Planning Staff's recommendation for approval is based on two sets of criteria. One being the site's consistency with the current Land Development Regulations (LDR's), and the other, findings required to consider a Special Exception. Planning Staff's responses to the applicant's presentation on consistency with the LDR's are, the location and site are appropriate for an outdoor vehicle sales lot, the property is located within an area designated on both the Future Land Use Map and the Zoning Map for industrial uses. No specific design efforts are needed, no special visual screening is necessary for the northern, southern, or western boundaries, as all these surrounding properties are designated and/or used for industrial uses. As long as any vehicles stored along the eastern boundary are not large, construction type vehicles or unsightly, no special visual screening will be necessary there either. There should be no potential hazards associated with the proposed use, it would seem apparent that utilities are available and specifics will be addressed during the site plan review stage. The site has an existing unpaved wide driveway on Northwest 9" Street, given the size of the property, and the limited amount of traffic expected, should be capable of handling both on-site and off-site traffic. Planning Staff's responses to the applicant's presentation on the required findings are , the proposed use is not contrary to the Comprehensive Plan. Discuss potential Historic Preservation Regulations with Planning Mr. Brisson explained his memorandum dated May 12, 2015 in that previously, a copy of a Historic Preservation Staff (Exhibit 2). Ordinance for the City of Sebring was given to the Board Members to use as an example for them to provide comments. Each of the Boards' comments were compiled and inserted into the Ordinance immediately following the section they were addressing together with Mr. Brisson's comments. He advised the Board that he was there to further compile their suggestions in order to present a text amendment to the City Council. He was of the understanding that the Council was interested in knowing whether the Planning Board would recommend implementing historic preservation regulations. Chairperson Hoover expressed concern with saddling a private property owner with more restrictions and regulations. Member Baughman expressed his concern with government having more regulations, that it would discourage growth and not represent a positive statement. Member Brass agreed the City should start somewhere, but not to the extent of the tremendous hardship that the Sebring regulations offer. The constraints applied to some property owners would be hard as they may not be able to afford to restore the structure. Participation should be on a voluntary basis. The City needs to start protecting some of the historic assets or they will all be gone. More questions need to be asked and parameters and guidelines need to be established. Members Keefe and O'Brien suggested there were commercial buildings that should be listed as historical and believed regulations would be good for the community's tourism. Member McCoy expressed concern with where the funding would come from and what advantage the regulations would bring. There are two important timelines you need to be aware of regarding Special Exceptions. Per Sec. 70-348(4) of the City Land Development Regulations, Special Exception use; variance. Special Exception use and variance approvals shall have a valid period of not more than two years, prior to which a building permit application must be submitted or the approval shall lapse. Per Sec. 70- 373(f), Nonuse. If the special exception use granted by the board of adjustment should fail to exist or fail to be used for a continuous period of 180 days, then such use shall lapse and the current owner be required to reapply as provided in this division. In case of hardship, where the loss of such special exception would materially affect the integrity of any mortgage or other financing arrangement on the subject real property, the board of adjustment may consider such hardship in granting a renewal of such special exception. Given the size of the property and the limited amount of traffic expected, the site is capable of handling both on-site and off-site traffic. He said 15 percent of the property can be unpaved. He recommended approval. The city technical review committee will hear the specifics of the site plan at a future meeting. The applicant has two years to develop the project. Board member William O'Brien had ques- tions about car parts, oil, and equipment stored on the property. Karyne Brass said the city could be concerned about detergents draining off the property from car washes. Mr. Estremera said he has been in busi- ness for the past 20 years. He owns Baby Auto which is located on North Parrott Avenue at the railroad tracks. He said his water bill is $50 per month and he doesn't expect to add more car washes at the new facility. He can repair vehicles and plans to do so at the new location. The hours are between 9 a.m. and 6 p.m. He did not expect to create a noise problem. Mr. Estremera plans to be by appointment only and doesn't plan to be on site all the time. He could lease or sell his existing site. The property is zoned industrial. It was formerly the &me of Big `O' Boats. The petition was approved 7-0 with the re- quirement that batteries and any hazardous material be stored indoors. The planning board also spent considerable time discussing a proposed historic preserva- tion ordinance and the creation of a commis- sion to review local properties. After considerable discussion, the planning board recommended the creation of the com- mission in a vote of 5-2. Members Phil Baugh- man and Doug McCoy voted against the rec- ommendation to city council. Chairman Dawn Fox said she had questions about government —interference with property rights. Mr. Baughman said the city could have preserved the train station but no one wanted the liability. He stated the city has safeguards in place to protect old buildings with permits and communication with the owner. He contends more regulations don't fix a problem but just creates more havoc. "My recommendation is less regulation, this deters growth and is not a positive state- ment," he said. City attorney John Cook said the city staff did spend a lot of time and effort trying to save the train station. He said CSX did nothing to help the city on this issue. He said the city building department did drop the ball. As a re- sult, the city has more detailed and improved demolition permit applications. Mrs. Brass said she didn't want the city to dictate or be authori- tarian when it comes to historic preservation. "There are financial aid and grants and a lot of positives that can be done. It doesn't have to be a police state, Hitler driven, or a `do this or get out of town' proposal.
