Mayor Pro-Tem Watford read the following Proclamation for National Farm -City Week: WHEREAS, since our earliest
days as a nation, farmers have tilled the soil of this great land, feeding their families, other citizens, and people around
the world. Over the years, our economy has changed, but the American farm and ranch have remained a vital thread
in the fabric of our lives; and WHEREAS, our nation was founded on values of hard work, faith, family and community.
Those values still hold true for farmers and ranchers; and WHEREAS, by providing an abundant supply of safe, high -
quality food and fiber, our farmers and ranchers contribute to a quality of life in our country that is unmatched around
the world; and WHEREAS, farmers and ranchers do not work alone. Farm workers, researchers, educators,
processors, shippers, truck drivers, inspectors, agribusinesses, wholesalers, marketers, retailers and consumers,
many of whom are in urban and suburban areas, all play important roles in the incredible productivity of our nation's

quality of our lives. Rural and urban communities working together have made the most of our rich agricultural
resources, and they continue to contribute to the health and well-being of our people and to the strength of our
economy, NOW, THEREFORE, 1, James E. Kirk, Mayor of the City of Okeechobee, do hereby proclaim the week of
November 22, 2002 through November 28, 2002 as Farm -City Week; and I do further call upon citizens in rural and
urban areas to acknowledge and celebrate the achievements of all those who, working together, produce an
abundance of agricultural products that strengthen and enrich our community and our nation."
Mr. Watford commented that this was one of the best proclamations the City issues since agriculture is an important
way of life in Okeechobee. Mr. David Raulerson from Farm Bureau was present to receive the proclamation and
presented the Council and Staff with bags of fresh vegetables.
Council Member Chandler moved to dispense with the reading and approve the Summary of Council Acton for the
November 5, 2002 Regular Meeting; seconded by Council Member Williams. There was no discussion on this item.

Proposed Resolution No. 02-13 reads as follows: "WHEREAS, the City Council of the City of Okeechobee, Florida,
has received the canvassed returns of the City General Election held November 5,2002, and WHEREAS, Noel
Chandler, Low!yMarkham and Dowling R. Watford, Jr. received the highest number of votes for City Council
Membersand Lane Gamiotea was unopposed forelection as City Clerk. NOW THEREFORE, BE IT RESOLVED,
that Noel Chandler, Lowry Markham and Dowling R. Watford, Jr. be, and they are hereby declared elected
as City Council Members and that Lane Gamiotea be, and is hereby declared elected as City Clerk and shall

IX. NEW BUSINESS CONTINUED.
D. Discussion regarding issues from the Veterans Memorial Committee
- Herb Nix (Exhibit 6).
The Veteran's Memorial Park is Park "E" of F L A G L E R P A R K bound by North and South Park Streets and South
Parrot and Southwest 2" Avenues. Mr. Herb Nix is the President of the Veteran's Memorial Park Committee. He
addressed the Council with concerns from the Committee regarding various uses in the park. Nonprofit organizations
have been given permission to post temporary signs (regarding community events) on the Northeast corner of the
park, which is also at the intersection of Parrott Avenue (Highway 441) and North Park Street (State Road 70).
Business owners along South Park Street have held events on South Park Street and a hay wagon (flatbed semi
trailer) was put in the park to be used as a stage. During the Labor Day events a local business brought some of their
merchandise and set up a tent in the park to sell, The Committee would like to convey to the Council that these types
of uses take away from the appearance of the park and is disrespectful to the purpose of the park, which is to honor
our veterans.
Mr. Nix also noted thatthe Committee does notobjectto the United Way sign posted in the park. The sign is away from
the intersection and it was in that park before the renovations were done in 1997. They also do not objectto the City's
Christmas decorations thatare put atthe intersection and complimented the City Staff on whata greatjobthey do each
year to decorate the community for the holiday season. He continued by thanking the City Fire and Police
Departments along with the Police Auxiliary for their service and protection they provide the American Legion
throughout the year at various events that they sponsor.
Council Members Oliver, Chandler and Watford discussed the issues with Mr. Nix, They commented that they did not
think the temporary signs advertising community events were meant to be disrespectful to the veterans in any way.
There have been abuses with the use of the parks (for example the trailer being set in the park and the business that
put their tent in there). However, when the City learns of these abuses, they correct them as soon as possible. The
corner used for the temporary signs is the most visible one at the main intersection. Therefore, it is logical that the
Chamber of Commerce, churches and other nonprofit organizations would choose that park to post their signs.
Attorney Cook advised that he recently reviewed the Grant of License between the City and American Legion giving
the Legion use of the park to create a Veterans Memorial. He suggested that Administrator Veach, Mr. Nix and a
representative from the Chamber of Commerce meet to discuss an outline of what would be appropdate to
post in the park. Council agreed that they should meet and instructed that all parties be notified to do so.
Mr. Lawrence Cox, also of the American Legion addressed the Council asking that they please be careful with what
signs they allow in the park.
Council instructed Clerk Thomas to notify Administrator Veach of the reguest to hold this meetiqq.

which would be the third. A special meeting might have to be called (and advertised) regarding the industrial park.

Council Member Chandler advised the Council thathe metwith John Morgan ofthe South Florida Water Management
District They are starting a new project along with the Army Corp of Engineers and the Department of Environmental
Protection to dredge Taylor Creek and its feeder canals. This is part of the Lake Okeechobee Clean up Project that
addresses phosphoreus levels in the lake. In the past the project has focused mainly on the impact of the lake from
agriculture, However, they are now focusing on the urban areas that also feed into the lake (for example storm water
drainage from the City).
Mr. Morgan also stated that he knew of the City's situation with the boat ramp at Southwest 4" Street and V Avenue.
There is a possibility to include renovating the boat ramp with this project One reason the ramp is in the condition it
is in is due to the storm water drainage thatfeeds into Taylor Creekfrom 4 1h Street. If the ramp is included in the project
it could be a pilot project to try a "state of the art' system to slow the storm water flow and eliminate the erosion

problem. The purpose of Mr. Morgan's visit is to inform the Council of this project, invite the City to be a partner in it,
to assist in obtaining funding from the State. He will be presenting the same request to the County. This is a long term
operation and the part of the local governments (City and County) is to be committed to be there for the maintenance
of the project once it is completed. Mr. Morgan introduced Ms. Kim Sugar from the Department of Environmental
Protection Agency, who was also there to answer any questions the Council may have.
Council Member Chandler also noted that this Project is not for navigational purposes nor weed removal,
However, it will help eliminate that problem. The Council expressed their support for this project. Ms. Gail Powers of
the Lake Okeechobee Business Owners and Supporters briefly addressed the Council supporting Mr. Morgan and
the project and asked that the City step up to the plate and take the lead on this.
The Council appointed Mr. Chandierto be their liaison on this Project and instructed that Administrator Veach
add this to the list of items to be presented at the December 19 Legislative Delegation.
There being no further items on the agenda, Mayor Pro-Tem Watford adjourned the meeting at 6:57 p.m.

WHEREAS the City of Okeechobee is obligated by State Law to conform its ordinances
pertaining to elector and election issues to existing State Election Law Statutes,
which are amended from time to time by the State; and
WHEREAS existing City ordinances fail to adequately provide for qualifying periods for
candidates for general and special elections, or circumstances and procedures that
may arise when a special election or referendum is necessary; and
WHEREAS the City has the authority and obligation to amend certain ordinances in
Section 6 of the Code to provide sufficient clarity and information in the ordinance
to the citizens to permit adequate notice of, and orderly elections of candidates;
THEREFORE it is ordained by the City Council for the City of Okeechobee, Florida after
public discussion and majority vote, the certain portions of Section 6, Code of
Ordinances, be amended as follows:
Section 6-3. Qualifying fees for candidates.
All candidates for the office of City Clerk or City Council Member GOdneilfflam shall
pay a qualifying fee of fifty dollars ($50.00) upon qualifying as a candidate for any
City election, in addition to anv fees reauired bv State Law under Section 99.092.

Section 6-4. Proclamation calling election.
(a) Before any regular or speeial election, the Mayor shall issue his a
proclamation, signed by him or her, and attested by the City Clerk, calling

716, and particularly Section 155 of the Land Development Regulations, in the
following respects:

The following shall apply to all Citizen Boards, including the Planning Board, Board
of Adjustment, and any other Board comprised of citizens appointed by the City
Council:

City Council may appoint any or all of the members to serve jointly on the

A. Consider amending Volume One of the Unified Land Development Code (Land Attorney Cook explained that there recently has been an amendment to the Florida Statutes
Development Regulation's - LDR's). The proposed will amend sections specifically allowing for a nori-voting member to be appointed to Citizen Boards, specifically in this case a
relating to Section 155, pertaining to Citizen Boards.
Cn School Board Member to advise the Board when necessary. This member would attend
periodically.
It was thought that Attorney Cook is similar to the non -voting member as being kind of an advisory
member. Attorney Cook stated that he is in a different category due to the legal aspect he advises
the Board on. It was also mentioned that when new developments are proposed it might be nice
to have a member of the School Board there to respond as to how it may impact the nearby school*
There was no public comment. There was no further discussion from the Board.
Board Member Ledferd moved to recommend to the City Council to approve the Land
Development Regulation Amendment to the Citizen Boards Section 155. Board Member
Hoover seconded the motion.

Mr. Frank Mueller resigned as a regular member of the Planning Board -Land Planning Agency -Board
of Adjustment -Design Review Board. My office was advised that alternate member, Daniel Creech would
like to fill the term left vacant by Mr. Mueller. We have advertised the position and have not received any
applications to date. Please consider changing Mr. Creech's appoint from alternate to regular member
for a term beginning November 19, 2002 and ending April 30, 2005.
As soon as we receive an application for the alternate position we will forward it to you for appointment.

RESOLUTION NO. 02-14
A RESOLUTION OF THE CITY OF OKEECHOBEE, FLORIDA
SUPPORTING THE PROPOSAL TO ADD THE RENOVATION AND
IMPROVEMENTS OF FLAGLER PARK NO. 2 TO THE CAPITAL
IMPROVEMENTS ELEMENT OF THE COMPREHENSIVE PLAN FOR
FISCAL YEAR 2002-2003; CONTINGENT UPON FUNDING FROM THE
FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION, FLORIDA
RECREATION DEVELOPMENT ASSISTANCE PROGRAM (FRDAP)
PROGRAM; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Okeechobee believes the existence of
recreational opportunities is important to the physical, social and economic welfare
of the citizens of Okeechobee, and
WHEREAS, the City of Okeechobee has identified the need to increase outdoor
recreational opportunities for its citizens; and
WHEREAS, the City of Okeechobee is applying for 2002-2003 Florida Recreation
Development Assistance Program funds to construct various improvement at
Flagler Park No. 2. These improvements consist of pedestrian walkways, covered
picnic facility, picnic tables/park benches, security lights, landscaping and other
improvements.
NOW, THEREFORE, BE IT RESOLVED by the City Council, City of Okeechobee,
Florida that:
Section 1: The costs of construction of pedestrian walkways, covered picnic facility,
picnic tables/park benches, security lights, landscaping and other
improvements at Flagler Park No. 2 project totaling $115,000.00 will be
added to the Capital Improvements Element of the City of Okeechobee's
Comprehensive Plan for fiscal year 2002-2003 contingent upon receipt of
funding from the Florida Department of Environmental Protection's FRDAP
program; and
Section 2: This resolution shall become effective immediately upon its adoption.
