and WHEREAS, the quality 'and effectiveness of these facilities, as well as their planning, design, and
construction, is vitally dependent upon the efforts and skill of public works officials; and WHEREAS, the

Comprehensive Plan Small Scale Future Land Use Map Amendment Application No. 03-003-SSA was submitted by
Kenneth D, and Julie Edwards who is also the property owner. The request is to change the designated land use from
Multi -Family to Commercial on Lots 4 to 6 of Block 75, City of Okeechobee subdivision for the purpose of building a
professional office building.
The Planning Staff Report reflects that the proposed amendment is consistent with the Future Land Use categories
and Plan Policies. The proposed use will help to redevelop the area and provide increased property values. Public
Facilities are adequate for the site by the Okeechobee Utility Authority for water and wastewater. It is compatible with
adjacent and nearby land uses. There is an existing duplex rental unit to the West, a single family residence to the East
and South with warehouses to the North. Existing commercial type uses are also located to the East and South. The
area is three blocks from the proposed new court house facility. The proposal appears to be consistent with the
standards found in the Comprehensive Plan. Based on the above information, Planning Staff recommends approval.
The Land Planning Agency considered the application at the February 25, 2003 meeting and voted unanimously to
recommend approval to the City Council. Mr. Jim LaRue, City Planning Consultant was present to answer various
questions from the Council.

2. a) Discussion on motion. Council Member Watford thanked Clerk Gamiotea for providing the additional information to the Council. Currently the
City does not have any agreement or document that states how the elections are to be billed to the City. He agreed
that before the next election something needs to be in place between the two entifies. Mayor Kirk also agreed and
requested Clerk Gamiotea work with County Supervisor of Elections to present an agreement for consideration.

resolution. Council Member Markham asked for clarification, the language in the proposed resolution states that should

D. Discussion pertairting to Alley Closing Appfication No. 68 submitted Alley Closing Application No. 68 was submitted by Steven G. and Mary A. Porter along with co -applicants J4Iry D. and
by Mary and Steve Porter - City Clerk (Exhibit 7). Willa D. Townsend. Additional property owners within the block who signed Letters of Consent are Lucy Goglia, John
C. Perry, Jr. and Ricky R. Redish. The request is to close the North to South alley located in Block 34, First Addition
to South Okeechobee subdivision. No easements are being required by the utifity companies. City Engineer Bermudez
along with Public Works Director Robertson are objecting to the closing due to drainage issues within the area.
Attorney Cook asked whether Mr. Porter would object to a drainage easement being retained. Mr. Porter responded
that he did not object, however, he could not answer for the other property owners involved.

F. Motion to award a bid related to the Industrial Park project, pending Council Member Chandler moved to award a construction bid to O'Connor of Okeechobee, base bid amount of
EDA approval - Craig A. Smith & Associates. seventy-six thousand, two hundred sixty-five dollars ($76,265.00) related to the Industrial Park (Commerce Center)
I Project, pending Economic Development Administration (EDA) approval; seconded by Council Member Williams.
This bid award is for the Contract 1 A City of Okeechobee Commerce Center Bid No. PW 01-00-01 -03. EDA Project
No. 04-01-04895. O'Connor of Okeechobee and McCabe Brothers were the only two bids received. The bid was not
awarded to the low bidder because the bid packet was incomplete and therefore not considered a viable bid.
Administrator Veach advised that the City will not enter into the contract without approval from EDA and commitment
that expenses for this project are reimbursable by EDA grant monies.

G. Discussion regarding reimbursements/line of credit for the Industrial
Administrator Veach requested direction from the Council regarding whether they wanted to make up -front payments

pertaining to the commerce center project out of the State Board Investment Fund (City Reserves) or pursue a line of
crecrit from a financial institution. The was a lengthy discussion between the Administrator and Council Members
whereby Mr. Veach explained that the City will need to expend a considerable amount of money; and it could be a
considerable amount of time before the City will receive reimbursements on this project from the grant monies. Mayor
Kirk commented that it would be better to use the money in reserves than to pay interest on a line of credit Council
concurred.
Council also discussed the engineering contract with Craig A. Smith and Associates. Mr. Veach will schedule Gene
Shriner of CAS to appear before them to discuss what the minimum acceptable payment would be for CAS to move
forward with the project at this time.

Below is a brief summary of past and upcoming events.
SYNOPSIS
DEPARTW
ADMINISTRAMN GRIT — Attorney Hellinger has resubmitted a notice of pending matters to the court
regarding the venue issue. As yet, no decision has been reached.
On December 301h, the City was served a summons by the Liquidating Trustee for
GRIT that we were being sued for the $48,648.03 that they claim the City owes them
for payment of one of Bettye's hospital bills. The hospital now indicates to the City
that they have been paid in this matter. Attorneys Cook and Robbins discussed the
matter and recommend that the City make no reimbursement at this time. Attorney
Robbins has submitted a proper response to the lawsuit.
Bettye Taylor continues to experience issues with her back and has been evaluated to
determine proper treatment. This evaluation began on January 8 1h and was concluded
on February 4 1h . Her doctor recommended surgery, however, Bettye is reluctant to
have additional surgery at this time. She is continuing treatment at a pain management
clinic. As with all of Bettye's medical expenses related to her back, the City is paying
the cost. This expenditure is coming from the legal cost line item (acct. 514).
Fire Station Project — The City Engineer reports that we are on schedule and budget
at this time. Councilman Chandler is currently participating in weekly "construction
meetings" in which the Administrator, Engineer, Public Works Director, Fire Chiefand
Building Official discuss the project and its progress.
Chief Tomey and Oscar Bermudez made a presentation in St. Petersburg this week
regarding the fire station and handicap accessibility. They were told to continue this
project as planned. However, the City was encouraged to begin a planning process,
which would ultimately address accessibility issues for all city governmental facilities.
Preliminary discussions have begun.

POLICE
Gallagher Bassett Services, Inc. is handling a lawsuit filed by Charlene Hamner against
the City of Okeechobee. Ms. Hamner is suing following an automobile collision with
one of our on duty City police officers (in a police car). Mediation for this matter has
been rescheduled for early March.
PUBLIC WORKS
Construction on the street projects has been completed, with the exception of issues
pertaining to NW 7 1h Street. Donnie Robertson is addressing the matter with the
Contractor.
Donnie is looking for an evergreen tree to plant in City Hall Park, which win become
our permanent Christmas tree.
CITY ATTORNEY
The following are included in the items I have asked Attorney Cook to address.
I . Procurement of the Billy Mason property.
2. Noise/breach of peace/animal ordinance.
3. LDR issues such as non -conforming structure, building site elevations, visibility
triangles and street cut/right-of-way resolution.
4. Pension Ordinance language (City Council item for March 18,h).
5. Legal issues and contracts related to the City's industrial park.
6. Hamrick Trust — John is attempting to locate and secure a research firm that is
well versed in reversionary issues.
7. City/County contractor licensing agreement — this proposed language is
currently being reviewed by the County Attorney.
8. GRIT issues.
9. Adelphia Contract.
10. Marvin Brantley's continuing situation.
CITY CLERK
The Municipal Code Corporation reported that our Code Books are in final editing
mode and should be delivered by the middle of March.
There is a vacancy for an alternate member to the PlanningBoard/Board of
Adjustments and Code Enforcement Board.

PROVIDING FOR INCLUSION OF ORDINANCE AND REVISED FUTURE
LAND USE MAP IN THE COMPREHENSIVE PLAN; PROVIDING FOR AN
EFF13CTIVE DATE.
WHEREAS, the City Council of the City of Okeechobee recognizes the need to plan for
orderly growth and development; and
WHEREAS, Chapter 163, Florida Statues, and Rule 9J5, Florida Administrative Code
provide for amendment to Adopted Comprehensive Plans; and
WHEREAS, the City has received and reviewed certain application(s) for a small-scale
amendment to the Future Land Use Element of the City's Comprehensive Plan, and
said application(s) being reviewed by the City's Land Planning Agency at a duly
advertised meeting, and submitted by staff report, which determined such
applicant(s) to be consistent with the Comprehensive Plan and appropriate to the
future land uses within the City; and
WHEREAS, the City has agreed with the recommendations of the Land Planning Agency

THIS ORDINANCE shall be known as the "City of Okeechobee Small Scale
Development Activities Comprehensive Plan Amendment", pursuant to F.S.
163-3187, and shall be effective within the City limits of the City of Okeechobee,
Florida.
SECTION 2 AUTHORITY.
This City of Okeechobee Small Scale Development Activities
Comprehensive Plan Amendment is adopted pursuant to the provisions of Chapter
163.3187, Part 11, Florida Statutes.
SECTION 3 REVISIONS TO THE FUTURE LAND USE MAP.
1. The following described land is hereby redesignated for purposes of

residential triplex rental unit. The owner feels the nature of this is suitable for the area, as
there are many rental units on the west and south sides of the property. Adjacent to the
property to the west is a residential rental complex known as Okeechobee Commons. The
current zoning designation is Residential Multiple Family. The current Future Land Use

The subject property is located between both a developed multi -family lot and a
vacant commercial lot. The likelihood of this property devel 6ping for Single Family
use is small and may better serve the area by providing affordable rental units. The
subject property is already zoned for Multi -Family use and the owner will not need to
petition the City for a rezoning if this amendment is approved.

side, the commercially zoned property on the east side, and the church use on the
south side.
D. Compliance with Specific Standards of the Plan.
This proposal appears to be consistent with the standards found in the
Comprehensive Plan.
Analysis and Conclusions
The request is reasonable and should not cause any impact to nearby properties. The
requested small-scale map amendment will make the property consistent with the
existing Residential Multi -Family zoning. The proposed use is consistent with the

Attorney Cook explained that the intent of the amendment was to combine two different sections
within the LDR's pertaining to Section 681 (4) and (5). He further explained that the some of the
temporary use applications require insurance that was not initially required. Also to be
incorporated is fimdrasing for non-profit organizations. He explained that not all ftmdrasing
requests include yard sales and bake sales. Attorney Cook noted that by amending this section it
will limit the types of fandraising that can be donejor example collecting donations such as a boot
drive in the main intersection. He added tha; the Sheriffs Office is currently working in
connection with the City Police Department on a proposal to ban all activities in the. main
intersection for safety reasons.
Attorney Cook indicated that he was not comfortable with the current wording, but feels it clearly
states the intent of the changes. He will redo the wording prior to the City Council meeting.
There was no public comment. There was no discussion from the Agency.
Agency Member Hoover moved to recommend to the City Council to grant approval of Land
Development Regulations amendment to Section 681 (4) and (5). Agency Member Keller
seconded the motion.

PRCIVIDING FOR INCLUSION OF ORDINANCE AND REVISED FUTURE

EFFIECTIVE DATE.
WHEREAS, the City Council of the City of Okeechobee recognizes the need to plan for
ordedY growth and development; and
WHEREAS, Chapter 163, Florida Statues, and Rule 9J5, Florida Administrative Code
Provide for amendment to Adopted Comprehensive Plans; and
WHEREAS the City has received and reviewed certain application(s) for a small-scale
a;�endment to the Future Land Use Element of the City's Comprehensive Plan, and
said application(s) being reviewed by the City's Land Planning Agency at a duly
advertised meeting, and submitted by staff report, which determined such
applicant(s) to be consistent with the Comprehensive Plan and appropriate to the
future land uses within the City; and
WHEREAS, the City has agreed with the recommendations of the Land Planning Agency
that the proposed application(s) complies with the requirements of Florida Statutes

The subject property is located in a neighborhood that contains a variety of land uses including
industrial and warehousing to the north, single family to the east, a triplex and duplex to the
west, and a condemned single family home to the south. In the extended area there are offices, a
church, motels, and commercial businesses. It is also likely that the proposed courthouse, which
is located less than three blocks to the south, will place pressure on this area for additional office
use. Given the analysis of the immediate area, the proposed use appears to be reasonable.
I Comprehensive Plan Analysis
A. Consistency with the Land Use Categories and Plan Policies.
The proposed amendment is consistent with the Future Land Use Categories and Plan
Policies, and the proposed use will help to redevelop the area and provide increased
property values.
B. Concurrency of Adequate Public Facilities
The Utility Authority has sewer and water service available for this site.
C. Compatibility with Adjacent and Nearby Land Uses
The proposed land use is compatible with the adjacent and nearby uses which include
office, industrial and commercial uses. Furthermore, the proposed office use will only
cause minimal traffic impact in the area. The existing Single Family Land Use
District is also situated in an area that is buffered by Industrial to the north and
Commercial to the east and south, thus making land uses such as office more
compatible with the larger scale development of the area.
D. Compliance with Specific Standards of the Plan.
This proposal appears to be consistent with the standards of the Comprehensive Plan.
Analysis and Conclusions
The subject property is located in an area of mixed land use such as industrial, multi-
family, office and commercial uses. Commercial land use and zoning districts are
located as close as one-half block away to the south and to the east of the subject
parcel, and parcels designated with the Public Facilities Future Land Use Category
are located as close as two blocks to the south. Industrial land use is also located
across the street to the north of this property. There are condemned residential
properties next to this property as well. Given the existing condition and uses in the

area, the proposed office appears to be compatible and should help to improve
property values.
The proposed use is also consistent with the Comprehensive Plan; therefore, based on

Attorney Cook explained that the intent of the amendment was to combine two different sections
within the LDR's pertaining to Section 681 (4) and (5). He further explained that the some ofthe
temporary use applications require insurance that was not initially required. Also to be
incorporated is ftindrasing for non-profit organizations. He explained that not all fundrasing
requests include yard sales and bake sales. Attorney Cook noted that by amending this section it
will limit the types of fandraising that can be done,,'for example collecting donations such as a boot
drive in the main intersection. He added that the Sheriffs Office is currently working in
connection with the City Police Department on a proposal to ban all activities in the main
intersection for safety reasons.
Attorney Cook indicated that he was not comfortable with the current wording, but feels it clearly
states the intent of the changes. He will redo the wording prior to the City Council meeting.
There was no public comment. There was no discussion from the Agency.
Agency Member Hoover moved to recommend to the City Council to grant approval of Land
Development Regulations amendment to Section 681 (4) and (5). Agency Member Keller

The matter before you is to consider approving the costs for the September 10, 2002 Special Election
(held during the 2002 Primary) and the November 5, 2002 General Election. It was our intention to pay
for the Special Election out of the 2001-2002 Budget and the General Election from the 21002-2003
Budget. However, due to billing methods both elections Will need to be paid out of the 2002-2003
Budget. Since this amount i s over seven thousand, five hundred dollars, Council approval is necessary.
I also wanted to notify the Council that this expenditure might require a budget amendment. I will be
monitoring the situation very closely and working with the Administrator to make sure it is taken care of
appropriately.

Attached herewith is the additional information provided by the County Supervisor of Elections as to what
formula or method was used to calculate the City's portion of the primary and general election costs.
There is not an interlocal or any type of agreement between the City and County setting out how the
billing was to be calculated. The 1986 election was the first one that was handled by the County and
according to the election invoices all expenses pertaining to the election were tallied, divided in half, and
the City paid 50 percent. At that time the City shared all of its precincts and polling places with the
County's. As the election process has changed with technology and redistricting of the precincts, it has
caused the billing method to also change. As you will see on the attached invoice, Mrs. Chandler's
method does charge the City 100 percent for the precincts and polling places that are the City (and 82
percentfor the one that is shared). However, she does not charge us for equipment delivery and set up,
equipment calibration, advertisements, household sample ballot mailings and additional day time
election workers.
Mrs. Chandler also suggested that now may be the time to consider an interlocal agreement that would
address how the election process is handled and invoiced. There are several County's that handle their
City's election and most of them work under some type of interlocal agreement. Atter she forwards a
proposed copy of the agreement, I will ask Attorney Cook to review it prior to submitting it to the Council
for consideration.

*The Florida Election Reform Act of 2001 enacted many election law changes and
mandated the acquisition of a new voting system for Okeechobee County. The Reform
Act, the new voting system, and the post-2000 election climate increased the training
required for poll workers. Resultantly, poll worker costs increased.
Since the 1998 election cycle, the computation method used for poll worker election
cost is the precinct cost of poll workers x the precinct percentage of city electors. This
method is shown on the 2002 Cost Computation sheet.
"The rent for a polling location is $100.00. Since the 1998 election cycle, the
computation method used for polling site rent cost is the rent for the polling site x the
precinct percentage of city electors. This method is shown on the 2002 Cost
Computation sheet.
'The average rate of election cost increase per election cycle 1992 - 2002 is 15%.
Additionally, election costs such as Precinct Equipment Delivery Costs, Legal
Advertisements, and Household Sample Ballot Mailings are not included in the cost
computations. Some of these costs were previously included in the City Election

FOR EFFECTIVE DATE.
WHEREAS the land development regulations for the City of Okeechobee, Florida, provide
for regulation and requirements for temporary structures and temporary off -
premises sales in section 681(4) and section 681(5), which sections are not
uniform; and
WHEREAS it is desirable for the City, to promote interests of uniformity for these sections,
and to permit the use of a single application form and procedure for such
applications by city staff within the city; and
WHEREAS it has become necessary to provide for additional off -premises activities in
these sections to include fund raising type activities not traditionally found in off -
premises sales activities; and
THEREFORE, be it ordained and adopted by the City of Okeechobee, Florida, that
the following amendments to Section 680, Land Development Regulations:

The following temporary structures may be permitted upon the issuance of a

organization on or abutting their principal use.
c Commercial carnival, circus or fair in commercial or industrial districts.
d Similar temporary structures where the period of use will not exceed 30 days
a year.

provisions and portions of this ordinance shall remain in full force and effect.

SSA. Consider a recommendation to the City Council, to change the land use
designation from Single Family to Multi Family located within the 100 Block of
NW I I' Street. The property owner and applicant is Lake View Builders, Inc.
B. Comprehensive Plan, Future Land Use Map Amendment Application No. 03-003-
SSA. Consider a recommendation to the City Council, to change the land use
designation from Multi Family to Commercial located within the 200 Block of
NW 7 th Street. The property owners and applicants are Kenneth D. and Julie
Edwards.
Mr. Don Murray of LaRue Planning and Management Services, gave a brief background of the
subject property. He explained that the applicant is requesting to change from Single Family to
Multi Family to allow for the construction of a triplex. Mr. Murray explained that the proposed
use is consistent with the surrounding uses and with the existing zoning classification. Planning
Staffrecommends that the Land Planning Agency recommend to the City Council to grant approval
of Application No. 03-002-SSA to change the existing land use from Single Family to Multi
Family to allow for the construction of a triplex located within the 100 Block of N.W. I I " Street.

Attorney Cook explained that the intent of the amendment was to combine two different sections
within the LDR's pertaining to Section 681 (4) and (5). He further explained that the some of the
temporary use applications require insurance that was not initially required. Also to be
incorporated is fundrasing for non-profit organizations. He explained that not all ftindrasing
requests include yard sales and bake sales. Attorney Cook noted that by amending this section it
will limit the types of fandraising that can be done, for example collecting donations such as a boot
drive in the main intersection. He added that the Sheriffs Office is currently working in
connection with the City Police Department on a proposal to ban all activities in the main
intersection for safety reasons.
Attorney Cook indicated that he was not comfortable with the current wording, but feels it clearly
states the intent of the changes. He will redo the wording prior to the City Council meeting.
There was no public comment. There was no discussion from the Agency.
Agency Member Hoover moved to recommend to the City Council to grant approval of Land
Development Regulations amendment to Section 681 (4) and (5). Agency Member Keller

approved, except for parking layout and compliance with applicable codes; and
WHEREAS, of particular concern to the City of Okeechobee was the plan submitted by
Okeechobee Countyto complywith City Land Development Regulations concerning
off-street parking for the facility; and
WHEREAS, at its meeting of February 26, 2003, the Technical Review Committee
reviewed the parking plan and proposal of Okeechobee County, and determined to
recommend to the City Council a reduction in required off-street parking spaces
under applicable code, due to a surplus of on -street parking in the vicinity of the
courthouse; the addition of a parking lot adjacent to the courthouse on the grounds
of the First United Methodist Church of Okeechobee, and contract between the
church and the County that would add 69 off-street parking spaces; and the
statistics supplied by Okeechobee Countywhich illustrates the location and number
of available parking spaces, both on -street and off-street in the vicinity of the
courthouse;and
WHEREAS, the City Council for the City of Okeechobee, Florida is empowered by the
provisions of Section 454, Land Development Regulations, to reduce the required
number of off-street parking, spaces by up to 50 percent in public use zoning
districts, upon recommendation of the Technical Review Committee under certain
circumstances; i
NOW, THEREFORE, it is hereby resolved and approved by majority vote of the City
Council for the City of Okeechobee, Florida, that:
The City of Okeechobee, Florida has the authority under the provisions of
Section 454, Land Development Regulations, as amended, to. reduce in
appropriate circumstances the number of off-street parking space�- in a
public use zoning district by up to 50 percent of the required number.
2. That the requirement for off-street parking for the courthouse facility in Block
125, City of Okeechobee, considering a total of 72,922 square feet of net
usable floor space, is 182 parkingspaces, and the County is requesting a
50 percent reduction in such requirement, or a total of 91 off-street parking
spaces.

3. That the Technical Review Committee, at its meeting of February 26, 2003,
determined that due of a surplus of on -street parking, and the addition of 69
spaces in a leased parking lot, and the parking plan submitted by the
County, it would be appropriate to make a recommendation to the City
Council to approve a reduction in off-street parking spaces, which
recommendation is herein accepted by the City.
4. That the parking plan submitted by the County, (attached as exhibit W, and
incorporated herein by reference), illustrates that the plan, with the use of
both on -street and off-street parking, will supply sufficient parking for the
facility at the present time, and such parking plan is approved by the City
Council.
6. That of significant concern to the City however, is that future expansion of
the facility, its personnel, offices, pedestrian and vehicular traffic, and
general use of the courthouse, will present an increase in parking
requirements and spaces, with the concurrent problem of sufficient storm
water drainage from the site.
6. That upon the plans, specifications and documents presented at this time,
and accepting the recommendation of the Technical Review Committee, the
City Council hereby approves the request of the applicant Okeechobee
County, Florida, for a reduction in off-street parking at the courthouse facility
in Block 125, from the required number of 182 spaces, to a total of 91 off-
street parking spaces; conditioned however, upon the execution of an
acceptable Inter -local Agreement between the City and County which will
address the future concerns of the City for parking and drainage
requirements.
7. That it is not the intent, and this resolution shall not cause, a variance or
waiver, in any applicable section of the Land Development Codes of the City
of Okeechobee that May be in effect upon an application or permit request
by Okeechobee County in the future for expansion or enlargement of the
physical facility, or modification of, the courthouse facility, its parking or
drainage plan, in Block 125, City of Okeechobee.
8. That this resolu ' tion shall become effective immediately upon adoption by the
City Council at its meeting of March 4, 2003; however, should the City and
County not enter into an acceptable Inter -local Agreement to implement the
requirements of future parking and drainage issues within 60 days of this
resolution, it shall lapse and become null and void without further action by
the City Council.

Okeechobee County Courthouse Expansion Project
Blocks 125 and 138

Request for a Reduction of Parking Spaces in a Public Use District
Okeechobee Pounty is proposing to expand the county courthouse located in the downtown area of
the City of Okeechobee.
Okeechobee County requests that the City of Okeechobee find that there is a surplus of on-streei
parking available in the inunediate vicinity of the courthouse that is not required by other uses, and
accordingly that the City of Okeechobee grant a 50% reduction in the number of off-street parking
spaces that are required to be provided in association with the courthouse expansion project.
Description of the Okeechobee County Courthouse Expansion Project
The current, historic courthouse is situated in the center of an entire city block and has a footprint
of 13,269 square feet. The total gross floor area of the building is 24,286 square feet. When vacated
by the various court and Clerk functions, the building will be renovated. Following the renovation,
possible usas for the building include county administrative offices or possibly some continuation
of court activities, but a final decision has not yet been made.
The courthouse expansion will occupy the block to the north of the historic courthouse. The portion
of NW 3 d *reet between the two courthouse blocks lias been vacated by the City, allowing for a
unified governmental/judicial district. The new courthouse will have a footprint of 28,058 square
feet.
The interior of the three-story courthouse expansion will be approximately 76,273 square feet. Of
that total are several areas found only on the ground floor that are external to the main structure.
These include the security lobby that comprises the front entrance, mid the prisoner sally port,
generator room, and electrical and fire pump rooms to the rear. The front security lobby and the rear
prisoner sally port usually would 'not be found in a governinent building, but are provided to ensure
security for the unique functions of a courthouse. Areas such as the unoccupied electrical and fire
pump rooms sometimes are located within a building, but have been located outside of the main
structure for safety and architectural reasons
Subtracting -the area of the ground floor external appul tenances, the result is a working gross area
of 72,922 square feet for the three-story building.
City Parking requirements
City of Okeechobee regulations require 1 parking space for each 400 square feet of net floor area for
a governinent office or courthouse. Using the net area of 72,922 square feet, a total of 182 parking
spaces are required.

Section 454 of the City's land development regulations, as amended, states that City Council may
reduce the number of off-street parking spaces that must be provided if the Technical Review
Committee finds that there is a surplus of on -street parking in the immediate vicinity that is not
required by other uses. The maximum reduction that may be granted by City Council is 50%.
Accordingly, up to 91 of the required off-street parking spaces may be substituted for on -street
parking if it is available. A minimurn of 91 off-street parking spaces would still be required.
Parking available
Off-street parking spaces
Of the required 182 parking spaces, 97 will be provided off-street. That includes 28 spaces to be
located to the rear of the courthouse expansion, and another 69 that will be provided in a parking lot
that the County will construct on an adjoining block owned by the First Methodist Church.
By providing the 97 off-street parking spaces as described, the courthouse expansion -project will
exceed the minimum requirement of 91 off-street parking spaces, and will have a small surplus of
6 off-street parking spaces.

On-streetparking spaces
A review ofparking currently available or that will be consti ucted in association with the courthouse
expansion indicates that there will be a surplus of 153 on -street parking spaces within one block of
the courthouse. That includes an allowance for businesses in the area that rely on on�street parking
for all or part of their parking needs. The availability of on -street parking spaces is des c*ribed as
follows:
As part of the courthouse construction project, on -street parking will be constructed adjacent to
Block 125, the block on which the courthouse expansion will be located. On -street parking
contiguous to Block 125 will consist of 15 spaces to be constructed on the east side of NW 4"'
Avenue, 13 spaces to be constructed on the west side of NW Yd Avenue, and the use of 15 spaces
that can be striped on the north side of the block (south side of NW 4 Ih Street).
A total of 43 on -street parking spaces will be constructed or otherwise available surrounding and
contiguous to the courthouse expansion block, all of which can be considered surplus on -street,
parking.
To the east of the courthouse, all of Block 139 is owned by the First Methodist Church, all of Block
124 is owned by the Episcopal Church, and most of Block 107 is occupied by Okeechobee Rehab.
Because of their hours of operation, on -street parking adjacent to the church properties will be
available during business hours of the courthouse. On -street parking will also be available near
Okeechobee Rehab, as on -street parking there is rarely used. Accordingly, on -street parking on both
sides ofNW Td Street between NW 2",Avenue and NW P Avenue will be available for use, as well
as parking on the both sides of NW 4b Street between NW 2 nd Avenue and NW P Avenue. In
addition, the Countywill construct on -street parking on the east side ofNW P AvenuebetweenNW
3 d Street and NW 4" Street.

Allowing for some driveways, a total of 96 on -street parking spaces in this area can be considered
surplus.
North of the courthouse expansion, on the north side of NW 0 Street between NW 3" Avenue and
W 4 th Avenue, are 2 residences and one small office building. Providinig for a driveway connection

In the immediate area of the courthouse, a total of 153 on -street parking spaces are. or will be
available that are not otherwise in use and can be considered surplus. That includes the spaces
contiguous to the courthouse expansion block, several spaces across the street to the north, and a
nuniber of parking spaces within one block to the east.
Up to 91 on -street parking spaces are required for the courthouse expansion project. The available
surplus of 153 surplus significantly exceeds the number of spaces needed, still leaving an additional
62 on -street parking spaces not allocated for courthouse use.
In addition to the surplus 153 on -street parking spaces available contiguous to or to the north and
east of the eourthouse, ample parking is available for the businesses which are located to the west
of the cout thouse, most of which rely significantly or exclusively on on -street parking to meet their
parking needs.
Available parking in that area includes both sides of NW 4"' Street between NW 4dAvenue and NW
5"' Avenue,, where 28 spaces can be provided by striping the existing roadway. Another 22 spaces
already exist on both sides of NW Td Street between NW 0 Avenue and NW 5'h Avenue. Finally,
16 spaces will be available on the west side of NW 4"' Avenue between NW 3 d Street mid NW Wh
Street. 'Those 16 spaces will be constructed in association with the courthouse expansion project,
even though it is anticipated that the spaces will be used by nearby businesses and are not intended
for courthouse use. Altogether, a total of 66 on -street parking spaces will be available for use by
local businesses in the area west of the courthouse.
Request for a Reduction of Parking Spaces in a Public Use District
In total, there are or will be 221 on -street parking spaces in the inunediate vicinity of the coui-thouse
expansion, not including any of the spaces South of NW 3 d Street that surround the historic, existing
courthouse.
At least 153 of the 221 on -street parking spaces are surplus mid are not required by other uses.
Okeechobee County requests that the City of Okeechobee find that there is a surplus of on -street
parking available in the in-unediate vicinity of the courthouse that is not required by other uses, and
accordingly that the City of Okeechobee grant a 50% reduction in the number of ofPstreet parking
spaces that are required to be provided in association with the courthouse expansion project.
TIiis would result in a minimum of 91 parking spaces being provided off-street, and the use of up
to 91 on -street parking spaces in the vicinity'of die courthouse expansion.

Request for a Reduction of Parking Spaces in a Public Use District
Okeechobee County is proposing to expand the county courthouse located in the downtown area of
the City of Okeechobee.
Okeechobee County requests that the City of Okeechobee find that there is a surplus of on -street
parking available in the immediate vicinity of the courthouse that is not required by other uses, and
accordingly that the City of Okeechobee grant a 50% reduction in the number of off-street parking
spaces that are required to be provided in association with the courthouse expansion project.
Description of the Okeechobee County Courthouse Expansion Project
The current, historic courthouse is situated in the center of an entire city block and has a footprint
of 13,269 square feet. The total gross floor area of the building is 24,286 square feet. When vacated
by the various court and Clerk functions, the building will be renovated. Following the renovation,
possible uses for the building include county administrative offices or possibly some continuation
of court activities, but a final decision has not yet been made.
The courthouse expansion will occupy the block to the north of the historic courthouse. The portion
of NW Yd Street between the two courthouse blocks has been vacated by the City, allowing for a
unified governmental/judicial district. The new courthouse will have a footprint of 28,058 square
feet.
The interior of the three-story courthouse expansion will be approximately 76,273 square feet. Of
that total are several areas found only on the ground floor that are external to the main structure.
These include the security lobby that comprises the front entrance, and the prisoner sally port,
generator room, and electrical and fire pump rooms to the rear. The front security lobby and the rear
prisoner sally port usually would not be found in a government building, but are provided to ensure
security for the unique functions of a courthouse. Areas such as the unoccupied electrical and fire
pump rooms sometimes are located within a building, but have been located outside of the main
structure for safety and architectural reasons
Subtracting the area of the ground floor external appurtenances, the result is a working gross area
of 72,922 square feet for the three-story building.
City Parking requirements
City of Okeechobee regulations require 1 parking space for each 400 square feet of net floor area for
a government office or courthouse. Using the net area of 72,922 square feet, a total of 182 parking
spaces are required.

Section 454 of the City's land development regulations, as amended, states that City Council may
reduce the number of off-street parking spaces that must be provided if the Technical Review
Committee finds that there is a surplus of on -street parking in the immediate vicinity that is not
required by other uses. The maximum reduction that may be granted by City Council is 50%.
Accordingly, up to 91 of the required off-street parking spaces may be substituted for on -street
parking if it is available. A minimum of 91 off-street parking spaces would still be required.

Off-street parking spaces
Of the required 182 parking spaces, 97 will be provided off-street. That includes 28 spaces to be
located to the rear of the courthouse expansion, and another 69 that will be provided in a parking lot
that the County will construct on an adjoining block owned by the First Methodist Church.
By providing the 97 off-street parking spaces as described, the courthouse expansion project will
exceed the minimum requirement of 91 off-street parking spaces, and will have a small surplus of
6 off-street parking spaces.
On -street parking spaces' )
A review ofparking currently available or that will be constructed in association with the courthouse
expansion indicates that there will be a surplus of 153 on -street parking spaces within one block of
the courthouse. That includes an allowance for businesses in the area that rely on on -street parking
for all or part of their parking needs. The availability of on -street parking spaces is described as
follows:
As part of the courthouse construction project, on -street parking will be constructed adjacent to
Block 125, the block on which the courthouse expansion will be located. On -street parking
contiguous to Block 125 will consist of 15 spaces to be constructed on the east side of NW 4h
Avenue, 13 spaces to be constructed on the west side of NW 3d Avenue, and the use of 15 spaces
that can be striped on the north side of the block (south side of NW 4a' Street).
A total of 43 on -street parking spaces will be constructed or otherwise available surrounding and
contiguous to the courthouse expansion block, all of which can be considered surplus on -street
parking.
To the east of the courthouse, all of Block 139 is owned by the First Methodist Church, all of Block
124 is owned by the Episcopal Church, and most of Block 107 is occupied by Okeechobee Rehab.
Because of their hours of operation, on -street parking adjacent to the church properties will be
available during business hours of the courthouse. On -street parking will also be available near
Okeechobee Rehab, as on -street parking there is rarely used. Accordingly, on -street parking on both
sides ofNW YdStreet between NW 2 d Avenue and NW YdAvenue will be available for use, as well
as parking on the both sides of NW 4bStreet between NW 2 nd Avenue and NW YdAvenue. In
addition, the County will construct on -street parking on the east side ofNW YdAvenuebetweenNW
3rd Street and NW 4thStreet.

Allowing for some driveways, a total of 96 on -street parking spaces in this area can be considered
surplus.
North of the courthouse expansion, on the north side of NW 4" Street between NW 3' Avenue and
NW 4th Avenue, are 2 residences and one small office building. Providing for a driveway connection
and business use by the office, 14 on -street parking spaces can be considered surplus, not including
2 spaces for use by the professional office.
In the immediate area of the courthouse, a total of 153 on -street parking spaces are or will be
available that are not otherwise in use and can be considered surplus. That includes the spaces
contiguous to the courthouse expansion block, several spaces across the street to the north, and a
number of parking spaces within one block to the east.
Up to 91 on -street parking spaces are required for the courthouse expansion project. The available
surplus of 153 surplus significantly exceeds the number of spaces needed, still leaving an additional
62 on -street parking spaces not allocated for courthouse use.
In addition to the surplus 153 on -street parking spaces available contiguous to or to the north and
east of the courthouse, ample parking is available for the businesses which are located to the west
of the courthouse, most of which rely significantly or exclusively on on -street parking to meet their
parking needs.
Available parking in that area includes both sides ofNW 4th Street between NW 401 Avenue and NW
5 Ih Avenue, where 28 spaces can be provided by striping the existing roadway. Another 22 spaces
already exist on both sides of NW 3dStreet between NW 4ffi Avenue and NW 5'h Avenue. Finally,
16 spaces will be available on the west side of NW 4hAvenue between NW 3'dStreet and NW 4th
Street. Those 16 spaces will be constructed in association with the courthouse expansion project,
even though it is anticipated that the spaces will be used by nearby businesses and are not intended
for courthouse use. Altogether, a total of 66 on -street parking spaces will be available for use by
local businesses in the area west of the courthouse.

In total, there are or will be 221 on -street parking spaces in the immediate vicinity of the courthouse
expansion, not including any of the spaces south of NW 3 rd Street that surround the historic, existing
courthouse,
At least 153 of the 221 on -street parking spaces are surplus and are not required by other uses.

OKEECHOBEE COUNTY DEVELOPMENT AGREEMENT
THIS Agreement, made and entered into this day of , 2003, by and
between OKEECHOBEE COUNTY, a political subdivision of the State of Florida (hereinafter
refereed to as'�OWNER`% and THE CITY OF OKEECHOBEE, a political subdivision ofthe State
of Florida (hereinafter referred to as "CITY").
RECITALS
A. OWNER is the fee simple owner of a certain tract of land located within The City of
Okeechobee consisting of approximately 1.55 acres; the said property hereinafter
being referred to as "PROPERTY" and being more particularly described in Exhibit
"A" attached hereto and made a part hereof OWNER is the holder of all legal and
equitable ownership rights in the PROPERTY.
B. The OWNER represents that it is the fee simple owner of the PROPERTY and that
the rights granted herein and the obligations created hereby shall in no way be affected
by the property right ofany other entity at the time ofthe execution ofthis Agreement
or at any time between the execution of this Agreement and the recording of this
Agreement in the Public Records of Okeechobee County, Florida. The parties herein
agree and all other third parties are hereby put on notice that the rights of the CITY,
the development limitations and all other matters affecting the land are in all ways
superior in right, title and interest to any subsequent mortgage, or any other type of
legal or equitable interest subsequent in time to the recording of this Agreement.
C. The OWNER desires to develop the PROPERTY as a public facility consisting of a
new Courthouse, two office buildings (future), and related, incidental uses. The
parties recognize said use was approved pursuant to CITY's Small Scale Area Map
Amendment, dated February 4, 2003, Ordinance No. 813, and Zoning Amendment
dated Februairy 4, 2003, Ordinance No. 814. The current land use plan is therefore
reasonable and appropriate for application to the PROPERTY upon fulfillment ofthe
OWNER's obligations under this Development Agreement. It is the purpose of this
Agreement to provide a mechanism to mitigate potential adverse parking and traffic
circulation impacts created by the development ofthe PROPERTY and to ensure that
adequate public services may be provided to the PROPERTY and to the balance of
the residents of the CITY.
D. The OWNER agrees to construct certain parking, landscaping, pedestrian, and
transportation improvements as set forth in this Agreement, which improvements will
mitigate the potential adverse impacts of the proposed development.
E. This Agreement is authorized by Section 163-3220, et seq., Florida Statutes (1989),
and the CITY OF OKEECHOBEE Unified Land Development Code Ordinance No.
716, as amended, and the provisions of those laws as they exist as of the date of this
Agreement are incorporated herein by reference and shall govern the relationship of
the parties under the terms of this Agreement. Any matters required by existing state
statute or CITY Ordinance(s) which are not a part of this Agreement shall,
nevertheless, be complied with by the parties. The OWNER and its successors in
interest shall be responsible for every obligation set forth under the terms of this
Agreement. The PROJECT as set forth herein is consistent with the CITY OF
OKEECHOBEE Comprehensive Land Use Plan and CITY OF OKEECHOBEE
Unified Land Development Code.

NOW THEREFORE, in consideration of the mutual promises and covenants herein made and
agreed to be kept, the parties hereto agree as follows:
The foregoing recitals are true and correct and are incorporated herein by reference.
2. This Agreement will be valid for ten (10) years from the date that it is executed by all
parties. This Agreement may be extended by mutual consent of the CITY and
OWNER, subject to a public hearing pursuant to 163-322 1, Florida Statutes. Further
this Agreement may be amended or canceled by mutual consent ofthe parties or their
successors in interest.
3. The OWNER represents that nothing herein is barred or prohibited by any other
contractual agreement to which it is a party or to which any of its agents or
representatives are a party, by any existing statute or rule, by an existing govenunental
agency, by any third party, or by the rights of any other party with a direct or
contingent interest in the PROPERTY, whether legal or equitable.
4. All development rights created hereunder will be subject to compliance with all CITY
ordinances, zoning approval, Ordinance No. 814, site plan approvals, and shall be in
compliance with all development permits and applicable regulations of CITY,
Regional, District, State and Federal Agencies. The fifflure of this Agreement to
address a particular permit, condition, term, or restriction shall not relieve the
OWNER of the necessity of complying with the existing law governing said
permitting requirements, conditions, terms or restrictions and any matter or thing
required to be done under existing ordinances ofthe CITY or regulations ofany other
government agency or other entity having legal authority over the PROPERTY. No
such ordinance, law or regulation will otherwise be amended, modified or waived
unless conduct constituting such modification, amendment or waiver is provided for
herein and all necessary procedural steps are taken relative to the granting of such
modification, amendment or waiver in accordance with terms of applicable CITY
ordinances and State Statutes. All applicable impact fees, development review fees,
building permit fees, and all other fees of any type shall be paid in accordance with
their terms and in such amounts applicable as they become due and payable except as
is otherwise specifically provided herein.
5. (a) The parties agree that the CITY's willingness to enter into this Agreement,
the staff approval or recommendation relative to the proposed development,
land use plan designations, the passage ofordinances attempting to modify the
land use designations, submittals to or before the City of Okeechobee City
Council or the Florida Department of Community Affairs, and any other act
in furtherance of this Agreement by the CITY, including the negotiations
leading up to the execution of this Agreement, will not be used by the
OWNER or its successors in interest in any way whatsoever as committing
the CITY legally through theory of equitable estoppel or any other legal
theory to the approval of such proposed development in the event that this
Agreement is terminated or for any other reason does not take effect in all
material respects. ne parties further agree that any and all action by the
OWNER or its representatives in negotiation ofthis Agreement and including
all efforts in the implementation of this Agreement or submittals to other
governmental bodies shall in no way be deemed to be an action in reliance
giving rise to an equitable estoppel and, in the event that it is not possible to
implement this Agreement fiffly, the parties' legal positions Will be identical
to the legal position that they would have maintained, if any, and all matters
regarding the proposed development of the PROPERTY had never been
discussed between them.

(b) The parties recognized that the OWNER's prior development known asthe
existing Okeechobee Courthouse, is exempt from their Agreement, but not
exempt from all other CITY ordinances, and laws governing permitting
requirements, terms, restrictions or site plan conditions resulting from changes
in the use of the land, structure, or site plan for such prior development.
6. Notwithstanding the current land use plan designations, the maximum intensity which
may be built on the PROPERTY shall not be greater than 73.000 net square feet of
floor area for Phase 1, as reflected on Exhibit "B Site Plan".
7. In accord with the Project's Exhibit "B Site Plan7' the project shall be phased as set
forth in the approved site plan approval, and such subsequent phases, additions, new
structures, and/or modifications will require new site plans subject to CITY's
ordinances and review and approval process.
8. When the public health, safety and weffare would be adversely affected by the use of
parking and traffic circulation, such lands and all such matters will be addressed
during the permitting process and nothing herein shall limit the legislative discretion
of the CITY in the permitting process to ensure and protect the health, safety, and
welfare ofthe public. However, such limitations shall not act to reduce the maximum
allowable development provided for herein above.
9. Facilities shall be complete, inspected and approved by the CITY prior to the issuance
of a Certificate of Occupancy on the PROPERTY.
10. AD government approvals and permits will be obtained by OWNER at OWNER's sole
cost. In the event that any development permissions are not received, no further
development of the PROPERTY will be allowed until such time as the City Council
has reviewed the matter and determined whether or not to terminate the Development
Agreement or to modify it in a manner consistent with the public interest. Under these
conditions, action and reliance on this Development Agreement or expenditures in
pursuance ofits terms and ofany right accruing the OWNER hereunder, shall not vest
any development rights in OWNER nor shall it constitute partial performance entitling
OWNER to a continuation of this Agreement.
11. The OWNER will provide the following substantiation:
(1) Off site parking with church in order to mitigate the adverse impacts of the
proposed development. A Parking Agreement with the church will be
provided, (Exhibit "C")
(2) A five (5) year traffic and parking monitoring program, (Exhibit "D");.
(3) Affirmation that no less than twenty-eight (28) parking spaces will remain on
the new courthouse site;
(4) Required handicap parking spaces for the new parking areas conforming to
State Federal requirements;
(5) Landscaped parking buffer areas for every twelve (12) spaces that are
provided on the street;
(6) Street/median landscaping, irrigation and continued maintenance;
(7) Adequate and safe pedestrian crossings for street parking based on a plan
approved by the City Engineer;
(8) Road improvements to meet CITY parking and curbing standards as per
CITY Land Development Regulations.

12. The development ofthe PROPERTY shall meet the requirements of all existing CITY
ordinances except as is otherwise specifically waived or modified herein. The CITY
and the OWNER shall coordinate the scheduling of construction obligations herein
with the development schedule of the OWNER so that infi-astructure improvements
provided for herein will be completed in a timely fashion so as to provi4e services to
the proposed development in an orderly manner.
13. If required by law, OWNER will obtain development permits from the appropriate
and necessary government agencies.
14. Any notice or request required or authorized to be given by the terms of this
Agreement or under any applicable law by either party shall be in writing, hand -
delivered, or sent by certified or registered mail, postage prepaid, return receipt
requested. Such written notice shall be addressed as follow:

15. This Agreement shall constitute a covenant running with the land for the duration
hereof and shall be binding upon the OWNER and upon all persons deri%bg title by,
through or under said OWNER and upon its assigns and successors in title. The
Agreements contained herein shall benefit and limit all present and future owners of
the PROPERTY and the CITY for the term hereof
16. This Agreement constitutes the entire Agreement and understanding between the
parties and no modification hereof shall be made except by written Agreement
executed with the same formality of this Agreement. The parties acknowledge that
there are no outstanding agreements of any kind between the parties other than as
reflected herein. Except as is otherwise specifically provided herein the PROPERTY
shall be subject to the laws, ordinances and regulations of The City of Okeechobee,
Florida, as they exist as of the date of this Agreement.
17. Any reference in this Agreement to the OWNER contemplates the undersigned or its
successors in interest. Assignment of any rights or interest or obligations under this
Agreement shall not relieve the OWNER fromresponsibilityto perform all obligations
ofthe OWNER hereunder except upon a release being executed by the porties hereto
and recorded in the Public Records of Okeechobee County, Florida, upon such terms
that are mutually satisfactory to the parties.

The Engineering Department has visited the site and found that
drainage problems eidst near the subject alley.
We should be aware of the critical drainage problems within the City of
Okeechobee especially on S. Parrott Ave and for that reason the
Engineering Office DOES NOT recommend approving the request for
the Alley Closing.
It is the Engineering Department's opinion that the City should be'very
cautious before abandoning any street right-of-ways or alleys.
