Chief Tomey introduced Mr. Sammy Hancock, who was hired as the part time Code Enforcement Officer. He recently
retired from Lucent Technologies and commented it was nice to be here. The Council welcomed Mr. Hancock and
wished him good luck.

VII. PUBLIC HEARING FOR ORDINANCE ADOPTION CONTINUED.
A. 2. a) Motion to adopt Ordinance No. 810. 111 Council Member Chandler moved to adopt proposed Ordinance No. 810; seconded by Council Member Williams.
b) Public Comments. This ordinance pertains to Future Land Use Map Amendment Application No. 02-006-SSA submitted by the Visiting
Nurses Association who is also the property owner. The request is to amend the land use designation from Residential
Single Family to Commercial. The property is located at Southeast 3" Avenue and 2"' Street. There is an existing non-
conforming structure located on the property and is approximately 0. 27 acres. There is also a rezoning application that
11 has been submitted for this property, proposed Ordinance No, 811, Application No. 02-005-R.
Planning Staff Report reflects that the proposal would extend the City's central business district to the Southeast and
the proposed photo studio would provide a compatible transition from more intensive central business district uses to
the residential uses in this area of the City. The amendment would help implement the portion of the Future Land Use
Policy 2.2 requiring the City to protect the use and value of private property from adverse impacts of incompatible land
uses, activities and hazards.
The property has adequate public facilities since the Okeechobee Utility Authority provides water and wastewater to
the site. The amendment is compatible with adjacent and nearby land uses. However, the existing residential structure
that is proposed to be converted into a photo studio encroaches on the front and side set backs. The proposal appears
to be consistent with the future land use and public facilibes elements of the Comprehensive Plan. However, there is
concern regarding the existing non -conforming structure. Section 754 (2) of the LDR's does not permit ownership
transferof a non -conforming structure, and requires such structuresto be brought into compliance with all currentCode
requirements. This issue will have to be addressed afterthe future land use and rezoning are completed. Planning Staff
recommends approval of the application.
The Land Planning Agency met and discussed the applicabon on November 26, 2002 and voted unanimously to
recommend to the City Council that the application be approved. Planning Consultant Jock Robertson noted that the
non -conforming use was discussed at the LIDA meeting, and this building will have to be addressed by the building
official.

MAYOR KIRK OPENED THE PUBLIC HEARING FOR COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG)
PROGRAM AT 6:34 P.M.
A. 1. a) Discuss the Summary of Grant Applicabon - Nancy Phillips, Grant Grant Administrator, Nancy Phillips addressed the Council regarding the Commercial Revitalization Community
Administrator (Exhibit 2). Development Block Grant Application. If the grant is awarded the following activities will be undertaken: $554,000.00
for 4,100 linear feet of sidewalks and pedestrian malls for Park No. 1, 3, 4, 5 and 6. A FRDAP grant application has
been submitted for Park No. 2; $90,000.00 for facade improvements to the six businesses located along North West
11 Park Street, that have expressed interest in participating; and $56,000.00 for grant administration.
At the previous meeting Ms. Phillips advised the Council that the cost for engineering would be covered by the grant.
I n order to give the City enough points to go over the minimum threshold, the City will have to absorb the engineering
costs. She met with Administrator Veach, City Engineer Bermudez and Mr. Bermudez was confident he could handle
the project. The application's score is 614.04 out of a possible one thousand points. Additional needs have been noted
in the application, should there be money available for Park No. 2 (should the FRDAP grant not be funded) and a street
scape project along North West Park Street.
Council was concerned with the low score. Ms. Phillips responded that the City has done all it can, to maximize the
points. If this grant is not funded, the City can try again next year and with the Main Street Program starting back up
it would be possible to work with them in assisting with the applicabon,
Council thanked Ms Phillips and City Staff for their work on the application.

OFFICIALS AND GENERAL PUBLIC AT 6:44 P.M.
Grant Administrator, Nancy Phillips reviewed the Fair Housing Workshop Training Manual with the Council. This is a
Federal and State requirement when applying for grants,
Every American has the right to fair housing. The right to live where they choose, to raise a family, to own a home, in
dignity and without fear of discriminabon regardless of race, color, religion, sex, national origin, handicap or familial
status. The Fair Housing Act protects people with physical or mental disabilities. It is illegal for anyone to deny an
individual housing because that individual has a mental or physical disability, or a record of having had a mental or
physical disability, or because people think an individual might have a mental or physical disability. Individuals with
mental retardation, mental illness, epilepsy, cerebral palsy, visual and hearing impairments, AIDS and other disabilibes
are protected by the Fair Housing Act. People who use walkers, wheelchairs, service dogs, or a personal care
attendant are also protected against housing discrimination.
Ms. Phillips held a workshop for Realtors earlier today regarding fair housing. Should the City be awarded the CDBG
grant there will be a fair housing acbvity requirement.

This ordinance pertains to Rezoning Application No. 02-005-R submitted by the Visiting Nurses Association who is
also the property owner. The request is to amend the rezoning designation from Residential Multiple Family to
Commercial, Professional, Office, The property is located at Southeast 3r'Avenue and 2 nd Street. There is an existing
non -conforming commercial business located on the property and is approximately 0.27 acres. There is also a future
land use amendment application that has been submitted for this property, proposed Ordinance No. 810, Application
No. 02-006-SSA.
Council MemberWatford commented that the Commercial, Professional, Office designation would be a good use due
to the surrounding residential area, a heavier commercial designabon would adversely impact the neighborhood.

IV. NEW BUSINESS.
A. Comprehensive Plan, Future Land Use Map Amendment Application No. 02-006-SSA.
Consider a recommendation tothe City Council, to change the land use designation from
Multi Family to Commercial located at 213 S.E. 2 nd Street. The property owner and
applicant is Visiting Nurses Association.
Mr. Jock Robertson, representative of LaRue Planning and Management Services, gave a brief
background of the subject property. He explained that the applicant is requesting to change from
Multi Family to Commercial to allow for a business to operate within the existing structure. Mr.
Robertson noted that the existing structure does not meet code and would be addressed by a
different Board. The purpose of this public hearing is to determine wether this location is
appropriate for commercial development in th ' e future. Mr. Robertson explained that the Visiting
Nurses Association owns the adjoining property that is already zoned Commercial Professional
Office. He added that with the adjoining property already zoned Commercial Professional Office
that it just confirms that this zoning change is consistent with the surrounding properties. Mr.
Robertson continued that the proposed change would allow for a good transitional buffer for the
nearby residential properties. Planning Staff recommends to the Land Planning Agency to

side yard, with intent to lease out for photo studio use. However, Section 754 (2.) of
the City Land Development Code does not permit ownership transfer of a non-
conforming structure, and requires such structures to be brought into compliance with
all current Code requirements. Future Land Use Policy 2. 1:c) for Commercial
designation permits office uses at a maximum floor area ratio of 3.00 and a
maximum impervious surface not to exceed 85% of the site. The non -conforming
issue would have to be dealt with after the Future Land Use and Zoning stage.
Comprehensive Plan Analysis
A. Consistency with the Land Use Categories and Plan Policies.
This proposal would extend the City central business district southeast on the
Future Land Use Map. As such, the proposed photo studio use would provide a
compatible transition from more intensive central business district uses to the
residential uses in the southeast sector of the City. This amendment would help
implement the portion of Future Land Use Policy 2.2 requiring the City to protect
the use and value of private property from adverse impacts of incompatible land
uses, activities, and hazards.
B. Concurrency of Adequate Public Facilities
The Utility Authority has sewer and water service available for this site.

C. Compatibility with Adjacent and Nearby Land Uses
See analysis under criteria A, above. This amendment would provide a
compatible transition between more intensive central business district
development and less intensive residential development. However, the existing
residential structure on the site encroaches the complete 20 feet front yard, and
some side yard of the requested CPO rezoning, plus another three feet into the SE
2 nd Street right-of-way.
D. Compliance with Specific Standards of the Plan.
This proposal appears to be consistent with the Future Land Use and public
facilities elements of the Comprehensive Plan. However, the City Code requires
that the non -conforming building be brought into compliance with current
requirements.
Findings and Conclusions
Staff finds this petition to be consistent with the City Comprehensive Plan and
recommends approval.

The City of Okeechobee is applying to the Florida Department of Community Affairs
(DCA) for a grant under the Commercial Revitalization category in an amount up to
$700,000 under the IFFY 2003 Florida Small Cities Community Development Block
Grant (CDBG) Program. For each activity that is proposed, at least 70% of the funds
must benefit low and moderate income persons. The activities, dollar amounts and

The CDBG project will undertake fagade improvements to six (6) commercial
businesses and the construction of 4, 100 linear feet of sidewalks and associated
lighting, landscaping, trash receptacles, and benches in the Community
Redevelopment Area (CRA) known as "Flagler Park". If funds become available after
all addressed need has been met, additional work will be completed in the CRA as
noted in the grant application.
The City of Okeechobee plans to minimize displacement of persons as a result of
planned CDBG funded activities in the following manner: No permanent displacement
is anticipated.
If any persons are displaced as a result of these planned activities, the City will assist
such persons in the following manner: The City will follow the guidelines outlined in
their Antidisplacement and Relocation Policy.
A public hearing to provide citizens an opportunity to comment on the application will
be held at the City Council meeting on Tuesday, December 3, 2002 immediately
following the Christmas Lighting ceremony or at approximately 6:30 p.m. This meeting
will be held at the City of Okeechobee Council Chambers. A draft copy of parts of the
application will be available for review at that time. A final copy of the application will
be made available at the City Administrator's Office on Monday through Friday between
the hours of 8:00 a.m. to 1:00 p.m. and 2:00 p.m. to 4:30 p.m. no more than five days
after December 19, 2002. The application will be submitted to DCA on or before
December 19, 2002. To obtain additional information concerning the application and
the public hearing contact Mr. Bill Veach, City of Okeechobee Administrator, 55 S.E.
Third Avenue, Okeechobee, Florida or telephone 863-763-3372.
The public hearing is being conducted in a handicapped accessible location. Any
handicapped person requiring an interpreter for the hearing impaired or the visually
impaired shall contact Mr. Veach, City Administrator at least five calendar days prior to

WHAT IS FAIR HOUSING?
Every American has a right to fair housing. The right to live where they
choose,, to raise a family, to own a home -- in dignity and without fear of
discrimination -- is a fundamental right guaranteed to all Americans.
"Fair housing choice" means the ability of persons of similar income
levels regardless of race, color, religion, sex, national origin, handicap or
familial status to have available to them the same housing choices.
Fair housing is a right protected by federal and state laws. Fair housing
means an individual may freely choose a place to live without regard to
race, color, religion, sex, national origin, handicap or familial status.
The Fair Housing Act protects people with physical or mental disabilities.
It is illegal for anyone to deny an individual housing because that
individual has a mental or physical disability, or a record of having had a
mental or physical disability, or because people think an individual might
have a mental or physical disability. Individuals with mental retardation,
mental illness, epilepsy, cerebral palsy, visual and hearing impairments,
AIDS and other disabilities are protected by the Fair Housing Act. People
who use walkers, wheelchairs, service dogs, or a personal care attendant
are also protected against housing discrimination.
V41AT IS DISCRIMINATION?
Housing discrimination is rarely blatant. It is usually disguised and is
done with a smile and handshake. An individual's fair housing rights are
violated when he/she is prevented from doing one of the following
because of race., color, religion, sex, national origin, handicap or familial
status:

2. Viewing or purchasing a home;
3. Applying for or securing a house mortgage; and
4. Purchasing homeowners' or renters' insurance.

The Federal Fair Housing Act requires that local government aid in the
prevention of discrimination due to race,, color,, religion, sex, national
origin, handicap or familial status in the areas of rental and real estate
transactions within the local community.
By working with your local government, lending institutions, landlords,
and developers to educate individuals in your community about the Fair
Housin Act, discrimination can be eliminated.

WHAT TO DO IF DISCRIMINATED AGAINST
It is against the law to deny people the opportunity to live where they
want to live. If an individual feels that they are being treated unfairly,
please encourage them to take the following steps:
Call the United States Department of Housing and Urban
Development at 1-800-669-9777 or TDD 1-800-927-9275 for
hearing impaired
0 Call the local or state fair housing enforcement agency
Keep records of any meetings and phone calls with the landlord,
property manager, real estate agency, loan officer or insurance
agent. Include the person's name and title,- the meeting place, date
and time.
Write down what happened and what was said and save all receipts,
applications, business cards or other documents received during
your meetings.
DISCUSSION OF FAIR HOUSING ORDINANCE
Your local government has adopted a Fair Housing Ordinance as required
by the Community Development Block Grant (CDBG) Program. This
ordinance prohibits discrimination in the sale or rental of housing on the
basis of the seven (7) protected classes (i.e., race, color, religion, sex,
national origin, handicap or familial status).

HOW CAN FAIR HOUSING BE ENCOURAGED
IN YOUR COMMUNITY?
There are several ways to affirmatively further Fair housing in a
community. One way that the local government can affirmatively further
fair housing is to hold public educational/training programs for the
general public as well as financial institutions, Realtors, and private
developers to promote fair housing.
SUGGESTED ACTIVITIES TO
AFFIRMATIVELY FURTHER FAIR HOUSING
Promote efforts to enact strong fair housing laws by developing or
strengthening local fair housing laws or ordinances so they are
substantially equivalent to federal law;
2. Review local land use and zoning laws and procedures to determine
whether they contribute to, or detract from, progress in fair housing.
3. Send letters from the local government to businesses selling,
renting, or financing housing, encouraging them to adhere to the
Federal Fair Housing Law;
4. Provide for public endorsement of the principle of fair housing and
of the adherence to the Federal Fair Housing Law;
5. Require the use of affirmative marketing and advertising practices
by private developers as a condition for obtaining local licenses and
permits;
6. Establish a Fair Housing Commission to review and investigate
activities and complaints of housing -related industries including;

WHEREAS, the Florida Legislature, during the 1983 legislature session, enacted the
Florida Small Cities Community Development Block Grant Program Act, Florida
Statutes, Chapter290, to acceptand administerthe Community Development Block
Grant Program created by Title I of the Housing and Community Development Act
of 1974, as amended; and
WHEREAS, the purpose of the Florida Statutes, Chapter 290, is to assist local
governments in carrying out effective community development activities to arrest
and reverse community decline and restore community vitality; and
WHEREAS, Florida Statutes, Chapter 290, designates the Florida Department of
Community Affairs as the administering agency for the Florida Small Cities
Community Development Block Grant Program; and
WHEREAS, it is the intent of the City of Okeechobee to apply for Fiscal Year 2003 Florida
Small Cities Community Development Block Grant funding in the Commercial
Revitalization category and to provide all engineering -related services required for
the project utilizing the City Engineer; and
WHEREAS, the City's Fiscal Year 2003 Florida Small Cities Community Development
Block Grant Application reflects the community development needs of the City.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL, CITY OF
OKEECHOBEE, FLORIDA authorizes the Mayor and/or Mayor Pro-Tempore to
execute and submit to the Florida Department of Community Affairs the City's
proposal in the Commercial Revitalization category for Fiscal Year 2003 Florida

IV. NEW BUSINESS.
A. Rezoning Petition No. 02-005-R. Consider a recommendation to the City
Council to rezone 213 S.E. 2 nd Street from Residential Multiple Family (RMF)
to Commercial Professional Office (CPO). The property owner and applicant is
Visiting Nurses Association.
Mr. Jock Robertson, representative of LaRue Planning and Management Services, gave a brief
background of the subject property. Mr. Robertson explained that this petition is in connection
with a future land use map amendment. He explained that a zoning change from Residential
Multiple Family (RMF) to Commercial Professional Office (CPO) would be a good buffer between
the commercial businesses and the nearby residential area. Mr. Robertson further explained that
the Commercial Professional Office zoning district is the most restrictive and would best benefit
the City. Planning staff recommends that the Planning Board recommend to the City Council to
grant approval of Petition 02-005-R, to change the existing zoning classification of Residential
Multiple Family to Commercial Professional Office located at 213 S.E. 2 d Street.
There was some discussion about wether the subject property has sewer connections or is on a
septic, system. It was later the understanding that the subject property is on a septic system.
There were no further comments from the public. There was no further discussion from the Board.
Board Member Mavroides moved to recommend to the City Council to grant approval for
Petition 02-005-R, requesting to change the existing zoning classification of Residential
Multiple Family (RMF) to Commercial Professional Office (CPO) as recommended in
Planning staff's report. Board Member Keller seconded the motion.

WHEREAS, the City of Okeechobee Legislative Delegation is meeting in official session on
December 19, 2002 to receive public comment and to discuss legislation of local interest for
inclusion into their official requests to the Florida Legislature in the upcoming session; and
WHEREAS, the City of Okeechobee has determined that certain items of local concern are
important to the City and its citizens, as well as Okeechobee County as a whole, and these
items and their importance should be communicated to the Okeechobee Legislative
Delegation for presentation to, and consideration by, the Legislature in such upcoming
session; and

commission, authority, or committee. It applies equally to members of advisory and non -advisory bodies who are presented with a voting
conflict of interest under Section 112.3143, Florida Statutes.
Your responsibilities under the law when faced with voting on a measure in which you have a conflict of interest will vary greatly depending
on whether you hold an elective or appointive position. For this reason, please pay close attention to the instructions on this form before
completing the reverse side and filing the form.
INSTRUCTIONS FOR COMPLIANCE WITH SECTION 112.3143, FLORIDA STATUTES
A person holding elective or appointive county, municipal, or other local public office MUST ABSTAIN from voting on a measure which
inures to his or her special private gain or loss. Each elected or appointed local officer also is prohibited from knowingly voting on a mea-
sure which inures to the special gain or loss of a principal (other than a government agency) by whom he or she is retained (including the
parent organization or subsidiary of a corporate principal by which he or she is retained); to the special private gain or loss of a relative; or
to the special private gain or loss of a business associate. Commissioners of community redevelopment agencies under Sec. 163.356 or
163.357, F.S., and officers of independent special tax districts elected on a one -acre, one -vote basis are not prohibited from voting in that
capacity.
For purposes of this law, a "relative" includes only the officer's father, mother, son, daughter, husband, wife, brother, sister, father-in-law,
mother-in-law, son-in-law, and daughter-in-law. A "business associate" means any person or entity engaged in or carrying on a business
enterprise with the officer as a partner, joint venturer, coowner of property, or corporate shareholder (where the shares of the corporation
are not listed on any national or regional stock exchange).
ELECTED OFFICERS:
In addition to abstaining from voting in the situations described above, you must disclose the conflict:
PRIOR TO THE VOTE BEING TAKEN by publicly stating to the assembly the nature of your interest in the measure on which you
are abstaining from voting; and
WITHIN 15 DAYS AFTER THE VOTE OCCURS by completing and filing this form with the person responsible for recording the min-
utes of the meeting, who should incorporate the form in the minutes.
APPOINTED OFFICERS:
Although you must abstain from voting in the situations described above, you otherwise may participate in these matters. However, you
