CEB REGULAR MEETING - PAGE 2 OF 4 AGENDA BOARD ACTION, =VOTE VI. PUBLIC HEARING ITEMS. A. Disposition of Cases presented by Code Officer Sterling: This being a quasi-judicial proceeding, an oath was administered to those offering testimony, all responded affirmatively. Officer Sterling advised all events occurred within the corporate limits of the City of Okeechobee. The Officer's notes, testimony, photographs, and supporting documents were all entered as part of the official record. Case No. 17-039 Officer Sterling testified notice of violation/notice of hearing was sent by certified mail to the property owner's address and Spirit CV Okeechobee FL LLC. 106 N Parrott Avenue received. Also, a copy of the notice of violation/notice of hearing was hand delivered to the store manager. This case was Ch 30 Sec 30-43 Public nuisance postponed at the January 9, 2018 meeting, however as of this date no attempt has been made on the part of Spirit CV Ch 30 Sec 30-44 General cleaning & beautification Okeechobee FL to contact the City or bring the property into compliance. Chairperson Gamiotea asked Attorney Cook if this case should be based on the landscaping requirements of the original plans or the requirements of the Land Development Regulations. Attorney Cook recommended the board base their findings on the Land Development Regulations which were in effect when Spirit CV Okeechobee FL was built. Some questions were raised by the board members as to how to determine specifically what type or how much landscaping needed to be installed or replaced. Chairperson Gamiotea read Ch 90 Sec 90- 539(a) which states An applicant shall be entitled to demonstrate that the landscape and buffer requirements can be more effectively met by an alternative landscape plan." Chairperson Gamiotea said this gives City staff the ability to sit down and work with the property owner and determine an acceptable landscaping plan. Chief Smith added his understanding is for the Code Board to be the mechanism to get the property owner to meet with staff another words "bring them to the table" to work out the details. In addition, a question was asked in reference to the trash accumulating on the property. Chairperson Gamiotea said trash/litter accumulation is addressed in the public nuisance ordinance (Ch 30 Sec 30-43). Once the property owner is found in violation of this ordinance they are considered a repeat violator and it will be easier to deal with if they violate the same ordinance in the future. Ms. Sandy Perry, member of the Economic Council, addressed the board stating she has concerns as a citizen of Okeechobee that we need to improve the overall beautification of our City. She encouraged the Code Board to take whatever measures are necessary to get the property cleaned up and follow through until it is completed. She closed by saying when business owners disregard the appearance of their property they are not being good business owners or citizens.
