner Brisson explained the Applicant, Ms. Joy Kidwell, who is the Registered Agent for the property owner, JMK of Okeechobee, Inc., is proposing to vacate the vacant, unimproved 315 -foot long, 15 -foot wide North to South Alleyway between Northeast 13th and 14th Streets. In addition to this Alley, Block 2 consists of 26 lots and a previous West to East Alleyway that was abandoned between Lots 1 to 10 and 18 to 26 on December 13, 2016. JMK of Okeechobee, Inc., owns Lots 11 through 14 of Block 2, Muzaffar Husain Trustee owns Lots 15 through 18 of Block 2, and 441 Palms LLC owns Lots 1 through 10 and 21 through 26 of Block 2. TRC - March 15, 2018 - Page 1 of 3 V. NEW BUSINESS CONTINUED. A. Abandonment of Right -of -Way Petition No. 18 -001 -AC continued. Planning Staff Report continued: Planning Staff's responses to the required findings are the property is designated Commercial on the Future Land Use Map and Heavy Commercial on the Zoning Map. The proposed future use is undetermined. The lands bordering the Alley carry the same Future Land Use and Zoning designations which simplifies development and enhances the chances that all future development will be compatible with surrounding properties. The Alley is not the sole means of access to any property. All adjoining or nearby properties have access from Parrott Avenue and/or Northeast 13th Street. The public benefits associated with the abandonment are: the existing Alleyway is currently unused and has no immediate or future use; it will be a benefit to the City to remove the existing rights-of-way which will reduce the land the City is required to maintain and the property will be subject to ad valorem taxation. The applicant has submitted Letters of No Objection from Florida Power and Light, CenturyLink, Comcast Cable and Okeechobee Utility Authority. Planning Staff is recommending approval based on these findings. County Environmental Health Department: No issues were received. OUA: No issues were received. Public Works: Public Works Director Allen noted an easement is needed for access to the ditch along Northeast 14th Street for maintenance. Police Department: No issues were received. Building Official: No issues were received. Fire Department: No issues were received. Chairperson Montes De Oca asked whether there were any comments or questions from those in attendance. Mr. Mark Goodbread, representative for the applicant, JMK of Okeechobee, Inc., was in attendance. He did not have any comments nor did the Committee have any questions, Chairperson Montes De Oca then asked TRC Members to disclose for the record whether they had spoken to anyone regarding the Application or visited the site. Chairperson Montes De Oca disclosed he had spoken to Chief Peterson as he was not able to attend today's meeting. He also spoke to Mr. Steve Dobbs, Project Engineer for the Applicant and Mr. Goodbread. There were no other disclosures. A motion and a second was offered by Public Works Director Allen and Fire Chief Smith to recommend approval to the Planning Board for Abandonment of Right -of -Way Petition No. 18- 001 -AC, to abandon the 15 -foot wide Alley running North and South between Lots 11 through 16 and 10 and 17 of Block 2, CITY OF OKEECHOBEE, as recorded in Plat Book 5, Page 5, Public Records of Okeechobee Countv. with the followina condition: 1. At time of development a proper easement will need to be granted for sufficient access to the City/County drainage easement along Northeast 14th Street for maintenance. Motion carried unanimously. V. NEW BUSINESS — Secretary. A. Site Plan Review Application No. 17 -001 -TRC, Second Review, Phases One and Two, expansion to an existing nursing home facility located at 1646 Highway 441 North, Okeechobee, FL — Senior Planner. Application No. 17 -001 -TRC was first presented at the April 20, 2017, meeting. The action taken was to have the applicant resubmit revisions and additional documentation required. Planning Staff Report: The Okeechobee Health Care Facility is located on 10.95 vacant acres. To the North is Raulerson Hospital, to the East is Taylor Creek, to the South is Northeast 141 Street and to the West is Highway 441 North, (North Parrott Avenue), along with Sunshine State Surgical Center. The existing facilities encompass approximately 81,127 square feet to operate a 180 -bed TRC - June 15, 2017 - Page 1 of 3 V. NEW BUSINESS CONTINUED. A. Site Plan Review Application No. 17 -001 -TRC, Second Review, continued. Planning Staff Report continued: nursing home with administrative and staff offices, kitchen, dining, social, physical therapy and laundry areas, required parking (145 spaces), loading zones, retention, and landscaping. The project is proposed to be completed in phases. Each phase will appropriately address the required landscaping, paving and parking regulations as provided on the drawings. Phase One consists of a 14,700± square foot building which will expand the facilities by 18 -beds known as the "West -Expansion," and create a trash compactor area removing the existing garbage dumpsters; a 7,200 square foot laundry facility and loading dock; and a 42,562 square foot dry retention area. Phase Two will now consist of expanding the kitchen by 2,600 square feet and adding two 5,000 square foot and one 7,200 square foot maintenance buildings. The proposed 16,000 square foot "East -Expansion" facility was removed, which reduced the lot coverage and the overall impervious surface coverage. Planning Staff's responses to the required findings are the property is designated Commercial on the Future Land Use Map and Heavy Commercial on the Zoning Map. Adequacy of public facilities appear to have been or will be met. Regarding potable water and sanitary sewer, the applicant had previously provided letters from the Okeechobee Utility Authority (OUA) documenting there is adequate capacity and facilities. The County has confirmed a considerable level of excess capacity available to serve the solid waste disposal needs. The Applicant supplied an engineer's report addressing drainage and other aspects of the proposed project, no sidewalks are required. Planning Staff noted during the first TRC review, one of the stipulations was to submit a traffic impact analysis for the entire project including documentation on the current traffic levels being experienced by the existing nursing home facility as well as the projected traffic for all development envisioned for the project at buildout. The Applicant's representative has submitted only a cursory analysis using the Institute of Transportation Engineers (ITE) Traffic Generation Manual estimates for the "West -Expansion". In addition, he has stated since the "East -Expansion" was removed and the residual peak traffic impact for the nursing home at buildout is 44 trips, this is less than required for a full traffic study. Mr. Brisson stated ITE generation rates are only estimates based on some studies of other nursing homes. When there is an existing facility that is being expanded, traffic projections are best based upon the actual operation of the existing facility. The Applicant was to provide counts of vehicular traffic entering and exiting the site during the peak hours of operation of the facility as it exists now, thereby providing a basis for estimating the likely traffic generation for future expansions. The removal of the "East -Expansion" does not justify varying from the TRC's stipulation. It is clear that sometime in the future Parcel two, (refer to April 20, 2017 Minutes), will be put to more productive use and information should be provided that can be used in assessing potential traffic levels. The comparison of proposed and required dimensional standards found that all areas are adequate with the exception of one that was highlighted and listed as follows: 216 total parking spaces are planned for both phases of which nine are handicap spaces. However, at least one handicap space is to be provided for the maintenance building facilities. The following comments received by Secretary Burnette from Administrator Montes De Oca were read into the record by Building Official Newell. "Potential existing traffic and patterns shall be identified. Although the building was removed from the plans, the existing and potential traffic numbers should be noted and presented as per recommendation by Planner. I do not have additional comments and would be in support of the approval pending the above". TRC - June 15, 2017 - Page 2 of 3 V. NEW BUSINESS CONTINUED. A. Site Plan Review Application No. 17 -001 -TRC, Second Review, continued. County Environmental Health Department: No issues were received. QUA: Director Hayford commented all his requests have been satisfied and all easements issues have been handled. Public Works: Public Works Director Allen commented he still has concerns with the traffic study not being provided as we do not have a clear understanding of the actual traffic levels for the current and future uses. Police Department: Police Chief Peterson commented his Department researched and found no traffic accidents and no current issues at the proposed location. Building Official: No additional comments. Fire Department: Fire Chief Smith commented all his requests have been satisfied. Building Official Newell asked whether there were any comments or questions from those in attendance. Mr. Wendell Hall, P.A. with Bhide & Hall Architects, was in attendance. Mr. Newell commented the City has not received any building permits for the foundation as of yet. Mr. Hall responded he was working on submitting for that soon. Building Official Newell then asked TRC Members to disclose for the record whether they had spoken to anyone regarding the application or visited the site. There were no disclosures. The Building Official requested the action to be made in two separate motions. One regarding the approval or denial of the application without a traffic impact analysis and the other for the actual expansion. A motion and a second was offered by Police Chief Peterson and Fire Chief Smith to approve Site Plan Review Application No. 17 -001 -TRC, Second Review, Phase One only without a formal traffic impact analysis and to use the data presented until Phase Two of the project at which time a formal analysis would be required. Motion carried unanimously.
