Mayor Kirk read the proclamation in its entirety as follows: "WHEREAS, millions of Americans need supplemental
assistance at some time during each month; and WHEREAS, annually, the Treasure Coast Food Bank, Inc.
provides over 1.26 million meals to approximately 134 nonprofit agencies thatfeed hungry children, the ill and
needyin Indian River, Martin, Okeechobee and St. LucieCounties; andWHEREAS, Octoberis National Hunger
Awareness Month and October 16,2002 is World Food Day; and WHEREAS, the Treasure Coast Food Bank,
Inc. highlights its year -long efforts to feed the hungry by observing National Food Bank Week from October
13 to 19. NOW THEREFORE, 1, James E. Kirk, by the virtue of the authority vested in me as Mayor of the City
of Okeechobee, do hereby proclaim the month of October, 2002 as National Hunger Awareness Month, the
week of October 13 - 19, 2002 as National Food Bank Week and October 16, 2002 as World Food Day." There
was no one present to receive the proclamation. It will be mailed to the appropriate representative.

A. Proclaim the month of November, 2002 as "National Epilepsy Mayor Kirk read the proclamation in its entirety as follows: "WHEREAS, Epilepsy, also known as Seizure Disorder,
Awareness Month". has afflicted mankind since the dawn of our species and has been recognized since the earliest medical
wdtings; and WHEREAS, as long as 400 B.C., Hippocrates, the Father of Medicine, repudiated ancient beliefs
that Epilepsy was a visitation from the gods and sacred or that it was a curse from the gods that people
afflicted vAth this disorder held prophetic powers. Hippocrates believed that Epilepsy was a brain disorder;
and WHEREAS, a seizure is a sudden, brief attack of altered consciousness, motor activity or sensory
phenomena. It is a sign that certain brain cells (neurons) are discharging an excessive amount of electrical
impulses; and WHEREAS, Epilepsy can be caused by injury to the brain, lack of oxygen at birth, brain tumor,
infection and brain hemorrhage. In sixty percent of the cases, the cause is unknown; and WHEREAS, Epilepsy
can affect anyone, at any age and at any time; and WHEREAS, more than two million Americans are aff licted
with some type of Epilepsy. Of this number, 150,000 are Flodda residents; and WHEREAS, with the
administration of anti convu Isant drugs, two-thirds (66.66%)of those aff licted with Epilepsy are drug controlled;
and WHEREAS, lack of education about this disorder has contributed to age old myths, superstitions and
prejudices; and WHEREAS, the stigma associated with this disorder is sometimes worse than the disorder
itself; and WHEREAS, people who have Epilepsy make reliable and conscientious workers in job performance,
productivity, safety, cooperation and attendance; and WHEREAS, studies carried out in the UNITED STATES
over the past thirty years have indicated that of all disabilities, Epilepsy poses the greatest barrier to
employment with unemployment rates estimated to fall between 20 and 25 percent; and WHEREAS, Epilepsy
should not be a barrier to success. In addition to the normal requirements for success, a person who has
Epilepsy needs a supportive environment and employers who are willing to give them an opportunity to
become productive citizens. NOW, THEREFORE, 1, James E. Kirk, by the virtue of the authority vested in me
as Mayor of the City of Okeechobee, do hereby proclaim the month of November as "NATIONAL EPILEPSY
AWARENESS MONTH." There was no one present to receive the proclamation. It will be mailed to the appropriate
representative.

b) Public Comments. III Mayor Kirk asked whether there were any questions or comments from the public. There were none.
City Planning Consultant Jim LaRue addressed the Council. Future Land Use Map Amendment Application No. 02-
005-SSA for Wrights Addition, Lots 1 through 12 of Block 3 and Browning Addibon, Lots 1 through 7 and 15 through
20 including the North to South alley was submitted by Sylvester Bufler. The property owner is Thomas P. Evans. The
requestis to change the land use from Single Family to Multi -Family. The zoning is currently Multi -Family. The existing
status of this property is vacant. The applicant intends to develop the 4.03 acres into multi -family housing, which allows
ten units per acre.

A. 2. b) Public Comments continued. Planning Staff Report findings: The Future Land Use Map as reflected by the original City's Comprehensive Plan has
shown these lots as Single Family for a number of years. Inconsistently, the zoning forthese same lots has been Multi -
Family for an equal period of time. It is not known whetherthere was failure of the original Comprehensive Plan to show
Multi -Family as a Future Land Use for this property but that is a possibility, There is also a concern because Industrial
zoned property is tothe West. The appropriateness of residential housing nearthis area raises compatibility questions.
Added to the complexity of the consistency issue is that there are scattered multi -family units already built to the East
and West of these lots. There are adequate public facilities to the site since the OUA has sewer and water available
for this area. The use would be compatible with adjacent and nearby land uses.
In regards to compliance with specific standards of the plan, the City's Comprehensive Plan speaks to the provision
of a variety of housing types and the need for affordable housing as an issue for new development. The
appropriateness of this request should hinge on compatibility, whether sewer and water are available and traffic
impacts. All factors need to be shown to be not detrimental if the area becomes Multi -Family, Finally, there are no
known detrimental environmental impacts that would need to be considered if this property is changed to Multi -Family.
This change in the Future Land Use is recommended subject to a determination that traffic impact is not a factor. Site
Plan requirements can buffer this development from Industrial uses to the West.
The Land Planning Agency reviewed the application attheir September 24, 2002 meeting. The recommendation from
the LPA was for the applicant to submit a traffic study to the City Council along with the application. If the traffic study
indicated that there would not be a detrimental impact to the area, their recommendation was to approve the
application. The traffic study was presented in ExhibitOne, Mr. LaRue advised that based on the information contained
in the study, the area would not be overly impacted if it was developed Multi -Family verse's Single Family.
There was a lengthy discussion between the Council and Mr. LaRue.

IX. NEW BUSINESS - Mayor.
A. Review City Engineer's Proposal for the Fire Station - City
Administrator (Exhibit 2).
Administrator Veach and Staff presented the Council with a proposal to renovate the existing Fire Department Building
in the amount of four hundred sixty-eight thousand dollars ($468,000.00). As outlined in Exhibit Two, this includes
construction costs, unanticipated costs and other associated costs (office trailer, kitchen appliances and outfitting,
smoke alarm system, communication equipment, furniture and emergency generator). The Citywill actas the General
Contractor.
Council Member Chandler moved to approve the Fire Station Renovation Project in the amount of four hundred sixty-
eight thousand dollars ($468,000.00); seconded by Council Member Oliver.
There was a lengthy discussion between the Council and Staff. This project will add a bay on the North side of the
building with an enclosed stairwell and a pole area. It also encloses the back stairwell. Staffs intention was to meet
the City's needs for the next twenty-five to thirty years. The generator will service both the fire station and city hall
buildings. Engineer Bermudez has experience with this type of project, he responded that he was confident the City
can do this project within the budget as presented on the drawings in Exhibit Two. Staff intends to hire as many local
sub -contractors as possible, however, the bottom line is to stay within the budget.

C. 2. b) Discussion. Administrator Veach advised the Council that since they just approved the renovation project for the fire station, we
now have to amend the budget to provide the funding for it. Funds for this project were in the 2001-2002 budget. That
amount rolled back into the fund balance; now we are rolling an amount back out to cover the project cost. The
expenditures for the operating transfer out Capital Project Fund changes to reflect the project cost of $468,000.00 as
11 stipulated in the proposed budget amendment ordinance,

E. Discuss the Taylor Creek Boat Ramp at Southeast 4" Street - The City received notice that the boat ramp located at Southeast 4" Street would be closed. The Council was
Council Member Watford (Exhibit 6). concerned with this since it is the only public boat ramp in the City. Staff was instructed to find out what is qQinq
to be done v4th the boat ramp. If it is going to be closed, are their monies available to have it ropgired and
reopened. Is itfeasibleto have a boat ramp installed on the City's propeft located at Southeast 6thStreet and
117thAvenue (old sewer plant). Administrator Veach vAll report back to the Council.

AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA AMENDING
THE CITYOF OKEECHOBEE COMPREHENSIVEPLAN, ORDINANCE NO.
635 AS AMENDED, BY REVISING THE FUTURE LAND USE MAP;
PROVIDING FOR INCLUSION OF ORDINANCE AND REVISED FUTURE
LAND USE MAP IN THE COMPREHENSIVE PLAN; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of Okeechobee recognizes the need to plan for
orderly growth and development; and
WHEREAS, Chapter 163, Florida Statues, and Rule 9J5, Florida Administrafive Code
provide for amendment to Adopted Comprehensive Plans; and
WHEREAS, the City has received and reviewed certain application(s) for a smaj"cale
amendment to the Future Land Use Element of the City's Comprehensive Plan, and
said application(s) being reviewed by the City's Land Planning Agency at a duly
advertised meeting, and submitted by staff report, which determiined such
applicant(s) to be consistent with the Comprehensive Plan and approprkde to the
future land uses within the City; and
WHEREAS, the City has agreed with the recommendations of the Land Planning Agency
that the proposed application(s) complies with the requirements of Florida Stftdes
163, Part 11, and that the proposed applications are consistent WM the
Comprehensive Plan and appropriate to the future land uses within the City,
BE IT ORDAINED by the City Council of the City of Okeechobee, Florida as follows:
SECTION I SHORT TITLE.
THIS ORDINANCE shall be known as the "City of Okeechobee Small Scale
Development Activities Comprehensive Plan Amendment", pursuant to F.S.
163.3187, and shall be effective within the City limits of the City of Okeechobee,
Florida.
SECTION 2 AUTHORITY.
This City of Okeechobee Small Scale Development Activities Comprehensbo Plan
Amendment is adopted pursuant to the provisions of Chapter 163.3187, Part 11,
Florida Statutes.
SECTION 3
1 .
REVISIONS To THE FUTuRE LAND USE MAP.
The following described land is hereby redesignated for purposes of the
Future Land Use Map of the City of Okeechobee Comprehensive Plan:
a. Application No. 02-005-SSA, from Residential Single Family (RSF)
to Residential Mutti-Family (RMF). The Legal Description of Subject
Property is as follows:

SECTION 4 INCLUSION OF ORDINANCE AND REvisED FUTURE LAND USE MAP IN THE

It is the intention of the City Council of the City of Okeechobee, Florida and it is
hereby provided, that the provision of the Ordinance, and the revisions to the
Future Land Use Map more particularly described as "Future Land Use: 2000
City of Okeechobee, March 19, 1991, as amended December 6, 1994", which is
incorporated herein by reference, shall become and be made a part of the City
of Okeechobee Comprehensive Plan (City of Okeechobee Ordinance No. 635,
as amended).
SECTION 5 SEVERABILITY.
If any provision or portion of this ordinance is declared by any court of
competent jurisdiction to be void, unconstitutional, or unenforceable, then all
remaining provisions and portions of this ordinance shall remain in full force and
effect.
SECTION 6 EFFEcTivE DATE.
The effective date for the enactment of Ordinance No. 805 shall be thirty-one
(31) days after the adoption of this ordinance.

Pursuant to the conditions imposed by the City of Okeechobee's Local Planning Agency,
on September 24, 2002, a limited Scope Traffic Analysis should be submitted prior to the
City Council meeting in October.
Specifically, it would be beneficial if a Trazisportation Engineer or Planner could show
the impact of the additional trips on NW 3rd Street and NW 0 Avenue that will be
caused by the land use change.
As we discussed at the meeting, the maximum number of units that could be constructed
under the current land use is 24. If the land use is changed to accommodate your project,
the maximum number of units that could be built is 40. We recommend that the analysis
show the irnpect of the maximum difference, which is 16 units.

recent conversations, I am writing to give my opinion of probable traffic impacts
for the above -referenced project. In the absence of available existing trip and level
of service data for the area, the analysis will be based on a comparison of impacts
of the existing land use (residential single-family) and the proposed land use
(residential multi-farnily.) Our analysis follows:

IV. NEW BUSINESS.
A. Consider application 02-005-SSA: Thomas P. Evans is the property owner.
Sylvester Butler is the applicant. The property is located off of S.E. 10' Avenue
to include lots 1-7 inclusive, lots 15-20 inclusive and the alley lying between said
lots, Browning Addition; and all of Block 3, Wrights First Addition. The purpose
of the request is to allow a change in the Future Land Use Map from the existing
designation of Single Family to a Multi -Family designation.
0
Vince Cautero, Planning Consultant described the subject property and gave a brief background
of the surrounding properties. He explained that if granted the request this property would then
become consistent with the zoning map which already shows a designation of Residential Multiple
Family. Mr. Cautero explained that the application would normally require lanscaping plans to be
submitted however, the major concern with this application is the possible traffic impacts.
Planning Staff recommends that the requested change be granted subject to the determination that
a traffic impact is not a factor and that site plan requirements can buffer this development from the
Industrial uses to the west.
Attorney Cook explained that the Future Land Use map change could recommend approval to the
City Council subject to the submittal of the traffic study, but cannot make a conditional approval.
The Board has several questions regarding utilities to the site and the traffic impacts that 40
residential units would have on the area.
Mr. Sylvester Butler, applicant, addressed the Board. Mr. Butler informed the Board that the
proposed site does have utilities available. He added that the traffic should not impact the area,
with the help of a nearby traffic light.
There was further discussion from the Board regarding the traffic issue.
There was no fin-ther public comment. There was no further discussion from the Board.
Board Member Ledferd moved to recommend to the City Council to grant approval for
Future Land Use Map Amendment Application No. 02-005-SSA and for the applicant to
submit a traffic study as part of his application prior to the City Council meeting, requesting
to change the land use designation from Single Family to Multi Family. Board Member
Jones seconded the motion.

B. Consider amending the Unified Land Development Code (Land Development Attorney Cook explained that the Florida Building Code including the revisions and appendices
Regulations - LDR's) specifically section 130, pertaining to the construction - were adopted into the Florida Statues and will replace the current Standard Building Code. He
design and improvement regulations. explained that the Agency is not to adopt the code as it was already adopted but to simply change
the wording of the LDR's to correspond with the Florida Statues.
There was no comment from the public. There was no discussion from the Board.

The City's Multi -Family Residential Zoning District allows 10 units per acre and the
developer would build a little over forty units on this property.
A. Consistency with the Land Use Categories and Plan Policies.
The Future Land Use Map as reflected by the original City's Comprehensive Plan
has shown these lots as Single Family for a number of years. Inconsistently, the
zoning for these same lots has been Multi -Family for an equal period of time. It is not
known whether there was a failure of the original Comprehensive Plan to show
Multi -Family as a Future Land Use for this property but that is a possibility. There is
also a concern because Industrial zoned property is to the west. The appropriateness
of residential housing near this area raises compatibility questions. Added to the
complexity of the consistency issue is that there are scattered multi -family units
already built to the East and West of these lots.
B. Concurrency of Adequate Public Facilities
The Utility Authority has sewer and water available for this area.

C. Compatibility with Adjacent and Nearby Land Uses
See above comments concerning the Industrial property to the west. The Multi -
Family units, given appropriate buffers, may be more practical in this area than single
family homes.
D. Compliance with Specific Standards of the Plan.
The City's Comprehensive Plan speaks to the provision of a variety of housing types
and the need for affordable housing as an issue for new development. The
appropriateness of this request should hinge on compatibility, whether sewer and
water is available and traffic impacts. All factors need to be shown to be not
detrimental if this area becomes Multi -Family. Finally, there are no known
detrimental environmental impacts that would need to be considered if this property
is changed to Multi -Family
This change in Future Land Use is recommended subject to a determination that traffic
impact is not a factor. Site Plan requirements can buffer this development from Industrial
uses to the west.

WHEREAS the City of Okeechobee is obligated by State Law to conform its ordinances
pertaining to elector and election issues to existing State Election Law Statifts,
which are amended from time to time by the State; and
WHEREAS existing City ordinances fail to adequately provide for qualifying perloft for
candidates for general and special elections, or circumstances and proceduresthat
may arise when a special election or referendum is necessary; and
WHEREAS the City has the authority and obligation to amend certain ordirwme in
Section 6 of the Code to provide sufficient clarity and information in ft ordinance
to the citizens to permit adequate notice of, and orderly elections of, candkkfts;
THEREFORE it is ordained by the City Council for the City of Okeechobee, Florida Ow
public discussion and majority vote, the certain portions of Section 6, Code of
Ordinances, be amended as follows:
Section 6-3. Qualifying fees for candidafts.
All candidates for the office of City Clerk or City Council Member
pay a qualifying fee of fifty dollars ($60.00) upon qualifying as a canditiate for any
City election, in addition to anv fees recauired by State Law under Salim 99.002,
Florida Statutes.
Section 6-4. Proclamation calling election.
(a) Before any regular or spee"al election, the Mayor shall ism,* Me a

WHEREAS, the City is obligated to adopt uniform codes, standards and regulations that
pertain to building and development of property within the City of Okeechobee,

WHEREAS, the State of Florida has adopted a newer code to govern development, known
as the "FLORIDA BUILDING CODE", which State Statute, Chapter Ouved,
mandates that each governmental entity within the State of Floridaadopt said code
for use in their respective jurisdiction, and which code adequately protects the
public by providing all necessary standards and regulations pertaining to building
and development projects; and
THEREFORE, be it resolved and adopted by majority vote of the City Council for the City
of Okeechobee, Florida, that:
I This ordinance rescinds Section 131 (1) of Ordinance 716, Land
Development Regulations, which adopts as a building code for the City of
Okeechobee the "Southern Building Code Congress International."
2. That the City of Okeechobee, Florida hereby adopts as a building code
within the City the "FLORIDA BUILDING CODE" in its enfirety, indwfing b#A
not limited to all codes, maps, standards, and regulations, complete with
revisions and appendices from time to time, and incorporates same by
reference into Ordinance 716, Land Development Regulations at section
131 (1) thereof, as if fully set out therein.
3. That all fee schedules pertaining to this code shall continue to be set out in,
and revised from time to time, in appendix "C" to volume one of the Land
Development Code, as originally set forth in Resolution 98-11, and as
thereafter amended.
4. That if any portion of this ordinance were to be declared to be unenforceable
for any reason, the remainder shall continue to remain in full force and
effect.

B. Consider amending the Unified Land Development Code (Land Development Attorney Cook explained that the Florida Building Code including the revisions and appendices
Regulations - LDR's) specifically section 130, pertaining to the construction were adopted into the Florida Statues and will replace the current Standard Building Code. He
design and improvement regulations. explained that the Agency is not to adopt the code as it was already adopted but to simply change
the wording of the LDR's to correspond with the Florida Statues.
There was no comment from the public. There was no discussion from the Board.
Board Member Ledferd moved to recommend that the City Council approve the request to

On October 10, 2002, our boat ramp inspection at the Fourth Street boat ramp
on Taylor Creek (USACOE property) revealed that this ramp was undermined and the
concrete was broken, making this ramp unuseable.
Due to the limited parking at this site, which was created in 1962, we have
decided to close this facility. If there is a need to replace the facility at another location
with adequate parking, please contact me at 850-488-5460.

SUBJECT: Status Report

Below is a brief summary of past and upcoming events.
ADME'41STRATION GRIT — Attorney Hellinger has resubmitted a notice of pending matters to the
court regarding the venue issue. As yet, no decision has been reached.
Industrial Park/Sheffield Environmental Services — The EDA ($1.2 million) and
Transportation Grants ($1.125 million) are in place as are the County and State
appropriations.
The EDA has approved our request for an extension on the start dates and
completion dates of this project. The new start date is March 17, 2003 and the
completion date is September 17, 2004. As yet, there is no change in the status of
the private sector fimding.
We have received written notification that the change of scope request on the
remainder of the $300,000 appropriation has been approved. This enables us to
address NE 9" Street with the remainder of the appropriation fimds. CAS has
been notified to move forward in addressing NE, 9" Street planning and
construction bidding.
Nancy Phillips continues to explore grant possibilities related to Flagler Parks 3-
6 and storefronts along the North side of West Park Street. The City Council
will be kept informed ofpossibilities. Lydia Jean Williams, working closely with the
City Engineer, Director of Public Works and Nancy Phillips, has prepared and
submitted a $115,000 FRDAP grant request to refurbish Flag1erPairk#2. After
submitting a request for $50,000, we were informed that the limit had been raised
to $200,000. Lydia reworked our proposal adding improvements to the plan. We
should have some indication as to whether or not the project will be funded by
Spring.
ADMINISTRATION I have discussed with the City Council and Department Heads items for
CONTINUED consideration by our Lobbyist and the Okeechobee Delegation. They are:
Taylor Creek Bridge and a connector road
Downtown redevelopment
Continued improvements to US 441 and SR 70
Funding to address our canal situation
Mosquito abatement issue
Storm drainage
Street lioting
CLERK'S OFFICE Bonnie reports there are five candidates seeking election to the three open City
Council seats.
ENGINEERING The City Engineer has submitted a proposal of $468,000 for the complete retrofit
and refurnisbing of the Fire Station. This proposal will be considered by the City
Council on October 15'h and assumes the City will serve as the General Contractor
on the project. This proposal includes construction costs of $320,000; cost
overruns of $48,000 (15% is the industry norm); other costs including an
emergency generator, flumiture, communication equipment, etc. of $100,000.
Councilmen will receive a more detailed explanation ofthe proposal before the City
Council meeting.
FINANCE Lola Parker has prepared a budget amendment for FY 03. The City Council will
consider this proposal at the October 15'� meeting, only if the proposed Fire
Station renovations an approved.
PUBLIC WORKS Donnie Robertson underwent surgery for prostate cancer on October 74h. He is
expected to be out for at least 3 weeks, but the prognosis for a complete recovery is
very good. As ofthis writing ofthis report, he had come through surgery well, but
remained under observation in ICU at Raulerson Hospital. --
Construction (street) projects are underway and should be completed within a few
weeks.
Two members- of the Public Works staff have passed the prelim inary training
related to spraying for vegetation in and around water (canals). As we have
discussed, we feel our spraying effort will compliment the efforts of the Corps of
Engineers and help improve the situation around the canals in the City.
Donnie Robertson has obtained a quote for the 1': block of SW 12* Avenue
guardrail. He has submitted the costs to DOT for approval. You will recall,
this is being done at DOT's request (and expense).
POLICE The enhanced 911 system is fully operational. This system is state ofthe art and
every City Councilman is encouraged to stop in for an inspection.
RFP's have gone out for 22 new police cars and the financing required for the
procurement. These bids should come before the City Council at the November 5th
meeting.
CODE Marvin Brantley's fine was reduced to $7,500 and Attorney Cook has been
ENFORCEMENT instructed to work out an agreeable, timely payment schedule. IfMr. Brantley pays
the reduced fine, the foreclosure proceedings will be stopped. If not, they will
remain in effect.
