Disposition of Cases presented by Code Officer Sterling: Case No. 17-039 Spirit CV Okeechobee FL LLC. 106 N Parrott Avenue Ch 30 Sec 30-43 Public nuisance Ch 30 Sec 30-44 General cleaning & beautification BOARD ACTION- DISCUSSION - VOTE This being a quasi-judicial proceeding, an oath was administered to those offering testimony, all responded affirmatively. Officer Sterling advised all events occurred within the corporate limits of the City of Okeechobee. The Officer's notes, testimony, photographs, and supporting documents were all entered as part of the official record. Officer Sterling testified notice of violation/notice of hearing was sent by certified mail to the property owner's address and received. Officer Sterling stated the general cleaning and public nuisance violations were in regard to the landscaping. He told the board this business has failed to maintain the proper landscaping requirements according to the plans approved by the City. He said the store manager told him they are not getting any cooperation from the corporate headquarters. After looking over copies of plans given to the board, Chairperson Gamiotea stated these were proposed plans and not as builts. The Chairperson advised the board it would be difficult to enforce proposed plans because there could be numerous changes made before the final plans were submitted to the City for approval. Chairperson Gamiotea cautioned the board about taking action on proposed plans. He agreed something needs to be done. However, taking action that was later found to be unenforceable could mean it would have to be rescinded. Member Close moved Case No. 17-039, Spirit CV Okeechobee FL LLC, 106 N Parrott Avenue, be postponed until the next regular Code Enforcement Board meeting, based on the testimony of Code Officer Sterling; seconded by Member Conrad. Okeechobee Park Street LLC. 100 NW Park Street Officer Sterling said there were no official plans on file for Okeechobee Park Street LLC (Walgreens) because it was built before Ch 30 Sec 30-43 Public nuisance the Land Development Regulations (LDR's) were established by the City. Therefore, the City has nothing to show what the Ch 30 Sec 30-44 General cleaning & beautification original landscaping requirements were for this business. Also, Mr. Sterling said after talking with the store manager he found out the broken irrigation system had never been repaired. Officer Sterling said a lot of the vegetation is dead or very sparse. Chairperson Gamiotea read part of the City Ordinance pertaining to General cleaning & beautification (Ch 30 Sec 30-44, subsections b, f & g ) "(b) Also, all landscaping shall be trimmed and kept in a neat appearance so as not to adversely affect the aesthetic appearance of the property and adjacent properties. (f) It shall be unlawful for any person to cause, maintain, permit or allow to be caused, maintained or permitted the accumulation of any litter, garbage, abandoned property, stagnant water, untended vegetation or weeds on any construction or building site before, during or after completion of such construction or building. (g) It shall be the responsibility of all owners of improved property to maintain proper ground cover on their property (such ground cover including, but not limited to, grasses, concrete, asphalt decorative stones, in -laid brick, tile and shell rock) to prevent a condition that could endanger the health, safety and welfare of any member of the community; maintained as required in this section. Furthermore, appropriate landscaping shall be installed, replaced and maintained, in living condition, so as not to adversely affect the aesthetic appearance of the property and adjacent properties." Chairperson Gamiotea said this ordinance will allow City staff to specify to property owner what has to be done for property to be in compliance. Member Close moved to find Case 17-040, Okeechobee Park Street LLC,100 NW Park Street, in violation of Ch 30 Sec 30-43 Public nuisance and Sec 30-44 General cleaning & beautification, based on the testimony of Code Officer Sterling, recommending a copy of City Ordinance Ch 30 Sec 30-44 including subsections (f) and (g) be sent to Okeechobee Park Street LLC allowing twenty five days from receipt of proper notification to contact City Staff with a timetable stating their intentions for landscape improvements and maintenance, if the City has not received a specific timetable for the work to be done by the end of the twenty-five day period a fine of fifty dollars per day will be imposed; seconded by Member Pippin.
