The recommendation will be forwarded to the City Council for consideration at a Public Hearing, tentatively January 3, 2017, 6 pm. Special Exception Petition No. 16 -004 -SE, requests to allow a convenience store with fuel pumps within a Heavy Commercial Zoning District, (Ref. Sec. 90-283(24), containing approximately 0.93 unplatted acres and located at 1705 South Parrott Avenue. Parcel ID No. 2-28-37-35-OA00-00028-A000. The petition was submitted by Mr. Kenneth Wood, Managing Trustee of Alliance Fuel Marketing, LLC. This being a quasi-judicial proceeding, Notary Public Patty Burnette administered an oath to those intending to offer testimony, all responded affirmatively, and stated their names and addresses for the record: Bill Brisson, Senior Planner, LaRue Planning and Management, 1375 Jackson Street, Suite 206, Fort Myers, Florida and Mr. Kenneth Wood, 2078 South Orange Blossom Trail, Apopka, Florida. Chairperson Hoover yielded the floor to Mr. Bill Brisson, Senior Planner for LaRue Planning and Management Services, Inc. Mr. Brisson explained the subject property has been used as a convenience store with retail fuel sales in the past, although it has been closed for more than 180 days. Therefore, Special Exception approval is required from the Board of Adjustment to re -open or operate a new convenience store with fuel pumps. The applicant has stated the business will have 10 to 15 employees, be open from 5 AM to 10 PM and fuel sales will be undertaken in the existing fuel islands. Planner Brisson recommends approval based on the findings within the Planning Staff Report. Mr. Wood was present on behalf of the property owner and available for questions from the Board. Member McCoy wanted to make the applicant aware that it was his understanding that currently the property was not connected to sewer and should the applicant wish to have food service at this location, the current septic would not support this operation. Chairperson Hoover asked whether there were any comments or questions from those in attendance. There were none. Secretary Burnette noted for the record the petition was advertised in the local newspaper, a sign was posted on the subject property and courtesy notices were mailed to 18 surrounding property owners. .. I WAL1I17_l V. PUBLIC HEARING QUASI-JUDICIAL ITEM CONTINUED. B. 5. Disclosure of Ex -Parte Communications by the Board for Petition No 16 -004 -SE. 6. a) Consideration of a motion to approve or deny the petition with/without special conditions. L NOVEMBER 17,2016- PLANNING BOARD -PAGE 4 OF 5 ACTION - DISCUSSION -VOTE Chairperson Hoover asked Board Members to disclose for the record whether they had spoken to anyone else regarding the application or visited the site. There were none. Planning Staff's recommendation for approval is based on two sets of criteria. One being the site's consistency with the current Land Development Regulations (LDR's), and the other, findings required to consider a Special Exception. Planning Staff's responses to the applicant's presentation on consistency with the LDR's are, the location and specific site are appropriate for the proposed use. The property was previously used as a convenience store with fuel pumps and this use is specifically identified as a special exception use in the Heavy Commercial (CNV) Zoning District. No specific design efforts are needed. Aside from replacing the fuel tanks and cosmetic improvements to the existing building, there will be no changes to the property. The site is surrounded by other commercial uses so no special visual screening will be necessary. There should be no hazards or special problems associated with the proposed use as the subject property has previously functioned as a convenience store with fuel pumps for years without reported negative impacts. Reinstating the prior use in much the same manner should not create any additional demands for potable water, sanitary sewer services or provision of any other municipal services. Since it is unlikely that the traffic generated at the site after it reopens will exceed that which was historically experienced by the prior operation, no significant impact on the existing roadways is expected. Planning Staffs responses to the applicant's presentation on the required findings are, the property is designated Commercial on the Future Land Use Map and the proposed use is not contrary to the Comprehensive Plan. A convenience store with fuel pumps is specifically listed as a special exception use in the CHV Zoning District. The proposed use will not have an adverse effect on the public interest. The use is appropriate for the proposed location, is compatible with adjacent uses, and is not detrimental to urbanizing land use. The use will not affect property values or living conditions, nor be a deterrent to the development of adjacent property. Aside from replacing the existing fuel tanks with upgraded models and cosmetic improvements to the existing building, there will be no changes to the property. Therefore, no special visual screening or other improvements will be necessary. The proposed use is commercial and density is not a consideration. Given the use is essentially the same as has been operated in the past, the reinstatement of the use should not be expected to overburden any public facilities such as streets, schools, and utility services. The proposed use will not create traffic congestion, flooding, or drainage problems. No additional impervious surface is expected and therefore drainage should be unaffected by the change in use. The traffic generation should not exceed the levels of traffic normally associated with the previous use or other uses allowed in the CHV District. Motion and a second offered by Members Brass and Batton to approve Petition No. 16 -004 -SE, to allow a convenience store with fuel pumps within a Heavy Commercial Zoning District, (Ref. Sec. 90-283(24), containing approximately 0.93 unplatted acres and located at 1705 South Parrott Avenue. There are two important timelines you need to be aware of regarding Special Exceptions. Per Sec. 70-348(4) of the City Land Development Regulations, Special Exception use; variance. Special Exception use and variance approvals shall have a valid period of not more than two years, prior to which a building permit application must be submitted or the approval shall lapse. Per Sec. 70- 373(f), Nonuse. If the special exception use granted by the board of adjustment should fail to exist or fail to be used for a continuous period of 180 days, then such use shall lapse and the current owner be required to reapply as provided in this division. In case of hardship, where the loss of such special exception would materially affect the integrity of any mortgage or other financing arrangement on the subject real property, the board of adjustment may consider such hardship in granting a renewal of such special exception. The matter for consideration by the City of Okeechobee Board of Adjustment is a Special Exception application for a convenience store with retail fuel sales (i.e. fuel pumps) in the CHV zoning district. Serving Florida Loral Governments Since 1988 Staff Report Applicant's Name: OCP Industrial Ventures, LLC Special Exception Request Petition No. 16 -004 -SE Description of • The subject property lies in the CHV zoning district and is comprised of approximately 0.930 acres. The property has been used as a convenience store with retail fuel sales in the past, but has been closed for more than 180 days. "Convenience store with fuel pumps" was recently added as item (24) to the list of Special Exception uses in the CHV District. The prior facility may have previously received Special Exception approval as an auto service station. However, because it has been closed for more than 180 days, Special Exception approval from the Board of Adjustment is required to re -open or operate a new convenience store with fuel pumps. The Applicant has stated that the business will have 10 to 15 employees, be open from 5 AM to 10 PM and fuel sales will be undertaken in the existing fuel island. The Applicant has submitted, as part of the submission, brief statements and informa- tion addressing these standards. The Applicant's statements are shown in Times Roman typeface. Staff comments follow and are shown in bold Arial typeface. Serving Florida Local Governments Since 1988 Staff Report Applicant's Name: OCP Industrial Ventures, LLC Special Exception Request Petition No. 16 -004 -SE (1) Demonstrate that the proposed location and site are appropriate for the use. "The facility is existing and is consistent with the facilities around it." We agree that the location and site are appropriate for the use. The prop- erty has long been used as a convenience store w/fuel pumps, is zoned CHV, and is located along the City's major north -south commercial corridor. The CHV Zoning District specifically identifies a convenience store with fuel pumps as item (24) in the list of Special Exception uses. (2) Demonstrate how the site and proposed buildings have been designed so they are compatible with the adjacent uses and the neighborhood, or explain why no specific design efforts are needed. "The facility is existing. We plan to upgrade the building and the fueling area." There is no indication that the Applicant envisions any new construction. The existing building will be used as it has been in the past and the Appli- cant states that fuel will be dispensed in the existing pump islands. We agree that no special design efforts should be necessary as the property has already been functioning as a convenience store w/fuel pumps. (3) Demonstrate any landscaping techniques to visually screen the use from adjacent uses; or explain why no visual screening is necessary. "We do not plan to change the outside area. We are planning to replace fuel tanks to double wall." Aside from replacing the fuel tanks and cosmetic improvements to the existing building, there will be no changes to the property. The site is surrounded by other commercial uses no special visual screening will be necessary. Serving Florida Local Governments Since 1988 Staff Report Applicant's Name: OCP Industrial Ventures, LLC Special Exception Request Petition No. 16 -004 -SE (4) Demonstrate what is proposed to reduce the impacts of any potential hazards, problems or public nuisance generated by the use or explain how the nature of the use creates no such potential problems. "The facility is existing and should not add any additional impact." We agree there should be no hazards or special problems associated with the proposed use. The subject property has previously functioned as a convenience store w/fuel pumps for years without reported negative impacts. (5) Demonstrate how the utilities and other service requirements of the use can be met. All utilities and other services are existing." Reinstating the prior use in much the same manner as it has previously operated should create no additional demands for potable water, sanitary sewer services or provision of any other municipal services. (6) Demonstrate how the impact of traffic generation will be handled off site and on- site. "Facility is existing. It should not add additional impact to the area. Staff agrees that it is unlikely that the traffic generated at the site after it reopens will exceed that which was historically experienced by the prior convenience store w/fuel pumps. Therefore, no significant impact on existing roadways is expected. When reaching a conclusion on a Special Exception request, the Board of Adjustment must consider and show in its record the following findings as set forth in Section 70- 373(c). The Applicant has provided comment to each of the required findings. These are repeated herein in Times Roman typeface exactly as provided by the Applicant. Staff has made no attempt to correct typos, grammar, or clarify the Applicant's comments. Staff comments are shown in this bold Arial typeface. 4 Serving Florida laxal Governments Since 1988 Staff Report Applicant's Name: OCP Industrial Ventures, LLC Special Exception Request Petition No. 16 -004 -SE (1) The use is not contrary to the Comprehensive Plan requirements. "The facility has been here since 1986. It was closed to upgrade tanks." The Future Land Use classification of this parcel is Commercial. The granting of this Special Exception is consistent with that classification. (2) The use is specifically authorized as a Special Exception use in the zoning district. "The use is authorized and was just closed more than 180 days." A convenience store with fuel pumps is listed as an allowable Special Exception use in the CHV district [§90-283(24)]. (3) The use will not have an adverse effect on the public interest. "Re -opening the facility will not impact the area." We agree that reinstating the previous use on the property will have no adverse effect on the public interest. (4) The use is appropriate for the proposed location, is reasonably compatible with adjacent uses and is not detrimental to urbanizing land use pattems. "The facility is compatible with the area." We agree that the location and site are appropriate for the use. The prop- erty is located along the City's major north -south commercial corridor and is surrounded by other commercial zoning and uses. Serving Florida local Governments Since 1988 Staff Report Applicant's Name: OCP Industrial Ventures, LLC Special Exception Request Petition No. 16 -004 -SE (5) The use will not adversely affect property values or living conditions, nor be a deterrent to the development of adjacent property. "The facility is existing. Reopening site will improve the area." Given that this property has been used for a convenience store with fuel pumps for years, we agree that reinstating this use will not adversely affect property values or living conditions. Since this lot is in the CHV district, the proposed use should not adversely affect property values or discourage devel- opment of adjacent properties. (6) The use may be required to be screened from surrounding uses to reduce the impact of any nuisance or hazard to adjacent uses. "The facility will not requiring new screening." Aside from replacing the existing fuel tanks with upgraded models and cosmetic improvements to the existing building, there will be no changes to the property. Therefore, neither special visual screening nor other improvements will be necessary (7) The use will not create a density pattern that will overburden public facilities such as schools, streets, and utility services. "The facility is existing and will not create additional burden on the area." The proposed use is commercial and therefore density is not a considera- tion. Since the use is essentially the same as has been operated in the past, reinstatement of the use should not be expected to overburden any public facilities. Serving Florida Local Governments Since 1988 Staff Report Applicant's Name: OCP Industrial Ventures, LLC Special Exception Request Petition No. 16 -004 -SE (8) The use will not create traffic congestion, flooding or drainage problems, or otherwise affect public safety. "Facility is existing. There will be no new impact to traffic or drainage." The proposed use will not create traffic congestion, flooding, or drainage problems. No additional impervious surface is expected and therefore drainage should be unaffected by the change in the use. The traffic generation of the use should not exceed the levels of traffic normally asso- ciated with the previous use or other uses allowed in the CHV District. Recommendation Based upon the foregoing analysis and findings, Staff recommends that Petition Number 16 -004 -SE be approved as requested. Submitted by: Wm. F.
