Proclaim the month of October, 2002 as "Domestic Violence Awareness Month." Mayor Kirk called the October 1, 2002 Regular City Council Meeting to order at 6:00 p.m. Invocation was offered by Pastor Robert Rieffel; Mayor Kirk led the pledge of allegiance, City Clerk Thomas called the roll: Present Present Present Present Present Present Present Present Present Mayor Kirk read the proclamation in its entirety as follows: "WHEREAS, domestic violence transcends all ethnic, racial and socioeconomic boundaries. Its perpetrators abuse their victims both physically and mentally, and the effects of their attacks are far reaching - weakening the very core of our communities. Domestic violence is particularly devastating because it so often occurs in the privacy of the home, which is meant to be a place of shelter and securiity. During the month of October, Americans should contemplatethe scars that domestic violence leaves on our society and what each of us can doto preventit. WHEREAS, because domestic violence usually takes place in private, many Amedcans may not realize how Mdespread it is. Each year in the United States, approximately 1.5 million women are raped and/or physically assaulted by their c course of a year. PRESENTATION AND PROCLAMATIONS CONTINUED. A. Proclaim the month of October, 2002 as "Domestic Violence Awareness Month" continued. V. MINUTES - City Clerk. witness these attacks, thus becoming victims current or former husbands, partners and/or boyfriends. Many of these women are victimized more than once over the themselves. WHEREAS, our prosecutors, judges, law enforcement officers and victim advocates have worked hard to reduce domestic violence in our City and to assist victims and their families. Through education, awareness and enforcement, we are striving to prevent domestic violence and sexual assault. Public action and awareness will create a society that promotes strong values, fosters a safe and loving home environment for every family and refuses to tolerate domestic violence in any form. NOW THEREFORE, 1, James E. Kirk, by the virtue of the authority vested in me as Mayor of the City of Okeechobee, do hereby proclaim the month of October, 2002, Domestic Violence Awareness Month, and urge the citizens of this City to join together to end domestic violence that threatens so many of our citizens and children." County Judge Shirley Brennan was presentto receive the proclamation. She thanked the Council and she spoke briefly emphasizing the importance of educating the public regarding domestic violence. A. Motion to Temporary Street closing requests by First Baptist Church for Southwest 6th Avenue between North and South Park Streets on October 31, 2002 from 3:00 p.m. to 11:00 p.m. for the Fall Family Festival; and December 9 - 13, 2002 from 4:00 p.m. to 11:00 p.m. each evening for the "HIS Story" Program - Jim Vensel, Program Coordinator (Exhibit 1). Council Member Watford moved to approve the Temporary Street closing requests by First Baptist Church for Southwest 6th Avenue between North and South Park Streets on October 31, 2002 from 3:00 p.m. to 11:00 p.m. for the Fall Family Festival; and December 9 - 13, 2002 from 4:00 p,m. to 11:00 p.m. each evening for the "HIS Story" Program; seconded by Council Member Oliver. Motion to appoint Carolyn Arnold to the General Employee and OIJA Council Member Oliver moved to appoint Carolyn Arnold to the General Employee and OUA Pension fund Trustee Pension fund Trustee Board for a term beginning October 1, 2002 Board for a term beginning October 1, 2002 and ending November 30, 2003; seconded by Council Member Chandler. and ending November 30, 2003 - City Clerk (Exhibit 2). (Mrs. Arnold will serve out the unexpired term which was vacated by the resignation of Terisa Garcia). There was no discussion on this item. C. Approve recommendation from the Code Enforcement Board to condemn the real property of the Evelyn P. Dasher Estate located at 818 Southeast 1 Oth Street, and the real property of Thomas W. Gaughan/Sharon Nairnsey located at 207 Southwest 2nd Street - City Attorney (Exhibit 3). VOTE KIRK - YEA CHANDLER - YEA OLIVER - YEA WATFORD - YEA WILLIAMS - YEA MOTION CARRIED. Attorney Cook advised the Council that the condemnation process was quite lengthy and costly, He spoke with the secretary of the attorney (Mr. Montgomery) who is handling the Dasher Estate. She was familiar with it and relayed to him that Mr. Montgomery was working on a plan of action to take care of the property. Attorney Cook recommended that the Council not proceed with the condemnation procedures but give Attorney Montgomery a little more time, Council agreed. However they instructed Attorney Cook to notify Mr. Montgome!y that he had one week to at least get the propeft mowed. If it was not mowed, the City would have it done and the cost of movAng would be assessed to the prop ft . ADMINISTRATION GRIT —Attorney Hellinger has resubmitted a notice ofpending matters to the court regarding the venue issue. As yet, no decision has been reached. PRM — The City did receive a reduction in our insurance premium from $166,662 (the amount the City Council approved as a maximum on September 3') to $160,511. This is a $6,151 reduction. Industrial Park/Sheffield Environmental Services — The EDA ($1.2 million) and Transportation Grants ($1.125 million) are in place as are the County and State appropriations. I have submitted a quarterly report to EDA and OTTED (Transportation Grant) The EDA is evaluating information from Sheffield and will make a determination as to whether the thneline for commencement should be extended. The other EDA alternative would be to terminate the funding for the project. There is no change in the status of the private sector funding. We have received written notification that the change, of scope request on the remainder of the $300,000 appropriation has been approved. This enables us to address NE 9b Street with the remainder of the appropriation f1mds. CAS has been notified to move forward in addressing NE 9" Street planning and construction bidding. Mayor Kirk, Councilman Chandler and the City Administrator met with JD Alexander and members ofhis staffrecently. Topics of discussion included many of the items the City Council and staff had identified as issues for the Okeechobee Delegation and Lobbyist. As you know, Representative Alexander will be replacing Senator Laurent as a member of the Florida Senate. ADMINISTRATION CONTINUED CLERK'S OF710E GENERAL SERVICES Nancy Phillips continues to explore grant possibilities related to FlagJer Parks 3- 6 and storefi-outs along the North side of West Park Street. The City Council willbe kept informed ofpossibilities. Lydia Jean Williams, working closely with the City Engineer, Director of Public Works and Nancy Phillips, has prepared and submitted a $115,000 FRDAP grant request to refurbish FlaglerParik#2. Afier submitting a request for $50,000, we were informed that the limit had been raised to $200,000. Lydia reworked our proposal adding improvements to the ph-m We should have some indication as to whether or not the project will be funded by Spring. I have discussed with the City Council and Department Heads items for consideration by our Lobbyist and the Okeechobee Delegation. They are: • Taylor Creek Bridge and a connector road • Downtown redevelopment Continued improvements to US 441 and SR 70 Funding to address our canal situation Mosquito abatement issue Storm drainage Street lighting Dale indicates that there may be storm drainage funding available from this FY and he will explore the possibility immediately. This volunteer position will be advertised. 0 0 AM E� IMM.-M 24 M ENGINEERING' The City Engineer is preparing a proposal, which would indicate total costs ifthe City were to serve as the General Contractor on the refurbishing of the Fire Station. While it was stafFs original intent to present this proposal to the City Council on October 1", Oscar is finalizing the budget at this time and we Will present it on October 15'b. As I have previously reported, any action involving reconstruction ofthe facility will require a budget amendment, as we would now be into another fiscal year. The City Engineer is also addressing sidewaEks and LDR requirements (in conjunction with John Cook). Oscar believes that adequate requirements are already in place in the LDR7s, but they have not been adequately enforced in the past, when building plans have been approved. He will work to step up this requirement. Oscar and John are also working on a right-of-way use issue that must be clarified in the LDR's. FINANCE Lola Parker is in the process of confirming needed encumbrances and finalizing FY 02 budget issues. PUBLIC WORKS Donnie Robertson will undergo surgery for prostate cancer on September 30. He is expected to be out for at least 3 weeks, but the prognosis for a complete recovery is very good. Construction (street) projects are underway and should be completed within a few weeks. Two members of the Public Works staff have passed the preliminary training related to spraying for vegetation in and around water (canals). As we have discussed, we feel our spraying effort will compliment the efforts of the Corps of Engineers and help improve the situation around the canals in the City. Donnie Robertson has obtained a quote for the I' block of SW 12" Avenue guardrail. He has submitted the costs to DOT for approval. You will recall, this is being done at DOT's request (and expense). pUBLIC WORIKS Donnie Robertson is overseeing the installation of a new air handling (air 2, CONTINUED conditioning) unit in the Administration office. The old unit is nearly20 years old and began leaking above the ceiling in the outer office. It is being replaced immediately to prevent finther damage to the building. Two other units in City Hall (ofthe same age and similar condition) will be replaced as soon as we enter the new fiscal year.
