Mayor Kirk presented a Longevity Service Award to Mr. Bill Saum for his twenty years of outstanding service to the
City and its residents as an employee of the City. Mr. Saum commented "thank you for the chance to work for the City
it means a lot to me and the man I have become." He is currently employed with the Police Department as a Detective.
Mr. Fisher was not present to receive his Longevity Service Award for his twenty years of outstanding service to the
City and its residents. His Award will be forwarded to him. He is currently employed in the Public Works Department
as a Mechanic.
C. Recognize L. Keith Torney, 11 for twenty years of service with the City. Mayor Kirk presented a Longevity Service Award to Mr. Keith Tomey, Fire Chief, forhis twenty years ofoutstanding

A. 2. b) Public comments continued. Mayor Kirk asked whether there were any questions or comments from the public. Clerk Gamiotea advised that she
had received a request from the property owner of Block 129, which is located directly to the West of the site. They
stated that they did not object to the project so bng as it does not include the closing of Nor#wmt 4th Street, since that
is their only access to their property.
Council Member Watford noted that the easement addressed in Section Two of the ordinance only retains an
easement for the street and not the alleyways as requested by the Okeechobee Utility Authority. Following a brief
discussion, Council Member Watford moved to amend proposed Ordinance No. 832 to retain an easement withi n
the alleffays of Blocks 128 and 135, City of Okeechobee; seconded by Council Member Markham.

b) Public comments. This ordinance addresses Rezoning Application No. 03-004-R submitted by Mark Goodbread on behalf of the property
owner, Gagbee, Inc., George Goodbread, President. The application is requesting to rezone Lots 1 through 6 and 21
through 26 of Block 18, CITY OF OKEECHOBEE from Holding to Residential Multiple Family. The property is
approximately 2.5 acres and located between Northeast 1 1'hand 12t' Streets. The Council recently approved a Future
Land Use Map Amendment regarding this property. Should this ordinance be adopted, the zoning designation would
then be consistent with the future land use designation. The property owner is proposing to build multi -family or duplex
type housing on the property.
Planning Staff Report reflects that the proposed use is not contrary to Comprehensive Plan requirements. The planned
use is specifically authorized by the permitted uses. It will not have an adverse effect on public interest. It is appropriate
for the location and is reasonably compatible with adjacent land uses. The property to the North and East are vacant
with Single Family Future Land Use Designation. Property to the South has existing duplexes and to the West is a
residence and Family Health Clinic. It is not contrary or detrimental to urbanizing land use patterns. It will not adversely
affect property values, living conditions or be a deterrent to the improvement or development of adjacent property. The
property is of sufficient size to provide adequate buffering with surrounding land uses. The Okeechobee Utility Authority
has water and wastewater service available to the site. The developer will be responsible for improvements to
Northeast 1 1'hand 12' Streets (these items are addressed during site plan review).

B. 2. b) Public Comments continued. Construction standards for the streets should be done to solve any potential flooding or drainage problems. A traffic
impact analysis should be done to demonstrate that a multi -family development can be accommodated at this location.
The proposed use has not been inordinately burdened by the developers responsibility with improvements to I I 1h and
12'hStreets. The change would not constitute a grant of special privilege to an individual owner as contrasted with the
public welfare. Planning Staff recommends approval based on the above information. The Planning Board is also
recommending approval. The Board discussed the rezoning at the their July 22, 2003 meeting.

C. 2. b) Discussion continued. 11 Council Member Markham moved to adopt proposed Ordinance No. 834; seconded by Council Member Williams.
This ordinance addresses Rezoning Application No. 03-005-R submitted by the property owners, Anselmo and Mary
Anne Madrigal. The application is requesting to rezone Lot 6 and the West half of 5 of Block 89, CITY OF
OKEECHOBEE from Residential Multiple Family to Light Commercial. The property is approximately 0.241 acres and
located at Northeast 6th Street and 2nd Avenue. The Council recently approved a Future Land Use Map Amendment
regarding this property. Should this ordinance be adopted, the zoning designation would then be consistent with the
future land use designation. The property owner is proposing to build a gift shop on the property.
Planning Staff Report reflects that the proposed use is not contrary to Comprehensive Plan requirements. The planned
use is specifically authorized by the permitted uses. It will require buffering to avoid adverse effects on public interest.
It is appropriate for the location, however the building and off-street parking will require buffering in order to avoid
adverse effects on residential duplex units to the East and South. There is an existing residential home to the North
and the future site of Big Lake National Bank is to the West. Buffering is also required in order to not adversely affect
property values, living conditions or be a deterrent to the improvement or development of adjacent property. With
sufficient fencing and screening the impact of any nuisance or hazard to the neighborhood will be reduced. Public
Facilities will not be overburdened by the development. In addressing whether the proposed use would create traffic
congestion, flooding or drainage problems, or otherwise affect public safety, the property may be too small to provide
required parking capacity and adequate traffic ingress and egress. Adequate off-street parking and screening
requirements would not be an unnecessary restriction to inordinately burden the development. The proposed change
will not constitute a grant of special privilege to an individual owner as contrasted with the public welfare. Based on
the above information and the fact that adequate buffering, screening and fencing and off-street parking will be
appropriately addressed during site plan review, Planning Staff recommends approval. The Planning Board is also
recommending approval. The application was discussed at their July 22, 2003 meeting.
Mayor Kirk asked whether there were any questions or comments from the public. A letter submitted by Ann Suds of
107 Northeast 6th Street stated the following: Dear Sirs, Since I live within 100 feet of the property that is up for
rezoning, and did not receive a letter of notice, and due to medical reasons I cannot attend the meeting. I have no
objections to a 'gift shop' going in there. However I do object to a 'flea -market' as rumor has it, that it may be or
become. I would like to suggest a restricted zoning for a 'gift -shop' only. If the shop were to go out of business, then
it would revert back to present zoning." Council noted that special conditions or restrictions cannot be placed on
zonings. Clerk Gamiotea then read, as requested by Council, the permitted uses within a Light Commercial Zoning
District. Those permitted uses are: Code Book Section 90-252. (1) Professional office, business office, medical office.
(2) Retail store, retail service. (3) Personal service. (4) Craft studio.

A. Motion to approve a Fire Service Interlocal Agreement between the Council Member Chandler moved to approve a Fire Service Interlocal Agreement between the City and the County;
City and the County - Chief Tomey (Exhibit 4). 11 seconded by Council Member Williams.
There was a brief discussion regarding this item. Council expressed their appreciation to the County for working with
the City on this item, this is another sign of the willingness of both entities to keep a working relationship.

B. Consider appointment of an Ex-Officio Member to the Chamber of Based on the recommendation of Administrator Veach, the consideration of appointing of an Ex-Officio Member to the

C. Discuss costs associated with Outsourced Planning Services - City At the August 5 City Council Meeting, the Council instructed Administrator VeaGh to research what other entities are
Administrator. charged for out -sourcing their planning departments. Administrator Veach advised that based on the information
gathered outsourced rates are from ninety-fl" to one hundred five doffars ($95 - $105) per hour with no monthly cap.
Mr. LaRue's proposed increase based on an average of forty hours per month is eighty-seven dollars and fifty cents
($87.50) per hour with a monthly cap of three thousand, five hundred dollars ($3,500.00).
The Council thanked the Administrator for his information comment that the information provided gave them a better
idea of the rates. Council Member Wafford moved to accept (approve) the reguest (Contract Amendment) from
LaRue Planning and Management Services, Inc. to increase the monthly contract rate from two thousand, five
hundred dollars ($2,500.00) to three thousand, five hundred dollars ($3,500.00); seconded by Council Member
Chandler.

F. Discussion regarding a request by River Run Homeowners' Ms. Benda Bost, President of the River Run Homeowners' Association addressed the Council regarding the City
Association pertaining to Code Enforcement issues - Brenda Bost, authorizing building permits for older mobile homes (trailers) when their deed restdctions do not allow them and also
President (Exhibit 6). 1 restrict areas for single -wide and double -wide units.
Attorney Cook advised that the City does not have the authority to enforce deed restrictions. If a trailer is allowed by
City Code, then a building permit must be issued. However, the County recently adopted an ordinance placing an age
limit on mobile homes within the County. He recommended the City follow suit. Council agreed and instructed
Attorney Cook to amend the existing code to have age limits on mobile homes within the Cily. Attorney Cook
advised that he would submit an ordinance for Council consideration in October. Until an ordinance is adopted
building permit applications for River Run should be "flagged" so to advise the applicant of the deed
restrictions which could result in law suits. should the aDDlicant violate those restrictions. from the home
owners association.

proper exercise of the municipal authority of the City of Okeechobee as a
discretionary function;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

Section 1: The alleys, alleyways or streets described hereafter is hereby closed,
vacated and abandoned by the City of Okeechobee, Florida to -wit:
Any and All alleyways located in Block 128, CITY OF
OKEECHOBEE as recorded in Plat Book 1, Page 10, and Plat
Book 5, Page 5, Public Records, Okeechobee County, Florida,
more particularly described as those alleyways running East to

Date: August 13, 2003
This is the final public hearing regarding Alley Closing Application No. 69 submitted by the Board of
County Commissioners. The applicant is requesting to close that portion of Northwest 3 rd Street,
between 6 1h and 7 th Avenues, and the alleyways in Blocks 128 and 135, Okeechobee Subdivision.
All fee's have been paid. The ordinance was advertised in the Okeechobee News on August 8.
Nineteen certified letters were mailed to surrounding property owners. To date, no one has responded
to those notices. The proposed addressed the easement requested by the Okeechobee Utility Authority.

CERTAIN TRACT OF LAND MORE PARTICULARLY DESCRIBED HEREIN,
FROM HOLDING (H) ZONING DISTRICT TO RESIDENTIAL MULTI -FAMILY
(RMF) ZONING DISTRICT, AMENDING THE ZONING MAP
ACCORDINGLY, PROVIDING FOR CONFLICTS, SEVERABILITY AND AN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of Okeechobee, Florida has adopted Ordinance
Number: 402 in which a revised Official Zoning Map was adopted for said City; and
WHEREAS, the owner of the property more particularly described hereafter, has heretofore
filed a petition (Petition No. 03-004-R) pursuant to the Land Development
Regulations of the City of Okeechobee for the purpose of rezoning a certain tract
of land consisting of 2.5 acre(s) from Holding (H) Zoning District to Residential

Date: August 13, 2003
This is the final public hearing regarding Ordinance No. 833 approving Rezoning Application No. 03-
004-R. The application was submitted by Mark Goodbread on behalf of the property owner, Gagbee,
Inc., George Goodbread, President.
The request is to change the zoning on Lots 1 - 6 and 21 - 26 of Block 18 CITY OF OKEECHOBEE, from
Holding to Residential Multiple Family. Please refer to Code Book Section 90-192 for a list of permitted
uses within a RMF zoning district. Please note that the Council approved a Future Land Use Map
Amendment regarding this same property on July 15. If this amendment is approved, both maps will be
consistent.
All fee's have been paid. The ordinance was advertised in the Okeechobee News on August 8. The
Planning Board discussed the application and voted unanimouslyto recommend approval. Planning Staff
is also recommending approval. The General Services Department mailed twenty-two courtesy notices
to the surrounding property owners. To date, no one has responded to those notices. The property was
posted with a sign advertising the request of the rezoning, dates and times of both the Planning Board
and City Council public hearings.

Jim LaRue, of LaRue Planning and Management, City Planning Consultant, addressed the Board

LaRLie made a correction for the record, the Comprehensive Plan Analysis stated that the parcel
being rezoned is 3 5 acres, however the parcel is only 2.5 acres. The Board made a note of Mr.
LaRue's correction. Planning Staff recommends that the rezoning be approved.

The applicant requests a change in the zoning of the subject property from Holding to
Residential Multi -Family. The subject property is situated approximately four hundred
feet east of U.S. 441 and is bordered by N.E. 12 1h Street on the north and N.E. 1 lth Street
on the south. The property is 3.5 acres in size and is presently vacant with trees and
undergrowth on the lots. Most of the subject lots are in a Holding Zoning category except
lots 7 and 20 which are Residential Multi -Family. If developed, the property could have
approximately '35 dwelling units on site.
In terms of location, the subject property is behind or east of the Family Health Clinic
which fronts on Highway 441 (Parrot Avenue) and there is a single family home abutting
the southwestern edge of the property on N.E. 11 th Street. The scattered dwellings to the
south along N.E. 111 Street look to be duplexes or multi -family. Other surrounding areas
to the north and east contiguous to this property are vacant wooded areas. In reality, N.E.

This rezoning request is reasonable in this specific situation because multiple family
development is appropriate at this time and location. Currently, the neighborhood is
not fully developed, and the adjacent streets should be constructed prior to with the
development of the property. Other concurrency issues would also need resolution.

I The proposed use is not contrary to Comprehensive Plan requirements.
The request is consistent with a Future Land Use map recent amendment, and Future
Land Use Policy 1 1, Traffic Circulation Policy 8.1 and Housing Policy 1.1.
2. The proposed use being appliedfor is specifically authorized under the zoning district
in the Land Development Regulations
Section 90-192 specifically permits multiple family dwellings in the Residential Multiple
Family (RMF) District.

4. The use is appropriate for the location proposed, is reasonably compatible with

surrounded on the east, south and west by similar RIvIF zoning.

Construction standards for NE 11 th and I 21h Streets should solve any potential flooding or
drainage problems, and a traffic impact analysis should be under taken to demonstrate
that multiple family development can be accommodated at this location.
9. Theproposed use has not been inordinately burdened by unnecessary restrictions
Developer participation in construction N.E. I Ith and 12th Streets would not be an
unusual or inordinate burden.

proposed change will not constitute a grant of special privilege to an individual
owner as contrasted with the public we�fare.
The subject property is surrounded on three sides by similarly zoned parcels. Thus the
proposed change would not grant special privilege to the subject owner.

The subject property is located in a not fully developed area about 400 feet east of N1.
Parrott Avenue (Highway 44 1). With construction of NE I I" and 12 th streets and
connection to available sewer and water utilities, the proposed multiple -family

CERTAIN TRACT OF LAND MORE PARTICULARLY DESCRIBED HEREIN,
FROM RESIDENTIAL MULTI-FAMILY(RMF) ZONING DISTRICT TO LIGHT
COMMERCIAL (CLT) ZONING DISTRICT, AMENDING THE ZONING MAP
ACCORDINGLY, PROVIDING FOR CONFLICTS, SEVERABILITYANDAN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of Okeechobee, Florida has adopted Ordinance
Number: 402 in which a revised Official Zoning Map was adopted for said City; and
WHEREAS, the owner of the property more particularly described hereafter, has heretofore
filed a petition (Petition No. 03-005-R) pursuant to the Land Development
Regulations of the City of Okeechobee for the purpose of rezoning a certain tract
of land consisting of 0.241 acre(s) from Residential Multi -Family (RMF) Zoning
District to Light Commercial (CLT) Zoning District and that this request be removed
from the boundaries of the above mentioned zone to allow for the processing of the
rezoning application; and
WHEREAS, the City Council finds such rezoning consistent with the City's Comprehensive
Plan and deems it in the best interest of the inhabitants of said City to amend
aforesaid revised Zoning Map as hereinafter set forth:
Now THEREFORE, be it ordained by the City Council of the City of Okeechobee, Florida
that:
SECTION 1. LEGAL DESCRIPTION
The following described land, located in the City of Okeechobee, to -wit: Lot
6 and the West half of Lot 5, Block 89, Okeechobee, according to the plat
thereof recorded in Plat Book 5, Page 5, Public Records of Okeechobee
County, Florida.
SECTION 2. ZONING MAP AMENDMENT
That the aforesaid Revised Zoning Map of the City of Okeechobee be
amended to reflect the subject property zoning classification to be changed
from Residential Multi -Family (RMF) Zoning District to Light Commercial
(CLT) Zoning District.
SECTION 3. CONFLICT
All ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 4. SEVERABILITY
If any provision or portion of this ordinance is declared by any court of
competent jurisdiction to be void, unconstitutional, or unenforceable, then all
remaining provisions and portions of this ordinance shall remain in full force
and effect.

Date: August 13, 2003
This is the final public hearing regarding Ordinance No. 834 approving Rezoning Application No. 03-
005-R. The application was submitted by Anselmo and Mary Anne Madrigal, property owners and
applicants.
The request is to change the zoning on Lots 6 and the West 1/2 of Lot 5, Block 89, CITY OF
OKEECHOBEE, from Residential Multiple Family to Light Commercial. Please refer to Code Book
Section 90-252 for a list of permitted uses within a CLT zoning district. Please note that the Council
approved a Future Land Use Map Amendment regarding this same property on July 15. If this
amendment is approved, both maps will be consistent.
All fee's have been paid. The ordinance was advertised in the Okeechobee News on August 8. The
Planning Board discussed the application and voted unanimouslyto recommend approval. Planning Staff
is also recommending approval. The General Services Department mailed twenty courtesy notices to
the surrounding property owners. To date, one person has responded to those notices Attached is a
copy of the response. The property was posted with a sign advertising the request of the rezoning, dates
and times of both the Planning Board and City Council public hearings.

There was concern from the Board regarding parking issues, however LaRue stated that those
concerns needed to be addressed during Site Plan Review The Board should not make the basis
of the approval or denial oil parking issues, this meeting is only to address the rezoning.
There was a question fi-orn the public. Catherine Nix, adjacent property owner, addressed the
board. Mrs. Nix was concerned that the property would eventually turn into a flea market or dirift

OKEECHOBEE COUNTY-p FLORMA, a political subdivision ofthe State of Florida, by andtbrough its
Board of County Commissioners, hereinafter referred to as ' "County". and THE CITY OF
OKEECHOBEE, FLOREDA, aFlorida municipal corporation, by andthroughits City Council, hereinafter
re&Tred to as "City", pursuant to the Florida Interlocal Cooperation Act of 1969 (Section 163.01, Florida
Statutes).
WUNESSETH
wHEREAS, the County sad City both have the authority to provide mutual aid agwments to
respond to str=turc fires and fire alarms for the residents, busintsses and facilities within either respective
jurisdictioN and
WHEREAS, the County and City an both desirous of providing enhanced fire services to all
residents, businesses and facilities consistent with state law, and
WHEREAS, the County and the City have the power to enter into agreements with other
governmental agencies within or outside of their respective boundaries for joint performance, or the
pedormance by one unit on behalf of the other, or any of either agency's authorized functions; and
WHEREAS, the Municipal Home Rule Powers Act grants the City all governmental, corporate and
proprietary powers to enable it to conduct municipal government; perform municipal functions, and render
municipal services except wh� expressly prohibited by iaw; and
WHEREAS, the County and the City have the authority to enter into agreements with other persons
to undertake to fulfill some or all of their respective responsibiUdes for the provision of fire services; and
WHEREAS, the County and City doom it to be in the best interest of the public health, safety and
welfare to enter into a Interlocal Agreement to expand the use of personnel and equipment to better serve
the citizens of both the County and City.
NOW, THEREFORE, in consideration of the premises and of the terms, conditions and covenants
herein contained, it is agreed by and between the parties hereto, as follows:
L THAT the preambles stated above are tnie, correct and incorporated into this interlocal
agreement.
2. T14AT this Interlocal Agreement shall be effective from the date it is filed with the Clerk of

the Circuit Court of Okeechobee County, and so rernain in effect utrdl amended or tm=inated
" hereinafter provided. This agreement may be terminated in writing by either party upon
no less than sixty (60) days written notice; or amended as required hy mutual agreement of

3. THAT the County and City Fire Departments shall both work together within the city limits
and unincorporated areas of the County, to maintain the State ofFlorida Mandated minimum
of four (4) combat personnel at a strucure fire.
4. THAT by complying with a requirement for a ininimura of four (4) wmbat personnel, at a
structure fire, the County and City eW=ce personnel safety from both Departments at
structurt fires, and allows for persound.
5. THAT the following protocols shall apply to structure fire alarm within either the City or
County during the term of this Agreement -

7. Implementation Date. The implementation date shall be the first Monday fDllowing approval
by both governing bodies.
8. Obligations. Obligations under this Agreement are not an indebtedness of the County or
City. The respective obligations of mh party hereto under this Agreement shall not be an
indebtedness within the meaning of any constitutional, statutory, charter or ordinarice
provision or limitation of any party hereto. Neither of the parties hereto are obligated to pay
or cause to be paid any amounts due under this Agreement and the faith and credit of any
party hereto is not pledged to the payment of any amount due under this Agreement. This
Agreement shall not require any party hereto to levy or pledge any taxes whatsoever for the
payment of any amount due under this Agreement
9. Relationship of die Parties, Except as wt forth herein, neither party to this Agreement shall
have any responsibility whatsoever with respect to services provided or contractual
obligations assumed by the other party and nothing in this Agreement shall be deemed to
constitute any party a partner, agent or local representative ofthe other party, or to create any
type of fiduciary responsibility or relationship of any kind whatsoever between the parties.
Each party may in its sole discretion, determine that it is unable to respond to a call with the
contractual level if support described herein. Every attempt will be made to communicate to
the other party any uriavailability or delay.

12. Construction. Should any provision of this Agreement be subject to judicial interpretation,
it is agreed that the court interpreting or considering such provision will not apply the
presumption or rule of construction that the terms of this Agreement be more strictly
comtrued against the party which itself or through its counsel or other agent prepared the
same, as all parties hereto have participated in the preparation of the final form ofthis
Agreement through review by their respective counsel and the negotiation of changes in
language in any provision deemed MsWtable or inadequate as inig written, aud,
therefoM the applicatioti of such presumption or rule of construction would be inappropriate
and contmry to the intent of the parties,
13. Notices, All notices, consents, or other communications required, permitted or otherwise
delivered under this Agreement, except correspondence and trammittals relating to specific

Changes in the respective addresses of the parties may be made f3rom tim to time by either party by

14. Incorporation of Agrmments. This document supersedes all prior negotiations,
correspondence, conversations, agrecments, or understandings applicable to the matters
contained herein. Accordingly, it is agreed that no deviation ftom the terms of hereof shall
be predicated upon any prior representations or agreements, whether oral or written. It is
firther agreed that no modificatim amendment or alteration in the terms or conditions
herein shall be effective unless contained in a written document executed by the govmming
bodies of the parties and filed with the Clerk of the Circuit Court of Okeechobee County.
15. Severability. In the event that any provision of this Agreement shail, for any reason, be
determined to be invalid, illegal or unenforceable in any respect, the parties hereto shall
negotiate in good faith and agree as to such amendments, modifications or supplements of
or to this Agreement or such other appropriate actions as shall, to the maximum extent
practicable in light of such determination. implement and give effect to the, intentions of the
parties as reflected herein, and the other provisions of this Agreement shall, as so amended,
modified or supplemented or otherwise affected by such action, remain in full force and
effect.

The City of Okeechobee is soliciting proposals and/or letters for professional consulting services
to administer FFY 200' ) Community Development Block Grant (CDBG) from the Florida Small
Cities CDBG program in the area of Commercial Revitalization which will soon be awarded to
the City Administrative services will cover all aspects of grant administration from grant award
to close-out. Various administrative functions will include, but not be limited to, environmental
assessment, requests for funds, project oversight, monitoring of project, etc Proposals will be
evaluated upon a total of 100 points as follows: (1) Experience administering CDBG grants - 20
points; (2) Availability�Management of Staff Involved with this Project - 15 points; (3) Ability to

The City proposes to award a contract for grant administration to the provider(s) whose
proposal(s) are deemed most advantageous to the City subject to the negotiation of fair and
reasonable compensation consistent with industry standards. The City reserves the right to reject
any or all proposals. The City accepts no responsibility for expense of preparing or delivering
proposals to the City. Proposals not reaching the City by the deadline will not be opened and
will not be eligible for evaluation.
In compliance with section 287.017, Florida Statutes, for Public Entity Crimes, no person or
affiliate on the convicted vendors list may, for a period of 36 months after being placed on the
convicted vendors list: (1) submit a bid on a contract or request for proposals; (2) be awarded or
per -form work as a contractor, supplier, subcontractor or consultant. The City of Okeechobee
shall not accept any bid from, award any contracts to, or transact any business with any person or
affiliate in excess of the threshold for Category II (presently $15,000) in section 287,017, Florida

Please accept this letter as response of great interest to provide the City of
Okeechobee with Community Development Block Administration Services for a
Commercial Revitalization project as per your RFP. Enclosed with this letter are
the general selective criteria as requested for professional services in your RFP.
Nancy Phillips & Associates, L.C. (NPA) was formed in May of 2000 and
specializes in grantstfunding opportunities for specific projects. NPA has over 11
years experience in obtaining and maintaining sufficient funding for the local
government projects utilizing grant/funding sources in Tallahassee and
Washington, D.C. This ability to do this is outlined in our RFP response attached.
NPA, which is a Woman Owned Business Enterprise, is truly an expert in CDBG.
Ms. Phillips' immediate past experience was managing the Grant Administration
Division of Craig A. Smith & Associates for over 4 years. Prior to this, Ms. Phillips
was with the Florida Department of Community Affairs, CDBG Offices, as their
CDBG Economic Development Specialist. She knows and understands CDBG
from the inside out. Ms. Phillips has participated in many facets of CDBG grant
planning and administration as well as implementation.
Ms. Phillips currently serves as a member of the Statewide CSBG/CDBG Advisory
Committee and provides policy direction to the Florida Small Cities Community
Development Block Grant Program.

Ms. Phillips has also served in Local Government Economic Development
Councils. She was also a specialist with the former State Department of
Commerce in Tallahassee. She was one of the very few qualified persons
selected to go to Homestead, Florida, for many weeks after Hurricane Andrew to
assist in administering and implementing the CDBG Hurricane Disaster Recovery
effort. These projects alone were $21,000,000 in CDBG funds.
With regard to the projects Key Team Members; I am fully authorized to
contractually bind the company. I have over 1 1years personal experience in
grants/funding related projects (making sure the project can fit into the grant
funding parameters). Additionally, I will ensure that the firm's resources are
available and are utilized in a manner that will bring your project in on time and
within budget.

APPROACH AND ACTIVITIES
NPA may provide the local government with complete management and reporting for
their CDBG project, including separate financial tracking. The staff of NPA wil I allocate
the appropriate amount of time required to properly administer the CDBG grant on
behalf of the your community.
NPA may utilize the following approach and perform the following activities while
undertaking CDBG Administration Services if selected:

charge of overseeing the administration of the CDBG program.
EQUIPMENT
NPA has various types of equipment available in-house to provide the necessary
documents required for the CDBG program. In addition to in-house equipment,
including but not limited to, facsimile machine, computers, Power Point Presentation
equipment, etc., the principal staff who will be primarily responsible for the CDBG
program have statewide cellular phones readily available.

If selected as the CDBG Consultant, NPA proposes to complete the CDBG Grant
Administration Services before the end of the grant period allowed by the Florida
Department of Community Affairs, if feasible. Based upon the type of project selected,
NPA will work diligently to complete the project in the shortest amount of time possible;
thus, increasing chances for additional funding.

COMPENSATION
NPA is committed to performing the Grant Administration Services for the appropriate
CDBG program category of Commercial Revitalization.
The fee to provide these services for the City's CDBG project shall not exceed the
maximum allowable fee noted according to CDBG rules and regulations. For
Commercial Revitalization projects, the allowable grant administration fee shall not
exceed 8 percent of grant award.
Since the City is receiving a partial funding for this project, the fee shall not exceed the
8 percent allowed based upon the amount of the partial funding award. If additional
funding is received from DCA, the total amount charged for grant administration shall
not to exceed the sum of $56,000 allowed for a fully funded project.

I
Municipalities have always formed a core of C3TS' client base. In
addition to providing these municipalities with both engineering and
architecture services, we also create, review, and update the
documents that steer them into the future. These include Stormwater
Master Plans, Land Development Codes, Comprehensive Master
Plans, and award -winning Five -Year Capital Improvement Plans.
Along with these services, C3TS has helped many of these cities to
obtain millions of dollars in county, state, federal, and private grant
funds so that their projects can, in effect, pay for themselves.
C3TS has successfully prepared grant proposals for projects ranging
from the fairly uncomplicated, such as a one-time gift to repair the
leaky roof of a senior citizens' center, to the expansive, such as multi-
year funding for citywide street and drainage improvements. We also
have obtained funds to demolish unsafe structures and have produced
State Revolving Loan Fund applications, generating the financing
needed to improve wastewater systems and to correct
infiltration/inflow problems.
Our involvement with parks and recreation funding has been
especially successful. We have prepared grant proposals to acquire
land for the creation of public parks, to build recreational facilities,
and to obtain landscaping and playground equipment.
Our staff keeps in close contact with dozens of agencies to stay
informed of the latest grants available for a myriad of needs. No
matter the size or scope of the project, we provide detailed assistance
at every step of the process, from seeking out potential funding
sources and preparing the proposal documents, all the way through
preparing the final administrative reports once the project is complete.

Capital Improvement Program & Yearly Updates, City of Opa-locka, Florida —
Project Manager for the development of a Capital Improvement Program for the
rehabilitation and expansion of the City of Opa-locka's infrastructure. Yearly
amendments for this plan have been developed with the current document adopted for
fiscal years 1996 - 2000. The five-year Capital Improvement Plan identifies necessary
capital projects totaling $17,790,700 00 The preparation of the Capital Improvement
Plan (CIP) involved preparing various engineering studies for roadway improvements,
resurfacing projects, drainage projects, landscaping, street lighting, environmental
contamination abatement, sanitary sewer collection and transmission, water distribution
systems, parks and recreation improvements, and demolition of unsafe structures.
included in this program was the identification of funding sources, revenue projects,
requirements for applicable grants, as well as other required planning information.
Emergency Chlorine Vapor Scrubber, City of North Miami Beach, Florida —
Principal -in -Charge for this project which encompasses the retrofit to an existing
chlorine storage facility, as well as the installation of an emergency vapor scrubber
system at the Norwood Water Treatment Plant. This plant processes 16 million gallons
of water per day, using the lime softening method. Chlorine gas is used for disinfection,
employing two -ton cylinders of chlorine per day. The scrubber system is designed to
remove chlorine gas, which is highly toxic and hazardous in the event of an accidental
release
Cairo Lane Street Improvements, City of Opa-locka, Florida — Project Manager for
the design of approximately 0.5 miles of roadway resurfacing for a three -lane section.
This road is presently servicing a heavy industrial area. The project is being funded
through a special assessment and includes; roadway design, pavement markings and
around signage, drainage design, landscaping, and provisions for water and sanitary
sewer services.
9 Replacement of ACP Water Mains along N.W. 135th Street & Opa-locka Blvd., City of Opa-Locka, Florida —
This project, completed in 1994 at a cost of $650,000, replaced approximately 2 miles of old asbestos cement (ACP)
force mains and water mains in the City of Opa-locka, in connection with the widening and rehabilitation of the NW
135th Street/ Opa-locka Boulevard corridor Sizes of mains replaced varied from 8" to 16" diameter, and the project
also included a bridge attachment for a 12" water main aerial crossing over the Opa-locka Canal.

in the grants field through the research and preparation of grants. He completed multiple

City from United States EPA which included, testing storm water samples in order to
determine levels and localities of high pollution in the City's Stormwater drainage

CAD System Manager / IT Liaison, City of Miami, Department of Public Works,
Florida — Operated and maintained the Departments Computer Aided Design and
Drafting (CADD) system. Represented the Department of Public Works as liaison with
the City Department of Information Technology. Provided technical support to
employees within the Department of Public Works.

- Selection of hardware and software, purchased and installed 13 workstation CADD
- Installed and maintained AutoDesk software for the use of CADD draftsmen engineers

sector. Mr. Ruskay has extensive experience in the evaluation and management of
various grant programs, obtaining $12 million dollars in less than 3 years. He has
worked with a wide range of local governments to find and obtain the funding
necessary to make their capital projects a success. Mr. Ruskay en)oys a tremendous
grant application success rate of 92 percent. His grant applications consistently place
in the top percentages of funding program rankings. In 2000, he submitted projects
to Florida Department of Environmental Protection that ranked #1 in the State, in
both development and land acquisition. Additionally, Ryan placed the #1 ranked land
acquisition application for the federally funded Land and Water Conservation Fund.
This experience comes from both private and public sectors. Prior to his experience

in the bill itself Collaborated with Senator Foreman's office on final draft to be
introduced.

person team that was responsible for evaluation of FRDAP applicants. The
evaluation team awarded each project a score that was used in determining a
priority fist, which would be presented to the Florida Legislature.

Below is a brief summary of past and upcoming events.

ADMINISTRATION I GRIT — There are no new developments since your update at our last meeting.
Fire Station Project — The City Engineer reports that he still anticipates completion
of the project this summer. Hanging of sheetrock has begun downstairs. The project
continues to be on budget at this time. Weekly "construction meetings", in which the
Administrator, Engineer, Public Works Director, Fire Chief, Building Official and
Councilman Chandler discuss the project and its progress, are continuing.
Industrial Park — On Monday, August 11, 1 met with Jim Orth of CAS and Nancy
Phillips to discuss our plans and our various grants. I will be meeting with Dale Milita
on Friday, August 15. At this firne, we plan to contact the granting entities for
direction on how to proceed. If they agree to keep at least partial funding in place, we
will present a scaled down project to the City Council, which would still construct the
bridge, a street through the industrial park and partial water and sewer.
I have also been working closely with Leo Comer this week to obtain information
related to sale and lease prices for developed and undeveloped industrial zoned land.
I will keep you updated as developments occur in this important project.
SR 70 Meeting — A SR 70 corridor advisory committee has been formed by DOT and
will be meeting monthly. The committee will address issues related to the eventual
widening of SR 70, across the State. I attended the first meeting of the group on
Monday, July 2 1, in Arcadia. It is currently planned the group will meet monthly. They
have requested that we send our engineer to the second meeting, as they will be dealing
with engineering related issues. We will participate in any manner requested on this
important issue.

AMINISTRATION
Widening of NE 6 1h Street —Oscar has determined an estimated cost of $60,000 for
CONTINUED
widening and related NE 6 Street work. It has been suggested that I approach Big
Lake Bank with a proposal that the City would reimburse up to $30,000 of the cost of
widening if they were to bid the work out with their project. I certainly can present this
possibility to Joe Mullins for his consideration when I return to Okeechobee, next
week.
Step Pay Plan — The Administrator has visited each department to explain it to the
employees (with the exception of city Hall, planned Monday, august 18). Thus far, the
feedback seems to be positive from the employees. The finalized plan will be in your
budget packets for discussion at Budget Workshop.
Flagler Parks — We have received finalized contracts for the $415,859.00 CDBG grant
for parks 3-6. We have also advertised for a grant administrator (using procedures
required by the state). We received two proposals, but only one was complete.
Council will consider these at the August 19 meeting. Final plans for the project, to be
developed primarily by Oscar Bermudez, will be submitted later in the process.
Robin Brock has successfully completed the four-part Florida Institute of Government
(FIOG) training program and has received certification in Secretarial Development.
FINANCE
The consultant to assist in bringing the City into GASB 34 compliance, is currently
gathering information from the staff in the Finance Department.
The budget packets for FY03-04 have been prepared and distributed. I plan to meet
with each Councilman, individually, before the first workshop on Tuesday evening.
PUBLIC WORKS
Public Works employees have been and continue to be most helpful in the Fire Station
project.
Public Works is currently painting City Hall to match the newly painted Fire Station.
Public Works employees continue to disburse pellets into standing water and have
begun limited spraying of wet areas to help keep the mosquito population down.

SYNOPSIS
Donnie Robertson and Oscar Bermudez seem to have cleared permitting issues with
DEP related to the 4 th Street Boat Ramp. The ramp has been reopened following minor
repairs; however, more extensive repairs are needed.
Donnie Robertson is working with the contractor to schedule installation of the
guardrail on SW 12'h Avenue at SR 70.
Oscar Bermudez continues to work with various entities of DEP to develop a master
drainage plan. Staff met with representatives from Berryman & Henigar to discuss
upcoming state and federal mandates related to stormwater. Oscar also continues daily
oversight and coordination of the Fire Station project.
Public Works employees continue limited spraying within the canals and report positive
results. Current high water conditions limit the progress that can be made.
Oscar Bermudez has been invited to Panama City by the International Association of
Forensic Engineers to make a presentation on forensic engineering to an international
group of engineers.
The following are included in the items I have asked Attorney Cook to address.
I . Procurement of the Billy Mason/NE 9th Street right-of-way.
2. Noise/breach of peace/animal ordinance.
3. LDR issues such as conversion of former residential structures to commercial,
non-confornfing structures, building site elevations, visibility triangles, drainage
and street cut/right-of-way resolution.
4. Hamrick Trust — John is in discussion with the County Attorney on this matter.
