Mayor Kirk asked whether there were any questions or comments from the public. Surrounding Property Owner, Wanda Summerrall of 1008 Southwest 2nc Avenue, stated her concerns regarding drainage in the area and asked whether there would be any on site water retention for the proposed multi -family development. Attorney Cook responded that the developer would be required to have on site retention which would be addressed during site plan reviews. There was a brief discussion between the Council and Staff. Council Member Watford noted staff comments regarding drainage problem and the "City should be very cautious before closing alleys." c) Vote on motion. Mr. John Dulmer, City Planning Consultant addressed the Council regarding Rezoning Application No. 02-002-R submitted by Glenn Sneider, property owner being Derita Watford. The applicant is requesting a change in zoning from Residential Single Family One to Commercial Professional Office. The property is located at200 Southwest 9" Street. Legal description being Lots 4, 5, and 6 of Block 3, South Okeechobee and is approximately .49 acres. Planning Staff Report reflects that the property has a simultaneous Future Land Use Application to amend the map from Single Family to Commercial. If this request is approved the rezoning will be consistent. The property is located within the City of Okeechobee's Urban Service Area and the concurrency should not be an issue. Surrounding land uses include single-family residences and School Board offices. These are consistent with a professional office especially if the residential architecture is retained. The proposal is consistent with Comprehensive Plan standards. Specifically Future Land Use Policy 2.2, 2.3, and Traffic Circulation Policy 8.2. The use of an attorney's office is specifically allowed under the CPO Zoning District. Landscape regulations will be addressed at the time of the Site Plan Review. NEW BUSINESS CONTINUED. B. 2. b) Discussion. c) Vote on motion. C. Motion to designate Bill Veach as the City's voting delegate to the Florida League of Cities - City Administrator (Exhibit 5). Mr. Mack Worley, Jr., Code Enforcement Board Vice Chairperson, addressed the Council stating that all land within the City could fall into four categories: "Unplatted and undeveloped" lands are considered to be raw land or unimproved land. "Platted and undeveloped" lands are considered to be raw land or unimproved land. "Platted and developed" lands are considered to be developed or improved land. "Unpllatted and partially developed" lands are considered as developed and improved land only for that portion of the whole parcel that includes actual developed land. There were still some grey areas. The Board tried to exclude areas that have been historically used for agriculture. Council Member Oliver asked whether the Code Enforcement Officer would be able to decide which lands are which. City Administrator Veach noted that there is always going to be some areas open to interpretation. Upon request by Council Member Oliver, Council instructed staff to supply them with a map indicating these four areas and the "grey areas." Council Member Oliver moved to designate Bill Veach as the City's voting delegate to the Florida League of Cities; seconded by Council Member Chandler. Discussion related to parking on South Park Street - Councilman Council Member Chandler addressed the Council regarding parking along South Park Street stating thatThe One Stop Chandler. Career Center located in the 100 Block would be moving to the location that Rita's Furniture used to have in Block 200. The Council had to address a parking problem several months ago regarding this business, therefore he suggested the Council go ahead and consider installing 2-Hour parking signs in the block they will be moving to. 352 JUNE 18, 2002 - REGULAR MEETING - PAGE 8 OF 9 II AGENDA III COUNCIL ACTION - DISCUSSION - VOTE I) VII. NEW BUSINESS CONTINUED. D. Discussion related to parking on South Park Street continued E. Update regarding the Adelphia Franchise - City Attorney F. Consider proposals for architectural services related to Fire Department renovations - City Administrator (Exhibit 6). Mr. John Dulmer, City Planning Consultant addressed the Council suggesting that in an area like that, Staff is careful to consider only businesses that are of the same intensity as other businesses since there are existing parking problems. He also noted that Planning Staff would be willing to assist in anyway possible with this situation. Police Chief, Denny Davis commented the 2-Hour Parking signs that were put up have helped out with the parking. Council instructed Staff to install 2-Hour Parking Signs in the 200 Block of South Park Street. Attorney Cook addressed the Council regarding the pending issue of proposed Ordinance No. 775 adopting a revised Franchise Agreement with Adelphia Cable. As Council is aware, due to recent news articles, Adelphia is having financial difficulties. After he and Administrator Veach met recently with Adelphia representatives and were assured that the company was sound, the next day there was another article explaining that Adelphia had cancelled all sub- contractor work within the State of Florida. There is only one area of the City's Franchise agreement with Adelphia that needs to be worked out. Adelphia's legal department was suppose to have reviewed the City's proposed amendment and reply back to us. To date, the City has not received a reply. In light of all the recent publicity Attorney Cook advised that he would be reviewing the Franchise agreement again, especially the areas related to what happens should Adelphia file for bankruptcy. He knew the Council would want to make sure the citizens of the City were protected. Council thanked Attorney Cook for his update. Citizen Frank Irby also addressed the Council and asked whether they could regulate how much Adelphia can increase their rates within a period of time. Over the past several years the increase has been minimal, however, the last increase was over 30 percent (for The Raulerson Hospital). Council thanked Mr. Irby for his comments and asked Attorney Cook to research whether thatwas addressed in the proposed Franchise. Administrator Veach explained that he had instructed the City Engineer to solicit proposals for architectural services related to the Fire Department renovations. Exhibit Six lists the three firms that responded. Staff recommended the low bidder, Stephan Claren. The City should be aware of the critical drainage problems on South Parrot Avenue where severe flood conditions exist. The proposed project, that is located on SW 2nd Avenue, runs parallel to Parrott Avenue and is currently affected by the flooding conditions. We have learned from DOT that drainage improvements on Parrott Avenue will take is at least four years before solutions can be implemented. The subject property is in close proximity to the Commercial future land use classification of the adopted comprehensive plan separated only by Southwest Second Avenue. The Commercial future land use along Highway 441 denotes existing development where commercial uses predominate and where commercial development is logical and appropriate. Due to the current level of commercial activity focused at the highway it can be anticipated that there should be commercial growth in the general vicinity. There are also other commercially zoned sites and uses along Southwest Second Avenue. Additionally, properties along Southwest Second Avenue are appropriate for the establishment of less intense commercial uses, and would be an appropriate transition between heavier commercial uses found to the east and nearby residential properties to the west. I am also writing for my mother, Wilma LaMartin, who is also an adjoining property owner and was notified by your office. We feel that this has always been an historic neighborhood of homes and to change to commercial would adversely affect the value of the neighborhood. This change would necessitate a parking lot and more traffic in the area. There are families that live near the property with small children. The neighborhood does not need more traffic due to commercial enterprise. Rezoning to Commercial Professional Office would also require a change in the future land use map and this would set a precedent in changing the use of a neighborhood that has been historically homes for decades. It is a savings to tax payers when children live within walking distance of the schools and do riot need to be bussed. Rezoning would increase traffic and regretfully this has already become a higher traffic area. The city saw fit to build a sidewalk on S. W. 9th Street recently for safety of pedestrian traffic and leading to the school. There are historical homes in the area which we believe will always be kept in that mode. Th Street. We recently purchased our home (209 S.W. Th Street) on February 28, 2002. One of the reasons we decided to purchase our home is because we sought out a safe, clean residential area that would be near our jobs and near our children's school. We have two small children and were ecstatic to own our own home in a beautiful residential neighborhood. You can imagine that we were quite surprised and upset to see the proposed change on the land that sits just across from our own property. We would like to convey our objection to the proposed land change. Southwest Ninth Street is already highly traveled and we do not wish for a business to bring additional traffic. '\V1e are also concerned about the various other likely scenarios that could occur if the zoning is changed. A parking lot, additional businesses, the type(s) of businesses, etc... In addition, the value of our property is brought down! We object to any businesses encroaching on our front doorstep, or the second block of the city for that matter. Ours is clearly a residential area with numerous families and that environment should be protected. There is clearly an abundance of locations for businesses of this type elsewhere in the city of Okeechobee. Although, we did not receive notification of this change by mail, we wished to express our concern by letter as well as attendance at the upcoming Public Hearing. General cleaning and beautification In the interpretation of this section, the City has determined that all lands in the City fall into the following categories, and the code will be enforced in this section to conform to these categories: "Unplatted and undeveloped" lands are considered to be raw land or unimproved land."Platted and undeveloped" lands are considered to be raw land or unimproved land."Platted and developed" lands are considered to be developed or improved land. "Unplatted and partially developed" lands are considered as developed and w- improved land only for that portion of the whole parcel that includes actual developed land. SECTION III. That in all other respects, chapter 8 of the code of ordinances for the City of Okeechobee, Florida shall remain unchanged. SECTION IV. SEVERABILITY Should any provision or section of this ordinance or the regulation adopted by reference and attached to this ordinance, be held by a court of competent jurisdiction to be unconstitutional or otherwise invalid, such decision shall not affect the validity of this ordinance or the regulations as a whole, or any part thereof, other than the specific part so declared by the court to be invalid or unconstitutional SECTION V. EFFECTIVE DATE This ordinance shall take effect upon second and final reading by the City Council on the 2nd day of July, 2002. Member Worley presented a definition of improved lands for the board to consider. After a lengthy discussion, Member Gamiotea moved to have the Code Board make a recommendation to the City Council to use this as a description of what the Code Board believes should be classified as improved lands inside the City of Okeechobee, seconded by Member Weisser. DISCUSSION Chairperson Montesi opened the floor for disussion on cleaning of improved and raw land. Member C. NEW BUSINESS - Discuss Code Enforcement Procedures Worley questioned the responsibility of the property owners to keep the power line easements clean. Mayor Kirk agreed for the need to be very specific in how the ordinance is worded so that the 1. Improved and raw land responsibility would not be taken off the utililty company and placed on the property owner. Attorney Cook said he would make corrections and make sure the ordinance is consistent with Section 515 of the 2. Abandoned vehicles no tags Land Development Regulations. Attorney Cook stated that he felt the two main issues that need to be considered were if the Code Enforcement Board wanted to recommend to the City Council that all property in the City be considered • improved property and if the Code Board felt it was a good idea to include a hardship clause to apply in cases that it was determined strict or immediate compliance would cause the property owner to suffer a hardship. Code Board members discussed some of the advantages and disadvantages of having a hardship clause written into the ordinance. Member Worley felt the Code Enforcement Board should be leading the City into the direction of becoming a well kept community. Mayor Kirk mentioned his concern of requiring property owners to remove all natural growth and cautioned that we do not get to that point all at once. Mayor Kirk suggested keeping a distinction between improved and unimproved property. Member Gamiotea mentioned that it might be helpful to take into consideration the size of the property. He said, for example making a special exception for property larger than one acre to maintain it's natural Florida beauty would be one way to assure all natural vegetation was not removed. Member Worley suggested keeping the existing ordinance and just rewording the sections dealing with improved and unimproved property. He gave an example of how it might be worded to say if the property has a residential structur( • there is an irrefutable presumption that it is improved land, but if it has infrastructure there is a refutable presumption that it may be improved land. Chairperson Montesi asked the Code Board Members to take these suggestions into consideration and the discussion would be continued at the next workshop. Chairperson Montesi opened the floor for discussion of disabled, inoperative motor vehicles, vessels or speciality vehicles. There was some discussion as to the type of covering that should be allowed for disabled vehicles. Chairperson Montesi suggested having a ten day limit for disabled vehicles and after that should be moved. Member Gamiotea mentioned that even if a vehicle was operable it still needed to have a current tag. The Code Enforcement Board Members decided to schedule the next workshop on April 9, 2002 at 6 p.m. with the regularly scheduled meeting to follow at 7 p.m. 9, 2002 - Code Enforcement W 2 of 3 AGENDA C. Abandoned vehicles no tags DISCUSSION Attorney Cook reminded the Code Board that the issue of abandoned vehicles had been sufficiently discussed at the last workshop, and the issue which needed further discussion was improved and raw lands. Vice -Chairperson Worley opened the floor for discussion and began by saying he had done some research and felt that all land within the City fell into four categories. He found by looking at the maps the City has land that is unplatted and undeveloped, land that is platted and undeveloped, land that is platted and developed and land that is unplatted but has been partially developed. He explained developed land as land serviced by infrastructure to the extent that it is available for building a residence, commercial or industrial building. Where as raw land would be considered land which has not been developed beyond what is necessary for a bone fide agricultural use, such as fencing, improved pasture, water for livestock, etc. He stated in his opinion land that is unplatted and undeveloped would be considered raw land, land that is platted and developed would be considered improved land, land that is platted and undeveloped would be considered raw land and land that is platted and partially developed only the portion developed would be considered improved the rest would be considered raw land. There was some discussion by the board members as to whether a possible third definition should be added to cover land that is platted and partially developed. If three difinitions were used they could be described as improved, partially improved and raw lands. Attorney Cook brought up the question of how the section of land owned by Doc Watford would be handled, which is platted and has improvements on the lands surrounding it, but his land is undeveloped. Member Worley felt it would fall into the category of improved land. Chief Tomey asked the Board if they felt agricultural land should be maintained to a certain standard. Member Gamiotea suggested this could be covered if we used the nuisance vegetation clause in the definition that Attorney Cook had suggested at the last workshop for raw lands. Then the Code Board could review the City Council's input at the next meeting on June 1 Ith before the matter went before City Council for final approval on June 18, 2002.
